- So here we are, at the end of arguments with the case now in the hands of the jury.
Thursday we saw the end of witness testimony when the teams wrapped up their rebuttals. Team Heard was running tight on time, but were able to avoid running out and being cut off during testimony. They closed out their case by having Amber Heard take the stand again, and the day wrapped early.
Friday was closing arguments. Both sides were allotted equal time to pitch the jury on their theory of the case. Both sides received objections during their closings, and we discuss objecting during close in this recap.
Once both sides finished their closing arguments, the case was sent to the jury. They deliberated for several hours before breaking for the long weekend. They'll return to the court to resume deliberations no later then 9AM EST this morning, Tuesday May 31st. We'll be live from 8:45AM EST for verdict watch, and filling the time looking at the UK trial.

For some background- This is a defamation case between Johnny Depp and Amber Heard. Johnny Depp is suing Amber Heard for defamation stemming from her OpEd published in The Washington Post in 2018. Amber Heard is counter suing for defamation claims based on statements made by Johnny Depp's former lawyer. The trial is taking place in Fairfax, Virginia, the proper venue as The Washington Post is headquartered in said location. Presiding is Judge Penny Azcarate, Johnny Depp is represented by Ben Chew, Camille Vasquez, and more. Amber Heard is represented by Elaine Bredehoft, Ben Rottenborn, and more.

Elaine gave me the vibes of being desperate to win with all her hand gestures that was really not needed but made her look like she is sinking away….
The: either believe Amber Heard, or believe Johnny Depp and [insert whopping list of people]
Was awesome.
Days after watching the closing argument from Rottenborne, one comment he made stood out to me in my memory.
It was something to the sorts of "Mr. JD testified that more forms of abuse exists than just physical abuse. All we have to prove is that Mr. Depp abused Ms. Heard once, to dismiss his claim. If you find Mr. Jepp guilty just once of abuse, then all abuse must be true".
To me that felt entirely unbalanced. This whole trial we had little glimpses of truth between them when listening to the voice recordings and various other pieces submitted. He is insinuating that if you find 1 harsh word towards Ms. Heard, that would automatically equate to abuse and therefore Mr. JD is guilty.
Idk, it just felt like a very unfair closing statement to me.
They were well done considering time and client, one side had presented a better case and that showed. I liked the panel pointing out how the objections during closing were irregular. I've learned a lot!
Camille absolutely slayed it. How the jury can return anything other than finding Amber responsible and Johnny not responsible after all that, I've no clue.
I’ve noticed Camille says “tell the world” a lot during the closing argument. And each time she did I was reminded of AH saying “Tell the world, Johnny”. I’m sure that was a subliminal tactic and I admire them a lot for it 😂

Elaine lied her ass off & made me scream when she said Amber was “entitled to half of everything” in the divorce. In California, property division is not a 50/50 split - especially in a short term marriage like this one. A marriage that lasts less that 10 years will have a set duration of spousal support, which is typically one half the length of the marriage. They were married 2 years, entitling her to ONE year of spousal support from Johnny. NOT half of everything!!

Why should she be even supported after the marriage ends when she also works. Marriage and divorce laws should be evaluated, why should a man still support a woman after marriage and without kids at that.
As a former victim of IPV, I knew EXACTLY which pictures documented which event. Episodic memory tied to trauma was readily retrievable for me.
Obvious to me, too! Here's a list of names to ponder when we all reflect on this moment of time in history: Anita Hill, Monica Lewinsky, Dylan Farrow, Mia Farrow, Evan Rachel Wood, Rose McGowan, Christine Blasey Ford, and any one of the 30+ women who were drugged [allegedly] then raped [allegedly] by a very famous comedian and TV dad of the 80s and 90s. Did you know that not only the cops mis-read the Petito situation, but so did most of social media? That is, until Gabby wound up dead.
That’s so interesting! I experienced childhood trauma relating to parental IPV and my memory is gone. Like whole years missing.
Yes, I studied trauma at Harvard, something the professors stated were , "we remember trauma all too well". With that said, the memory is rarely linear and it come in fragments.

