Can I Work Or Not? All 100%s are Not the Same!

    Yes, technically you could also have a 100% rating based on an extraschedular rating review, but that is a one-off unique and veteran specific case. And not accounted for in this discussion.
    The other common 100% rating is, Total Disability Based on Individual Unemployability (TDIU). If a veteran qualifies for this program (see my Video on IU), the VA then compensates the veteran at the 100% level.
    So can I work or not? With a 100% schedular rating, there is no limit on employment or income. So, yes you can work. With TDIU compensated at the 100% level, you can not work and earn above the Health and Human Services set poverty level (I know I said HUD in the video). For 2021, the 100% poverty level income limit is $12880 for the veteran themselves. It does not include other members of the household. (aspe.hhs.gov/poverty-guidelines). Be aware that the IRS and the VA databases do connect and if your income from gainful employment is over the limit, the VA will find out about it through your IRS tax filings. EDIT: I REMOVED THE REFERENCE TO MORE THAN ONE PERSON. THE LIMIT IS FOR THE VETERANS INCOME EARNED FROM GAINFUL EMPLOYMENT - NOT RETIREMENT OR SPOUSAL INCOME, BUT INVESTMENT INCOME MAY BE CONSIDERED A FORM OF SELF-EMPLOYMENT AND COULD COUNT TOWARDS THE LIMIT.
    If you were TDIU but now can work, your combined VA disability rating returns to whatever it was (per the schedule) before the TDIU was applied.

    Yes, this helped. But unfortunately I dont trust the IRS and the VA when it comes to money. Its difficult for me to take that step. Im at 100% T&P and legit. Just scared of the whole damn thing

    If the disability limits available opportunities I say yes. After the military I wasn't the same emotionally or mentally than before the service. If there is anything limiting you from seeking the best in life, just take disability and don't work.

    I received 100% P&T TDIU in 2020. However, in 2021 I was given 100% P&T based on my disabilities backdated to 2018. My VA Summary of Benefits says that I am 100% P&T based on TDIU but then it also says that I became totally and permanently disabled due to my service-connected disabilities on OCT 29, 2018. I am very confused as I was an international school teacher working overseas and would like to do this again. My current combined total rating is 100% so can I work or not?

    The question I have is , can I pass my Disability onto my spouse when I die if I'm on the PTIU or if I'm just under 100% P&T can she receive my Disability on the DIC schedule payment ? Could you please address those questions so when I die can she apply to receive the spousal amount of my Military Disability ? Thank You .

    I’m rated at 70% IU, paid at 100%. I’m in the process of putting in claims for 100% PTSD and 100% TBI. With either case, can I win the lottery or an investment pay off where I receive a lifetime income from losing my VA Disability?

    What if the individual is TDIU and 100% scheduler, does the 100% scheduler rating take precedent over the TDIU, and make it moot?

    Im 67yr on 80% service cont but pd 100% unemply and totally and permanently disabled both awarded back in 2000, what happens if i start buying rental properties or start a property investing business and don't collect income -rolling it

    What about if you have social security income. Does that count if you are granted TDIU. I heard they are two separate things.

    Is the poverty level threshold based on one or two persons? I was led to believe it is one (the veteran) only.

    Love your channel. I need clarification based off thos information. In 2016 I have a scheduler rating of 80% service connected but 20% IU making me 100%. I had around 4 reevaluation but Im the fall of 2020 after my last one they made me P&T. Am I still affected by 20% IU when It comes to receiving any type of income? Thank you.

    I was awarded 100% TDIU just a few days ago in July 2023. I do not want to sit around in my butt for the rest of my life, so I have to find a job that will work with my disabilities. What’s the max I can make per yr as a single guy without getting raising eyebrows?

    If one was recently rated 100% for PTSD. Can one still hold a well paying full time job that they have had for 15 years? Or do they have to quit?

    Does being on the non-va disablity service connection income, also mean I can collect an income under the poverty level?

    I’m rated 100% for PTSD alone. Can I still work? I received 100% for PTSD in October and I’ve been working since then. It’s now the end of January and I’m hearing two different things. Some people say you can work and some people say you can’t. Can you clarify this for me?

    GM I have 100% scheduler rating and my conditions are as followed 70% for major depressive disorder 50% for migraines

    Can you go from IU disability rating to Total permanent if you want and your health have gotten worse even if you some of those are not service connected. Like arthritis in the knee but it happen after you got your 100 percent IU?
