Bajita salamat po sa lesson at sa pagpapatuloy sa Rights of the accused dito natutunan ko kung ano ang mga nakapaloob sa rules 115 sa una na hindi pwedeng pilitin ng prosecutor na tumestigo sa sarili na right against self incrimination at at cross examine the witness kung saan pwedeng tanungin ng abugado ang witness na isinalang ng prosecutor sunod ay pwedeng pilitin ang testigo kasama ang ebidensya na alam nya para sayo at speedy, impartial and public trial na kailangan mabilis ang trial para hindi makulong ang isang inosenteng tao at pantay ang tingin ng ng husgado at kahit sinong tao ay pwedeng pumunta sa public trial basta ito ay maayos ang suot at To appeal

It is the continues of the paragraph under section 1 of rule 115; to be exempt from being compelled to be a witness against himself, to confront and cross examine the witnesses against him at the trial, to have comoulsory process issued to secure the attendance of witnesses and production of other evidence in his behalf, to have speedy, impartial and public trial, and to appeal in all cases allowed and in the manner prescribed by law.     Magandang araw justice buddy! Sa karugtong ng ating nakaraang talakayan, limang karapatan pa ang nadagdag sa aking kaalaman. Una, bawal kang piliting tumistigo laban sa sarili mo. May karapatan rin ang iyong abogado na gisahin ang testigo ng prosecutor para gibain ang nasabing pahayag ng testigo. May karapatan ding isagpina ang testigo upang mapilitan itong pumunta sa isang pagdinig o hiring. Angnisang kaso rin ay kailangang mabilis, totoo at tapat dahil ang isang pagdinig na mayroong mabagal na resulta, ibig sabihin ay ipinagkakait ang hustisya o katarungan ang isang akusado. Mayroon ding karapatang umapila maging ang akusado o ang biktima. Maraming salamt justice buddy!

    Thanks Atty, I learned more about Rule 115 Section 1, which grants the accused and victim rights in the criminal justice system. The accused has the right to defend themselves, prove guilt, hire a lawyer, read the case, be protected, have a witness, and have relatives attend the trial.

    Good day atty. Muli, ang isang akusado ay nararapat paren itrato bilang tao at bigyang kaalaman sa kanyang karapatan. Walang sino man ang pwedeng tumawag sakanyang isang kriminal hanggat hindi napapatunayan sa korte na siya'y nagkasala. Ayon nga sa ating UDHR Artikulo 10, Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.     Good day again atty! thanks again for the continuation of our discussion regarding the rights of the accused under Rule 115 of the Revised Rules of Criminal Procedure. Accused, Offender, suspects really are the pampered party! they have more rights than we expected despite the things that they are the one who did the bad things. one of the things i learn was the justice delayed, justice denied kaya kelangan mabilisan ang pag dinig sa mga kaso. More over i also learned the impartiality of the court where there is equal treatment to prosecution and defence. and lastly the public trial where i learned that anyone can join or watch the trial.     Good day, Atty! Thank you for discussing part 2 of Rule 115. Makakatulong to sa mga taong nacharge-an ng kaso at walang testigo. Pero hindi pwedeng pilitin ng prosecutor ang testigo at ito ay tinatawag na right against self-incrimination. At kung meron naman na testigo na isasalang pwede mong icross-examine muna bago isalang sa husgado. Kung may pagkakataon naman na ayaw humarap ng testigo sa husgado magrerequest ang prosecutor sa judge ng sub poena decus tecum at ito ang ibibigay sa testigo at wala nasiyang magagawa kundi tumestigo sa kaso.     Maraming salamat Atty!! Mas marami pa akong nalaman sa Rule 115 Section 1, Right of accused at trial. the accused and the victim they both had a Rights pagdating sa Criminal Justice system. The accused has right to defend him/herself. Karaptan niyang mapatunayan ang kanyang sarii kung siya ba ay nagkasala o hindi nagkasala. Karapatan niyang kumuha ng abogadong mag dedepensa sa kanya. Karapatan niyang malinawan at basahan ng kasong isinampa sa kanya. Karapatan niyang maprotektahan. Karapatan niyang magkaroon ng testigo. Sa loob ng trial karapatan ng kanyang kamag-anak o mga kakilala na pumunta sa mismong trial. Nalaman ko rin po yung proseso sa loob ng korte at mga nangyayari sa loob ng korte.

