      Or even in ways they did specifically intend, considering one of the main things Nintendo usually does when making a sequel is remove gameplay elements & content from earlier installments without replacing them with anything.

      Why should they? The events should pay nintendo for using their games and equipment. Stop being privileged. Nintendo could easy shut this whole thing down. Besides the smash community has a lot of bad rep: pedophilia, drama, sexism and abuse by players. As a company I would never acknowledge a sport that has those problems.

      @@FutureRules How much money do you think Smash is making and what is the price per ounce on the crack cocaine you must be on. Like you're going to appeal to archaic IP law and then blame a scene with no oversight precisely because we've been cast aside by the main developer? And who is privileged? You know tournaments do have to pay fees to license music that is on stream right? It has never been free. That was the whole Evo 2013 drama, and further issues were had with Smash 4/Ultimate because certain music cannot always be licensed so players/TOs have to avoid certain stages or songs. (Xenoblade, Sonic, Metal Gear Solid etc etc.)
      We bleed out money to host tournaments as is, mainstay/popular tournaments can't even stay afloat in this economy broadly but especially with the decline of esports capital investments. God I hate that you can come in here sucking off the biggest abuser of the scene and then blame everyone else who just wanted to play as a cartoon fox and a fucking electric mouse...I'm just wondering why nobodies at the bottom are boot-licking these Nintendo executives (who couldn't care less about Intellectual Property btw they're just lawyers not actual devs or creators of the IPs) because at least they get paid to do this. You're just paying lip service to a corporation for free.

      @@FutureRules Most game devs/publishers would be salivating at the idea of a third-party funding events which increase their products' profile. It's free marketing and good PR. It's so valuable that many companies help advertising, funding and provide merch at the events to make it more successful.
      Organisers of any public event have the responsibility to uphold a code of conduct. Failing that should reflect poorly on the organiser, not the game or its creators.
      Overly cautious (or malicious) IP lawyers would agree with you but PR/marketing would gladly tell legal to STFU, lest everyone miss out on their Christmas bonus from the inevitable sales boost.

      I agree. If Nintendo wants to get these people to play by their rules, they should throw these events a bit of money. Instead of them using the stick (that is, their lawyers), they should give them a bit of an incentive (i.e. the carrot), and promote the competition in some way.

      Nintendo hates that their games have a competitive community. They always targeted casual gaming and they get worked up at the existence of hardcore players.
      They think Smash should be played with item and stage effects, Pokemon competitive needs to be double battle because of reasons and they will take this opinions to the grave.

      I don't regret at all not giving any money to Nintendo since the big copyright controversy last fall or whenever it was. They're such a nonsense company now. Their abusive handling of customer relations and their egregious exploitation with their mobile games is too much. If one is so inclined, everything you could get on a Switch can be found online or bought from a reseller store like Gamestop.

      Google the „right to repair“ movement.
      Many similarities because in its core it’s about the question if you actually own things you buy. If so, you should have the right to use it how you want and repair it how you like.

      @@ZergS4uc3Not putting games on a disk is in no way a crime and would screw over so many other developers. Immediately PC games that run on Unreal Engine, Unity, etc. would then, by your definition, be illegal and the only legal games would be on consoles.

      It's not that they have control over the games/consoles... it's that they control the IP, which needs to be licensed if you are hosting a large event.
      If you hold an event titled, "Harry Potter" and you have a bunch of Harry Potter crap... then you are making money off of an IP you don't own.
      You can get away with small get together without licensing but once an event gets too big then you are stealing IP. Additionally, your event could damage the brand/IP being represented.
      You claiming it's okay to use ninetendo/smash bros IP for an event without paying a licensing fee would be like Disney land creating a Mario Park without paying Ninentendo.
      Now, Nintendo could be cool about imposing rules to those receiving licensing... but they aren't and unfortunately they are allowed to have stipulations for people using their IP.
      If I licensed their IP... I can't then modify the character to have no clothes on for the event, as Ninentendo probs has a rule against that. In fact, "no game modicifcations" is a nice and easy way to ensure that without creating an infinite list of "do not add dildos to the playable characters".
      Is short:
      1) Events of all kinds need to license the IP they use at said events
      2) companies can license IP to events WITH STIPULATIONS
      3) Companies like to create simple/broad rules rather than list off do/dont.
      4) They should create a list of allowed modification though... like no modifications to game used in the tournament, unless you wish to freeze the Pokémon stadium level. All other modifications disallowed.

