      Not sure who you spoke with, but here it is in the VA’s own words. www.benefits.va.gov/WARMS/docs/admin21/m21_1/mr/part3/subptii/M21-1MRIII_ii_6.doc Not every situation is covered, but injury, exposure and acute medical claims like a heart attack are covered and the service member is eligible to submit a VA claim.

      @@VeteransAdviceHub thanks for your response man. It was from the denial letter, acknowledging that I could have received my disability at this training… “However, this period of service is not considered active duty for VA purposes. (38 CFR 3.6, 38 CFR 3.7, 38 CFR 3.1)”

    Exactly sir and people will do that or they'll even bring their pets in the stores that claim that their pet friendly but on the outside it says service dogs only and if you contact the corporate to verify they say they are not a pet friendly they do not belong in the store with their pet and they should not have the dog in a shopping cart for that matter. However they do do this and then in 7 Mile Middlebelt Livonia the Dollar Tree there intentionally allows DC people to come in with their pets for profit at the expense of the safety of the customers and handlers like yourself and myself will have a service animal of medical alert as well as cardiac alert service animal and we have to deal with this and when we report it to the police department after the person comes up to us and tries to harass us with their dog who does not belong in that store can we call it out and we will go to contact the police about it because they are harassing Us in the store they're trying to get their dog so called socialized in that store that has no place to be there and the store then retaliates against the Handler with a disability and then tells the police department you know that their pet friendly establishment and they Welcome All Pets there when on the outside it says otherwise when you contact the corporate and they get away with this and they are never held accountable nor is the person who is assaulted harass us as a Handler a service dog who are the victims of the situation and the police department says well anybody can have a pet in his store it could be a pet friendly he cares and he's not going to do anything about it so this is a disservice to handlers with service dogs. And when you contact the cities like Livonia Michigan and the mayor's office and talk to them about this because you find out you're not the only victim of the situation and the police department is failing to is here to protocol and serve out a fine to the store for violating Federal Ada laws and not complying and that they are not friendly under their corporate and HR verifying that they are not they should not they should not be walking me anybody with pets in there and saying that they're probably when they are not. And that pet owner who assaulted and harass me should have been facing prison time and the classroom misdemeanor but again cities are letting these people off the hook with you know fake victimhood race hustle card and or trying to use equity to diverse inclusion to undermine real handlers and service dogs like you or me by letting people bring their pets in that do not belong there and then the police do not do their job about it and remove them and cite the store for breaking federal laws

      Your entitled to your opinion, and I do encourage everyone to do their own research and seek advice elsewhere. I never claimed to be be anything more than a person who has successfully gone through several different parts of the VA disability rating process. I share what I know.

    I am a National Guard Soldier who was placed on Title 32 502(f) Active Duty for Covid Operations. I was on Title 32 502(f) Active Duty for 2 years ( June 2019 until June 2022 ). On November 11, 2019, the VA sent me to do a Sleep Study. Then, I was admitted to do a Sleep Study for Fitting in February 2020. Thus, I was Diagnosed with OSA at that time. Finally, in October 2021, the VA issued me an actual CPAP Machine. As you can see, all of these took place while I was on Active Duty. My Struggle is understanding 'Why did the VA denied my Claim for Sleep Apnea for Service Connection? During my filing, I submitted my Task-Force-Covid DD214, My Medical Profile which contained Sleep Apnea, and the Sleep Study Notes. Still, they denied my Claim. Please help me with this ? As a fellow Veteran can you please give me some advice on going forward with this?.......Am I not considered Service Connected because I was on Title 32(f) ?

      You are Correct, you have to be on title 10 and the issue needs to be caused or aggravated by that service. Chronic situations like asthma or sleep apnea, even if discovered/diagnosed while on title 10 will likely be denied unless you can prove a causative link, like exposure to a burn pit and then being diagnosed with asthma for example. Full time regular active duty is considered different. In those cases medical issues discovered while on active duty are considered service connected just as long as it was not picked up on a entry physical.

      @@74D50 While I can't find the article that discussed this issue, I believe my comments to be accurate, and they did actually deny your claim. One clarification you could be eligible for service connected disabilities under title 32, as with title 10, if you are being paid federally and not by the State. Here is a good summary, but bottom line it is a complicated system. I am sure there position is that while you were diagnosed while on title 32, federally funded orders, your service did not cause your sleep apnea.       Thank you. That does make sense. I appreciate all the info you put out. I just had a LOD investigation assigned for Behavioral Health. Although its an actual Line of Duty, I hope I can file but I know its complicated being in the reserves or Natl Guard.​@VeteransAdviceHub

    I do have a question that seems hard to find a answer to. If you have active duty time to include 3 Deployments from 2003 -2011. During that time you went from AGR (2004- 2008)and back to Reservist and did stateside and overseas deployments from 2008- 2011 then went back Reserve from 2011 to 2015 what's your end date in relation to filing claims? Is it the end of your last DD214 coming off active (2011) or is it the end of your Reserve enlistment which would be 2015? I'm confused to how this will work for me.

