  • The plaintiff used to be close friends with the defendant. She moved into the defendant’s house, but they had to move out because the lease was up. The plaintiff claims the defendant locked her out and left her belongings, including her bed, outside. Her items got ruined, so she’s suing. The defendant argues the plaintiff never paid rent and she never moved her property outside.

    She lies a lot. Lol The boyfriend’s clothes mistakenly was with her clothes lol then her niece mistakenly deleted the pictures. Then she paid it off but can’t get proof. That’s so easy to get! Tenant needs to learn the law though but honestly I’d rather pay the $575 if that means I can get a bad tenant out 🤷🏽‍♀️

      Yeah, I kinda think $575 was a small price to pay for the defendant to get rid of that tenant. Money well spent. Plus she had the satisfaction of throwing the plaintiff and her junk out on the street. 🤷🏾‍♂️

    The plaintiff should've filed a police report and had the defendant charged. It would've cost the defendant a few thousand in attorney's fees to defend herself in court, which would've served as punitive damages.

      @@alyssahamlett Good point, but a lot of people will hire or consult with a lawyer because they want to avoid an embarrassing conviction--even if only a misdemeanor--of doing something so stupid and so mean. That misdemeanor could easily cost her jobs in the future, hurt with rental applications, and prevent her from getting certain professional licenses. I'm not sure if the laws in NY have changed, but it used to be that misdemeanors could not be expunged. If not, it's a lifetime criminal record.

    This happened to me I gave my landlord 30 days notice I went to get my stuff the next day to went back to get more the locks were changed I called the police and they said it was a civil matter I had no money to take her to court and then she took my stuff and put it in her store for sale it was my baby cribs cloths shoes everything toys

    I think plaintiff does business erratically - her inconsistency is what caused most of the problem. Then she leaves her/ boyfriend's clothes in washer & dryer ?? Of her things were so important why didn't she rush to move it ?? She drags her feet removing her things. I couldn't be a landlord.

    Question: What if you're a 'renter' instead of 'landlord'.
    and you're Not renewing lease. Roommate's dragging her feet moving her stuff - ignoring your text warnings 2 weeks from deadline. Since both your names are on the lease, would you have the right to move roommate's stuff out to avoid being charged for the next month's rent ???
    ( Plus it could be even higher at the current market rate ????😢

    Both are so annoying. Plaintiff can’t answer a question directly…. And really doesn’t make sense. Defendant is narcissistic. I get why she was mad but she couldn’t just wait 2 weeks? Like seriously. They both are very inconsiderate

    By law you have to have a judgement from court and a locksmith and a cop to boot anyone out and would be required to inventory and store anything left for thirty days and a copy of a letter to last known address to inform them of all this .

      There are landlords who abuse it. Too many families with kids have been kicked out on the streets due to security deposits not being returned etc but I understand your point. Once you make a contract and allow people to live in your property and accept money, you now have rules to follow. If they are living for free as guests, you can kick them out anytime, furniture included.

    Lots of landlords don’t understand this they say well it’s my place. But as soon as you hand the keys over it’s now the renters place and locking them out is violating their rights to there home. This is why if you want a renter out you gotta follow the steps file an eviction notice now the renter has a notice in writing. Once you do that and they still won’t leave now you can take it to court and have proof you sent them an eviction notice. There’s your proof judge will grant you permission to change the locks and police will kick out the tenet. You gotta follow the steps as long as that tenet keeps paying rent it’s there place this is why we have security deposit if the tenet wrecks their place that’s your insurance.
