James Crumbley in court: Judge considers pretrial motion on excluding witnesses

- The father of the Oxford High School shooter appeared in court Wednesday for a pretrial hearing regarding multiple motions brought by the defense. Only one of the motions was discussed in court Wednesday, regarding the prosecution's witness list. Here's the full hearing.
This defense lawyer seems to have more professionalism than Jennifer’s lawyer
If James is lucky, his defense attorney won't spend a third of the time talking about herself and her own family.
would be hard to have less
That’s why she left Shannon’s firm
Ahh yes. The poor man’s Pam Beesly.
Her attorney was a total idiot

Hopefully the defence lawyer doesn’t start telling us all about her and her kids lives.
I can't get over her comments about her opps 4th baby, can you image her children watch that online?
lol
It’s defense not defence
@@stevetrivagoIt’s the British/Canadian spelling.
😂😂
I can’t believe how much disdain I have looking at him & how upset I am thinking about the pain and destruction they have caused. I’m so happy parents are finally being held accountable.
It's about time. I have so much respect for these brave prosecutors.
The dad will be found guilty as well. Don't even have to watch the trial to know that. They are definitely using the parents as an example for all parents. In my opinion they now need to go back to every case and charge those parents as well.
My son had a gun at 15 yrs old. He also went to the high school for a hunters safety class with his dad. That he successfully completed and got a certificate for. They also gave every kid and parent free safety locks for their guns as well in class. He is 34 yrs old and never killed or ever hurt anyone. As a parent we kept all of our guns locked up in a gun vault, all with safety locks on each one as well. Only taken out for hunting season. You have to watch and take care of your kids.
I hope we have less whining from the defense this time around.
Are you on trial? Why do you care?
@@susankeene2785 Why do you?! lol 🤦♀️
@@susankeene2785 Everyone should care when an attorney makes a mockery of a proceeding where 4 kids are dead.
Not that same judge please……..
seriously, that judge looked like she didn't even want to be there.
🤡🇺🇸⚖️..ugh
My thoughts exactly
I know right. That's what I SAID
Judge reminds me of the low talker from Senfeld. 🙄
This judge is a walking Nyquil bottle of snooze.
Oh no, not the same judge!! I barely made it through the mom’s trial. She was terrible.
I thought the worst aspect of how this judge works is that she allows for speaking objections. Meaning that the lawyers can just argue objections loudly in front of the jury, and by that, they mention things they want to bring up and for what purpose, so even if the thing is not allowed in the end, the jury cant unhear what they just heard. No other judge I've seen does this! They all either excuse the jury, or the lawyers walk up to the judge's bench and talk quietly. Judges can even put on white noise.
I mean, it's informative for us to hear all the discussion fully, but it seems insane to have the jury hear it.
🙌🏼
I agree. It was so unusual! Why why why? To save time? @@viqala9159
@@viqala9159I’m hoping she read some of our negative posts amd changes some things. Doubt it but we can only hope!
@@viqala9159I completely agree with you. I have never seen a judge not say “overruled or sustained” as well.
Isn’t it refreshing to see how an actual professional defense attorney acts like in court? Sloppy Smith should take some notes.
Yes!
I know, right?
It begs the question, why were they law partners? For those who may not know> >This attorney and Shannon Smith used to be partners in their law practice.
IIRC, Shannon Smith spoke the most during the arraignment and frequent Zoom motion hearings when BOTH represented James & Jennifer Crumbley together as a unit. The case was split just 2 months before Jennifer’s trial. Shannon Smith was a dumpster fire. 🔥
He’s got a much better attorney than the mom 😮
This judge still hasn’t figured out how to speak up and not mumble.
To me, the "Um" and hesitant way of speaking makes her appear insecure. However, I find that the female lawyers on both sides do this too. In the Jennifer Crumbley trial they both said "I am sorry" way too much. I understand it could be nerves. I appreciate a straight forward and direct way of speaking myself.
it’s so annoying
She’s soooo lackluster I can’t take it anymore.
This isn't a TV show you can cast and recast when you don't like someone. There is nothing to show the judge is unfit or incompetent. If the jury, attorneys and accused can hear and understand her - there is not need to change her way of speaking
She actually seems louder this time around.
Didn't understand why he had headphones then I realized it's the low talking judge and he just wants to hear her.
