  • On December 4, 2023, NY v. Jonathan Majors kicked off with opening statements and its first witness testimony. This is the recap of Day 1 of this trial, which includes opening statements and testimony from their first witness.
    FOR CONTEXT:
    New York prosecutors allege that on March 25, 2023, actor Jonathan Majors physically assaulted his then-girlfriend, Grace Jabbari in the back seat of a hired driver's car before throwing her back into the car after she tried to get out. Jabbari says that as a result of this altercation, she suffered a fractured right middle finger, a cut to her right ear, and bruising to her head. Majors, on the other hand, disputes the characterization of the altercation: he says she attacked him, and that he suffered scratches on his face and body as a result, and that he threw her into the car so he could get away from her before she tried chasing him down on the streets of New York.

      This is separate from an opinion on the overall case but in regard to the finger injury different people have different pain thresholds. I suffer from frequent migraines that are excruciating, recently while I had one I was bitten by a dog on my ring finger and there was a massive amount of bleeding and the finger was fractured. My migraine was much more painful than my finger, the doctor and nurses at the ER were surprised by that.

      ​@@jorzolek01With as much pain as a migraine causes in your head I don't find it hard to believe that the injured finger wouldn't be nearly as bothersome. A migraine could feel much more acute and that pain takes up a lot of your brain's processing. But it's not just about the perceived levels of pain. A finger fracture commonly causes so much swelling that it's difficult to move the finger at all. And you would be able to distinguish such swelling from footage as clear as what we saw of her tying her hair with quick, dexterous and unencumbered motions.
      I feel like I'm leaning towards the defense already. Like Alyte said, their theory feels more believable as a whole for now. There could be parts of the truth on both sides.

      It never ceases to amaze me the amount of mental gymnastics people will go through to try to justify the bias that they already have implicit bias is real out here in the streets

      @@jorzolek01 And you think the girl and the two guys consoling, and then partying with her all night wouldn't have seen her fractured, bleeding finger or wouldn't have accidentaly aggravated it!??? 3 videos clearly show her using that same hand freely stroking her hair, dancing, getting twirled around with that same fracture finger! (a FBI forensic video enhancement will prove if she's telling the truth )We are talking 8 to 9 hrs from the taxi assault till she was found drunk in a closet and no one saw her bruises or bleeding??? I fractured my finger and it swollen 2x its size. Hairline fracture could not be used as ecidence because she DIDN'T go straight to the hospital after the alledged assault! She could have did that falling from being drunk in those missing hours she was partying. Please stop with the excuses or what if nonsense to justify this clearly flawed accusation. She should have went straight to the hospital, like any sane person who was jusy violently assauted. So let's wait for the evidence to prove what really happened!

    I watched the video of her after the incident talking to people. She did not seem ashamed at all. She was upset and angry. She told them about the incident but she did not mention any physical assault. She said he was texting another woman and that she needed to get her phone from him. When he walked past she tried to get to him. She was not scared. She had no visible injuries as far as I could see on the video.

      I have a small correction you said she saw him texting. He received a message and she tried to take his phone not her phone from him. But I do agree with everything else.

    I might be influenced by personal bias and it’s only just started so obviously I’ll hold judgement until the verdict. But at first glance Major’s story just makes more logical sense to me. She seems to have a lot of holes in her story.

    It's very refreshing to see a video about this case that isn't entirely biased in one way or the other.     I was originally a Majors supporter mainly because he was canceled so fast after the allegations. But every one is so far for or against him and I'm happy to find someone neutral covering this.

    I'm glad the judge allowed the showing that the ex gf had a warrant for her arrest in UK, to show her character. Too, bad before she turned herself in, the DA already decided not to charge her.

    Its a sham of a case. The cops harrassed the "victim" until she said what they wanted her to say. They tried to pin an assault charge on Johnathan Majors because he's high profile and they wanted to get gold stars next to their names. Its sad. This case never shouldve been brought to trial but I believe he will be found innocent by a jury of his peers. Hopefully he can get all the negativity out of his life after this.

