Lesson 21: Rights of the Accused

Can I absent in Trial Court? -Yes it called Trial in absentia but the court proceed the case but in arraignment no absent as much as possible. Part 1: Rights of the Accused
Section 1. Rights of accused at the trial.
- In all criminal prosecutions, the accused shall be entitled to the following rights:
(a) To be presumed innocent until the contrary is proved beyond reasonable doubt.
(b) To be informed of the nature and cause of the accusation against him.
- This part says that the accused person has the right to be informed and aware on what did they file a case to him and what is the root cause of the accusation against him.
(c) To be present and defend in person and by counsel at every stage of the proceedings, from arraignment to promulgation of the judgment.
- Trial in absentia - you are allowed to be absent but the hearing would still be ongoing even though you are not present, provided that you are present in arraignment. But you are not allowed to not attend here because they do not consider proxy here, especially if you are the accused.
- Appear without counsel - it is only allowed if an accused person can prove that he/she can defend himself/herself to the court (especially if the accused is also a lawyer), in that case, the accused person can probably defend himself without the help of any lawyer.
(d) To testify as a witness in his own behalf but subject to cross-examination on matters covered by direct examination. His silence shall not in any manner prejudice him.

What are the right of the accused?
Section 1. RIGHTS OF THE ACCUSED AT TRIAL.
- In all criminal prosecutions, the accused shall be entitled to the following rights:
(a) TO BE PRESUMED INNOCENT until the contrary is proved beyond a reasonable doubt.
Ayon sa batas at sa mata ng batas inosente ang akusado. Ang obligado at magpapatunay na may kinalaman ang akusado sa kaso o krimen ay ang prosecution. “PROOF BEYOND A REASONABLE DOUBT” ang quantum of evidence pagdating sa mga kasong kriminal and the legal standard that the prosecution must meet in order to successfully find a criminal defendant guilty of a crime.
(b) To be informed of the nature and cause of the accusation against him.
A COMPLAINT AFFIDAVIT is a sworn statement prepared by someone who wishes to file a legal complaint.
A COUNTER AFFIDAVIT is an affidavit filed by the respondent in reply to a petition.
An ARRAIGNMENT is a court proceeding at which a criminal defendant is formally advised of the charges against him and asked to enter a plea to the charges.
(c) To be present and defend in person and by counsel at every stage of the proceedings, from arraignment to promulgation of the judgment.
Trial in absentia is a criminal proceeding in a court of law in which the person who is subject to it is not physically present at those proceedings.
Appearance without counsel, pag criminal case pangkaraniwan kailangan may abogado, pero kung maipapakita sa Hukuman na kayang ipagtanggol ang sarili, appearance without counsel is allowed.
(d) To testify as a witness in his own behalf but subject to cross-examination on covered by direct examination. His silence shall not in any manner prejudice him.
In law, cross examinationis the interrogation of a witness called by one's opponent; to test the credibility of statements the witness made during direct examination.

RULE 115 - RIGHTS OF ACCUSED
Section 1
In all criminal prosecutions, the accused shall be entitled to thefollowing rights:
(a) To be presumed innocent until the contrary is proved beyond reasonable doubt.
* In a court of law, when someone is accused of a crime and is on trial for it, the prosecutor has to produce proof that the crime was committed by the accused. And it has to be strong enough proofs that there is no doubt left that the accused did indeed commit the crime - enough proof so that there is is no reasonable (sensible) doubt remaining in the mind.
(b) To be informed of the nature and cause of the accusation against him.
(c) To be present and defend in person and by counsel at every stage of the proceedings, fromarraignment to promulgation of the judgment.
* The accused may, however, waive his presence at thetrial pursuant to the stipulations set forth in his bail, unless his presence is specifically ordered by thecourt for purposes of identification. The absence of the accused without justifiable cause at the trialof which he had notice shall be considered a waiver of his right to be present thereat. When anaccused under custody escapes, he shall be deemed to have waived his right to be present on allsubsequent trial dates until custody over him is regained. Upon motion, the accused may be allowedto defend himself in person when it sufficiently appears to the court that he can properly protect hisrights without the assistance of counsel.

Rule 115
Section 1. Rights of the accused at trial.
- In all criminal prosecutions, the accused shall be entitled to the following rights:

✓ In the eyes of the law the accused presumed to be innocent. The burden of proof lies to the prosecution and they are the one or they have the obligation to prove the guilt of the accused.
b.) To be informed of the nature and cause of the accusation against him.
✓All the accused has the right to know what the complaint against him and to know what is the case to be filed against him. The accused will know it, by way of giving him the copy of complaint, resolution and information of the prosecutor. Because the accused need to answer the complaint or the accusation against him. And second is by way of arraignment.
c.) To be present and defend in person and by counsel at every stage of the proceedings, from arraignment to promulgation of the judgement.
✓ All the accused can present and defend themselves or by counsel at every stage of the proceeding.
• Trial in absentia
✓ The accused can be absent but provided that he need to be present in arraignment.
• Appear without counsel
✓If you know you can defend yourself without a counsel it can be.
d.) To testify as a witness in his own behalf but subject to cross-examination on matters covered by direct examination. His silence shall not in any manner prejudice him.
✓ If you don't have a witness you can testify for yourself. However, the law expects you to say things that are favorable to you, thus you will be subjected to cross examination.

