    - it is one of the most famous exception to the rule on warrantless arrest
    B. Hot Pursuit
    - Fresh Pursuit
    - The crime was committed but you didn't see the actual crime, but their is personal knowledge based on probable cause
    C. Prisoner Arrest
    - The person who escaped from prison (PDL or Person Deprived of Liberty) can arrest without warrant

    Good evening, Atty! Today, I learned the three valid exceptions in order for an arrest without a warrant to be lawful in contrast to the general rule. In flagrante delicto is when the person was caught in the act committing the crime. While in Hot Pursuit or Fresh Pursuit is when the crime was freshly made in which the arresting officer may have a personal knowledge regarding the probable cause of the crime. Third is Prisoner Arrest wherein when a person deprived of liberty was caught fleeing or escaping a jail or prison. Thank you for the new food for the brain!

    In accordance to Rule 113, section 5 Arrest without warrant; when lawful, you can arrest without warrant under three exceptions;
    A. In flagrante delicto - this a caught in the act
    B. Hot pursuit or fresh pursuit - you didn't see the crime personally but the crime has just been committed.
    C. Prisoner's arrest - you can arrest the Person deprived liberty fleeing from the custody in valid.

    Under Section 5 Rule 113
    - A peace officer or a private person may, without a warrant, arrest a person:
    (A) IN FLAGRANTE DELICTO
    -in American they call it "CAUGHT IN THE ACT"
    - one of the most famous exceptions to the rule on a warrantless arrest.
    (B) HOT PURSUIT
    - the crime happened that you didn't witnessesed it but the crime just happened minutes ago.
    - in other book, they called it "FRESH PURSUIT".
    (C) PRISONER ARREST
    - if the PDL run away from the prison and if you saw the PDL around the area, you can arrest it even without the warrant of arrest.

    Good day Atty.
    I learned the three aspects of performing a warrantless arrest. It was stress in the video that warrantless arrest has three requisites that if it is satisfied in a given scenario, a warrantless arrest can be performed. First is the in flagrante delicto" rule, or when in the presence of the policeman, it was discussed that the person to be arrested has committed, is actually committing, or is attempting to commit an offense, warrantless can be performed.Second, is when an offense has just been committed, and he has probable cause to believe, based on personal knowledge of facts or circumstances, that the person to be arrested has committed it, the hot pursuit arrest rule. And lastly, when the person to be arrested is a prisoner who has escaped from a penal establishment, the warrantless arrest can be done.

    I gained a lot of knowledge from the topic you chose for us. The three exemptions under section 5, rule 113, are my favorite part of the video. The most fascinating aspect of the topic is that it is not always illegal to arrest someone without a warrant issued by a police officer or even a private citizen. As long as it's listed in Section 5's paragraphs A, B, and C.

    Discuss the three basic instances when is warrantless arrest lawful.
    In general, the rule an officer are not allowed to make an arrest without warrant but there is exception in making an arrest Under section (5) paragraph b of rule 113 in criminal procedure arrest without warrant is lawful. A police officer or a private person may without arrest a person when:
    A. In flagrante delicto - called in America is caught in the act. Arrest even without a warrant is lawful because it is in a flagrante delicto. It was a famous exemption to the rule of warrantless arrest.
    B. Hot pursuit - it happens but you don't see it. You are allowed to arrest without a warrant of arrest because of the personal knowledge base on the probable cause. Hot pursuit has another term this is a Fresh Pursuit.
    C. Prisoner arrest - If the police officer saw a prisoner or PDL (person deprived of liberty) with or without a warrantless arrest automatically arrested.

    Under the Rules of Court, Rule 113, Section 5, a warrantless arrest, also known as "citizen’s arrest," is lawful under three circumstances:
    1. When, within the sight of the cop, the individual to be captured has submitted, is really submitting, or is endeavoring to submit an offense. This is the "in flagrante delicto" rule.

