    CONTEXT:
    On the morning of January 29, 2022, John O'Keefe's body was found on a snow plow in front of the home of fellow police officer Brian Albert. The night before, he had gone to a bar with his girlfriend, Karen Read, as well as some friends and acquaintances, including Brian. Not long after, Karen was charged with John's murder, but her defense alleges that she is being framed by the group of people who met up at Brian's home after the bar closed. Trial begins Tuesday, April 16, 2024 with jury selection.

    I legit SHOUTED when you mentioned that the victim was missing a shoe and the investigator said THEY NEVER EVEN WENT INSIDE THE HOUSE TO LOOK FOR IT??? That shoe is gonna haunt my thoughts now. I was already ready to believe this was a police cover up but now I’m absolutely convinced. What happened to the shoe?????

    I think it’s possible that when Jennifer McCabe went into the house while the first responders were there, she told the others that Karen was hysterically shouting that she hit him, and that gave them the idea to frame her with the car accident theory. No tailight pieces were found at the time; it wasn’t until Michael Proctor had had custody of the vehicle and gone back to the house that pieces started to appear. I think framing her was something that they decided to do after he was dead

      It seems like the "I hit him" confession was just made up hours after he was found. When Karen Read was already in the hospital.
      I know an NYPD homicide detective. A very Michael Proctor type of guy. Shockingly honest for being someone so dirty.
      He'll tell you outright to never believe a confession that isn't on video or in the defendant's own handwriting. Because they just make them up.
      He laughs at everyone who falls for it so easily.
      One thing I've always hated about crooked people. They're dead right when they say people are stupid and will believe anything.
      A tip. When it comes to really shady stuff like suspiciously missing video. They find it funny how obvious they can be and still get away with it. It's a rush for them. A test of their ability to lie their way out of something.

    When you spoke to the prosecution sighing I hoped you’d cover the audible sighs of the judge. Especially pointedly AT the defense questioning. It’s so incredibly unprofessional.

    I’m right there with you with the “what if any”…it’s so annoying! Between Elaine and Lally, I will have to banish this term from my own vocabulary (not that I used it much). It’s ridiculous! Another question I have is about going over and over each paramedic’s education and credentialing history…why? How is that relevant?

      Lally draws out certain witnesses so he can end every day with one of his biggest liars on the stand uncross-examined. That way the jury goes home stewing on it. They don't know it will be quickly refuted in the morning.
      He's pulling out every single crooked prosecutor trick I've ever seen. It's awful. Awful because it shouldn't work as well as it does.
      Of course in a case like this with an innocent woman on trial. The last thing he wants is to clearly lay out all the facts and an easy to understand timeline.
      So it takes a very different technique than normal trial work.
      The Chinese menu of evidence is another good example of how prosecutors in cases like this confuse the jury. They spew so many contradictory things at them the jury just gives up trying to figure out what is true and what isn't. They each pick and choose whichever version of the "facts" they like best.
      It's no skin off his nose if the jury doesn't have a clear picture of say what John O'Keefe was wearing that night. If some juror wants to believe he was wearing a puffy coat so what?

    Me, if i was on jury duty, i would find hard to believe that cops and other witness can perfeclty remember everything that corroborates with the prosecution but sunddely have memory issues when the 'memory' might contradict it.

    5:43 I think this is my biggest complaint with the prosecution. When he spent what must have been at least 5 minutes asking the first EMT/Firefighter about training and work history, I get it. You have to build up their qualifications. But then spending 10+ more minutes going into extreme depth on how many vehicles each fire station has, the command structure of the fire department, what route they took to the crime scene, the depth that they discuss the weather, etc. I was wondering what the importance of these details will end up being maybe 10 witnesses from now. When he discussed these exact same questions for the next firefighter/EMT I was in total awe. Are they trying to kill time to put time pressures on the judge and defense by going over pointless crap?
    Edit: Also the thing that jumped out to me the most about Mr. Nuttall's testimony was the fact that he *ONLY* heard Read say, "I hit him, I hit him." This is just after two police officers testified to hearing her screaming at least ten times, "Is he dead, is he dead?" If I was on the jury I would be wondering if maybe Mr. Nuttall's memory got this muddled up too, because he expressed no recollection of Read saying that. But perhaps the firefighter taking the stand today will corroborate what Mr. Nuttall said...assuming the prosecution doesn't ask questions about the history of fire departments or why it was snowing on that day.

