  • So... we thought Day 18 had a lot of witnesses. Well, Day 19 woke up and whispered into the ear of Amber Heard's legal team 'Hold my witness list'. Day 19 saw 12, yes, an even dozen, witnesses. All but one testified by video deposition, with Ron Schnell being the only one who appeared live in the flesh in the courtroom.
    All said and done, we heard from the following witnesses:
    Bruce Witkin, Tracey Jacobs, Joel Mandel, Adam Waldman, Det. Marie Sandanaga, Ronald Schnell, Michele Mulrooney, Tina Newman, Ellen Barkin, Dr. Alan Blaustein, Eric George, and Jessica Kovacevic

    For some background- This is a defamation case between Johnny Depp and Amber Heard. Johnny Depp is suing Amber Heard for defamation stemming from her OpEd published in The Washington Post in 2018. Amber Heard is counter suing for defamation claims based on statements made by Johnny Depp's former lawyer. The trial is taking place in Fairfax, Virginia, the proper venue as The Washington Post is headquartered in said location. Presiding is Judge Penny Azcarate, Johnny Depp is represented by Ben Chew, Camille Vasquez, and more. Amber Heard is represented by Elaine Bredehoft, Ben Rottenborn, and more.

    I’m not from US, English is my 3rd language, I don’t follow any of the Hollywood drama, and I have no interest in law. Yet, here I am unnaturally obsessed with case and following law channels like these to understand the case. Anyone else in the same boat?

    It was basically an entire day of witnesses saying Johnny had been using drugs and alcohol “successfully” for decades but his life started falling apart when he met amber. Oh and also that he wasn’t aggressive or violent when he was drunk and/or high. Plus JDs attorney got to call Amber a turd several times.

      Good points! I knew someone that maintained for many years using drugs and alcohol. He was what I called a "happy" drunk. Never aggressive or violent either. It was his opinion that people used drugs or alcohol as an excuse to be violent.

    Johnny withdrawing from everyone while A.H. had all her friends and family living for free in all the suites in the penthouse tells me how A.H. worked her psychological attacks on him in order to isolate him. He was never allowed to leave whether it be to remove himself from a volatile situation or whether he had to go to work or visit with his children. Everything A.H. accused Johnny of appears to be everything she knew she was doing to him.

      I’ve been in a relationship like this. You end up with your self esteem on the floor and no ability to see any light. My best goes to him, it takes years to recover from damage to that degree.

    I'm surprised you didn't mention the second part of Mr. Waldman's testimony, I found that to be the most detrimental part of that day to AH's case, the fact that he points out witnesses and reasons to bolster the claim of it being a hoax and also the fact that he reported perjury by AH to the police seemed pretty important to me.

      The @legalbytes panel wasn’t listening to the depo testimonies. Totally checked out. Alyte was focused on catching up with super chats and talking over witnesses, to the point I’m surprised she feels comfortable doing an overview of the day. Generally, I love enjoy this channel, watched the whole trial here but that was disappointing. I couldn’t hear either the panel or the witnesses.

      @@Suresurely attorneys are generally good at listening and thinking on their feet. But if it helps, watch without commentary and then watch reviews. I know some people prefer it that way, like my friend.

I generally like when Alyte and panel break in with lawyer explanations in quick bursts during the trail, but they were fully talking over the witnesses that day so there was a cacophony of simultaneous voices that was tough for me to take. I switched to TUG stream because TUG doesn't talk at all while testimony is happening in the courtroom.

    Non-evidentiary factors that the jury sees all day, every day: Interactions between counsel and clients. Depp team is a smooth, relaxed, warm team. Heard team is tense, non-supportive, and rendered ineffective. They don't seem to like her. Facial expressions of Depp and Heard are very different. As a juror, I would notice.

