  • The plaintiff gave the defendant a deposit for an apartment, but she claims the defendant started making outrageous demands. She changed her mind about the apartment, but now the defendant won’t return the deposit, so she’s suing. The defendant argues the plaintiff lied on her application, so she doesn’t owe anything

The plaintiff's lucky she didn't get sued for one month of rent also. The defendant had every right to collect the rent for the 1st month and possibly longer. They had a signed lease, and the tenant broke it, making her responsible for the rent until the landlord finds another tenant. Most courts will let the landlord keep the deposit and charge rent as long they can physically prove that they were trying to mitigate their damages by finding another tenant. The planttiff got very lucky in this case.

I had to be a landlord for several years when I signed mortgage for another. She moved out and started taking in renters. When city moved them out when they had no utilities because nonpayment, the insurance company came in to assess damages. That amount was almost 3k they have me. Sadly they do not pay for bedbug infestation. House was damaged, filthy and infested. Ever in that position again I’d be damned fussy who I rented to. Renters also left owing me approx 4 months rent. Took to small claims for rent and was awarded. Never saw another penny from award. Court awards but do not make sure it’s ever paid. 5/6 years later walked into a coffee shop and guess who was taking my order. I gave up trying to collect. In meantime I was paying two mortgage payments. Never again. There are slumlords as well as slum renters.

Anyone that needs to be told "deposits are nonrefundable" isn't someone that would understand that "deposits are nonrefundable". Also, blocking them a lawyer would advise you against blocking someone like the plantiff. You say "They want drama" but it's gathering evidence to prove how unstable the person is because this is the kind of crazy that will sign saying "I accept I owe 2000" and then get surprised when they still owe 2000.

The defendant is actually very lucky that the plaintiff did not move in to her unit. It seems like the plaintiff has some anger issues and does not know how to process certain things appropriately. I can't imagine having her as tenant? It's unfortunate because the planes have probably realized after her outburst that she messed up but then she took it too far with those text messages. She's lucky that the defendant didn't file harassment charges on her because that's the little definition of harassment. Personally I probably would have just gave her back the money just to be done with her but legally she is not entitled to that money.