Oh that's why? So they're like a makeshift hearing aid? I was wondering
this judge is ridiculous, needs to speak up...
That’s why?! It looks goofy as hell!!
@@Jennifermcintyretrials are not a fashion show
Or maybe he's listening to some reo speedwagon. Who knows.
Well at least we have a defense attorney who acts like as adult!
I can’t explain how frustrating it is that the Judge whispers! This is a very important case and we’d like to hear everything that’s said.
mumbler ugh
Turn on the subtitles, it's not perfect but it definitely helps. Sometimes these courtrooms have really bad acoustics and can make it really hard to hear.
It's important that the court participants hear her, not us TV/CZcamsrs.
Wear earbuds and stop whining, Shannon.
If it weren’t that the judge is surrounded by marble surfaces, we’d likely hear nada.
This judge understands quickly as long as it's explained to her endlessly!
perfect description‼️ it's so painful. it's like she's physically there but gone, at the same time.
Totally!
Two words, plead guilty.
I don't think that either parent was offered a plea deal
I can't imagine being shot and watching friends die and then being told one can't testify as a witness to the event because it might be prejudicial to the defendant.
For all the people asking about the headset, it’s so he can hear the judge and attorneys. He must have hearing issues
Of course he is hearing impaired. He's been at the shooting range with his son. He's a gun slinger. LOL
@@gregorylyon1004 my thought exactly!
The judge does not project, her voice, making it very difficult to understand what she is saying. The lawyers understand because they’re standing so close to her.
Why would anyone keep an attorney who is literally limited in the ability to introduce evidence?
He should have gone with a public defender because this is the lawyer that may have got herself into trouble when they were on the run before they were arrested. I'm assuming they already paid them and they're broke now but don't realize a PD would be a better choice. Too much conflict here.
@Tiffany-Rose you mean a public pretender? PD's still work for the state on a salary basis. They have no incentive to fight hard. A private counsel is a much better choice if one can afford it.
@@justkim9827 but he actually has chosen to keep her
I feel bad for him but only because his wife treated him like a buffoon and threw him under the bus, he is however just as guilty as her .
I believe he is more guilty than she was.
I feel bad for him cause all of this was out of left field for both of the parents. Too busy to pay attention and now, end up in jail. Tragic all around
@@jennifertucker6082 He literally bought his son the gun! He failed to secure the gun in any way, shape, or form. He's going down for this and rightly so.
From her trial, it seems like he was more G bc he bought the gun, was resposible for storing it, etc. Will be interesting.
She was her own worst enemy.
Oh no not that judge again! Ugh
This judge is annoying.
Maybe there will be a change of venue and a new judge
That's my hope@@RW-to2fy
She’s wishy-washy
Well, this man already has a WAY BETTER lawyer than Jennifer...
I hate to say it, but the defense attorney here made a lot of sense when she said the video + the witnesses the state wants in is a bit cumulative or prejudicial. I don't think the state even needs all that. I think the previous gun owner is very relevant though...
I agree about her having a way better lawyer and making much more sense; however, I don't think the previous gun owner is relevant at all.
I do. If they're going to argue that James was negligent, having the witness state that the cable lock was in the same condition that he sold it in is something they could use to bolster that argument. It really depends on how they use him.
... We saw from Jennifer's trial how prejudicial the videos were, much less witnesses/victims?
Totally unnecessary for what they're charging him for. It's already been established that his son did the crime. Revisiting that is pointless unless you're going for the emotional appeal.
Yeah, that's what a defense attorney is supposed to be like. She's supposed to make you see her client's side of things and present it in a way that makes you see there's some reason in it. I think the prosecution should be allowed to have these witnesses lined up just in case, but anyone could see the defense's point.
Jennifer really drew the short straw when she got Shannon Smith.
Between the chairs & podium, there’s no room for the flailing of arms, walking around, etc. plus, we can’t see the attys’ messy paperwork.
this judge drives me nuts....already prosecution is having to repeat his points over and over before she understands it
Not this judge again
Why the need for headphones?
I suspect he is hard of hearing.
If he’s hard of hearing why cover his ears? Hearing aids are usually inserted in an ear…
I had the same question!
Because he only speaks Spanish.
@@jviewz88no he only speaks French.
I really don’t like this judge , watched all of the other trial and she just seems very unprofessional
Actually she is a Good Judge.
