In this lesson, I learned the difference between the Preliminary Investigation and Inquest Proceeding. The purpose of Preliminary Investigation is to determine if there is probable cause for the purpose of filling an information however in Inquest Proceeding the purpose is to determine if there is valid cause for the continued detention. Good day Atty./Sir. Thank you for this knowledgeable discussion ☺️

Good evening atty. I've learned that preliminary investigation and inquest proceeding are both jobs of a public prosecutor. Thank you again atty

  • @marjolynvillamarzo4463

If a person is NOT YET arrested, detained, no warrant arrest, there is regular filing and determining if there is probable cause to file an information. Therefore, the preliminary investigation is proper while if the person is ALREADY arrested, detained, the conduct of inquest proceeding with a summary in nature, determining the valid cause for continued detention and lastly the warrant of arrest is not needed hence the inquest proceeding is proper.
Thank you, Atty for discussing the clear distinction between the two! God bless!

The difference is that in preliminary investigation, the person is not yet arrested and accused, whereas in inquest, the person is already arrested and held. There is no need for a warrant of arrest for the preliminary investigation, and there is no need for a warrant of arrest for the inquest. Thank you, sir, for another piece of information

After watching this video, I am able to differentiate the preliminary investigation and inquest proceeding. Preliminary investigation is proper when the person is not yet arrested and detained. Preliminary investigation is to determine if there is a probable cause to file an information. After gathering information from the preliminary investigation, you can now issue a warrant of arrest.
In the inquest proceeding, the person is already arrested and detained. Inquest proceeding is also summary in nature. Its purpose is to determine if there is valid cause for the continued detention and there is no need for warrant of arrest. Thank you for this lesson atty, I have learned a lot.

    LESSON 18
Thank you for bringing up such a fascinating topic. Atty. Jeffrey Bajita!
    1. What are the differences between preliminary investigation and inquest proceeding?
Preliminary investigation, on the other hand, is an investigation to establish if there is sufficient evidence to support a well-founded suspicion that a crime has been committed and that the responder is most likely guilty and should be detained for trial.
Inquest proceeding is described as an informal and summary inquiry undertaken by a public prosecutor in criminal cases involving people arrested and held without the benefit of a court-issued arrest warrant. The purpose of the inquiry is to assess whether the accused should be held in jail and prosecuted in court.
    2. When is preliminary investigation proper?
    (a) Person is not yet arrested
    (b) Person is not yet detained
    (c) Regular Filing
    (d) To determine if there is probable cause to file an information sheet
    (e) No warrant of arrest yet

Good day Atty. This gave me a lot of information and understanding, not only in the differences of Preliminary Investigation and Inquest Proceeding but also in their own purpose and function. I've learned that they were both mandate and duty of a prosecutor. Their differences defines their purpose. Preliminary Investigation were conducted to determine if there is a probable cause to file an information while Inquest Proceeding were conducted to determine if there is a valid cause for the continued detention. So that Preliminary Investigation is where the offender is not yet arrested, not yet detained and no warrant of arrest yet while in Inquest proceeding offender is already arrested, detained and no need for warrant of arrest. Thank you Atty. for clearly differentiating this two mandate of prosecutor. Good day and God bless!

What are the differences of preliminary investigation and inquest proceeding?
In Preliminary investigation the person is not arrested and detained yet there is no warrant of arrest therefore, there will be a regular filing and they will investigate if there is probable cause after that they will make resolution and information to pass into the court and then they will file a request “they will file a motion for the issuance of warrant of arrest” while In inquest proceeding, the person is already arrested and detained and after that they will summary it in nature and determine if there is valid cause for the continued arrest and lastly it is not needed for warrant of arrest since the person is already arrested.

    LESSON 18:
Good day, Mr. Bajita! Thank you once more for this fantastic lesson. I've learned so much!
What is the difference between a preliminary investigation and an inquest proceeding?
    - In a preliminary investigation, the participant is not held in custody, but there is no justification of arrest, and there will be a regular proceedings and then they will start investigating when there is sufficient evidence, after that they will start making a negotiated settlement as well as data to transfer through into court, and they'll just file a proposal "those who will file a petition again for issuing of criminal charge," whereas in an official inquiry procedure, the person is already arrested and imprisoned, and after that they will summa.
    When is preliminary investigation proper?

This lesson talks about the difference between the preliminary investigation and the inquest proceeding and when is it proper to conduct one. I learned that it is proper to conduct a preliminary investigation if the person is not yet arrested and detained because there will be a regular filling first and the officers must first determine if there is a probable cause to file information so it means there is no warrant of arrest yet to be done. On the other hand, inquest proceeding is proper if the person is already arrested and detained and the summary in nature is already done and so that the officers will be able to determine if there is a valid reason for them to continue the detention time lastly it inquest proceeding doesn't require a warrant of arrest where the hot pursuit, warrantless arrest, and prisoners' arrest take its place. Thank you, Atty. for another lesson!