    That summary of the opening statements brought me back to Depp v Heard with hardcore whiplash... 😬 Both sides of the case feel so incredibly similar to what we saw in Virginia. Remains to be seen whether this will be a repeat of that result or the opposite.

    I was trying to find ppl who are covering this trial... I had to search on CZcams but glad I found you. I hope you're able to read unbiased reports on the trial. Honestly, a lot of what Majors said months ago made sense. But I want to know if his team produced videos of the incident? If they had it, I don't think this should've even gotten to this point

    I think it could go either way with Jabari going out after the physical incident. To me it isn’t something I would do & it could appear strange to the average person. Especially since she just met the people she went clubbing with. However, I can understand someone acting irrationally after a traumatic event & like you said numbing themselves with substances and the party life to try to forget about it. Someone with a substance abuse issue doesn’t always care who they are with as long as they get their fix. The prosecution needs to show that Jabari has a history of behaving this way in order for a jury to understand this imo.

    My gut twisted when she said it was her fault too, but we have to remember that cover-ups become standard because they’re plausible. She COULD have broken her own finger roughly grabbing for something. Or the lie could be that that’s WHEN it happened. She could have broken it slipping on the bathroom floor.
    There are too many unknowns.
    Both these people are from vulnerable demographics, the most important thing is that they’re separated and safe. We’re good with that for the moment and can focus on the 2nd most important thing now; finding the Truth.

    I admit to being hesitant to click this video because of the title. "Multiverse" refers to Majors's career, and "violence" refers to the allegation the prosecution is making against him. I therefore assumed you would be biased against him. (Conversely, if the video had been titled "Dancing your way through false allegations", I would have assumed an opposite bias, as it would then reference her career and the allegations the defense is making.) That doesn't appear to be the case, and I thought your coverage was refreshingly fact-based and impartial. So, overall I think it's a really great explanation of the trial, I just would've preferred a more neutral title.

    You come across as a balanced commentator, basing your comments on evidence and law. I am glad I found this channel.
    I found this video trying to find more about the NY vs. Johnathan Majors case after listening to an obtuse video by 'J.D. - A Lawyer Explains'. There, he said, "Johnathan Majors' Conviction Makes Absolutely No Sense! (it violates the DA's policy)", even though he admitted not watching the trial or seeing the evidence. Some of his points were that the injury was not major, and the DA's first stated policy was to not pursue "minor" crimes. But N.Y. Penal Code §120.00 (Assault in the Third Degree) only requires negligent infliction of some physical injury. And the DA later revised his policy to give more discretion to ADAs. (I'm not bringing these points up in his channel because he refused to answer a simple query.)

      Thank you for your comment and your kind words! Just want to say one thing, that while Section 120 does allow for conviction with criminal negligence, that’s limited to situations where the defendant has caused harm to another person by means of a deadly weapon or a dangerous instrument. Because that’s not implicated in this situation, negligence wouldn’t be enough to convict Majors for aggravated assault. The only options for this case are intentional or reckless physical assault.

      I agree that this case does not implicate §120.05.
      I also believe that based on the evidence that I've seen Majors probably did injure Jabbari and therefore should have been found Not Guilty, but I also perceive that many juries do not take that principle to heart.

      I believe the state indicated that they intend their case-in-chief to take up about 6 court days. Then the defense, I would imagine, would take somewhere around there as well. So I’d wager this case should last around a couple weeks, maybe a little more.

She ran up 1000s of dollars on Jonathan Majors card at the club on alcohol. She could have used the same card to check into hotel if she felt not safe. Instead went to his home and called him over 30 times.

      Yeah I don't get it. Just running the alleged scenario through my. Ind. If you were trying to grab YOUR phone back from someone seems you could scratch them or hit them by accident. Seems like she blew the whole thing up over her ego and not wanting to break up. Idk. But going to the club with people and charging almost 1k on HIS credit card then going back to HIS apartment doesn't sound like someone who is scared of what may happen to her by that SAME particular man. WEIRD

    Ill be honest. Ever since Amber Heard, I've had a hard time beliveing any accuser. Especially when it brings a sudden end to a career. There's a problem with that, but thats what happens when false acusers take over.

