    Thank you for this lesson about the Adultery and Concubinage. In this lesson I've learned the difference of adultery and concubinage. If the person guilty of adultery committed this offense while being abandoned without justification by the offended spouse, the penalty next lower in degree than that provided in the next preceding paragraph shall be imposed.     Good day Attorney, Thank you for making this video. In this lesson I've learned the difference of adultery and concubinage.
    Who prosecutes adultery and concubinage?
    -Only the injured spouse has the authority to submit a complaint against the perpetrators of adultery or concubinage, as I learned here. In-laws and children have no legal standing to bring a case against a marriage. Adultery and concubinage can only be committed by two people, thus I learned that not only one person should be convicted in this case. You can't even bring a case against the mistress by herself. They can both sue if the aggrieved spouse files a case. You will no longer be able to prosecute these people after you have allowed and summoned them.
    - Adultery and concubinage offences will not be punished unless the aggrieved spouse files a complaint

    Good day Attorney our Justice Buddy! I learned from your discussion are about who must prosecute criminal action. Ot os written in the Rule 110 section 5 that all criminal actions either commenced by complaint or by information shall be prosecuted under the direction and control of a public prosecutor.     Lesson 20:
    Who prosecutes adultery and concubinage?
    I discovered here that only the offended spouse has the authority to file a complaint against the perpetrators of adultery or concubinage. When it comes to initiating a lawsuit against a couple, in-laws or children have no standing. I also discovered that in this scenario, not just one person should be prosecuted because adultery and concubinage can only be committed by two persons. You can't even file a case with just the mistress. If the offended spouse files a lawsuit, they can both sue. However, once you allow and summon these persons, you are no longer able to prosecute them.

    Good afternoon Atty. Jeffrey Bajita. In this video, I learned that based on rule 110 section 5 rules of court that all criminal actions shall be prosecuted under the direction and control of a public prosecutor. Also, this general rule has an exemption wherein section 5 under rule 110 the crime of adultery and concubinage shall not be prosecuted unless the complaint is filed by the offended spouse. Furthermore, you cannot charge the affair of the accused only instead the both of them will be in jail if you filed a case. Lastly, I learned that the real victim of every criminal case is not the private offended party instead of the people of the Philippines. Thank you Buddy for the clear discussion!

Nalaman ko na kung ikaw ay nais magsampa ng kasong Adultery or Concubinage ay hindi mo maaring iasa sa ibang tao na sila ang magsampa, dahil hindi naman sila ang nakaranas ng mga bagay na iyong naranasan noon.     Here is my insight about this video lesson,
    LESSON # 29:
    • Who prosecutes adultery and concubinage?
    - According to Section 5 of Rule 110 as the general rule. Who must prosecute criminal action. - All criminal actions either commenced by complaint or by information shall be prosecuted under the direction and control of a public prosecutor.
    - Also in Section 5 as the exemption to the rule. The crimes of adultery and concubinage shall not be prosecuted except upon a complaint filed by the offended spouse.
    - No one can prosecute the case even if a family member or the prosecutor. Only the offended spouse can filed a complaint.
    - Section 5 of Rule 110 also states that The offended party cannot institute criminal prosecution without including the guilty parties, if both are alive nor in any case if the offended party has consented to the offense or pardoned the offenders.

    Natutunan ko sa video na ito na kapag ang kaso ay adultery o concubinagae, walang maaring magsampa nito kundi ang offended spouse lamang. Ngunit ang offended party ay hindi maaaring iisa lamang ang sasampahan ng kaso dahil hindi maisasakatuparan ang nagawang krimen (pagtataksil sa asawa) kung iisa lamang ang partidong involved.     Knowledge obtained:
    - Under the Rule 110 , Section 5, all criminal complaint or information should be under the direction of the Public prosecutor. And all criminal cases is considered as public case where the actual offended party is the people of the philippines and not the actual private offended party.

    Good day Atty! This lesson taught me the about the things regarding with who must prosecute criminal actions which is the Public Prosecutor. Another thing is the crimes of Adultery and concubinage shall not be prosecuted except upon a complaint filed by the offended spouse, meaning when the case is adultery and concubinage no one can start the prosecution against the spouse except the victim itself. thank you Atty!

    Good afternoon atty, thank you so much for the new knowledge you taught us. I have now learned that the criminal case is presumed by public crime law that the real victim is not the private offended party but the real victim is the Filipino people. The public prosecutor is the public's lawyer. And another thing I learned today is about adultery and concubinage, that when you file a lawsuit it should not be your eldest child, parent, or any other relative to file a lawsuit but the real spouse. There should also be no choice of who is to blame, but what is stated in the law is that both parties are guilty.

    lesson 20 Good afternoon Atty. It was such an entertaining and knowledgeable discussion. I've learned that in filing a case when it comes to adultery and concubinage, the only person who has the rights to file the case is the offended spouse not any other concerned relatives or citizens.
    Who prosecutes adultery and concubinage?
    As a general rule, under rule 110 section 5 - All criminal actions either commenced by complaint or by information shall be prosecuted under the direction and control of a public prosecutor .
    - There is an exemption under the same rule and same section that the one who prosecutes cases of adultery and concubine is not the public prosecutor but only the offended spouse.

    Good day Atty., you've taught us more about the Rule 110 that we've you've discussed on your previous video lecture. This video pertains the Rule 110, under section 5 which states that all criminal acts should be prosecuted or under the control of our public prosecutor because based on our general rule, all criminal acts were against the people of the Philippines. But in every general rule there are exceptions like crimes of adultery and concubinage, that it shall not be prosecuted except upon a complaint filed by the offended spouse, but an offended spouse could not institute a criminal prosecution without including the guilty parties.     Who prosecutes adultery and concubinage?
    Only the injured spouse has the authority to submit a complaint against the perpetrators of adultery or concubinage, as I discovered here. In-laws and children have no legal standing to bring a case against a couple. Adultery and concubinage can only be committed by two people, so I discovered that not only one person should be prosecuted in this case. You can't even file a case against the mistress by herself. They can both sue if the offended spouse files a case. You will no longer be able to prosecute these people once you have allowed and summoned them.

    I learned about the prosecution of criminal cases such as adultery and concubinage in this video. I also learned about Rule 110 Section 5: Who must prosecute criminal activity, which states that any criminal action brought by accusation or knowledge must be pursued under the supervision and control of a public prosecutor. Moreover, that the offended partner is the only one who can file a lawsuit against adultery or concubinage suspects. When it comes to filing a case against a couple, in-laws or children have no legal standing. I also learned that in this situation, not only one person should face charges because adultery and concubinage can only be committed by two persons. thank you Atty

Under Rule 110 Section 5; all criminals actions either commenced by complaint or by information shall be prosecuted under the direction and control of a public prosecutor. Criminal cases is also consider to be public crime, the victim was considered to be the people of the Philippines. For the crimes of adultery and concubinage (crime against chastity) shall not be persecuted except upon a complaint filed by the offended spouse. He /she cannot institute criminal prosecution without including both guilty parties. Also when the offended party has consented to the offense or pardoned the offenders. Thank you so much atty.