    Here is my insight about Lesson 15;
    When is warrantless arrest is lawful
    -according to Section 2 of Articles 3, 1997 constitution no arrest can be made without a warrant of arrest as a general rule.
    In general rule Warrant less Arrest is not lawful or unlawful not a valid. This will be valid when exceptions are entered.
    Under Section 5 of Rule 113 of our criminal procedure there are three exceptions to warrantless arrest. We cannot arrest someone if we don’t have warrant of arrest of course basic rules but there are exceptions to make arrest valid.
    So, when will be a warrantless arrest be lawful?
    There are three exceptions to this;
    1. IN FLAGRANTE DELICTO
    - In America they call it caught in the act.
    - The one of the most famous exceptions to the rule on warrant less arrest.
    2. HOT PURSUIT
    - Don't have seen it but it's powerful.
    - Personal knowledge based probable cause.
    - In another book it is called as well as "FRESH PURSUIT".
    3. PRISONER ARREST
    • The PDL flees and you see that even if you do not have a warrant of arrest according to the law, you can arrest that person valid such as cannot be charged because you are protected by Paragraph C. Section 5 of rule 113 of our criminal procedure.

    b.Hotpursuit also called fresh pursuit. This is the second exception where the police officer did not actually see the crime happen but has personal knowledge based on probable cause that a crime happened and he needs to arrest a person.
    c.Prisoners arrest - The warrantless arrest is lawful if the person to be arrested is a prisoner who escaped from any jail.

    Section 5, Rule 113 of the Rules of Court: a peace officer or private person can execute or make an arrest following these three instances:
    A. In Flagrante Delicto; - The person was caught in the act doing the crime.
    B. Hot Pursuit; & - The crime has already been committed. The arresting should have knowledge about the crime or knows that there is a probable cause to make an arrest.
    C. Prisoner Arrest - If a prisoner escapes a penal establishment or the place where he is serving final judgement or is temporarily confined while his case is pending, can be arrested without an arrest warrant.

    Good afternoon Atty. Jeffrey Bajita. In this video, I learned that in arresting a warrant is necessary and it answers that arresting not having warrant is unlawful. On the other hand, there are exceptions in arresting without warrant. These are the In flagrante delicto or caught on the act, Hot pursuit, and Prisoner arrest. Those are important to know because those are exceptional in arresting without warrant. Thank you!

    When is Warrantless Arrest Lawful?
    🔹 According to Rule 113 of Criminal Procedure;
    Section 5: A peace officer or a private person may, without a warrant, arrest a person (considering the following:)
    A. In Flagrante Delicto- or caught in the act. An officer can arrest the culprit without a warrant if the crime is caught in action and if the officer witness the scene himself.
    B. Hot Pursuit- or fresh pursuit of the officer didn't witness the crime of action but caught the crime that have just ended. When he determined the culprit and caught him or her on the run, the officer can arrest him or her without a warrant.
    C. Prisoner Arrest- is when a prisoner or Person Deprived of Liberty (PDL) have caught escaping the prison or when an officer seen a prisoner that have escaped, they can be arrested without a warrant.

    When is it legal to detain someone without a warrant?
    A. In flagrante delicto; caught in act
    For example, when a person doing crime, you can arrest it when you actually see the persons crime. Arrest even without warrant will be lawful because you caught it in act.
    B. Hot pursuit/fresh pursuit-the crime occurred but you were unaware of it; yet, it did occur.
    C. Prisoner Arrest - The person who escaped "PDL" has been apprehended. When you notice someone escaping, you have a valid reason to suspect

    Good day Atty. my favorite part of your discussion is the section 5. Arrest without warrant or the Exceptions, first the In Flagrante delicto when you caught in the act committing the crime it's ok to arrest it without the warrant of Arrest and second the Hot Pursuit or Fresh Pursuit when the police have a chance to personal managed base on probable cause and last the Prisoner Arrest when the prisoner escape to the jail, nowadays they called Person Deprived of Liberty.
