      Yeah, that key phrase was the red flag that they were not dealing with reasonable cops.
      I have never, ever, heard anyone utter the words "don't get smart with me" except to bully someone into submitting, because they can't win a rational discussion.
      May as well say "I am low IQ, bossy, and demand submission".
      It's what parents say when they _want_ to say "shut up and do what you're told", but deep down understand that sounds kinda a55enine, so they rephrase it.

      If an officer arrest you and doesn't articulate the crime he suspects you of committing or especially investigating, you can resist arrest and if you get injured, you can sue for a lot more and subject the officer to civil litigation since he not only broke policy but the law as well when you got injured (assault).

    "We got a call" quickly turns to "Can I see some ID?", which then turns to escalation and an innocent person in handcuffs on the way to jail. That is the playbook for law enforcement in the US. Kudos to this kid for defending his constitutional rights, I hope he wins big in a lawsuit

      He should use that money to go after the reason he was there. It sounds as if there was supposed to be a handover of a child for visitation and the person chose to call the cops on them instead of give the kid over…. Perhaps he showed up early and was waiting there. Not sure if it is her or his kid, but odds are a disgruntled ex is involved because of that new boy/girlfriend they are irrational and abusing the law. Cops sure hooked that person up!

      @@evalex71 I lived in Canada for 30 years, cops routinely run roughshod over your 'rights', in fact, advocating for your rights will often get you a "what do you think this is, the US?" response from police. lawsuits are basically non-existent here because payouts are minimal, so lawyers and, more importantly, individuals who have been wronged don't bother pursuing them unless you are rich/ want to voluntarily go bankrupt.

      DAs are elected officials that typically campaign that they'll be tough on crime. I mean nobody wants a DA who doesn't know how to get a conviction for the thieves, rapists, and other miscreants in the community. Furthermore, DAs are beholden to the PD for all their evidence in court. Therefore, DAs never want to antagonize PDs for fear of reprisal. All the chief has to do is tell his cops to go soft on investigations, suddenly the DA looks incompetent and loses re-election. Just look at what happened with Nurse Wubbels. The cop was recorded saying that he would start sending more homeless patients to that hospital because they suddenly refused to allow them draw blood on a patient without a warrant. So, don't think for a second that the actions of cops don't have sinister enablers within the community.

      Colorado passed a law that the cops can be individually sued and the cops themselves have to pay out from their own pocket.
      A few months after the murder of George Floyd by Minneapolis police officer Derek Chauvin, Colorado lawmakers passed a qualified immunity ban for law enforcement officers. It allows officers to be sued individually with a cap of up to $25,000.
      Now the other 49 states and the federal government need to follow this.

      Many, many cops do their job out of a sense of duty to the community. I applaud them.
      A fair number do it because if they tried to be a mechanic and fix cars, they'd get fired when the cars aren't fixed. I just hope they're not too bullheaded to get better at it.
      And a handful do it because they want to bully people. That sort finds their way into these kinds of videos disproportionately often. And really should be screened out of any line of work with implied authority. That sort shouldn't even be a shift manager at a fast food place. If that sort gets into a leadership position in a precinct, then that municipality will soon have a 'gang problem' and they'll be wearing uniforms.

      @@valdes77 Nah, jail. Obviously it's not currently a criminal offense to grossly violate someone's rights, but I'd be fine with criminal statutes being passed to criminalize it. Civil penalties obviously aren't enough. This is just what you're seeing now that cameras are ubiquitous. Before cameras were everywhere, this stuff still happened, and worse. Imagine what you haven't seen. This is just the tip of the iceberg, and violating people's rights is a common occurrence in law enforcement.
      The cops need to have actual consequences happen to them when they violate people's rights, and civil consequences aren't getting the job done. Cops still routinely act this way and even claim to be trained to act this way. Maybe if they could be actually held criminally responsible, they would change their behavior. Or if not, we'd have a good remedy.

    UPDATE: The two officers who first attended the call lost the lawsuit and were held accountable for the unlawful arrest and search of both the man and the woman. I am not sure what the department did with the police officers, they may have been suspended, or demoted, I don't know. All that matters is they were held accountable for their wrong-doings. Those two officers were disgusting.

