There is a tattoo artist from my small home town. He actually did prison time for beating a man to death. He is treated like a god in our town because of his tattoo shop...everyone ignores that he beat a man to death because he did his time...he barely did any time, he still gets his full life to live. The man he killed was just a random man he got in to a disagreement with at a party. I grew up hearing the story, and then later reading the articles once Google was a thing. It was awful. In the United States, if you are hired at a particular amount and your employer underpays you, the employer owes your back pay... even if the employee doesn't notice it. That's a huge labor violation here. And the state will go after an employer who does that. If she heads to her local Employment Development Department (EDD) and complains, the agency will file suit against Eddie and get her back wages.

And on-top of the wages, they usually owe super (retirement fund required by law), AND haven't properly done their own taxes, let alone withheld their legally required by law amount from our pay checks that's auto sent to the ATO. And then they get fined for it, as well, you should be punished for it.

@@frickfrack7075 Not exactly. Burden of proof as I understand it is a principle in how the evidence is judged at the end of the trial. That's different from the beginning of the trial, which has a process called "discovery" where both sides have to gather their evidence, which can include search warrants and subpoenas if the judge agrees they're necessary. They're supposed to enter all of this into evidence and share it with each other before the trial begins. It can get SUPER messy. If you're suing someone who fired you because you were late, they can demand you turn over every email and text message in your possession that mentions you, your job, your boss, and lateness, to see if you WERE punctual or not. It's a harrowing process, even if the truth is 100% on your side.

I have worked in HR and payroll for over ten years. It is ABSOLUTELY NOT the employees responsibility to ensure they are paid correctly. It is good practice to review your pay because mistakes happen in payroll but if a mistake happens it is on the company to correct it. Offer letters are considered binding and if she has one that states $22 an hour she should get back payed for everything she is owed. The employer is filing her tax documents and should have caught it. I get many small businesses like these don’t have experienced finance professionals but it’s not an excuse.
People bringing up why she didn’t bring up pay before or any of these things also fail to account for the power dynamics at play. It’s often hard for employees especially in smaller business to challenge their employers on pay when they are afraid of retaliation. Even though retaliation is the #1 reason companies get sued for discrimination/harassment because it’s very easy to win those cases. It’s much harder to prove an employer is being abusive or discriminatory without documentation. But you can prove retaliation. My point is, she can fight this and win.

I work for a small/middle-sized company and I always check my pay because things happen a lot. At one point I noticed that about $70 had been subtracted instead of added to my pay, and I went to HR to tell them. They agreed that it was a mistake, that shouldn't even be possible, and she would correct it. But since then it's been months and I haven't got that money back or the original $70 I should have been paid...

    • @joelman1989
      @joelman1989 Před 3 měsíci +1

@@CainXVII i did mention it but to be clear I do recommend always checking your pay for that reason. Things do happen. There are HRIS systems that should prevent a lot of errors but they’re only as good as the information that gets put into them and without people trained to be very detail oriented and know what to look for it’s not uncommon for errors like that to happen.
That’s pretty annoying though that you still haven’t gotten your money. We all make mistakes. But when I make a mistake that results in an error on a check I (and my coworkers) treat it as an emergency. I’ve even added money to checks to cover for late fees etc. Because I hate the idea of someone missing out on money because of my mistake.
My first supervisor was honestly a Nazi about this stuff. She would freak out over the tiniest error and I resented her for years. Then I went to a company that was incredibly mismanaged and I realized how grateful I was that she drilled perfection into me. I immediately encountered tons of errors in the system and worked for weeks to correct everything. Set up processes to prevent future errors. My point is that there is a best practice that should be followed but unfortunately it isn’t always followed. Still, it’s ok the employer to correct issues promptly.