      I get what you're saying. I think what matters is that you are open-minded, and that goes both ways (towards the alleged abuser and victim). I think AH taught us a valuable lesson that we need to verify before we believe without a doubt that the person accused is guilty.

    You just hope the tangible evidence outweighs the he said she said. This just seems like the video surveillance, eye witnesses, and the doctors vs. gossip. But we don’t know what’s yet to be laid out so we shall see. Hopefully justice is served fairly and completely in this, and honestly all cases.

    Hm. I think it's not completely unreasonable for her to go out with strangers afterward. First, if she was just attacked, she might not feel comfortable returning to a home she might be sharing with her alleged abuser. So she went practically anywhere else. Second, she's keeping herself in public, and with other people. Lowering the odds of direct acts of retribution by virtue of all the possible witnesses she surrounded herself with.
    There's also the element of being alone in a crowd.
    We'll see how this goes, and which side the evidence backs up more. Just from the basic facts as we have them so far, I think it can go either way.
    The finger thingie definitely doesn't pass the smell test though.

      Here is the thing. There is not feeling safe and going out and being spiteful and going out. While out she ran up 1000s of dollars on a tab with Jonathan Majors card. Then went home (he was not there and checked into a hotel) and called him over 30s times and threatened to unalive herself because he broke up with her.

      @onikehbrown yep! Another Amber Heard situation. The DAs office can't back down now because if they did, they would be looking down a lawsuit from Majors. For them, it's not about "justice" for the alleged victim but a credibility one with the state.

    Shes saying she was pumped up with adrenaline and didnt feel that pain at first (I assume shes trying to explain the video). But like you said, if her finger was broken it wouldnt just be _pain_ keeping her from doing what shes doing in the video, her finger should have been to swollen to bend the way it does when shes putting her hair back

      They have over an hour of video of her at the club partying after Majors left and she is using the injured hand to grab drinks and people and dancing and texting on her phone with no apparent signs of injury.

    Unless they have medical records from her and his past partners that look like a 5 boroughs phone directory I tend to believe the defense story here. Her actions after the alleged assault do not align with normal behavior (I took psychology in school and was NCO in the army so counselled numerous DV incidents). Further, her actions on video that night after the alleged assault do not indicate injuries reported, so while they certainly appear to have been genuine injuries, they could not have been inflicted by him. Nothing prevents her from having been mishandled by the strangers she clubbed with or simply fell on her way home. In addition to having been an NCO I also spent 4 years as a Pinkerton Lt Investigator so I feel I am being reasonable in my observation of what we have been presented here.

Evidence seems to point towards his version of events being true but the limited video I've seen of him addressing the situation seems a bit scripted, not that I blame him for only using prepared statements in front of cameras. I really want to see the rest of the prosecution evidence

      Injuries can come up after an incident just like they can after a car accident. She's running on adrenaline and then goes out to drink too calm down, the injuries could have manifested themselves the next day. This is a really poor storyline that keeps being repeated that she's fine and she's partying etc. People handle trauma in very different ways and most victims in relationships don't leave, they keep trying to appease their abuser.

    I’ve heard this bit about her going to a club after the assault.
    Can somebody explain to me the logic behind why her being out at a club later on means that he didn’t hit her?
    I really really valued your coverage of past trials and I’m trying to keep an open mind about this particular point, but I can’t help but feel like that’s one of these straw man, red herring types of arguments: She went out to the club -> she was in a good mood -> he couldn’t have hurt her that badly -> she’s lying about the whole thing
    I don’t know….that logic is extremely tenuous. You’d be hard pressed to convince me of that without some serious further corroboration.
    It assumes that you can’t assault somebody unless you like put them in the hospital and out of commission for a week with a neck brace on and walking on crutches.
    In New York, where I live, to prove assault you only have to show that a person injured another without justification (like in self defense). That injury could essentially be anything.

