when you have 8 cops for no crime you have too many cops on payroll.
It's a dangerous city, and the suspect could easily have friends nearby who are looking to harm cops. There are a lot of gangstas around.

Maybe the reason why there is so much crime is because America overpolices poor communities, which keeps them poor and drives them towards more crime... No country has even close to the police presence of America, and yet the country has insane ammounts of crime. It's almost as if police presence if making crime worse and not the contrary. What's so frustrating about this is, "we need your ID for the report"... no, you don't. In reports "subject unknown to me" is fully acceptable and holds legal merit
Exactly, it's not the responsibility nor obligations of Americans to assist cops!
The real reason they want that ID is so they can check if you have active warrants and so they can have you on file as a possible suspect if something happens in that area during the day they interacted with you in that area. This is why its important that you don’t ID yourself if you don’t have to.
I see this over and over and it seems the police requiring their reports have someone's name on there legal or not is the problem.
No what is frustrating is that some state are so out of aline with the Constitution that someone can't carry a firearm in this state.
@@DemocratsLoveKummyInTheirTummyMy understanding for the reason they insist on ID is to check for warrants, they use the reason of putting it on a report because if they told you they want to check you for warrants you might be less likely to give your ID. Either way we have a constitutional right to be free from unreasonable searches and seizures which this one falls under so the reasoning for not giving the ID is really of no consequence, we have the right to not ID and we don't even have to explain ourself. The burden of proof is on the officers, but notice how they switch it and want you to prove yourself. Not all of them but it seems to be a common tactic which has an effect on how people view officers. It's tyrannical behavior like this that puts a disconnect between officers and the people they serve
I’m from Newark. I can personally testify that the young men and women on this force are absolute goof balls with no real understanding of their duties to protect and uphold constitutional rights. They are used to being over aggressive because they usually deal with more serious crimes. I’ll give an example: if they’re dealing with a drug dealer or a murderer, they’re fine, but dealing with innocent citizens isn’t their strong suit. They’re like over aggressive dogs. Great when they bite an intruder in the ass, horrible when they bite your neighbors kid for no reason.

Even if the officer knows that they are not allowed to ask they will still keep trying because if they run you and get something they win. They will then put you in the system and then anytime they are close they will get you. They will find your car, house and they will try and get you. They hold grudges.
When a video like this happens people need to make the call out to bring 100s if not thousands of auditors out and about and show a force that will piss off the police and train them and teach them that you can not request ID.
For every audit or for every video in major cities you could ideally get 100s of people to show up. Use social media to get people to show up in force.

Even if they know they can not get an ID they still push over and over till a supervisor tells them to stop. Keep in mind it does not matter to them because they have qualified immunity.

Considering that Newark is the most dangerous city in New Jersey and was the car theft capital of the world not too long ago, I'd say the cops were justified in their actions. The cameraman appeared to be up to no good.

Well that might make people less likely to call police if something actual is happening. I’d rather the police know how to do their actual job and once they Dispel the suspicion they let people go, no asking ID, none of that BS. Just a quick “Alright sir/m’am have a nice day/night.” Over in 3-5 minutes.
I live in Newark, NJ. The cops here do this all the time. They are constantly harassing residents here for no reason. They pulled the same line on my husband and detained him for 3 hours! They will stop you and detain you on "suspicion of someone that matches your description that they are investigating" bc they don't like the way you look. But when I called the police bc someone was trying to mug me, they hung up on me and never called back or showed up to the scene. I, along with other Newark residents, have pics on my Facebook account of officers asleep in their cruiser while on duty! Several officers have been fired bc of this! There are several precincts in Newark that all NEED to be investigated!!! The cops here are out of control. Citizens here are genuinely afraid of the police. They need to be stopped!!!

The cop literally said at 5:15 "our suspicion is dispelled, but we still need to identify the person you are speaking with." You give the citizen a B+ for contesting reasonable suspicion (he had not committed a crime), but the cop admitted this fact to him at 5:15.
The cops own words turned this one. They WOULD have had grounds if they asked first, but to late and having such a big mouth tool that lol! If they'd asked him from jump , before they dispelled suspicion, they'd have had grounds and made the citizen within their right to ask or even demand id

That’s the thing with auditors some times. They could just leave the scene if they wanted to or deescalate but they want to milk the situation as much as possible, which I understand some times if the cops just look super bad and you’re pursuing the lawsuit route.

Cops are glorified meter maids. They cause trouble for you to extract money outta you for the city. It’s disgusting really.
This gentleman deserves an A plus, imo. He maintained his composure and articulated his argument quite well. The publisher of this video has to appreciate the level of stress being imposed. These officers may deal with this type of stop and detention every day.
The general public are typically not trained to politely argue and mitigate a traffic stop.

In fact they care _only_ about their report. In most cases we see on CZcams it's obvious that the cops know from the get-go that the guy is no threat to anything, there's no law enforcement problem they are going to address, and nothing to "investigate". Looking at their body language you can see that they don't even listen and could not care less. The only thing they care about is their report they need to close by reporting that they checked someone's ID and thus solved the problem. Their whole existence and pretense that they somehow provide security is one big lie. Whenever the situation becomes really "insecure", "officer safety" immediately comes into picture, and "the scene" becomes completely clear of any cops, as we see in one school shooting after another.