      When did the issue(s) you are filing a claim for happen. I would make sure to include the correct DD-214 to document you were on active duty federal orders (title 10) at the time the issue you are claiming was caused. If you are asking what end of service date for the general info on the form, I would use the latest dd-214 you have. The reserve time will not help your cause unless there was an injury while on title 10 that you can prove. Deployment overseas time is federal time so document those times. Sorry for not being able to give you a straightforward answer. The system is a bit too complicated for that.

    I'm 64, 100% disabled homeless veteran. I'm Being denied housing through Hudvash because of my disability rating. It took 2 years to get a primary care giver here in my hometown of lacrosse wisconsin. I had my evaluation done in Boston. Last April both of my kynedys shut down. Mayo clinic put a catheter in me. There were no follow up appointments. 4 months later i had a appointment with the kidney doctor, he didn't notice that they didn't replace the catheter with a new one, once per month. I went into emergency a few days later, i was peeing around the catheter. It was growing in me. With nothing for pain the nurse pulled it out, i was bleeding. She wanted to put a new one in while i was bleeding. I said no way. A week later i went to the hospital for antibiotics because i was peeing infection. They told me i had to wait a week. A friend gave me a ride to Tomah VA hospital. Got the antibiotics that same day. I was peeing infection for a hole month. No lawyers would take my case. Board, probono, other lawyers i call out of state. At the time my kidneys shutdown, i told them i had a hernia. No medical treatment since April. I'm in a tent no one is willing to do anything. Thanks for listening. There's not alot i can do. My greatest ohoner when i was in, was 1 of 20 picked off the base , in congratulation on supporting the base by Ohamar Bradley.

      Retirement, annuity and investment income are all unearned income and do not count towards the earned income limit for TDIU. The limits are connected to "substantially gainful employment" in other words, earned income.

    Yeah but the military says bc I choose to join the guard to protect America from invaders I'm not a veteran ...you didn't go fight someone else's war so you are less than ....I was on call 24 7 my friend went to Iraq after 911 she came back in pieces in a body bag ..it's hurtful to not be considered anything and the ARNG doesn't help with Thier moronic commercial calling it part time service....anyways that's 20yrs of frustration thanx for all you do

      remember veteran status is not the same as VA benefit eligibility. For example one of the options to be eligible for (not the same as financially qualifying for) a VA home loan you just need 6 creditable years in the Selected Reserve. The devil is always in the details, research and read the eligibility requirements for any benefit you have questions on. that is always my first step.

    I received 100% P&T TDIU in 2020. However, in 2021 I was given 100% P&T based on my disabilities backdated to 2018. My VA Summary of Benefits says that I am 100% P&T based on TDIU but then it also says that I became totally and permanently disabled due to my service-connected disabilities on OCT 29, 2018. I am very confused as I was an international school teacher working overseas and would like to do this again. My current combined total rating is 100% so can I work or not?

      if you are rated as 100% TDIU and you went back to work (substantially gainful employment) and did not communicate with the VA at all, eventually they would notice you working through you paying taxes. they would them figure out when you worked and from that date, give you one year to see if working is sustainable. Then after that year, they would revert you back to your highest schedular (standard type most of us have) rating in your case 100%. I tell you that story to tell you this. Communicate with the VA. it's much simpler to get things sorted out up from. if the effective date of the 100% P&T is prior to the TDIU than i don't see any reason you couldn't drop the IU and revert back to your standard rating (already at 100). With 100% P&T you can work without limitation. yeah it's a dumba$$ system.

      My opinion: As long as you do not earn above the annual poverty limit, you should be OK, but I would consult with an attorney on this one. It's hard to say your disabilities are keeping you from working if you are starting a business. A small enterprise, say out o f your home and within the limitations of your disabilities might be fine, again as long as you don't earn over the limit. You can always actually ask the VA. I've never experienced it myself, but I understand they do have people to evaluate unique situations.

    I have just received my IU and I was working part time but not able to make the income over the federal poverty level. Would I have to quit my part time job

      As long as your total employment income is not above the annual HUD poverty limit, you would be fine. Note the IRS and VA databases are connected, so if you show taxable income from employment, it will cross over to the VA and they may take review your claim. Investment and other passive income is not considered gainful employment, so does not count toward the poverty determination.

    I’m rated at 70% IU, paid at 100%. I’m in the process of putting in claims for 100% PTSD and 100% TBI. With either case, can I win the lottery or an investment pay off where I receive a lifetime income from losing my VA Disability?

