      Rarely do I disagree with a rating, the guy did try to take the phone. The attempt should be treated the same as if he did seize it, like they try to add on things.

      The cops could literally have said this is the way it is, we have a felony and we suspect you have evidence, you don't have to comply but if you choose not to we will get a search warrant and that will disrupt your life further when we come to your home and seize your phone with a warrant. We will get that video one way or another and if you delete it that is in fact a felony. We don't want to make an issue for you and we don't want to seize your phone but this is a serious charge and it will be pursued. I apologize for the inconvenience.
      That sounds pretty harsh but it's all the facts, it's courteous even though it's blunt and it just lays out the situation, you don't need to get into a fight or threaten arrest and should she decide not to comply with your request then you just follow the enshrined procedure, get the warrant and seize the phone. Don't step for a second or by an inch outside the bounds of your power as established by law, you don't need to be rude but you also don't need to acquiesce and drop it. That evidence is fairly crucial and there's no legal reason it wouldn't be collected one way or another.

      The women were hoping to get viral video of the police in the wrong. They ended up getting video of police in the right. They are required under federal law to hand over the evidence as they are a material witness and can be jailed if they refuse to hand over evidence that is vital to the case.

      D- in my opinion... F is more reserved for those who blantaly abuse the law in retaliation. These guys were intidimidating for sure and bad.. but... they didn't arrest her for sticking to their rights when they could.
      It's like comparing someone who will beat you up for talking back or someone will beat you up if you ultimately get over their limit. Both are bad, just one you can avoid the conflict. Wich makes them "Slightly" better.
      F officers would have arrested her regardless if she complied. As you saw the officer was trying to arrest them for "Reaching, Threatening body language and such" But the Chief pushed it off and didn't let him. Wich means the chief KNEW it would be a bad arrest, wich is slightly better no?

      I don't think there's a single video on this channel that gives the police less than an F where multiple people aren't in the comments saying it deserved an F. Of course, if those commenters had their way, then every video would rate the police an F, making the rating system pointless. The whole point of the middle grades isn't that they didn't do something (maybe even multiple somethings) wrong, it's that what they did wrong wasn't as bad as some of the other examples. If they'd actually arrested her or assaulted her, or illegally seized her phone, they for sure would have gotten an F.

There was a time when a person would be automatically be on the police side , but years of over policing and paramilitary action of the police has ruined that once intricatel component of citizen cooperation.       Have you seen some of the F videos? They showed some restraint in violating someone's rights. There's been many cops who would have arrested her the second she refused anything they asked for or demanded. I will say though trying to illegally sieze her phone by trying to grab it from her does put them in D territory though.

    The witness would have probably cooperated if the cops weren't total dicks to her. They never seem to understand or care about that and act like we owe them something. Treat an innocent woman like a criminal and wonder why she doesn't want to help them. Worst part is this jackass is probably already working at another police department. There needs to be a "do not hire" list for cops that get fired for misconduct. If we can't trust them all we can't trust any of them.

      I do not agree with ATA’s grades often because he chastises, comments and downgrades often due to citizens exorcising their 1st amendment by using offensive words. To be honest, his comments about not complying when someone doesn’t need to or using language that may offend others aggravate me.       If y neighbour gets murdered or their children get abducted and raped/sexually abused and i may have heard or seen something youre saying as a citizen i should not help the police investigate the crime..and presumably of you get mugged, assaulted, your kids get sexually abused etc you will obviously not help the police investigate it either, right..

      Remember that it's about rights and what they can do. ATA tries to be unbiased but I do dagree C- is too high. More like a D- as they kept threatening a false arrest. F would mean they trampled over her rights over nothing and she be in handcuffs much earlier as the police points out. They aren't good, but they are better then the worst examples. And yes that does sound like "defending them" but it's not. After all we are comparing someone who assault and arrest you for disagreeing, with someone who will assault and arrest you for not giving them what they need ultimately. One is waiting for YOU to make the mistake so they can move in freely (as you saw with the "Fist motion excuse") the other doesn't need a reason but minor annoyance.