I have an overwhelming respect for KB for grading himself on this matter. I feel a lot of people do not take the time for self reflection and understand what they did wrong and KB shows that he is a very responsible person for the self reflection and wanting to learn from his mistakes and grow to become a better person. Why can't you see these frauditors for what they really are? They are not "Journalists" fighting for imaginary rights. What they do has nothing to do with education. It has nothing to do with auditing. It has nothing to do with the constitution . We should require that cops must articulate their supposed suspicions
Arguably they are required to per the 4th amendment. Otherwise, what is being argued, is that it is completely reasonable for any armed person to hold someone without giving any reason and citizens must always obey any order given by such armed person, or else be subject to violence including but not limited to lethal force.
That means, IMO, per the 4th amendment all detainments and especially arrests without giving RAS/PC and citing/quoting law being enforced is criminal conduct and should result in criminal charges.
Especially in cases like this where they are violating 4th amendment rights purely because someone called and told the cops that they believed someone might be exercising their 2a rights. That is both felony conspiracy against rights and felony deprivation of rights under USC 18.13.241 and 242. Multiple counts for every, single, officer.
Do you want to reduce violence or do you want nice sound bites? We need to go into high crime areas and institute stop and frisk to get illegal guns off the streets and arrest people with warrants. This "tying the hands of police" results in more crime.

I find it highly unlikely that it’s coincidence that so many cops confuse a traffic stop with stopping someone in public.
It's a reflex. All they do is traffic stops until they get a false call like this - because of that, they have the muscle memory metaphorically speaking to ID the contacted person no matter what because during a traffic stop you must identify and prove you have a license to operate a motor vehicle unless the stop is unlawful, but then again as another commenter said we are expected to be lawyers and judges and hope we don't get assaulted in the event that we are brought to a robed bundle of sticks with a gavel that often goes where the Sun don't shine who then judges whether or not we were right. The time for discussions and debate is over when the stupidity of the programmed individual is in play.

The manipulation and extended illegal detention should automatically make this a D or F. Not to mention, they weren't professional and were being selfish. Most police have set the bar so low that just the fact no one ended up in handcuffs is practically a good outcome.
If you give these guys an F, then what do you give the guys that do x10 worse? The interaction was fine, and they allowed the citizen to leave without much resistance in the end. They obviously have things they need to brush up on, but they didn't escalate like a lot of police normally do. As far as interactions go, I'd be perfectly fine with having an interaction like this.

Citizens need to learn to invoke their 5th amendment right immediately during any police encounter.

If you slip up and start answering questions then you've just waved the right to remain silent that you initially invoked.
However, when you ask for an attorney the cops must stop asking questions and cannot demand that you sign anything. Furthermore, if you slip up and answer a question it is inadmissible because it should not have happened without your attorney present to begin with.

As an on -duty city worker, the police "obstructed... a government function... by physical interference..."
And notice how they form and maintain a ring around him in an intimidating way, despite having immediately concluding he's not suspected of any crime.
End of the video also clearly shows that the police blocked the street, so not only was the stop extended, but they were impeding traffic. Police should not be above the law.

I really wonder what the call was like. "Yeah, there's a man with a gun and a walkie-talkie in the street" like... fuck, it's the US, what does a US citizen expect to see when looking out the window? And the cops showed up why? What crime was being commited? Is carrying a gun illegal in NJ? In such case, why are they so tame on their reaction when interacting with a man said to have a gun? It’s a particular damning indictment of the system when we’re grading police based on what they didn’t do rather than what they did do. They get a C for misunderstanding the law and violating civil rights, but not using violence. “They failed at their job but didn’t physically harm anyone, therefore earning a passing grade” tells us how unreasonably low our expectations for LE are.
Well said. While the citizens are also graded on what they should have done if they didn't act a certain way, despite being correct about not having to comply etc.

Manipulating the ID refusal into a "Obstruction" charge is for one thing and one thing only, giving the false reason as "completing their paperwork" the real reason is to run the ID through the data bases for wants and warrants. Then they have someone to arrest if there is a warrant justifying their jobs.
Obstruction is nice and vague and easily exploitable to ruin lives with impunity. That's why bad cops love it. (Along with "resisting" and "disorderly"; those are the three magic-spells cops love to cast to poof people away to the dungeon. 😠)

That's is not completely true. It depends on the State. About half the States have ,"stop and ID laws". It is unfortunate that people do not always live by the law and therefore Police or Someone is necessary to enforce the Rules. To have order in society we all have agreed to trade a little of our personal freedom for safety and security. That is part of the social contract.

The problem with your grading system is you hold citizens to a hirer standard than our police.
We are expected to be lawyers to exist without our rights being infringed but police don't even need a basic understanding of the laws they enforce.
He holds them both to the same standard. The law is the standard. One would hope the cop is more learned in the law, but it doesn't seem to be the reality of the world, based on these videos. Also, many times the cop knows the law really well, to a degree they manipulate it. Often times they are playing stupid, because ignorance of the law IS a valid excuse, in a hearing about stripping QI from an officer, because intent to deny rights has to be established in the case. It's performative; they know the real law, they are just abusing the system.