    The cops assertion that "no ID = Obstruction" is trotted out so many times that it must be being taught as a goto arrest tactic. The supervisors and training academies must face some hard questioning to get any accountability.

      Cops love vague and ambiguous magic spells like "Disorderum", "Obstructicus", and "Resistorium" to cast on people to poof them away to the dungeon. They are happy to arrest people for resisting arrest like some sort of twisted Ouroboros. Many of them think they're allowed to walk up to random people on the street for no reason and demand ID and people are required to give it to them just because they're cops.       Maybe they are taught to tell people that, as a lie, to get them to identify. But then later after the training they forget that it is only a lie. I also suspect they think anything that obstructs their investigation is illegal rather than understand exactly what the obstruction law defined as obstruction.

    I once asked a cop if being suspicious is a crime, and what deems one suspicious. they said no not by itself, and what deems one suspicious is whatever they believe that'll support reasonable suspicion, I rebuttaled with then all you need for reasonable suspicion to detain someone is a belief even a false believe or a wrong belief. In short they said essentially they can create a false belief to support the ARS to them detain and potentially arrest someone. They said its then up to the courts to determine if it was lawful or unjustified. They dont need to call a sergeant or supervisor and by doing so is th3n being nice. It seems like a very easily exploited loophole used to harass people and supported by dept and sop

      In civil court, yeah. But that’s not the only lawful avenue of attack.
      Any rights violation you can sue for is also an actual crime - as in handcuffs, jail and criminal court trial - as well. And since the crime is federal, it’s a crime everywhere in the USA.
      The US Supreme Court has affirmed the validity of citizen’s arrests, and has ruled that if a citizen’s arrest for a city, county or state level violation of the law is valid, it would also be valid for a crime of the same severity on the federal level.
      In most states with laws that allow citizen’s arrests, it’s lawful to use any type or degree of force that police can.
      I’m not saying to beat the crap out of a cop while making such an arrest, but if your local cops consider a complimentary choke hold or body slam or pepper spraying or tasing to be just part of the arrest procedure even for people who aren’t resosting, a strong case could be made for doing those things to any cop you arrest. It’s a gray area. But force that is actually mecessary to end resistance or prevent escape isn’t in a gray area at all - even if a bad cop gets killed while resisting arrest.

      Here is the legal part of it. Detention is an arrest, even detention while in handcuffs. Detention is temporary delay, but when you can not leave of your own recognizance, then it is an arrest, and no Miranda rights were ever read at the time of the detention/arrest. It was wise of the ACCUSED to not say anything without a legal representative present at the immediate time of questioning. This should be a giant monetary lawsuit, involving two litigants placed in handcuffs AND arrest mode.

      Here is another scenario. The 911 caller on a CUSTODY VIOLATION complaint knows the names of who they are accusing. BUT police, after supervisor shows up, have still no evidence of wrongful doing at the time of arrest so now you pile unlawful arrest because the obstruction charge is brought against specific human beings, BUT the law is not specific and applies only to corporate persons, not private human beings. Major, major lawsuit and can charge clear up to Governor for not protecting rights of human beings of his State/Republic.

      Another thing. Police officers are hired to protect CITY ASSETS only . A human being is NOT a "City Asset". A human being is a Sovereign and able to make their own decisions. A Sheriff is an elected official of the County and is the chief law enforcement officer of the county AND no other law enforcement supercedes his elected authority. The Sheriff's primary duty is to protect all human beings rights inside the boundaries of the County, no matter what. The city police stepped out of their box and trespassed on the authority of the Sheriff by stripping those two human beings of their inherent rights. Besides imposing laws by inserting names into the law, which has never been amended by legally elected legislators. This leads to the question of police officers unlawfully stepping into Legislative jurisdiction and becoming unelected legislators and changing the law to defend their unlawful actions. You should have criminal and civil litigation pending against the police, Sheriff, and Governor.

      The thing is, assault is a breach of the peace, and breach of the peace is something you can make a lawful citizen’s arrest for in about 36 out of 50 states, as well as in all purely federal areas of the USA. If you are in one of the areas where it’s lawful, you can preempt the cop’s BS attempt to fabricate an assault by arresting the cop first.