      @@jackdennis2748 It's just that it's a slippery slope when you are just using bought products from that company. What stops Microsoft or the hardware manufacturers and every one on the chain to start dictating what "their" products can be used for. There is a big difference using trademarked names and creating new products when you don't own it yes but when you are using the bought product and using it as it was intended then they should have no right to tell anyone that they can't do it.

Nintendo owns the intellectual property of the game they can act like this when it pertains to it being used in a public venue - private and public are two different things. Just because other companies choose not to what Nintendo does - doesn't mean that what there doing is against the law. Is it a scum bag thing to do? Obviously; not very good for customer relations.
      Modding however when its distributed beyond it being private is something all companies have the ability to send cease and desists and even sue if they refused to do so. Most companies look the other way so as long as money is not being made of mods (or their IP in general) but when money is involved its all hands of and they go for it - with few weird exceptions here and there. Technically when you modify pre-existing code from their IP and upload it online you don't even 'legally' own it.
      Nintendo is rather zealous in defending their IP because if you don't defend it as so, or at least appear to be doing that you can lose it. Imagine if they lost the IP to Mario because they allowed every Tom, Dick and Harry to do what they want with it. This is what is driving Nintendo to act the way they do.

      They’ve done that several times actually I think. That’s why no one talks about some versions of the game anymore and they do talk about 5E, cause the rules were stricter in versions 2 and 4 if I remember correctly.

      In my own ignorance, I think the main thing is literally that a videogame is played on a screen, thus making it a whole other deal legally. I remember reading that for example WoTC couldn't sue you over a CARD Magic the gathering event, but they could if you used the videogame in the event. Weird thing about something on a screen actually making a difference legally, someone with actual legal knowledge could correct me

      (context for those not in the know: several months ago WotC pulled some shit by changing the Open Gaming License which allowed 3rd parties to create content using the DnD system and tried to essentially make new modified one with harsher stipulations on how much revenue said content creators were allowed to receive, while also trying to legally invalidate the previous OGL by threatening lawsuit to anyone who tried to maintain content for the previous system)

    Just for clarification, Ludwig misread that clause about organizers. He thought it was talking about how much organizers are allowed to make it was actually about how much prize money organizers are allowed to GIVE over a year long period. In another clause, they say organizers are not allowed to make money from the tournament that exceeds the costs to run it

    Fun fact: anyone can be cease and desisted for any reason. It's just a notice of possible legal action, the cease and desist itself has no ability to enforce anything other than through intimidation unless sent by a court itself regarding actual illegal action.

      They’ve always hated game modifications, even before these guidelines were released. That’s what led them to take down Riptide and The Big House. The guidelines mentioning game mods are more a restatement of that than an attempt to lay down completely new ground. Nintendo has, after all, always seen mods as essentially illegal.

      Nintendo is essentially given the legal right to control how their IP is presented, including (and perhaps especially) "public performances" like tournaments that are hosted and broadcasted before large numbers of people. Essentially, all community-run tournaments for every game are in a legal grey area, so it's not "making up" rules per se. Nintendo, however, seems to be one of the few companies that is willing to be THIS intent on controlling every single aspect of it, and it's disheartening to see how much their desire for dominance has stifled fan enjoyment of their games in the process.

    No sponsorships allowed.
    No use of any images of copyright words or character pictures (can't use icons for character selection, smash in any names etc)
    The no mods includes fixes like ucf.
    No organization can have total prizes more than 10k per year.
    This list is crazy, and hurts the scene so much.

      During the Wii U era I was always _this close_ to getting one for the games, but then they either pulled some legal shit or they put some inane restriction that made no sense.
      Switch era? Joycon Drift and how they've gone through 3.5 (.5 is non-hack non-redbox, lasted only a month, priorities) Switch revisions with zero efforts to fix. Single issue before I considered anything.

      Their games aren’t sure-fire bangers either, at least not nowadays - in the past decade or so Nintendo games have started to alternate between hits and misses, so that redeeming quality is gone as well. Now Nintendo’s reputation is worsened by its legal team, and its games aren’t good enough on average to balance it out - they’re slipping into purely negative territory by now.

    In regards to the map determining the winner, they both played the same character in the clip and I personally think the ability to adapt to stage changes shouldn't be overlooked.