      She claimed to have a broken finger but instead of going to the hospital she goes to the club. That sounds ridiculous for any person to do after an assault. Let alone dancing partying and drinking with said broken finger.

      ​@@vegasroller7026she's clearly going to be running on adrenaline after the incident which will mask the pain like a car accident, she goes out has a few drinks which will also help with the pain, then she didn't even stay out that long, maybe she was feeling worse after the adrenaline wore off and went home. I think it's really dangerous everyone keeps painting some scenario for her and taking it as the complete truth.

      She has admitted chasing him and physically assaulting him. The taxi driver backs up that she was the aggressor. She could have broken her finger when hitting him or when he was trying to defend himself from her. That's unlikely as there are a couple of videos before and after entering the club where she was using her hand with no sign of injury. That injury could also be caused due to damage after getting drunk. More may come out but with all the details so far it appears that her broken finger is least likely to be caused as she explained. His story apparently has a witness and video evidence to support it, he story is just her word and it contradicts an independent witness and video footage

    Grace Jabari’s whole narrative was focused on Jonathan receiving a message on his phone from another woman! Even when she randomly approached those group of people outside the hotel, the first thing she did was name drop Jonathan Majors! Why does the name of your boyfriend even matter! Then, Jabari reveals her “injuries” to the group, when she doesn’t receive the reaction that she wants from them, because the group was unimpressed, she then proceeds to give out irrelevant information about Jonathan receiving a text message from another woman. The woman in the group I believe starts to realize that Grace Jabari is in her feelings and full of shit and tries to tell her she should go home in an Uber. If Grace Jabari was so injured as she claims, why didn’t she immediately flag a car down for help instead of running after Jonathan! She ran almost 5 blocks passed how many cars and all of a sudden she sees a random group of people and all of a sudden she is so injured! Bullshit!

    While I'm waiting to see what the evidence shows, I will caution that not EVERY victim of abuse acts/responds the same way. Because you EXPECT "shame", you're already coloring bias against her. Some abuse victims very desperately need to act as if the abuse isn't doing to them what it really is, trying to pretend everything is fine. How many woman have we found out YEARS later were abused by their partners but had put on a happy face in public? Not saying he did it, cause like I said, I'm waiting to see the evidence but I hate seeing an automatic bias of "how an abuse victim SHOULD act". It reminds me of rape trials where the victim wasn't believed because she didn't cry on the stand. 🤦🏻

    1:21 These are not "just allegations." These are actual criminal charges for which Majors is currently on trial. "Just allegations" applies to those who haven't been charged with a crime(s).

      Charges are based on allegations. Convictions are based on evidence and arguments. So yes, these are just allegations, for example, she at some point alleged that she was strangled…the evidence did not support it and thus the charge that came from that allegation was dropped early on. He was clearly charged for it, but because no evidence supported it, said charges were dropped.

    I don't believe her at all. For me, the most compelling thing was that he would not have called for assistance when he found her unconscious. He would have not done that at all knowing he abused her. I don't believe this. he may have a history of aggression or whatever, but in this particular case, I think she's fucking lying. The patterns are too similar, including threats of suicide. I really hate this case.

    I know nothing about this case or who these people are (I am purely here because it’s
    Legal Bytes 😁) but on the topic of ‘partying with strangers after an assault’ it is absolutely possible that putting yourself amongst strangers and drinking alcohol is a reaction to trauma.
    It’s not fun, in fact it’s a terrible decision that makes you so so vulnerable. The fact that they would ‘rather’ do that than return to a place of safety does at least give credibility to this narrative. I don’t know if they live together, in which case why would they return to the place where the alleged aggressor was residing?
    I will agree that the social stance on this, plus the footage, will probably leave little room for discussion, but thought it would be beneficial to add this to the discussion.

    I fractured my left 5th metacarpal ( bone beneath the pinky) after a fall and it was only excruciating in certain positions. I automatically stopped bending my pinky to avoid pain. In fact, I didn’t realize it was broken until 2 days after the fall….so there’s that…