What are the RIGHTS of the ACCUSED?
RULE 115 is about the RIGHTS OF THE ACCUSED
Section 1. RIGHTS OF THE ACCUSED AT TRIAL.
- In all criminal prosecutions, the accused shall be entitled to the following rights:
(a) TO BE PRESUMED INNOCENT until the contrary is proved beyond a reasonable doubt.
Ang akusado ang ay inosente sa mata ng batas. Ang PROSECUTION and obligado na magpatunay na may kinalaman ang akusado sa kaso o krimen. Ang quantum of evidence pagdating sa mga kasong criminal ay “PROOF BEYOND A REASONABLE DOUBT” the legal standard that the prosecution must meet in order to successfully find a criminal defendant guilty of a crime.
(b) TO BE INFORMED of the nature and cause of the accusation against him.
A COMPLAINT AFFIDAVIT is a sworn statement prepared by someone who wishes to file a legal complaint.
A COUNTER AFFIDAVIT is an affidavit filed by the respondent in reply to a petition.
An ARRAIGNMENT is a court proceeding at which a criminal defendant is formally advised of the charges against him and asked to enter a plea to the charges.
(c) TO BE PRESENT AND DEFEND IN PERSON AND BY COUNSEL at every stage of the proceedings, from arraignment to promulgation of the judgment.
TRIAL IN ABSENTIA is a criminal proceeding in a court of law in which the person who is subject to it is not physically present at those proceedings.
APPEARANCE WITHOUT COUNSEL, pagka CRIMINAL CASE pangkaraniwan kailangan may ABAGADO, pero kung maipapakita sa Hukuman na kayang ipagtanggol ang sarili, appearance without counsel is allowed.
(d) TO TESTIFY AS A WITNESS IN HIS OWN BEHALF but subject to cross-examination on covered by direct examination. His silence shall not in any manner prejudice him.
In law, CROSS-EXAMINATION is the interrogation of a witness called by one's opponent; to test the credibility of statements the witness made during direct examination.

-Meaning every one shall be presumed innocent until it proved guilty. The obligated to prove the case was the Prosecutions.
(b) TO BE INFORMED of the nature and cause of the accusation against him.
-Meaning all accused have the right to inform regarding with the case that have been charged with him/her and what is the cause of accusation.
(c) TO BE PRESENT AND DEFEND IN PERSON AND BY COUNSEL at all stages of the proceedings, from arraignment to judgment proclamation.
-Meaning as a accused you have the right to attend hearing and defend yourself by having a counsel, from arraignment until the judgment of the judge.
*Trial in absentia. You can decide not to attend but in Arraignment you must be present. because in arraignment attendance is a must.
*Appear without counsel. As long as you can defend yourself. For. example you are a lawyer and you are accused, it can be. but in criminal case usually it is a must to have a counsel.
(d) TO TESTIFY AS A WITNESS ON HIS OWN BEHALF, but under cross-examination on issues not covered by direct examination. His silence will not affect him in any way.
-Meaning You have the rights to testify for yourself, why? because the law assumed that the accused is innocent until it proved guilty.

In lesson 40 in Education of Human Rights, I learned that Rights of the Accused under section 1 of rule 115 - rights of accused at a trial states that in all criminal prosecutions, the accused shall be entitles to rights: (1) to be presumed innocent until the contrary is proved beyond reasonable doubt, (2) to be informed of the nature and cause of the accusation against him, (3) to be present and defend in person and by counsel at every stage of proceedings, from arraignment to promulgation of the judgement, and (4) to testify as a witness in his own behalf but subject to cross-examination on matters covered by direct examination. Good Day Att. I've learned about accused persons' rights. It is the accused's rules in Rule 115. In addition, section 1 of Rule 115 of the RPC governs criminal process.
(a) Being presumed innocent until proven guilty beyond a reasonable doubt.
(b) To be made aware of the nature and basis of the charges leveled against him.
(c) To be present and defend in person and by counsel at all stages of the proceedings, from arraignment to judgment proclamation.
(d) To testify in his own behalf as a witness, but to be susceptible to cross examination on matters not covered by direct examination. His silence will not affect him in any way.