The infuriating thing about Rottenborn's objections was that Rottenborn himself repeatedly misrepresented testimony and incorrectly stated the standard of law.
Why isn’t he called before the board for that?
I think there could be repercussions for quite a few people, but i think everyone is so relieved it is over, they want to put it behind them...except writers. I feel sorry for Amber's legal team and the fiery hell they walked into. You can bet there will be books and movies about that! I think, though, that most of the world has SO MUCH other tragedy and worry going on that they will not go after anyone, but just try to find a way to survive and cope physically and emotionally with their own lives. I think a movie about life in America during and after the World Wars and that Great Depression would be good. It would show us how much worse it was and how people worked together to face life and rebuild. It would have to be a series, and would have to include how inhumane we can become when afraid. Part of our Nation had the same mentality that was in Germany. And it is still with us. The trial showed us ourselves, the good, bad, and ugly. And it showed the part corrupt money tries to play into every scenario. I pray, Lord, please help us.

I only watched some clips, but Vasquez' cross of AH was rather satisfyingly savage. That Camille managed to draw out of Amber both that the op-ed was about Depp and that, according to Heard, everyone was lying except Heard made for some pretty riveting viewing.

this case brings a sense of justice as well as a sense of frustration. one of my best friends had an ex who became abusive toward the end of the relationship. she has proceeded to slander him in a way like this after she found out he was seeing other people post breakup. the aftermath has been nothing short of traumatic, and it’s painful to see his abuse picked up by those around us as if he is in the wrong. i still feel sick and hopeless sometimes for him, knowing he can’t defend himself like this. he struggles to even hear about this case because of the trauma

It's almost as if AH's lawyers gave up on her at the end. I suspect that AH was not candid with them from the beginning.

Whenever your argument to a jury boils down to the constitution, you're in trouble. Juries are finders of fact, not high brow legal opinion. There's a reason why you give a jury 23 pages of instructions that explicitly state the law and the court's interpretation of it. If the judge agreed with your first amendment argument, the jury would have been sent home the day Johnny's team rested.
Sure, the jury CAN decide that they know the law better than the judge, but anything more than a passing mention of Amber's first amendment rights just screams desperation.

My wife and I have been glued to your daily commentary while the trial is live, the back and forth of you and your panelists during breaks and of course your recaps help to condense a lot of info so folks can take it in into a much more easily understood summary, like cliff notes for each day of trial. I had one question(I also reached out to law and lumber with this question) but first I’d like to mention a quick bit of background on me. I have always loved the law, had even entertained the idea of becoming a lawyer once but I decided my love for teaching outweighs my love of the law so I am currently working on my BS in Secondary Edu w/ a focus on political science. So I’ve taken a lot of classes regarding the Constitution and its influence on most most our laws. This is why I was baffled that AH’s team used the 1st Amendment and its freedom of speech component in their closing argument as their theme of defense. Rottenborn basically told the jury that the WP op ed that AH wrote is protected speech under the 1st Amendment and that the jury cannot be both for the 1st Amendment and award a win for JD because if that. It always been my understanding that freedom of speech protects you from censorship from the government as well as being punished by the government for exercising your freedom of speech. It does not allow for anyone to say anything they want without repercussions, basically people can still be held accountable for what they say, a common example of this is the illegality of yelling fire in a crowded room. The 1st Amendment doesn’t protect libel, slander or defamation is also my understanding. So it felt like Rottenborn was misinterpreting the 1st Amendment and misinforming the jury, intentionally or not I cannot say. If his interpretation of the freedom of speech were true, how could have JD sued for defamation in the first place? How could AH countersued for defamation? And how did it make it to trial if AH’s WP op ed is considered protected speech? Thank you again for all your hard work and in advance if you manage to free up some time to both read my comment and answer my question or questions as it were 😁 truly appreciate all the dedicated lawyers of lawtube and their commitment to helping us understand the law and the trial process! I watched both closing arguments; I felt Johnny's team nailed it, while Ambers team started strong with the first lawyer Ben but when Elaine showed up, it was utterly confusing and very difficult to follow and watch; it was nothing but word salad with a few points that could be legibly understood, and even those points were very weak. I hope they rule in favor of Johnny today!!!!

If I'm ever get in a bind, I'll be sure to hire whoever was the top Mean Girl at their high school as my lawyer. I thought it was a mis-print when I saw a video titled, "'No one showed up to support Amber except her sister' states Camille Vasquez." Surely, a professional lawyer in a televised, high profile case wouldn't say something like that in closing. But...yeah...Queen of Snark [Ms. Vasquez] sure did.
I also hope they rule in his favor, too, because if they don't he'll never leave Amber alone - his loss in the UK trial proved that. She's resilient enough to bounce back, but he's shown himself to be rather petty and spiteful. @@lorithrun296 I don't think he's petty and spiteful at all. He just didn't want the world to think he was a wife beater, since he was innocent. I mean, in the recordings from when they were going through the divorce (I think the "tell the world, Johnny" recording), he begged her to not go after him so they could just put it behind them. He was willing to pay her and everything (despite the fact that, as we can now pretty clearly see, she was abusive to him), just to get past the pain and move on.