    A blessed day Atty. Bajita! I've learned a lot regarding the rights of the accused especially Rule 15 Section 1 also known as the right of the accused at trial. Under this rule are the following knowledge that I've learned: the right to self incrimination, the right to confront and cross examine the prosecutor's witness, right to have a compulsory process to ensure the attendance of the witness, right for speedy and impartial public trial, and the last is the right to appeal in all cases allowed and the manner prescribed.     Good day atty! thank you for another lesson that you discuss to us. I learn about the topic Right of the accused part 2 is the different Right of the accused at trail. First is To be exempt from being compelled to be witness agains himself, Second Cross examine the witness, third secure the attendance of witness and production of other evidence, fourth is speedy, impartial, and public trail, last is To appeal all of the accused have right to appeal but it defends on the case and we need the proper rule about the appeal. For me this is cover by article 7 of UDOH that All are equal before the law , without any discrimination to equal protection of the law. thank you and Godblesa

    Good day atty thankyou for discussing the part of the Right of the Accused. In this video as a watch i learned that there are still more rights an accused can attain just like the right for self incrimination , in cross-examining the witness against him, right to have a speedy , impartial angld public trial and to appeal in all cases allowe in the manner prescribed by the law. The trial of the Accused should not be delayed and the Accused will be handled in matter of time. The trial is open for the public and can watch what will happen in the court but there are rules that should be followed when watching the trial. And it should also be as we all know Be fair and just .

I learned regardless of sex, race, or other personal circumstances, everyone has the same rights and freedoms, including those who are guilty of a crime. They are entitled to a public and impartial hearing at which they will be provided with all relevant defense materials. It entails not having to testify about himself, executing cross-examination of the witness, appointing an urgent request as required by law, and ensuring the presence of witnesses.

    good day atty. bajita and thank you again sa pag explain ng maayos at malinaw and also we thank that we finish and do what you give to us and in the last part of the video it was said that it was necessary to hurry and the court had to attend the meeting to be held and atty. Bajita that if the court does not attend, he will be arrested and the case will be dismissed and this is what I learned today and thank you again.

    Good day Atty. Thankyou for the well explained discussion about the Rights of the Accused. I've learned that the prosecutor is not allowed for you to testify against yourself that is called rights against self incrimination. The accused has the right to confront and cross-examine the witness against him in trial. Moreover, he is also allowed to secure the attendance of witnesses and production of other evidence in his behalf. (h) to have speedy, impartial and public trial. In public trial, rules should be followed when appearing. (i) he has the rights to appeal in wll cases allowed in the manner prescribed by law.

    Good day, Atty!Thankyou for this continuation of Rights of the Accused. I learned about five more rights of the accused. First, is right to be free from being forced to testify against himself. Second, is the right to confront and cross-examine the prosecutors witness follows. Third, is the right to have a summons given to compel the witnesses presence. Fourth, is since Justice deffered is justice withheld",the right to speedy, impartial, and public trial is guaranteed. Lastly, in both cases the right to appeal is allowed and the manner prescribed.     Greetings, Justice Buddy! Thank you for sharing your knowledge. THE LAST FIVE RIGHTS OF THE ACCUSED UNDER RULE 115 OF THE REVISED RULES OF CRIMINAL PROCEDURE
    What are the RIGHTS of the ACCUSED?
    RULE 115 is about the RIGHTS OF THE ACCUSED
    Section 1. RIGHTS OF THE ACCUSED AT TRIAL
    In all criminal prosecutions, the accused shall be entitled to the following rights:
    (e) TO BE EXEMPT from being COMPELLED to be a WITNESS AGAINST HIMSELF.
    The right against SELF-INCRIMINATION is found in Article III, Sec. 17 of the 1987 Philippine Constitution which states that "No person shall be compelled to be a witness against himself".
    THE RIGHT TO REFUSE TO TAKE THE WITNESS STAND.
    THE RIGHT TO REFUSE TO ANSWER AN INCRIMINATORY QUESTION.
    (f) To confront and CROSS-EXAMINE THE WITNESSES against him at the trial.
    Interrogating the opposing party's witness who has already testified, ang abogado ang magconduct ng cross-examination para kontrahin o tutulan kung ano man ang testimonya na ibinigay o inilahad ng testigo laban sayo.
    (g) To have a compulsory process issued to SECURE THE ATTENDANCE OF WITNESSES AND PRODUCTION OF OTHER EVIDENCE on his behalf.
    SUBPOENA AD TESTIFICANDUM A writ commanding a person to appear in court to testify as a witness.
    SUBPOENA DUCES TECUM - It is used to compel the production of books, records, things, or documents therein specified; requires the witness to produce a document or documents pertinent to a proceeding.
    (h) To have a SPEEDY, IMPARTIAL, and PUBLIC TRIAL.
    SPEEDY "JUSTICE DELAYED IS JUSTICE DENIED"
    IMPARTIAL THE ABSENCE OF PREJUDICE OR BIAS. THE PRESENCE OF FAIR AND JUST. PUBLIC TRIAL - A TRIAL THAT IS OPEN TO THE PUBLIC
    (i) TO APPEAL in all cases allowed and in the manner prescribed by law.
    AN APPEAL IS A MATTER OF RIGHT. An appeal is a defendant's request that an unfavorable ruling be reviewed. The right to appeal is established by statute or constitutional provision, but it does have limits, rules, and regulations. Take note that, kailangan yung kaso ay maaaring iapela dahil may mga kaso na hindi na maaaring iapela.
