  • The plaintiff hired the defendant to install a vent and outlets in her bathroom. She claims she paid him for the work, but he never showed up. She’s suing for a refund. The defendant argues he spent lots of time at the plaintiff’s house preparing for the work, but then she changed her mind and now wants her money back.

      Years ago had someone threaten to sue my dad over a plumbing issue. Claim was that a fitting was poorly glued and 15 years later the leak was discovered. Their insurance company contacted him with a claim. My dad knew the people involved were sketchy. They bought it from the people he originally sold it to. I contacted the insurance company requesting to inspect the part and for the license number of the plumber who diagnosed the issue. The insurance company kept trying to fax pictures of the part and ignored the request for the license number. After a few weeks the insurance company was sent a certified letter informing them that, because of their refusal to allow physical inspection of the part and the use of unqualified, unlicensed plumbers, plus the failure of the owner to allow my dad to mitigate the damages, we consider the matter closed. I also pointed out that, if they choose litigation, they will have to explain their refusal to provide the information and their client's refusal to contact my dad to allow him to mitigate the damage. They did not contact us after that. The house was well out of warranty, and although they might have been able to sue on the basis of a latent defect, their failure to use a licensed plumber and their failure to allow us to see their evidence would have been enough to sink their case. Crappy dark grey on black pictures of a fitting is not the same as the physical inspection of that fitting. I suspect they tried nailing something to the wall and hit a pipe and wanted someone else to pay the bill. An unglued fitting isn't likely to hold for years, it would have failed on the first pressure test before the drywall went up.

      Yes! I’m in other process. Read all of the reviews, check BBB, get 3 qoutes or more, ask for pictures, ask for references if needed. It’s similiar to a job interview. Congratulations on your remodeling!❤️

      As long as you do your research get references and make notes on anything wrong don’t pay till job complete etc. in fact go back and watch some other cases so u know what others did wrong lol

    He kind of showed his follow through wasn't there. Even before she contracted with him. He had a contract with home advisor. He wasn't only willing to break that contract. He wanted the customer to break their contract with home advisor also. Funny he didn't fulfill his end of her contract either. Then the best one was the verbal agreement. He agreed to sent her the money back but he didn't follow though with that either.

    So he wanted to refund the customer to keep her happy since he's just starting out, yet hasn't done it in all this time. Now suddenly he feels he shouldn't have to refund her. What happened to keeping the customer happy? Yeah he's a liar and a cheat. She joined him in that and ended up paying for it.

    Why does she keep bringing up home advisor, she has to right to cancel them and hire any independent contractor or any individual that is suited for the job in which she needs, they then have the obligation to complete said work😑🙄 end of the story!

      Clearly because she had went thru them in the first place and because she got in connect with someone THROUGH home advisor, they are cheating them out if commission. She never would've found the work if they didn't do the work. And if she had stayed with them and he didn't show up, it would be on record with them and she would've been given her money back without going thru all this. Her circumventing home advisor allows him to cheat more people. The gact that you need that explained to you and can't understand why she is bringing it up, says something about how you do things.

      @@janelle_111 ooooo going after my spelling on a u tube comment, where spelling doesn't matter and phones auto correct spelling often...you must feel so so smart!! Good for you!! If you were able to read it, you'll survive.
      And to your point of the refund, that's what she was trying to explain to her. See how easily she got her deposit refunded? Well if she hadn't gone along with his plan to cheat out home advisor of their commission, once he gave her a quote, she paid and he didn't show, she could've easily handled it with home advisor and been given her refund as easily as they refunded her deposit. Instead she still doesn't have the work done, she had to wait to try and collect, she had to pay to file this case, etc. She was trying to teach her a lesson about what happens when you try to go around the system she chose to use and didnt think about consequences of. Seems like she got it but clearly that lesson is lost on some people...not that hard to figure out. Don't call me names, like a 6 year old, because I was able to get it. It's okay!

    Home Advisor charges now? 🤔 It’s been years since I’ve used them, but I’ve never paid a fee when I connected with, and hired contractors from their site. I was actually using them back when they went by another name (which I can’t remember).

      I agree. They’re scammers. My company contracted with them. They sent dated/expired referrals and charged my company for referrals not the job. Therefore, if they send you 10 referrals per week, your company is billed $35.00 per referral whether the referral is legitimate, expired or failed to materialize. I filed Formal complaints with the Better Business Bureau. They, eventually, returned my fees once I proved the referrals were old and/or expired.

    The defendant broke his contract with Home Advisor, then broke his written contract with the plaintiff, then broke his verbal and written agreement to refund her, and he does shady deals with his cousin (who refused to show his face in court), I hope Home Advisor bans him from their website...

    I had issues involving a handyman Home Advisors sent to me to do some work at my residence, and no money was refunded to me. Home Advisors does not refund money for poor, shoddy, or unacceptable work performed by their referrals. They mediate, but what happens is HA encourages the two parties to work it out. They also stop using people they contract with if they receive too many complaints from customers. I know because it happened to me.
    The contractor in this video was trying to pull a fast one. He was clearly defrauding the customer by saying he provided the customer with a $300 refund yet he didn't do it and blamed the lady who hired him for the reason why the job was stalled. He's a crook, and I wouldn't use him under any circumstances.

    edit: duh silly me.. by having the electrician as a witness I suppose... but still, would it not be simpler to have her submit phone records showing she called?

    This guy is something. Says he wants to make customer happy and give money back- but he just "forgot." Then in court he says he does NOT want to give money back. These contractors cannot be trusted- ever.
    I tried hard to hire some for a pretty simple job (Elect., Paint, Construction- 4 a Kitch/Bath renovation) and it was a nightmare. Those referral services are the worse too. They invite ambiguity, project creep and confusion. Their agreements are one sided to their advantage. Don't sign them! Often it is only the worse and most desperate contractors who use those services. The good ones have waiting lists 1 year long. The problem is people want work done on the cheap. She probably did too and got what she paid for. Get licensed and insured contractors on good recommendations from a friend. Verify everything including all permits- have them pull them. Talk with your town permit office and construction inspectors- they actually can be your friend. They know about contractors and what work needs to get done.

    I had a somewhat similar experience with an electrician, even though it wasn't through Home Advisor. I needed some work done (still do) and the electrician came by, looked at what needed doing, said he'd check to see if he had the needed equipment, and that was the last I saw of him. This was back when the first financial assistance was paid by the government. Luckily, I never paid him anything (he didn't ask for any) to do the job. He never contacted me again, nor could I ever get him to answer any calls.

    I worked for a contractor that pays Home Advisor for referrals. I was not aware that the customer had to pay Home Advisor for using their services.

    Wtf is an “E 2 electrician…I’m a red seal in cananda I’ve never heard of that term in the USA or Canada….in fact, if I had to guess? It SOUNDS like an apprentice, a seconded year maybe….all the more reason I wouldn’t be throwing titles around because sure as shit isint helping a clients confidence when your primary electrical contact is an apprentice…..