      Fully agree. I am interested in hearing both sides but honestly tune out until the 'introduction' period for each witness is over and I need to force myself to pay attention again after. That's not what you want as an attorney I imagine.

    Love these recaps! It’s wild to me that the cops didn’t check the inside of the house. They didn’t just find the body in the lawn but that was the party he attended.

    First off, youre my favorite explainer. Court TV has Vinnie, but he is not the communicator you are. Hes a good kid, mind you. And a great presence on CTV.
    I was thinking: that fireman may have been paid off by the PD. His face says deceit to me. He even looks like he has some dark addiction😅 .
    I doubt you " forget" that the girlfriend of your dead PD buddy says, " I Did It," standing over the newly discovered body. Thats ISNT POSSIBLE.

    I have to say living in a place where it snows pretty deep like up to your knees or waist every year no matter what I have to say even if somebody was doing chest compressions and wiped the snow off of his top half in order to do that I think that his legs and feet would still be covered in that snow and would still show how much was on top even before they had wiped any off because they're not going to wipe off his feet in order to do chest compressions

    That “what if anything “ drives me nuts !
    I don’t know much about this case and for now the only things I have clear is the defence theory. The questions (and answers) that make sense as the ones from the defence!
    The prosecution is not clear, jumps from one thing to another constantly and even the timeline is not clear at all..:

    The judge isn’t making it easy either to believe the prosecution with her sighing when the defense speaks or she rules on anything. That being said , is it possible Jennifer McCabe asked Karen “did you hit him? Or you hit him? And in shock she thought she did ?

    I am usually skeptical with the "I was framed" defense especially when cops are being blamed for the framing. That being said, I am fully open to the possibility in this case based on what little I have heard so far. That first officer expects everyone to believe that the defendant made an statement of guilt and he forgot until later? That is ridiculous.

      See, for me, since the defense has already planted the seed of corruption, I’m wondering if officer saraf was told, “hey, this is a brother cop, he’s a good guy, dont worry about the details of the report, we’re looking out for him so he doesn’t have too much grief about this.” And basically encouraged him to either shoddily fill out the form, or not check up on the details, because they were looking out for the family and wanted to muddy up any potential investigation. Botching things like who was first on the scene, the address, and the times people arrived would do just that. This investigation was shoddy at the beginning and I believe that was purposeful, but it was to help the cop family. I think pinning it on Karen was an afterthought, and then suddenly they had to try and clean up the investigation to clearly point to her. What bolsters this for me is that Saraf’s testimony changed over time and became more damning for karen after he had met with proctor, and that the pieces of taillight were only found after proctor had had custody of Karen’s car

    Knowing which way they approached the scene is important as it will highlight what they were able to see on the drive since what the plow guy claims to have or not have seen while driving on the same roads is part of the defense case.

    When I watched this prosecutor I felt like… here was a man who believes that the defendant is actually innocent (and probably that the police was at best incompetent) but he has to do his job anyway so he does the barest minimum to be sure he can’t be fired/disciplined for it.
    I don’t want to say sabotage, but his heart definitely isn’t in this prosecution.

    Ems/firemen would have bought it to attention they saw the missing shoe & fragments of the taillight if it was present, they just said the the leaf blower removed the snow! No taillight fragments! If they bright up a evidence the shoe that means the police planted it just like taillight fragments! The defense is doing a great job poking holes in the prosecution! A win for Karen Read!

    Dispatch log is important. Its the first doc. the defense gets to start going over case & theres so much info. wrong on it. (Youll see later they got a doc. then phone numbers are changed on it , but nobody told def. -where Brian & Brian destroyed old phones & got new ones.) In the 1st report they also put B. Albert [no first name but everyone elses 1st name is on there w wrong address again.] This case is terrible...only the beginning. (I heard what Karen said from that car cam with my crappy phone on speaker. If jury didnt hear it, they will when they get it to deliberate with.Plolice didnt knock on door to ask if homeowners saw or heard anything or do a sweep outside the house. Nothing.