      The characters didn't matter there. The stage transition put a barrier between the players causing one player who had an absolute advantage to suddenly return to neutral and allowing the opponent to reverse the situation without any skill interaction between the players.
      Random hazards and stage transitions in this co text aren't necessarily disliked because certain characters gain advantage, but thay it adds random elements to the game which detract from the game normally determined by pure skill.

    On showing / sharing the official paperwork and removing the adress: you can use filters on gimp or photoshop to make grey text (or watermark in the background) disappear by using filters or manipulating color. Reducing contrast or adjusting the brightness/contrast curves in gimp might work.

    I don’t see this turning out well for major tournaments. Nintendo can easily hand out their licenses for locals, but i feel like all of the majors will get their applications ghosted, or be given the licenses, only for the tourney to be cancelled last minute. I have no faith in nintendo to do this properly since they are always trying to fuck us over whenever they can.

      Hard agree, there's so much historical evidence where tournaments have been screwed by Nintendo.
      There's no reason to trust them now, they don't deserve the benefit of the doubt when there's not enough evidence to show they're willing to align their goals with ours.
      If they were doing this in good faith, they wouldn't need to do this in the first place. They could just leave us alone or build their own events.

Almost all of the major tournaments that have been canceled have only done so under the threat of legal action, either through official correspondence or docs like C&Ds. There're few options for the TOs at that point, and the majority of melee community leaders have been openly critical of Nintendo since time immemorial

    Ludwig, the regulation said that an organizer can't hold tournaments where the TOTAL prize pool in a 12 month period is over $10k, preventing an organizer from just holding a bunch of smaller tournaments as a workaround to the &5k guideline. It doesn't restrict the income of the organizer themself

    I don't really understand how they can do this from like, a legal perspective. Surely if you own all the hardware and software you can do whatever you damn well please. And there's no way they can tell you what hardware you can use as far as controllers go, that's just stupid.

      Bro there's an whole ongoing issue with right to repair. Apple was notorious for this, making it difficult to repair their products outside an approved shop or how they had features to make it difficult to modify an iphone or even how they tried to fight against jailbreaking.

    The thing I am more worried about is the lack of use of UCF (Universal Controller Fix). With unmodified nintendo hardware, a lot of moves are very difficult and simple fixes like in UCF are a great way to even the playing field between competitors

      UCF is essentially invisible. So long as no one talks about it, its essentially impossible to prove whether it is/isn't used at any given tournament.
      We know for damn sure nintendo doesn't care enough to actually send people to tournaments to verify that the games are run on virgin software. So long as you cant tell visually that they're modded, it'll probably be fine.

    I'm pretty sure that when it comes specifically to online, they cannot tolerate online modifications being shown off and used in a public setting due to various legal things involving the transmission of data. It really sucks but that's way you can't show off things like Slippy or Botw multiplayer.

    It's not $10k earnings for an organizer -- an organizer can only give out $10k in winnings every 12 months, which means you can't host tournaments with prizes very often at all.

      what they did here is shitty but absolutely not true at all. nintendo is one of the only companies to not enforce crunch because they know it ruins games. no other AAA development team does that. totk had a year if polish, mario wonder had no deadline. most of this is done by the business side of nintendo and NoA. they have some of the best developers and engineers in the entire industry, we can count on one had how many competent dev teams there are and nintendo like idk 4 or so separate dev teams are some of them. fromsoft and insomniac are some other ones off the top of my head

    You can have a bigger prize pool and player pool by having 3 tournaments. Split the full tournament down the middle for the first 2. The winners or top 8 from each of the 2 tournaments win some prize and entrance into the 3rd tournament which would only have those 2-16 players. (Could also be top 32 or whatever you want).

    I assume someone commented already but i am at 3:53 and noticed him talking about a T.O. being able to "make" over 10k, but it mentions the amount they can OFFER is 10k, so with a max of 5k, they could only do two tournaments with 5k in prizes in an entire year, it seems like they don't want the T.O. making any money on the tournaments, as it mentions all the money paid has to go to running the tournament or prizes

    I love that last clip with Mango. And as someone who travelled around 15 years ago going to Melee tournaments, its very true. Those who want to play melee will always play for the love of the game regardless of what Nintendo does. Also Nintendo can't patch gamecube games.
