    Tennessee resident here. I can't stand our federal, state, or local government. With that being said yall reside in Ohio. This was a second "retreat" home. Yall were not living there. Yall paid $306,000 and were offered $490,000. Yall are claiming it was generational yet you were renting it out for profit. Clearly a $3,000,000 counter offer screams money hungry. It would be wise to take the $184,000 profit and roll on back home. #richfolksproblems

      @penni6432 Před měsícem +2

      Why does it matter where this family's initial home resides? I'm sure there are many homes in TN that are rented out for "profit."
      The counteroffer if that is correct is for loss of projected revenue, in the situation as you stated is for business and not personal use.
      For example, someone trying to sell their business: while the asking price may seem high based on annual profit, it is the projected revenue the company will make based on history trend that allows the owner to ask for a reasonable price.
      The point here is that, because of a ridiculous law, the government can come in and take what they want. Karma is ugly.

      If you had a piece of property that was worth several million dollars, would you be okay with the government taking it from you and giving you a fraction of what it's worth? Why should the city be allowed to take what they want and not pay the full value? Would the city allow you to pay whatever you feel like paying on your property taxes? No! They'd take your property away from you by force! I don't care if she paid $1 for the property. That is irrelevant. You don't sell your house based on what you paid for it. You sell it based on what it appraises for!

    I made a comment a few days ago but I really think the city did deposit the condemnation award into the court registry for you and your lender to withdraw. This is what gives the city possession and is standard practice with most condemning authorities. Can you please confirm whether the city deposited the condemnation award? If city did then legally you have been paid and city has equitable title. The city will not obtain complete title until a final judgment is rendered and at that time a final judgement gets recorded in the real property records. If the city did not deposit the award, then they have explaining to do as to what they are basing their possession on. Keep in mind I am from Texas so perhaps Tennessee follows different rules when condemning. It just seems unheard of to not get paid prior to you moving out.

    • @1982MCI
      @1982MCI Před měsícem +7

      I was wondering the same thing but in Tennessee I think they would be required to deposit the funds in an escrow account which would be held by either a Real Estate Attorney or the Title Company. I am not in Tennessee either but was a licensed Broker in Mississippi & Alabama and currently am in NC and that’s the way it is here although the question still remains as to how can they take title or possession without paying fair market value and at least making the deposit of “fair market value” into escrow. The original offer that the city threw out was based upon an appraisal done with a city approved appraiser who did a Residential appraisal and this property has been zoned I believe C-9 which allows for ANY commercial use on that property which we all know significantly drives up the value from ten fold up to possibly hundred fold and from what I have heard the offer was for less than $150k which is a slap in the face and is the city trying to steal the property!!
      With the first offer being rejected, the property owners have the right to the case being heard in court and they were never given that opportunity. The city moved directly into condemnation and then bulldozing. There are some major issues here with how this was handled. The mayors house overlooks this house from higher up the hill and he watched them remodel for 7 months without telling them they were about to lose the home. The campground is at the bottom of the hill and the road had been planned to go through the side of that property for years before it magically changed course and went out of the way to go through this family’s living room. Third, the mayor that lives at the top of the hill is co-owner of the campgrounds at the bottom of the hill and how much influence did he have to reroute the road to protect his investment while destroying someone else’s investment and wouldn’t this be considered a conflict of interest to be a voting member of a government body that is voting on what happens to a property he has financial interests in?
      At the very least, this property needed to be appraised under a commercial/income producing property appraisal and then using that as the basis to make a fair market value offer to them with. Then if rejected, at least the deposit made before they moved forward which I still say they had no right to do without a court battle but at least the deposit would be closer to what market value should be.
      There’s a lot of “Stink” to this case that needs to be heard by a jury in my opinion. There’s a lot of things happening or not happening that should here, but that’s just based off my 30 years of experience as a Broker in 3 states