I figure Johnny Depp won after AH last cross-examination she clearly stated she wrote oped about Johnny. Exactly the reason why Johnny is suing her. Thank you for the breakdown about the objections during the closing arguments. I thought you weren't allowed to object at that time. After you explanation I totally understand now.
I have no idea why Depp's team didn't drill down on this more in their closing arguments. There was too much emphasis on nonsense like Amber being bad at crying and making fun of Johnny's career.

Dr. Hughes herself said on day 23 that she searched particularly for signs of PTSD and nothing else. Her evaluation was only in that direction, because AH stated she has PTSD.
I have enjoyed your recaps throughout the trial. They are reasonably short and to the point so thank you for that. My question is about how the judge gave incorrect instructions to the jury, will that have any impact on the case?

I'm really glad you (try to) give an unbiased take of the trial even though thats not 100% possible. I'm really careful of being swayed by public opinion and would definitely hate to get the facts presented wrong.
Can you please also do mini-recaps of verdict watch days? Like the missed chance for objecting to the “send a message” statement which was brought in as a motion on verdict watch day 1. I am wondering if the reason for missing it (or the judge dismissing it) was that they were talking about JD sending a message and not the defense asking the Jury to send a message (and thus focusing on larger social issues than the trial scope itself)

I had seen the cabinet video when it was first published. Amber literally smirks and laughs mockingly when she picks up the device. There was no sense of shock or fear in her face. It looked like she was almost mocking that " fat old man".
The video played in the closing although was longer, they still cut it to not show amber laughing. Really manipulative.
One of the most baffling moments in Rottenborn's closing arguments was when they played like two seconds of audio where Depp yells "You're a f****ng c***!". What does that prove? I think we've all resorted to mean words in a heated argument at some point in our lives. All this showed was how afraid they were of letting the jury in on the context.
Thank you very much for this recaps ❤. I was following this trial just now and I tried to watch the actual trial but some of this video depositions made it impossible to me to follow actual facts. More importantly I am not only not have any legal background but I'm also not from US so I was coming to some conclusions, that after I listened to you legal explanations, turns out to be false and was a result of my lack of knowledge. Also your commentary was not heavily biased what was really important to me since I wanted to look objectively on the case.

I can’t see a scenario where amber wins her case. The number was outlandish, and her case was weak.
I haven't seen where she says "about Johnny". Does anyone have a link? I've seen clips where she says "that's why I wrote the op ed..." Followed by "currying favor..." But I can't find where shes says she wrote it about him.
Yes I did watch the closing arguments on your stream, but only Johnnys attorneys. Watching Ambers team gives me anxiety. I pretty much feel bad for them, as they work to make something out of not much evidence. It is like watching a sinking ship and them grasping at straws. That is why I love your recaps. Everything said and done thank you for not sensationalizing your recaps. Using the words destroyed, wrecked and etc, etc, etc. I know you have had your own issues regarding Legal Tube and I'm glad you have continued on despite what happened. @@kermitfrog593 Depends on what you mean on a win. Her counterclaim is unsupportable and that seems to be the feeling from all lawyers on the internet. So, she isn't getting any money. If the jury reject Johnny's claim, which I find unlikely, she doesn't go bankrupt. Is that a win?
@@jessjess23brooks89 A win for Amber is Johnny's claim being thrown out. She's already lost much in the court of public opinion but if Johnny loses it will allow her to save some face. And the media - who's been largely pro Amber because they supported her in 2016 and are trying to save face themselves - will jump on the bandwagon and say 'told you so.'

Johnny has been vindicated by the public, but if he doesn't get that piece of paper the media will be horrible, as you said. Even if he wins one dollar, I just want to see the lying press backtrack. These articles are ridiculous and have really made me think twice of anything I read or watch in the media.