      Other sources of income do not impact VA disability compensation from a schedular (think standard) VA rating, assuming you meet the criteria. So you can be 100% rated and be a millionaire! But if you are on TDIU (rated at 70% and Collecting at 100%) if you have a job (gainful employment) and make more than the annual federal HUP poverty amount, the VA may review your TDIU claim. If you don't meet the TDUI criteria, they will reduce your compensation back to the 70% level.

    Hello, Does this still apply after you left active duty (over 5years) and go reserves again? If you get hurt during reserves drill or has to be like where you are actives for a long time while on reserves and you get injured? Can still file for VA disability while on reserves correct?

      Yes you can file a VA disability claim while in the reserves. As long the the issue is not service disqualifying you can have Rated VA disabilities and still serve in the Reserves. You just can't collect both VA disability compensation and reserve pay for say a drill weekend. As far as a service connected injury, as long as it was while on orders/drill and it is a finite describable incident that caused the injury, that would generally be considered service related. Things like chronic health issues (sleep apnea or asthma for example) as not service connected unless you were diagnosed while on full time active duty (i.e., regular service) or the result of a specific, documentable incident or exposure while on orders.

    Thank you brother, just reminded me of something that I forget about occasionally. Pain and hyper vigilance compound each other and make me snap. I get excellent care at VA but still have many bad days. Also, as long as we have each other, we are not truly alone.

      You are correct. I have made progress with my own PTSD by simply talking about it, first to a therapist, but eventually to other vets as well. I live with pain daily, but two knee replacements tamped that down a bit, now just everything else hurts!

    Im 67yr on 80% service cont but pd 100% unemply and totally and permanently disabled both awarded back in 2000, what happens if i start buying rental properties or start a property investing business and don't collect income -rolling it

      My understanding is that investment income or other passive income is not counted. The benefit is for a physical inability to hold substantially gainful employment (work). If you actively manage the property and fix things, mow the lawn, etc. that would be considered earned income and would count against your substantially gainful employment dollar limit, the annual poverty threshold. if you just collect the checks and have say a property management company administer your property, that would be passive.

    I got my 100% P&T in December. I actually have an appeal that is still pending a hearing. Honestly, this really cant HELP me in any way. I dont think would hurt either, but why waste people's time with this? Is there a way to cancel an appeal? Might sound silly , but by me getting out of the way, mabey also someone else can move ahead just a little bit also

    I am rated 50% PTSD service connected. I am wanting to increase it. I plan on filing myself. The forms I need to fill out are the intent to file,526EZ, and the 4138, is this correct?

      PTSD has it's own specific statement form. www.vba.va.gov/pubs/forms/vba-21-0781-are.pdf. I would recommend gathering all your info and supporting documentation, scan in each supporting doc as a pdf and then do the forms online.     My husbands' rating is 90%. The VA told him to apply for IU. He has not worked since 2001. The form ask for employment info for last 5 years worked. Do I need to research and provide his employment info from 2001?

      By definition TDIU increases your VA disability compensation to the 100% level because you are not able to work due to the service connected disabilities. If you are able to generate employment income, it has to be below the federal poverty threshold. The 2023 threshold is $13590. If you make more than that, you would become ineligible for TDIU. FYI, the VA and the IRS databases do connect and employment income over the limit on your taxes will trigger a review on the VA side. Not included as employment income are other sources like investment income or rental income. It has to do with the ability to "work."       What do you mean "accepted" VA disability and VA medical are two different programs. If you mean VA medical, no. VA medical is directly for veterans only. There are additional programs that spouses can qualify for in specific circumstances.www.va.gov/health-care/family-caregiver-benefits/

    My combined rate is 120% but VA math puts it at 80%. I've been put at 100% for unemployable. I have had two cardiac ablations and defibrillator implanted. Next month I have open heart surgery to repair my tricuspid valve. What do I have to do to change my service connected disability to permanent and total disability? I was in iraq in 2003 first wave also exposed to burn pits. Burning shit detail ect.

      two components , the percent rating after VA math, you know about that. The other is will they likely ever change or improve? I'd say what you described would be permanent. After the procedures, if they stem from service connected issues, review the criteria for the rating of your heart issues, may be eligible for an increase. If you think you are, I'd summit a request for increase with all the medical documentation included. P&T is related to VA disability, but a separate decision from the percentage rating. If they approve your new claim, but don't designate as P& T, or you decide to now submit a new claim, the process is the same for P&T. You have to submit a new claim and request P&T designation.       go to medical, complain about everything, spouse says you snore, mention it, feet hurt sometimes, mention it, trouble sleeping, mention it. You get my point. Also towards the end, make a copy of your medical record and get copies of all your orders, deployment, pcs, unit changes, everything.

    I am rated 100% p&t and unemployabilty. The gave me a boost over the monthly payment for loss of a creative organ and extra for adding my wife. Would rather have health back instead of the money but can see that’s not gonna happen.