@@user-rd5yx2gs7o I don’t think she controlled the courtroom very well.
he was smart enough not to use her lawyer.
This judge…
At least the judge is talking louder now
Throw the key away.
Hopefully he leaned from Jennifer & won’t testify
This man has every right to have a trial. I am guessing he was not offered a plea deal because his wife/co-defendant was found guilty.
I don't think that either parent was offered a plea bargain. I'm pretty sure that at least one of them would have taken the deal and skipped the trial
How does he know if he can’t hear…..if he can’t hear that he can’t hear?
Oh No the same Judge Hope she has better control of the court this time ...
Oh lord, the same judge…. Hope she gets a better handle on this trial. Super worried about appeals for Jennifer.
He should learn from his wife’s trial.
I was thinking how much harder it would be to go to trial after his wife if she was found guilty, but then again, if they ensure he gets a fair and honest trial, it could be an advantage too because his lawyer will have had time to discover more points that the prosecution might bring up and better defense against said things. She'll at the very least know what NOT to do...
I wish there was a microphone that was appropriate for this judge who is a low talker.
Why does it matter why he has on earphones. It’s not altering the case in anyway.
People have a right to know since we don't ever see it. (Even if it does not alter the case)
@@henchyheld3925 : Is it a “right” to know? There’s a big difference between “Rights” and “Entitlement”.
It’s obviously altering the perceptions to the case for those with the inability to focus on the matters of the case.
Waited for judge to ask James if he was aware that JC wanted seperate trials so she could blame all this on James by throwing him under the bus? Also was James aware that JC and her lover had love sessions with other couples she recruited online through some app on her phone? If he knew both those facts that came from her mouth last trial, he might have gotten a different law firm to represent him. She was a 100% deceptive wife for sure. No loyalty to him or their son.
Apparently he was also having affairs, but I'm sure we'll find out in March...
We don’t know yet, what he was up to as well, pretty sure he wasn’t as loyal as we think. Phone records will be very interesting
Let's not forget that both parents showed their loyalty to their son by going on the run until they were arrested while they were in hiding! These dreadful parents don't know the meaning of loyalty, or taking responsibility.
The private sex life of a consenting adult does not determine that adult's ability to successfully parent. Jennifer's attorney should have fought to prevent that line of questioning from being admissible. It was wildly inappropriate. These parents are on trial for involuntary manslaughter, not their marriage vows. Infidelity is a moral offense, but it is not a crime. Hopefully this defense attorney has better sense.
I don’t care in the least about either parents sex life, they were neglectful parents and that’s what matters.
if she was found guilty theres no way he gets off it doesnt matter where the court case goes
Idk, it's a whole new jury and different defense attorney. James is morally cupable but who knows? I thought Jennifer's case could go either way too and her lawyer is wayyyy worse.
Well, the jury is supposed to essentially swear that they either haven't heard of the case before, or if they simply can't find anyone who hasn't heard of the case, they must swear to not use the previous outcome or any other sources of information such as news articles, youtube videos, etc...when determining the verdict. Of course, people can lie or break their "oath," but even then, there are plenty of people who disagreed with the outcome who might want to fight for this man. And vice versa. So it's really just as much of a crap shoot as Jen's trial was...
At least the lawyer is different
They have to use a different lawyer. He's a different defendant
he is sooo screwed
Maybe not, he has the advantage of seeing everything his wife did wrong.
@@reid_makes_artwhat they did wrong was hire the lawyers they did

Why was the original purchaser of the weapon brought into the case at all? I’m still not following that I’m sorry someone explain to me
They explained that they may call the original purchaser to ask questions about how the gun was locked/stored.
@@Sochi314Which as nothing to do with this case. Who cares how the previous owner secured this gun. Just because a gun is supplied with a cable lock doesn't mean you have to use it to secure the firearm. I have never used any of the cable locks that came with the guns that I have bought. Mine are in a separate locked case. Cable locks are easily defeated by bolt cutters.

Jennifer's attorney Shannon and James's current attorney used to be partners and were initially co-counsel to both James and Jennifer. The attorneys are no longer partners, Shannon represented only Jennifer and James' current attorney is representing him solely now. Info/evidence shared by Jennifer with James' attorney can't be used in James' defense as it was privileged at the time. I hope that's a little helpful.