Sorry but you are incorrect. Ben Chew did not object to the make-up argument in closing. HIs first objection was to the part when Elaine said Dr. Hughes used Nurse Erin's notes and another psychiatrists notes that documented clear abuse in order to come to the conclusions she had. The notes from the other psychiatrist were not in evidence and did not document abuse but Elaine was trying to slip them in sneakily. The judge did not allowed to Elaine to speak on testimony that wasn't in evidence regarding Dr. Hughes notes. Elaine had to walk it back that it was Elaine's opinion that there was evidence but there was not court admitted evidence from the other third party confirming abuse in the notes.

Good recap, except you didn't go over the rebuttals and the time difference leading into rebuttals.
Up until Elaines closing argument I thought she probably is a good lawyer with a bad client. However her closing argument felt more like she is raging and ranting around than being a good attorney, as a non-law-person I felt this was super weird
Amber probably drove Elaine up a wall stuffing post-its up her ass, and Elaine probably went "fine fuck it I'll show you what happens when I spew out all the post-its you shoved into me at the jury"
Really grateful for your recap. I went through the closing arguments and your assessment confirms my impression. I would only add that it seemed Elaine Bredahoft's was a rather frenzied almost incoherent rendering in an attempt to say "In spite of evidence and testimony, here's what is really going on" and after the objections she had to infer that what she was saying was how she interpreted things. I am not a lawyer, but in my untrained opinion, if this were a sporting event, it was what we call a blow-out...it wasn't even close. The jury may see it differently but there is the court of public opinion and how much difference does that make? Let me put it like this...O.J. Simpson's verdict was not guilty and he will never be tried again...but honestly, does anyone today believe he's innocent? (here's a clue, he even wrote a book about how he did it) I truly doubt money is even an issue with Johnny Depp, he just wanted to get his side of story out in one of the most expensive but perhaps effective ways. This trial is going to go down in history but the only monetary winners are probably going to be the lawyers...and that's okay, he can afford it...he sounded pretty good on stage with Jeff Beck...these people live lives the rest of us read about as we work to pay our bills.
Elaine's closing arguments felt like watching a high schooler half ass their way through a debate that isn't being graded.

I totally get that attorneys have very different styles but it just seemed like Elaine had no style whatsoever. Her closing was so meandering and rushed that any points she might have made were lost in the muddle.
Camille and Chew were so methodical and linear and had a cohesive theme they stuck to throughout. And the use of pauses really gave points a place to land.
Thank you for all your hard work and coverage on the trial! I’ve been turned into a Law Nerd and will continue to watch even after this trial is finished - can’t wait to see what’s next!

I think JD's legal team did a wonderful job in closing but Ben Chew should have done the objection in Elaine's closing like Alyta mentioned as there were clear misstatement. Why didn't he? Anyhow Ben Rottenborn was trying his best considering the blatant lies from his client already made a very bad situation, he may not be able to turn the situation around but it seems he used out all the tactics he could... IF the metadata was included in the evidence, then they can see it. Evidently some metadata was.... and some wasn't. (One of the lawyers pointed out there was no metadata for a particular photo)

Have heard this a few times that Amber was entitled to half of Depp’s income. But have never had clarification why she chose to not claim her ‘fair share’. This doesn’t seem likely. Could you please explain? Thank you

Thank you! Enjoyed all you have done. I feel that JDs 2 lawyers did a very good job and kept it to the evidence in their closing. I feel that Rottenborns style was good and played to jury well. Elaine was less so. Overall I felt AHs closing was too derogatory and out of line in their words and evidence was more iffy.
I watched Aquaman after watching both times Amber was on the stage, I mean stand. I saw the same facial expressions in the movie. Perhaps the lawyers could have suggested the jurors watch the movie 😂

I thought JDs lawyers had a prepared and rehearsed their final argument/statement and were prepared - it seemed professional and polished. where as I felt like AHs lawyers were winging it a bit and only had rough notes on what they were going to say. But I sort of felt that way the whole trial. I'm sure AHs lawyers did do due diligence but Elaine in particular was often floundering when questioning a witness and was objected... and that followed through on closing arguments.
my closing argument would be weak too if I was getting cooked for WEEKS by Camile lol

They both doubled down and dug in their heels with some bad acting in their respective cases, which is why I connected them in my mind.
Can you comment on the argument that one incident of abuse of any kind by Johnny is sufficient to prove Amber’s case?

Thanks for the great recap! I was very happy with the closing arguments by Johnny's lawyers, but Elaine on Amber's side, was surprisingly off and weird. She was all over the map, talking wildly fast, with some misinformation and bad reasoning. Looking forward to the verdict!