    If you haven’t gotten an attorney, you need to do so. And you need to get an attorney outside of the Pigeon Forge area. Probably at least one to two hours away from Pigeon Forge so that the attorney you choose will have no ties to the attorneys and city council in the Pigeon Forge area. Otherwise, “the Good Ol Boys” network will work against you. You absolutely need a lawsuit against the city. Just the fact that they allowed the property to be sold with it being marked for demolition is enough for the suit. As well as didn’t you say a council member watched you do renovation on the home all the while knowing what was in store for the property. That person if he was connected to the council should be held responsible for not disclosing his knowledge of the road being put through your home. Also, the owner of the property before you purchased it. Did that person have knowledge of the road construction? If so, the real estate company, previous owner, etc. should all be included in the lawsuit. Each and every person should be sued. An attorney will be able to help you. Contact news stations outside of Pigeon Forge to see if they will cover your situation. The objective is to think of ways to expose what has taken place. Pigeon Forge does not want this negative publicity. You might have to actually get down to holding a sign outside of a popular tourist spot and hold a sign telling their misdeeds.

I am glad that people are listening to this. I would definitely get an attorney outside of the county there. The 1% families pay off everyone and everything. They own all the property that many of the businesses sit on and the businesses pay to lease the land. Not the properties the actual land that this family owns. If the family decides they don't want to lease it to them anymore they will kick them out if the buildings that they built and take it over for their own family members. The chaos of the 2016 fires just proves how incompetent this family is since it was them in those elected officials jobs and they caused so much chaos since they turned away the national guard and never put a mass safety system in place to warn anyone with a cell phone in the facility. Thank you for your comments. We believe that the government should not have the power to arbitrarily determine property values or decide when to take private property.
      1. **Valuation Problems**: The $490K offer we received, based on the city’s appraisal using residential comparables, does not accurately reflect the true value of our property. This approach fails to consider its full market potential.
      2. **Eminent Domain Issues**: It is inherently unjust for the government to unilaterally decide when to seize someone's home. Property owners should have a significant voice in these decisions, and the process must be fair, transparent, and include just compensation based on accurate appraisals.
      This situation highlights the urgent need for reform in the way eminent domain is executed. Property rights must be respected, and owners should receive fair treatment and proper compensation.

    The more I think about this, the more I wonder if you will win a lawsuit because what judge in Pigeon Forge will rule in favor of you against the mayor etc.? A thought would be to start posting negative feedback on every site you can find regarding Pigeon Forge such as the camp ground that diverted the road through your property. Also negative feedback for every possible business (real estate company who sold you your home) near where your home was located etc. The idea is to bring awareness to your situation. Negative feedback really does have an impact on businesses. I would start with the camp ground and anything the council and mayor are involved with. People read reviews and make decisions based on the reviews.

    It seems like since the house is no longer there, then you get to name your price since the city illegally destroyed your property.

      There is a big difference of the market value of the property if it was appraised as just residential when it should have been done as a commercial appraisal based on the zoning. It doesn’t have to do with greed, it has to do with fair market value, which they are obviously not getting if appraisal was done with the the wrong zoning type.

  • @ljs444
    @ljs444 Před měsícem

    You don't need to be fighting this fight this is your number one mistake it's a ginormous mistake that you're making.
    You need to be hiring an attorney and allowing them to fight for you. I would almost get a constitutional rights attorney. As they cannot bulldoze your home that you own they have to legally take it from you that means going through a court battle.
    They cannot take your home while you own it and bulldoze it it is 100% illegal.
    The fact that you're fighting this without an attorney is absolutely insane You're going to lose 100% and you going to be financially responsible. Whether you like it or not.
    Absolutely get an attorney you can sue for millions and probably still keep the property.
    They just stomped all over your constitutional rights😮
    You could literally be sitting on a multi-million dollar lottery ticket and because you're too stupid to hire an attorney you basically ripping that ticket up and throwing it out the window

      They have an attorney!! But it also does not mean she can’t show up to council meetings and make life uncomfortable for the campground owner, er, ah, I mean mayor in the process.
      Watch all the videos and you will see that they have had council for most of this process. These are not dumb folks here, they understand they need support from the legal side and they have it but whether it’s the right attorney or not, that I can not answer

    It's not just pigeon forge, this is a large issue across the board. These politicians get in a public office and instantly become millionaire's. This happens all across our great nation. Contact Marsha Blackburn's office, she hoping to be re-elected for another term.