      When a couple of the lawtube guys got into the courtroom for one of the days AH was testifying, they found AH was literally intentionally tripping up her lawyer during direct exam. Sounds like something the jury would definitely pick up on.

      agreed - and I would add - AH's team come off as RUDE, incompetent, ineffective and increasing aggressive just like their client - AH also rude, aggressive - playing to the jury - hope they see & notice - the case should be able the facts & just facts - end of the day we're all people

      Also in addition: the lawyers in the audience said that the jurors visibly shows their dislike for Elaine every time she comes up. That's a bad bad blow for the AH team.

Im sure they hold her to stick to her story & im sure she argued that she could make it sound better with more horrible lies, like the SA allegations that have never been uttered b4.     He did drugs, abused furniture and struggled with inner demons. Things most of us can relate to one way or another. Not a shred of evidence that suggests he laid a hand on anyone. All we have is Amber's word that it happened.

      It's so redundant that it became annoying, Amber's team kept bringing up the drug abuse and his struggles with inner demons that we already know and the jury also know. It's over for Amber Heard.

    It wouldn't surprise me if the jury did check out half way through the day. It was exhausting. We could have skipped the day and it wouldn't have changed anything about the case.

      Except that if the jury didn't know by now (truly avoiding everything case related) they now know how much #JusticeforJohnny had been used, that hashtags like #AmberTurd and such exist. AH's team bringing this guy in and opening that up to be discussed was a huge mistake. I cannot fathom anyone allowing this kind of information to come before a jury.

      They did. If you watch "Law and Lumber" on CZcams he's talking about the jurors and what their reactions was to Amber Heard, and her "witnesses" and it definitely wasn't good for Amber Heard's team! They (the jurors) hated when she was incessantly staring at them and they are moving their chairs facing away from Amber and facing their chairs toward Camille when she was speaking or Elaine when she's speaking. Which the lawyers here on CZcams say isn't a good sign that it seems like the jurors are feeling uncomfortable when Amber is looking at them and only looking at her for a second but they look right back to whichever lawyer that's speaking. Law and Lumber (Rob) & lawyer Runckle said when Amber's team had so many video depositions that the jurors were falling asleep, looked bored, and kept yawning. Rob said that that's not a good sign for Amber Heard's team but good for Johnny's team. Anyways just look it up they explain a lot about how the jurors are reacting to Amber Heard's testimony, and her sides depositions, and her 2 witnesses.

    Adam Waldman is brilliant. Why amber wanted him on is crazy. He damned her. He was given the chance to call her out as a liar and it was all a hoax. Also revealing to the jury she could be investigated for perjury. Haha love it

    A Note about Lawyer Michelle Mulroney: Johnny testified that Amber told him the post nup lawyer yelled at her and had made her feel dumb and was really upset about it. Johnny told Amber he'd take care of it... then we get the story he called this lawyer and fired her on Amber's behalf. Adds up that he was laboring under what Amber had told him.

    I did always find it odd that Johnny suddenly married Amber when he never married the French actress/singer who is the mother of his children. Yes, people can change their minds and stances when in a different relationship, but with his former therapist saying Johnny initially didn’t want to marry Amber sticks out to me. I’ve been thinking as this trial has gone on that Amber enabled his addictions so she could have plausible deniability should he lash out while under the influence. Now I’m questioning if she pressured him into marriage but had an ulterior motive unbeknown to him.

      I think she wanted to marry him for the money/houses and so she can have all her friends and family in those penthouses. As she didn't want a prenup ornpostnup it all makes sense it was for the money. Poor JD was too in love to even notice

When he reevaluated his finances after the divorce I believe it came out that he didn’t release he had spent a ton on wine and those numbers magically reduced after the divorce. He really was in love. To me he seems to be the type that when he falls, he falls hard. Plus it’s come out she was love bombing him and that can deeply affect someone who’s never experienced it and is unable to recognize what it true is.

    You forgot to mention that AH's term shot another own goal by letting Adam Waldman testify that he filed a perjury claim regarding AH with the L.A. Sheriff's Department. After all, he is a lawyer and it would not be plausible that he makes a frivolous claim. He furthermore was able to name a number of witnesses who all contradicted the account of AH and her friends. So overall, AH's team got nothing out of him regarding what they wanted but took quite some damage regarding AH's credibility. Their only chance is that the jury could be confused about the attorney-client privilege and interpret Waldman's refusal to answer as an admission of guilt. One must hope that the jury will receive instructions how Waldman's decision to follow the instructions of his lawyer can and cannot be interpreted.