    I’m curious to hear from the experts if it is normal for the judge to call so many sidebars and to be trying this case from the bench? In the Depp trial, the judge only called sidebars if there were an objection by council, or if the lawyers requested it. She did not interrupt council to ask questions, or make statements unless it was in relationship to something requested by council.

    Had a thought listening to the part with the shoe that a possible scenario where he has his jacket on but minus a shoe (granted he went into the house), is that he was attacked whilst taking his shoes off in a hallway or at the front door and only managed one. I generally de shoe at the front door before my coat or jacket.

    I'm behind on the streams but I've hit 2 questions that I can't see have been answered yet. 1) did the responding officers know who lived at the property when they arrived? Could that be why they used another door number? 2) they stated the body was wearing a winter coat that was cut off by paramedics. Was there damage to the arm of the coat that matches the damage to the arm?

    Someone on another channel commented that they believe the district attorney has already cut a deal with the FBI in relation to this case and with the trial, he is just going through the motions?? Don't know how likely this is, but with his demeanour... Maybe?

    I thought that he was having a bad day, poor energy, Crohn’s disease, flu, poor sleep, etc. But hearing your thoughts, I am even more confused. The poor wording of question seems like a rookie mistake, yet still, there is a low energy wind that won’t reach his sails. Doldrums come to mind. Has he ever tried a significant case before? Who knows

    Saraf feels like the sort of person who hasn't been questioned in years - not in a legal sense, but just that he is not used to people not going along with him in any situation. Surprised he wasn't turning bright red by the end of it.

    I’m convinced that it’s possible that she said ‘I hit him’. I think it’s likely that the idea was planted in her head by the others who were there and while she was in shock, and only had the thought of saving her husband, she maybe parroted the things she had heard before and only later when she could process it all did she realize everything that was wrong with the situation

    I think we know the time she dropped him off. What was the time of death? What was the time where people were trying CPR?

    I think the idea of testifying to the exact route taken, as boring as it is, was to show how good of a memory of the events the witness has. It must be good if they know the turn by turn directions they made. Of course, this won't land with the jury if: 1) The prosecution doesn't make it clear why they keep asking such benign questions, and 2) The defense does an expert job of showing lapses in memory in other places.

    I noticed the sighing too. Maybe he just has a lot on his mind right now or the workload is getting to him, but it might come across as disinterested, apathetic or like he is going through the motions.

      Apparently he was forced to prosecute by his superior and they already said they were not ready to go to trial yet. I guess it shows 🤷‍♀️

    Not guilty. First, it’s crazy the police never considered the home owners. Secondly, they also looked no further than his wife. Third, there’s been nothing I’ve heard from the trial that is convincing either. Love your CZcams!

    Well, a paramedic is focused on saving the wounded, not on figuring out who did what, so it is natural that he does not remember some of the details - they simply do not matter to his immediate task. I wish the defense had pointed that his lapses of memory are normal.

      Yes, they Also are asking how the person was injured like a car, a big Mac truck, snowblower or a fight and that's so the may also determine what other injuries they should look for. Say a fracture anywhere, internal bleeding..

    Thanks for the very interesting recap.
    At this point, I have no reason to believe Ms Read was framed, but I am wondering if a competent investigation was done. They didn't talk to everyone or go in the house. I guarantee that LAPD would go into the house a dead body was found at and talk to every person there in detail. I think that should be standard operating procedure.
    I have a lot of concern about the officer who remembered almost a confession in April, when he didn't even record it the same day of the death. Did other people say it to him so much that his mind made him think he remembered it?

      Very concerning that the officer at the house was called and told another fellow officer was wounded and laying on his front lawn, don't you think it's strange Noone came out to help a brother cop?.

      @@keli449 I think it is totally strange and suspicious. It seems like there is no proper investigation of all of this, so I am not 100% certain on the actions of the Alberts. Did their dog kill O'Keefe? Huge question.

    Thank you for the recap. I’m not sure she was framed but there seems to be serious questions on how this case has been handled. I feel so sorry for the O’Keefe family having to see all the support for Read at court when they truly believe she kills their son.