Facts! I keep saying that we the people are not trained on anything about laws and order unless we actively seek the training. While 6 months is not enough training to enforce the law, it is much more than any average citizen receives.

The police fully expect everyone around them to be disarmed. How can anyone legally determine how close someone has to be to a cop to expect to be patted down and disarmed? 5 feet? 10 feet? Everyone within a 1 mile radius? 2?
It's ridiculous. They shouldn't be allowed to disarm anyone until they're actually under arrest. I know there's some bad people out there, and they might draw on a cop, but, oh well. They volunteered for that job and knew the risks involved beforehand.

People are legally allowed and disallowed to do many things, and then there is long list of exceptions and modifications for every one of those things :D And usually none of those laws are totally conclusive so you finally have to interpret it at court taking into account actual individual situation. So no, you are totally wrong. It's just not how law or even constitution has ever worked.

This universal belief by police across the country that once they stop someone then that person is compelled to identify themselves is frightening and is a major cause of police misconduct. This is a major issue nationwide and needs to be addressed. This country is in dire need of criminal justice reform to standardize and train all levels of law enforcement to the same level of knowledge and accountability. They all need to know what they can and can’t do by law to stop videos like these from appearing.
It really doesn’t matter what they believe they’ve already admitted that their suspicion has been dispelled. You are not in a stop and ID state and the statute regarding detention. There doesn’t give them the authority to ID you unless they’re making an arrest or writing a citation. So their 91 call doesn’t matter their beliefs. Don’t matter their suspicions have already been dispelled.
Every time they know they’re wrong they immediately go to “We got a call.” I’m calling bullsh*t on that call.

Every single police encounter turns into a fishing expedition, this one was no different. They are hoping to discover warrants or something in his background check they can arrest him for.
As someone who used to work in private security, I can confirm that for the vast majority of law enforcement, their primary concern is whether or not they have to write a report and whether they will be disciplined by their supervisor for not writing good reports (in this case, failing to identify a suspect on their report). This anti-deskwork attitude in law enforcement is perhaps one of the biggest problems that contributes to officers taking unnecessary or extreme actions during encounters. They are more afraid of getting in trouble with their supervisors over reports than they are with citizens potentially filing lawsuits against them. They are so concerned with avoiding clerical mistakes that they many times forget that the law and people's safety is more important. Perhaps if law enforcement agencies spent less training time doing push-ups and shooting practice, they could invest more time in writing classes or educational classroom training so that the armed killers they are putting on the streets would instead, be intelligent, knowledgeable, and well trained, trustworthy officers, rather than the simple brute thugs that the vast majority of them are
If u come to a stop light and it turns green how long do u have to proceed through? And if there is no traffic code related to that can they still use that as reasonable suspicion of a crime in this case (DWI)?
If this man is a city worker in the sanitation department, just like the police officers, he is a public servant.
As such, when approached by a police officer, the same reason he identifies himself in the service of his duties, this sanitation worker should have been obligated to do the same.

Target glancing, looking around for cover, taking inventory of the positions of nearby cops to decide which to shoot first by target glancing each cop... Just searching through your bag slowly after asking to look through it and given permission is not a reason to pull their guns or prepare to draw
Well they did get a call saying the guy had a hand gun, so they were most likely on edge in case he pulled out a gun. Not saying they should do that but I could understand why they might be ready for something bad to go down.
@@davebowman5152 if you're ready for something to go down, you don't spend thirty minutes repeating the same phrases expecting a different outcome OR cause something to happen. The man was standing, he was surrounded, was speaking clearly, had his hands out of his pockets, immediately identified himself as a public city worker and offered to call his supervisor at the office to verify that he was under employment with the city, didn't attempt to leave or run whatsoever, stood exactly on the same spot while speaking respectfully.
None of those things indicate danger, intent of danger, or the cops feeling that there was impending danger. When things go down, it takes seconds. The police know when they are in danger, and when they are not.
They also know when they packed their fishing rods for their expedition. A compliant citizen can easily be intimidated into forfeiting their rights. That's why their ego gets involved so deeply in these types of stops. They cannot handle someone who just stands up for themselves and their rights. That's why they surround you with more armed thugs.

Trying to educate officers is largely a useless task because they are institutionally incapable of learning from citizens. Non-auditors should insist and restate your unwillingness to ID or otherwise cooperate, protest and state the desire to be free to go and protest the extension of the stop. Just repeat endlessly until the police get tired of listening to you. For auditors, you should be well apprised of the law to make you point on camera. The actual law, not the CZcams version of the law.
It's worse than that, this is how they're specifically trained. More training can't fix a bad system or bad policy. 😕
I was born and raised there. The current mayor has I hear began reforming the Newark Police Department. Having said that, I would envoke my 5th Amendment right to remain silent. Never talk to cops, unless you are legally obligated to. And even then, say as little as possible. Better still, I know it's hard, just say I don't answer questions and I envoke my 5th Amendment right to remain silent.
