    In continuation to our discussion regarding the preliminary investigation, I learned here who are the authorized prosecutors that can conduct the investigation which I already have a background since it was discussed on our PCJS. My added learnings here are the remedies that the offended party can make if the Prosecutor refuses to file the case even when the presence of probable cause is there. I believe that these remedies are made to give importance to the rights of the offended party to achieve justice. Thank you for this, Attorney!

    Isang mapagpalang araw Atty! Maraming salamat po sa pagtalakay patungkol sa kung sino ba ang may karapatan o kanino bang sakop ang mga nagsasagawa ng preliminary investigation. Malinaw, maraming impormasyon at maayos na presentasyon po ang inyong naipabatid sa amin. Bukod sa mga ito, mayroon din tayong MARCCA na kung saan ay mga remedyo ng isang biktima kung sakaling hindi kasuhan ng abogado o prosecutor kahit may sapat na ebidensya laban rito. In this video, I have learned the officers who are authorized to conduct Preliminary Investigation; The provincial or city prosecutors, National and Regional state prosecutors, and Other officers that are authorized by the law. For this video, I was able to identify the authorized personnel who can conduct preliminary investigations these are the following, provincial or city prosecutors and their assistants, national and regional state prosecutors, and other officers authorized by law like the Office of the Ombudsman who prosecutes the public officers or employees of the government who committed an offense related to their job. I learned that the provincial or city prosecutor, the national and regional state prosecutor and other officers like ombuddsman can conduct a preliminary investigation. There is also remedies if the prosecutor refuses to file information despite the existence of probable cause. You can file mandamus, administrative case, motion for reconsideration, criminal case, or to hold the prosecutor civilly liable and/or to appeal to the DOJ.

I also learn the remedies if a prosecutor is not giving information where you can file mandamus, administrative case, reconsideration, and criminal case against the prosecutor and hold them civilly or appeal to the department of justice.

    I learned that the other officers are allowed to conduct preliminary investigation as long as they are authorized by the law. Also the provincial and city prosecutors and their assistants and even the National and Regional State prosecutors. The remedies of the offended party against a prosecutor who unreasonably refuses to file the information despite the existence of a probable cause is also discussed in this video. The first one is to file an action for Mandamus or the petition for the public officer that does not do their job when you wanted them to do their job for you. Next is to file an administrative case against the prosecutor, to file a motion for reconsideration, to file a criminal case against the prosecutor, to hold prosecutor civilly liable and lastly is to appeal to the DOJ. In this lecture I learned about the people who are authorized in conducting preliminary investigation such as the provincial/city prosecutor (Fiscal) and their assistants; National and Regional state prosecutors (wider scope) and other officers as may be authorized by law like (tagausig) of criminal cases when the public officers and employees become involved in connection with the performance of their official functions (Ombudsman). In additional the remedies of the offended party against a prosecutor who unreasonably refuses to file the information despite the existence of a probable cause (MARCCA) which is to file an action of Mandamus to compel the prosecutor to file the information (petition to public officer to do their job), File Administrative case against the prosecutor ( can be ignorance of law or neglect of duty), file a motion for Reconsideration , File Criminal case against prosecutor (if the prosecutor found guilty criminal case is synonimous to imprisonment/fine or both depends on the details of case), Hold the prosecutor Civilly liability amd lastly is to Appeal to the DOJ.I have learned so much from you and I look forward to learning more. And I've knew that the prosecutors who refuses the investigation even there is the existence of probable cause can be punished.