@@Tayl0r_ I agree with what that other commenter said. My uncle's a retired tattoo artist, he was one for almost 40 years and he said two very important things when it comes to a tattoo is a shop you trust, and an artist you trust. Always look around and find the perfect fit, and start off with a small tattoo and begin building a custom/artist relationship. Small pieces allow you to judge how the artist handles finer details and how gentle/heavy handed they might tattoo. You always wanna make sure you can sit through a tattoo of any length and it's important to make sure you find an artist that listens to you even for a small tattoo. Because trust me, a big tattoo is gonna require some breaks, from both you and the artist. I plan to get a custom tattoo made in a year when I can save up the money for it, and the artist is more than happy to wait until I have all the parts of this tattoo ready to begin designing. You just gotta find the right artist first, so I hope you get the tattoo of your dreams one day and I hope even some of this insane rambling helps or makes sense. 😅😅😅😅

You get some really scummy people running them and doing sketchy stuff, which is why you really need to do your research when going to a place you've never been before. There was an artist in my town that was sexually assaulting people for years during appointments, and the cops turned a blind eye to it because of lack of evidence. He made the mistake of telling people he was related to a famous musician, and when said musician looked into it and saw what his name was being used for, he contacted the state attorney's office. A computer error vs. A clear physical display of price is not the same under false advertisement law, that's why target can put one price online and a different in store. However if you try to trick someone into paying differently in person, or it can be reasonably proven. I.e. two different physical prices. Businesses like yours is the exact reason this law is in place!

I work in retail, I do indeed give them the price that it is tagged at. That's on us for not paying attention if it's the wrong price and they put it in their cart assuming they can afford the price attached. If however they looked at the tag for the product beside it by mistake we do not honor that, it happens, one drunken guy gave me the gears for selling rye bread at 35 dollars, he was looking at the tag for a bubblegum dispenser that happened to be on the next shelf (crawl out of the bottle dummy).

Then the bigger studio of artists started threatening her unless she joined a community of other artists who pool all the money they made that month that they claimed went towards improving their shops but the money just goes towards them doing a pub crawl once a month and they would often sleep with each other
Because of that a few artists would go to work with hangovers or not even open the shop for a week
No matter how many times she refused they would just up the threats
Including waiting till she leaves and then attack her

3:22 The problem is mostly employers DO get away with underpaying employees. It's the single most costly property crime in the US, wage theft. If you want to get paid and your employer doesn't want to pay, you can't go to the police. You have to go to the NLRB or state employment agencies, you can get a lawyer if you can afford one but otherwise you can report the employer and wait. Most people just give up.
If you live in America, say thanks to the Republicans who have continually underfunded the NLRB because they, the Republican Party supports the company over the worker. This is what they meant when they run their campaigns on 'Deregulation' for the last 40 years.

Her responsibility is to make sure she's getting paid the correct rate, however, her responsibility ends the moment she notifies her employer. One of the first things my wife and I do when we begin working for companies is check contracts, and ensure they're being upheld. One time she had to retroactively pay an employee five years of backpay. Oh boy was he happy, and the company was happy to have caught it.

12:00 at my last job when i turned 18 i was supposed to go from being paid 14.50 to 15.50.
14.50 was student wage and once you turn 18 you get minimum wage 15.50.
I didnt notice until i looked more closely at my pay stubs because usually id just look at my take gome pay, that i was still getting student wage after two-ish months.
I brought it up to my manager, the general manager, and then the lady that handles paychecks.
Lady that did paychecks apologized and said she thought she had my birthday marked to change my pay but much have forgotten so she changed it to the right rate and gave me "back pay".
So the differenece between would i should have gotten to what i did get was given to me on my next paycheck.

In a previous job, I met a guy who was trying to save his business. One of his employees got tired of not getting paid properly and turned the employer in. I can’t remember which government department it was, maybe Department of Employment. They came in and seized all the payroll records and other pertinent employment records. The biggest thing they got the employer on was tax evasion. Under-paying his employees robbed the government of the employee taxes. So he ended up owing back taxes, interest and penalties, fines, and back wages (unpaid wages). He owed hundreds of thousands of dollars. Needless to say, he lost his business. Don’t know if any of the employees got the money owed them because typically the government agency gets their money first.

I used to live an hour away from Seattle and I've heard such negative things about a tattoo shop that sounds exactly like this. Now I'm not wondering it isn't this shop.

There are apps you can use to record calls, or you can use a computer mic to record so you have proof if someone’s trying to be dodgy like that to avoid accountability

Yes but in certain states you can not record people on the phone without them knowing - so maybe that’s why she didn’t

you can't be sued for defamation if you're telling the truth? that's not how civil courts work buddy..... you can be sued for anything, no matter if it's true or not...

Well, they can attempt to sue you. If there’s no probable cause, the judge will chuck that case right out the window

She could actually sue him for stolen wages if she has documentation that what she was being paid is less than what they signed on the contract. It's called wage theft and it is, in fact, illegal to underpay someone like that.