    I’ve been binge watching these during a bout with insomnia (great great channel; you provide a real service) and what I’ve come up with is that your channel and channels like yours should be weekly mandatory watching by every police officer in every police department across the Nation. Especially since police departments do not seem to be big on training. It might go a long way to helping the police be more thoughtful and careful (to follow the law) during interactions with the public.

    The problem here is that the cops didn't approach her nicely. Then if she refused after their nice request, they simply could have explained the subpoena procedure politely. If she still refused, they could have obtained a warrant or subpoena. Instead, the escalated..

      Yup, there were MANY ways to have handled this MUCH better. They could've approached her like HUMANS and asked if she got it on camera, offered their card to her to email it to them, and warned about destroying evidence. They could have also noted her license-plate. They didn't need to act hostile from the start, demand to STEAL her phone (and of course, the PIN and access to everything on it), try to lie about it being a fake traffic-stop, threaten to arrest her, and force her to ID. 😒

      When she probably would've been happy enough to just send them a copy if they would've done something reasonable like listen when she said she SAW the whole thing, but not that she recorded it. Then again, I once saw a cop claim that he needed the original because making a copy would make it lose quality. Guess he doesn't know the difference between a digital copy and uploading it to some site that would compress it.

      Although I agree that the policemen did a terrible job, the grading that ATA uses goes from the worst case to the best case actions that each party does. There are realistic examples of the policemen arresting her purely for not giving her the evidence, or using unreasonable force for believing that the woman was gonna use her fist against her. I have to reiterate that yes, I agree that the policemen were bad, but there are worse things that they could have done to get an F.

      I was also rather surprised at this rating.
      A "C" rating should be considered as what it is: acceptable but not noteworthy or above average in any way. For law enforcement, that should mean understanding the law (including individual rights) and respecting the law. This is a baseline requirement of the profession, *not* a superlative behavior.
      These officers made several statements and actions indicating that, at a minimum, they did not understand their authority. At best, they were ignorant. Worse than that would be *knowledge* of authority but disregard of it. It may be difficult to ascribe intent, but it seems likely that there was minimal ignorance.
      I think this goes to at least a D, if not an F. And let's not make the mistake of limiting an F to only the "worst case" scenario. I've never seen a video on this channel that displayed a "worst case" scenario, and I've watched all of them. Furthermore, that's not the baseline of comparison, because that is not the *expectation* of the profession (or any profession).

      5 years of law school to be even considered lawyer ready.
      Compared the European Officers that require atleast 2 years of training to become a simple officer and 3 years to be a full one.

    Why would an officer who gave a completely truthful account of their lawful actions, in full accordance of reality, need to worry about any bystander having an additional objective documentation of said incident? 🤔

      The suspect said he was going to have his job for this. I think he wanted the video to prove he did nothing wrong so the suspect wouldn't have a case against him, but it backfired because he lost his job when trying to get the video. LOL!

      @@seeya205 Yea he did something even if we didn't notice. Maybe the search, maybe he cheap-shotted him somehow in the take down - a lot of cops like to ram a knee into the ribs or kidney or between the legs during that face down handcuffing technique if the suspect is talking or if it's somebody they don't care for for various reasons.

      Remember all you get is 2 weeks of training, then giving a gun and badge and hit the street and you have to pick it up from superiors who also only had 2 weeks of training.
      And they can get rehired on the SPOT somewhere else.
      Meanwhile Lawyers atleast take 5 years of law school, studying the law and processes and need atleast a year of internship to even be qualified as a lawyer.
      So even a law student who finishes 1 semester is more knowledgable of the law then an officer. Think about that!

    The witness was filming in landscape. That's almost unheard of these days. I'd give her a higher grade just for that.

    I just wish she would’ve held her ground all the way through cuz everything they were telling her about being arrested was just empty threats. They started the interaction as a-holes when they didn’t have to by trying to scare and intimidate her to handing over the phone.