      Not only that but we heard the testimony of some of those witnesses prior to Waldman's pre-recorded statement. So it served as a reminder and confirmation of what everyone had heard before. The timing of this was just ghastly for AH's side.

    My impression was that the Depp team has still a lot of things they did collect but did not brig up yet. I suppose they will keep that till Ambers team runs out of time and blast a firework towards the end of the trial. Thanks for your summary and commentary!

      Her side has yet to rest their case, and the dumbest thing they could do is run out all their time before rebuttal, but one way or another her turn will end and he can call/recall witnesses.

    I'm following this case like an addict. Unfortunately, I fell asleep on Thursday right before Ellen Barkin's testimony. Amber's case thus far is boring. I can't wait for the rebuttal case and the closings. I really hope the jury sees this case like we do. #JusticeForJohnnyDepp

      Barkin contributed nothing to the case except to show her displeasure at having been unceremoniously dumped by J Depp. Knowing that she fleeced her ex husband for $60 million in their divorce settlement also made her look like another A Heard. Her repeated pursing of her lips made her look like she would suck the blood out of you if she didn't like you.

    If Amber is claiming that the Op-Ed wasn’t about Johnny, there are a bunch of people now testifying that it was about him and they needed to be careful not to mention him. As you said, they were unsuccessful in hiding it, so here we are. But that destroys one of her defense arguments.
    Also, I don’t think it’s a coincidence that just like Camille, the sun was shining so brightly on you that you had to close your drapes. Good light shines are badass female lawyers! 🌞

    The most damaging part in my eyes was Mr Whitman’s testimony laying out the entire hoax and all the people that saw Amber that week with no bruises! He explained it all in detail and put that in the juror’s minds. Unbelievable 😭🤯🤯

      @@CJAmara My suspicions from watching the trial are that Heard's legal team are trying to sink their own ship at this point. Things like Muffin-gate show the potential that the legal team have been taking Heard at her word and as a result have been getting proverbially bent over in court for the world to see. It's clear they are fed up with trying to do the best for a client who won't help herself.
      Other examples include when Heard brings up Kate Moss, all the clips and edits focus on Depp and Chew grinning from ear to ear, but what a lot of people failed to see was Elaine also laughing and grinning; during Heard's redirect, Elaine just gives up like she can't be bothered anymore, though this is largely in part to Ms Vasquez.
      There is also an uncorroborated claim that Heard's lawyers were overheard during a break yelling at Heard "well then fire us if you want" or something to that effect. This is not corroborated however it is plausible and believable considering the time it is claimed to happen was after Heards testimony when she stormed out of the court, bearing in mind she also threw her current legal team and previous lawyers under several buses during her testimony - claiming her former legal team leaked things to the press during the divorce instead of it being her, claiming her current legal team has not admitted stuff into evidence she is trying to claim exists. It's very clear her legal team wants out, but at the same time does not want to cause a mistrial at this stage as every person on the planet is now prejudice to the case as a potential juror.

    Another great recap, thank you. Poor Elaine, she has a terribly bad tempered client and will be blamed for everything. Next week will be a mix of sensationalism, sizzling fireworks, comical theatre, shock and full of ‘oh my goodness!’. JD’s life will get back on track and Disney will come begging. (I do feel some sadness for AH she is her own worst enemy. Both AH and her sister are inveterate liars. Whitney is afraid of her sister and appear’s to try to keep her calm for self preservation. AH is a very troubled and angry woman who had everything, but is walking into a very empty world. I worry for her baby daughter. ). Wouldn’t it make a fantastic blockbuster movie! For gentleman Johnny.

Her own talent agent said that her Aquaman role should have put her very much in demand but she had to choose chaos and revenge. She did this to herself.

