    Good day Attorney Jeff, this lesson is about the RIGHTS OF THE ACCUSED, I have learned a lot about the RULE 115 SEC. 1. RIGHTS OF ACCUSED AT TRIAL in all criminal prosecutions the accused shall be entitled to be the following rights:
    (a) to be presumed innocent until the contrary is proved beyond reasonable doubt.
    (b) to be informed of the nature and cause of the accusation against him.
    (c) to be present and defend in person and by counsel at every stage of the proceedings from arraignment to promulgation of the judgment.
    •Trial in Absentia
    •Appear without counsel
    (d) testify as a witness in his own behalf but subject to cross examination on matters covered by direct examination. His silence shall not in any manner prejudice him. I've learned that Bail is a matter of right but with an exception because under Section 4 of Rule 114, All persons in custody shall be admitted to bail as a matter of right, with sufficient sureties, or released on recognizance as prescribed by law or this rule. Everyone has the right to get their cases released on bail especially when they are innocent. Also stated in Section 4 (a), before or after conviction by the Metropolitan Trial Court, Municipal Trial Court, Municipal Trial Court in Cities or Municipal Circuit Trial Court, and on Section 4 (b)before conviction by the Regional Trial Court of an offense not punishable by death, reclusion Perpetua, or life imprisonment.

    * The granting of bail is usually considered to be an inherent right. However, there are certain circumstances where bail may be refused. In bailable offences, it is a right of the accused to be released on bail. But in non bailable offences, the accused can be refused bail by the competent authority if the authority deems it fit. Unless exceptional circumstances are brought to the notice of the Court which may defeat proper investigation and a fair trial, the Court will not decline to grant bail to a person.

    In lesson 39 in Education of Human Rights, I learned that under section 4 of Rule 114 that All persons in custody shall be admitted to bail as a matter of right, with sufficient sureties, or released on recognizance of prescribed by law or this rule. I also learned that bail can be done when (a) before or after conviction by Metropolitan Trial Court, Municipal Trial Court in Cities, or Municipal Circuit Trial Court, and cannot be done when (b) before conviction by the Regional Trial Court of an offense not punishable by death, reclusion perpetua, or life imprisonment.

    When is Bail a matter of Right?
    The General rule based on the Constitution with regards to Bail as a matter of Right, all person is entitled to bail from all cases filed before him. However, according to Sec. 4 of Rule 114. Bail, a matter of right; exception. - All persons in custody shall be admitted to bail as a matter of right, with sufficient sureties, or released on recognizance as prescribed by law or this Rule.
    a.Before or after conviction by the Metropolitan Trial Court, Municipal Trial Court, Municipal Trial Court in Cities, or Municipal Circuit Trial Court
    - Bail is a matter of right when before and after conviction if the case is in the first level courts. However, in cases such as Homicide, which in the jurisdiction of a Regional Trial Court, bail is a matter of right. But not all cases filed in RTC is eligible for bail.
    b. Before conviction by the Regional Trial Court of an offense not punishable by death, reclusion perpetua, or life imprisonment.
    - Filing for bail after conviction is not feasible. Under paragraph B, bail is only a matter of right before conviction as the accused is presumed innocent until proven guilty. However, if the punishment is reclusion perpetua, life imprisonment, or death, bail is not a matter of right even before conviction (e.g Murder). For cases such as Homicide which the punishment is only Reclusion temporal, bail is eligible.

    Goodday atty i've learned that Bail is a matter of right but with an exception. Under Section 4 of Rule 114, All persons in custody shall be admitted to bail as a matter of right, with sufficient sureties, or released on recognizance as prescribed by law or this rule. Everyone has the right to get their cases released on bail especially when they are innocent. Also stated in Section 4 (a), before or after conviction by the Metropolitan Trial Court, Municipal Trial Court, Municipal Trial Court in Cities or Municipal Circuit Trial Court, and on Section 4 (b)before conviction by the Regional Trial Court of an offense not punishable by death, reclusion Perpetua, or life imprisonment.

    I've learned that the bail of matter of right under the rule 114 section 4 that everyone has the right to get their case release on bail specially when they are innocent. The bail is no longer eligible for bail in other cases.
