      I strongly suspect the defendants knew FULL WELL that the plaintiff had communicated with both the building manager and the father - they just wanted to keep the deposit. It seems quite unlikely to me that they did not at least communicate with the building manager. AND even if they didn't - they DID KNOW that the place got rented - and they were only out of pocket a couple hundred dollars. They should be grateful the place rented and they didn't lose any months. They should also be grateful that the tenant didn't decide to stay and just stop paying the full rent - they did not have to go through eviction proceedings.... either way - really ungrateful landlords. I hope karma catches up with them.

These idiots were so blinded by $$$ they couldn’t appreciate what she did for them. Son at the end STILL wanting another thousand more dollars from the plaintiff for the other tenant even though they kept her deposit!!! Outrageous.

      Technically the plaintiff and her roommate could have taken advantage of the no rent requirement the government enforced during Covid. Yes they would have owed later but very hard to collect!

    I feel sorry for dad, I have a feeling he'll be put in a nursing home soon and these kids will be fighting each other over his property. The defendant's are so focused on money they can't see or understand the facts. I can believe the ex-husband/ property manager didn't tell the ex-wife I imagine he does his best to avoid her.

      i don’t get why the father isn’t mentally there enough to be in court but is to be dealing with tenants? surely, he should either not be dealing with tenants if he’s as bad as his kids claim and never communicated about his tenant leaving to them or he can stand with his kids in court at least. it’s so odd, the defendants are assholes and had a terrible attitude esp the woman either way

    I’m a property manager and it’s a shame how this case played out. The tenant did the right things here. She communicated advance notice and attempted to make the landlord whole. Despite her roommates job loss she paid her portion, left the apartment in good condition, and took photos to help them get it shown/rented quickly. A lot of tenants would have been like “I’m out and that’s a you problem”. It’s even worse when you think this move out happened because of Covid through no fault of the roommate.
    It’s worse that the actual landlord isn’t in court. If they are letting him make decisions and run the business he should be there. These defendants have no business being landlords. They are just about collecting the money and don’t get their role. They also don’t understand the law or their leases. The two defendants are trying to manage the money rather than actually managing the business. Honest landlords don’t treat good tenants this way.

    The defendants are ignorant of the law. The plaintiff didn’t use her roommates portion of the security deposit for June’s rent. It was forfeited (by the roommate) when she didn’t pay her portion of the rent for June. What about that aren’t they understanding? 🙄 🤦🏾‍♀️

    IMO, The landlord shouldn't have gotten the two hundred, it wasn't the plaintiffs fault that they rented the apt for the one hundred dollar decrease. The landlord should be responsible for the $200.

      Because the lease had an end date and the renter didn't pay the agreed upon amount all the way to that date . So landlord lost $200. Now if its after the lease end date than you would be correct.

    I don't understand why landlords treat great tenants this way. I also now know I would have won my case whether I had shown up with all my documentation or not, as my landlord just decided he was keeping my deposit and never sent me anything stating why. Took me a year and a liein against him to get it, but it was hard earned money.

      They are both on the lease so they are jointly and severally liable for the entire rent. Landlords do this so that, if one of the roommate tenants drops the ball they can sue any or all of them collectively to recoup what is owed. While they can sue any/or all collectively they can only collect the sum owed once. That is why the plaintiff could technically be held accountable for the roommate’s half of rent, if the defendants didn’t have the roommate’s security deposit to apply to the June shortfall. You note they didn’t sue either of them for either the shortfall in the June rent, or the rents for July & August.
      Even though their own lease says the security deposits can’t be used for last month’s rent, that is exactly what they did with the roommate’s half since you notice they didn’t return it to the roommate. If they are going to hold the plaintiff to the no security can be applied to the rent then, in addition to sending a letter & cheque to the plaintiff outlining why they were keeping her deposit (minus what she said she would pay to offset their loss) they should have also sent a letter to the renter/roommate who left with a cheque for her security deposit back which, of course they didn’t do.

Once they admitted they never returned the roommates security AND admitted there was no damages.. it was over for them. No leg left to stand on. They never even tried to sue the other roommate or mentioned being damaged by her departure. They were simply just being greedy. Case closed.

      They didn't want to return the plaintiff's security bc they felt the rent should be paid and not come from the security. Despite that the roommate's security could and did apply. But then I doubt they wouldve given the roommate her security back either. Despite that it was rented the following month. As the female defendant states, she didn't think the plaintiff deserved it. Plaintiff has permission to break the lease. Just because they have 4 people who have zero communication between each other to determine that is ludicrous.

      I'm willing to believe that the dad did discuss things and it's why he wasn't present for the court case. Totally understand he's 92 but they easily could've had him appear to speak and say one way or the other.

    Wow those two siblings do not need to be landlords. The judge gave clear and concise reasoning why they were only out $200 and the defendant still didn't get it in the end. Talk about being ignorant and greedy.

    Also if you dont send that letter in some States not only do you lose the right to keep it at all.

    She should’ve gotten double the ruling because they didn’t send the letter within 14 days saying why they aren’t paying her back. Happy she got what she did tho

      That’s only for certain states. It’s also SOMETIMES only if it’s malicious intent according to a previous case

    Wow can you say GREEDY??! I am blown away by their “defense”.
    The plaintiff wanted to do the right thing and did everything she could to help and not leave them in the lurch yet they acted like she just tried to screw them over. Most landlords would LOVE a tenant like her. Yet he’s still arguing to the bitter end about her not getting the roommates permission when WHAT DOES IT MATTER? they should watch some of these cases of landlords who really did get screwed and count their blessings with this girl!
    They made themselves look awful and I’m glad they lost. Like someone else on here said bunch of greedy kids trying to get every penny of dads money.

    So leases will typically state if you break your lease you will forfeit your security deposit. However the fact in this matter is that the former tenant appeared to have been let out of her lease if a new resident was found, which one was. So they cant now say ok yes we will agree to let you out of your lease then turn around and not honor that. They played clueless, but I honestly think they didn't think she'd fight it.

    It's hard to know if the defendants are stupid,greedy or both. Awesome plaintiff, from all appearances an upstanding human being ! Cute too ! Judge Milian did her usual great job, even when the defendants clearly didn't produce the father because it would have hurt their chances of stealing from the upstanding, outstanding tenant...I kinda want the defendants punished for their wrongdoing whether it be stupidity or more likely greed !

    I'm a landlord and the judge is right. I don't understand why these two landlords don't get it. They've already been made whole. As a landlord I always strive to be fair. These two characters were just trying to take advantage of this tenant, who was kind enough to return the apartment in the same exact way it was rented to her. I wish I had tenants like her.

    I disagree with the 200. Why should the tenant be liable for changes in the rent? What if they raised the rent? Would the tenant be liable for that as well?

    I work in the apartment industry and live in apartments. I sincerely hate those who work in the industry and take advantage of residents knowing they don’t know tenant laws or even read their leases. I always educate my residents give copies of leases. Never am I shady and I always go above and beyond for those needing slack when it comes to rent. Essentially, at the end of the day my residents are like family to me. When someone moves out I’ll give them a copy of the form that details what we look for and will charge for any damages or cleanup after moving out so they at least have a change to get it done before then. Some ppl just don’t have hearts.