      For most of us who have been following the trial day after day full time, no movie can come closer to what we have witnessed. Besides, it has been sad for Johnny having to relive it although I think he can now look back stronger and wiser I hope. And sad for Amber who out of pure greed and meanness didn't see Johnny coming back giving such a fierce fight AND getting the support of millions of people. If Johnny wins it would be a huge step in acknowledging MenToo can be victims of DA.

    I have been neutral this whole time but I'm firmly in the Depp column because of what I've heard so far and this week. One, the pictures don't match the events she describes and lack of medical records. Two, I felt sorry for Mr. Depp when the ex-friend says everyone wants something from him and his doctor talking about his "devil" or internal struggle. As a healthcare professional, I struggled with the doctor testimony because the last thing any doctor wants to do is feel they have or are harming their patient. Dr/Patient priviledge is a very real thing. Three, the drugs and alcohol abuse has been overplayed. Four, her cross examination with the gaslighting, pledge vs donation, and her unwillingness to answer yes or no questions. Five, hearing perjury and police report from Mr. Waldman.

      There's so much to make anyone doubt her claims. One of the most obvious things for me is "everyone is lying or wrong but me" what's the tally up to now, 10? 12 people? Cops, docs, nurses, front desk people, lawyers, friends , her own psychologist. I mean come on! I'll give her 1 or 2 that work for Johnny but the amount of folks "lying" is just insane. Not believable at all. All she had to do was admit some responsibility in all of this. Admit her mistakes that are ON RECORD, we all heard them plain as day. Just tell the truth. She sunk her own ship here.

    Johnny told us this story. Amber blamed the whole thing on her lawyer, Johnny believed her and called said lawyer to yell at and fire.
    Nothing new came out of that testimony except that Amber never signed it.

      We have not gotten to the point where his team can call witnesses again. Once team AH rests the trial moves to rebuttal and JD can start calling witnesses.     I like everything you said about Heard's hashtag witness bringing in information that normally, the jury is not supposed to have. But what's more important is that now, the jury knows that a million people outside of the courthouse think Depp is innocent because of the "JusticeforJohnnyDepp" hashtag!

      I like how you actually seem to think you’re smarter than the judges and lawyers in this case, seeing as you think the jury “isn’t supposed to have” information from 2013 to 2020 that is relevant to the case. 😂 Those were old hashtags and social media activity, and data analysis takes a lot more effort than what you seem to think, seeing as you think the social media expert was referring to activity that “the jury isn’t allowed to have”. They wouldn’t allow the evidence or witness if what you said was true, but I find it absolutely hilarious that people think someone can collect and analyze data overnight, all while making charts for it, too. 🤣 And he also made the program to do it, I guess he just works super-fast. 🤷🏻‍♀️

    Really glad to have discovered you all. Like many others, a DV survivor who had zero opinion on this case three weeks ago. There was just so much stuff suddenly on Twitter and CZcams that I figured I had better find out what was going on and eight hours of a deep dive later, I was firmly in JD's camp, for all the reasons so many others have already said. I find it fascinating to hear opinions from your varied panel and, while I end up having to listen to it about four hours after you have started (I work after all!), it helps to realize that I am not the only one who finds this absolutely ridiculous!

      I have to say, I feel very uncomfortable watching the video of Johnny smashing things and slamming cupboards. Maybe I'm soft, but if a guy I was seeing did even a bit of that once, I'd be out of that relationship. It's not so much that it's ok to do, but more that it's not technically a sign of physical abuse towards Amber herself. In some audios, Amber admits to throwing things around too, so it seems to be a dynamic in their relationship just like the cursing each other out and not solely Johnny being the bad guy.

    My over-arching theory of their relationship:
    First, I think they are both hiding the fact that they cheated on their partners to be with each other. Neither is helped by this information, so no one will admit it, and it ultimately doesn't matter, but I have a pretty firm suspicion.
    More importantly, Amber did drugs to party, and Johnny does drugs to escape. So, Amber got access to all the coke and expensive wine she wanted, but I bet Johnny isn't actually super fun when he crosses from "normal" high/drunk to "very" high/drunk. Not even violent, per se, just not a great bunch of fun for a party. So, Amber didn't want to quit her own fun, but she didn't want Johnny to do what he wanted anymore. And thus begins the worst of their conflict, because at the end of the day, Amber is a very controlling and demanding person, and she seems to twist things she dislikes into personal slights against her. Personally feeling "disrespected", primarily by Johnny not being able to just stop doing the substances that have covered his own traumas for his entire life. Amber can't handle not getting her way, and she can't understand that another person's struggle isn't an attack on her, so she goes from annoying about it to frustrated to angry and she increasingly takes out that anger on him. The whole time, she is still unwilling to address her own substance use, leaving Johnny in a very dark place where only he is expected to be sober in a group of people who are anything but. This also explains why, at random, Amber stops caring about Johnny drinking. Multiple times on the stand she said he was clean and great, but then backtracks to say he was drinking wine, but it wasn't a problem. It's a problem when she perceives it as a problem, and then it's all Johnny's fault for his own "failure". She feels disrespected while also having no respect for him. That dehumanization increases her willingness to engage in demeaning actions, like hitting him and sending embarrassing photos of him to her friends. By then, he's in pretty deep emotionally and psychologically, and feels like he's the one messing up, so he doesn't want to "fail" at the relationship by leaving her.

    Another excellent video. I'm a lawyer sitting home bored recovering from surgery, and it looks like every lawyer on CZcams has been covering this trial. Watching all of the other lawyers' videos, none of them appear capable of withholding their contempt for Amber Heard, and their analyses suffer from it. Alyte comes across as the only one offering a balanced analysis.

    The genius witness repeatedly mentioned #justicefor Johnny and #amberturd etc
    Got the witness to say he is a fan of justice right after Johnny’s attorney states #justiceforjohnny 😊

I think you were reading superchats and missed what he said but basically he killed her counter claim and brought up a load of witnesses that sink her case and confirmed the LA County Sheriffs office were investigating her and Rocky for Purjury!!

I have been afraid of someone's temper and I can't imagine ever encouraging that behaviour. Amber wasn't scared of Johnny at all, she was just manipulating him and so were her friends.

      @@lesiaoneill8569 And why is there NO evidence of texts, calls etc of anyone telling her to leave him, that he was dangerous, that she was being abused and needed help etc??? Because unless I missed something those would be VERY BAD FRIENDS to not be begging her to leave!
      I stood up in court once for a good friend who had been abused and then stalked by her ex (despite a restraining order) and as soon as I'd learned he was hurting her I was like OH HELL NO and told her she needed to leave. He even tried to get me in trouble for something I'd done once (in my 20s I made some dumb choices) but even knowing he knew about that I was adamant about protecting my friend.
      So she either was NOT in any danger or they didn't care because of all the grifting off of JD. 😢😡

    I, personally, liked Day 19 way more than Day 18. Day 19 was like a continuous comedy of errors.
    Day 18…how was that a good day for Amber? It was just a big bunch of frustration, filled with freeloading witnesses who all had such inconsistent stories/testimonies…esp when compared to police depos and body-cam footage…I don’t see how anybody could believe them.

    I'm so glad to see this video. One, it's telling that AH's team is squandering their time on useless witnesses. It's almost as telling as the fact that her evidence to support her EPIC claims has simply failed to turn up. This feels like a deja vu of "weapons of mass destruction."

    I would like to see a psychological profile of Elaine. She seems incapable of moving on or adapting to a new strategy after her goal is blocked. Thus that eats up a lot of her time.

      My understanding is she not experienced in defamation cases, but is more practiced in corporate or civil rights law. So she may just not be used to the high profile, or very murky he-said-she-said type of case this is. She seems like the type that would be very good at wearing down some particular point of law or legal theory in a more structured case dealing with something that had more of a paper trail or smaller more focused incident.

If AH’s team runs out of time and JD’s team brings in a last minute witness that AH’s team cannot cross, then AH’s closing argument is the only way her attorneys can address that witness’s new testimony. This trial is turning out to be more like a chess match.

    The most significant thing I took from AH’s attorney’s testimony was that the OP Ed was truly about JD, whether he was named or not.

      @@65cj55 The defamation does not have to be the sole cause of lost income. In fact, for defamation per se, there is no need to prove any damages at all. Amber will have a much more difficult time proving damages in her case against him. This will be an interesting week. As for the conscience, I’m betting you don’t know any attorneys.

    I would've been suspicious on waldman's testimony if the privedge objections only came up a few times for critical questions, but since it was almost every question, i quickly realized it's like you said and i'm not versed in legal matters, so I firmly believe the jurors would pretty much realize this as well.

      I think it's like a gamble to bring mr waldman as a witness. Some juror may find it unsettling as he wanted to hide something and protect his ex-client, but thanks to him the juror knew about AH's perjury allegation. She did this before so she could do it again in this trial

I sympathize for the jurors that don’t have the benefit of your cometary to keep them alert. At this point all the jury are longing for get back to their own lives. If I were a juror I would be resentful of AH’s team for wasting my time.

      I'm a 46 old German living in Greece and during this trial have come to the conclusion that Mr Depp is a victim of domestic abuse by his former wife. I'm also a feminist. Whoever wants to label me as whatsoever can label me, I know that just because someone is a man that doesn't mean he can't be abused by a woman.

    It's interesting to get the strict lawyer angle on what is going on. It would be pretty good if there is someone with that kind of insight amongst the jury, considering how I regarded the Waldman questioning before getting a better understanding of the attorney-client privilege.
    The main reason for me to follow the case is psychological and from that perspective AH has lost by miles and miles. The way the witnesses produced by Ah's team more so corroborates the presentation of evidence from the other side is close to being absurdly comical.
    But as defamation can be so very hard to prove I wonder what the outcome will be?

    Elaine is like the dollar tree version of Saul goodman. Trying to be sleezy by handing out double negatives just so Waldman can spill the beans on Johnny lol. It probably would have worked if the person you’re questioning wasn’t an ATTORNEY!! Lol…. I’m certain Amber is going to play the “my council did not give me proper representation” she wants a retrial….

    As an observer from New Zealand, I have found this case fascinating and your analysis on this channel has been riveting. However, I come from a jurisdiction where legal proceedings would never be broadcast and analysed to this extent in real time (so called sub-judice). I do wonder whether this intense dissemination and discussion of proceedings undermines the chances of a fair trial ever taking place. It would be very hard for jury members to remain untouched by all the talk and the pro-Johnny anti-Amber social media commentary.

      I think JD's team pushed for the case to be televised as they knew he wouldn't get fair representation in the media. It's a contingency plan, even if he loses, he's managed to get his side of the story out.

      JD paid Judge and Judge paid additional security. That is why the current head of security clarified that Johnny had only been paying him a few years but he had worked for Depp via Judge for much longer.

    Q: Can you please explain why this has been ignored throughout the entire trial so far: AH lawyer’s letter of blackmail demanding 3 of JD’s 5 penthouses plus a monthly allowance of $50K (including vacation expenses) plus his car, or she’d go public like she did with the temporary restraining order (after he didn’t sign the agreement)? Isn’t this absolutely crucial in this case? Didn’t AH’s gang stage the DV call to 911 in order to justify the TRO, and isn’t the TRO defamatory?

      Exactly! It was covered somewhat in Laura Wasser's testimony on day 10, but I hope they reiterate this. Also shows a strong incentive for Josh Drew and Rocky Pennington to assist AH, because she was securing their penthouse on JD's dime in the demand letter. It's too late to pursue defamation for this though, statute is 1 year I believe. So he can only pursue defamation in relation to the op-ed, but he can show the TRO was part of a hoax to extort a more favourable divorce settlement.

      it's inadmissible unless the defense brings it up. it was approached vaguely by the plaintiff but they moved away from it because there would be serious problems if they went into it without permission.
