Day 20 RECAP! | What If Any Value Did These Witnesses Have? | Johnny Depp Vs. Amber Heard

  • Day 20 marked the start of the 6th and final week of the Johnny Depp Vs. Amber Heard defamation trial. With Amber's team running a severe time deficit to Johnny's team, the question on all our minds was how would they handle today? Would they rest and save time for cross examining rebuttal witnesses, or would they drag out their case and bring in more witnesses? The answer was the latter.
    The day kicked off with Orthopedic Surgeon Richard Moore, before we moved into a psychologist and Hollywood damages expert who were slightly more, should we day, entertaining... Dr. David Spiegel and Katherine Arnold. Both took considerable time, and engaged in contentious and drawn out cross exams with Depp lawyer Wayne Dennison. They debated Goldwater rules, movie trivia, Star Trek, and more. It was a rather interesting afternoon.

    For some background- This is a defamation case between Johnny Depp and Amber Heard. Johnny Depp is suing Amber Heard for defamation stemming from her OpEd published in The Washington Post in 2018. Amber Heard is counter suing for defamation claims based on statements made by Johnny Depp's former lawyer. The trial is taking place in Fairfax, Virginia, the proper venue as The Washington Post is headquartered in said location. Presiding is Judge Penny Azcarate, Johnny Depp is represented by Ben Chew, Camille Vasquez, and more. Amber Heard is represented by Elaine Bredehoft, Ben Rottenborn, and more.

      I think it may've been smart for the court to leave things as they were. This being such a public, high-profile case, I feel that if they had forced Spiegel to leave, then Amber's team and PR and everything else would go insane in the media, claiming an "obvious bias" of which she's been trying to argue has been against her this whole time, anyways (The whole "I spoke up against sv and faced our cultures wrath" kind of thing). I think it would give fuel to her fire, and this legal team and court don't want that kind of convoluted bad press, since they know the whole world is watching. I do believe that in any other case, he would've been kicked out though.

    JD first tried to tell the Australian doctor he caused the injury in a door, apparently trying to save Amber the embarrassment. Doctor didn't believe him and told JD it was a "high velocity" injury

    I think you really hit the points spot on. I wasn’t aware of Amber heard until this trial. I thought Depp was a “wife beater” to A partner. After stumbling on the live coverage of trial, I decided after Heard’s testimony and the other mountains of evidence that she was lying about Australia and super exaggerating or retelling a different version of all the other incidents. I feel sorry for whole mess but Depp needed to do this to exonerate his name. Wasn’t ever a particular Depp fan but I’ll go see his next movie if it’s upbeat like I hope his life will be.       That comment made me smile. I randomly heard about AH stuff a year ago or so and my first thought was that JD was, well, just another drug using VIP going crazy on his wife and I was mildly disappointed bc I did enjoy movies and some interviews of him in the past. But once I watched her testimony, it was so so obvious that she was lying. A gut feeling first, now I'm sure after seeing all these not-evidences on her side and her attitude compared to his way of dealing with the situation. I do hope there will be a good ending for him and some justice for all victims of DV and narcissistic people.

      You read my mind. Knew JD’s name and saw all of the Pirates, knew he wore rings. lol …and that’s the sum total. Knew nothing at all about Amber Heard.
      So, basically no opinion either way until I began watching the testimony/seeing the evidence.
      I don’t believe her. Full stop. This suit had to happen. I actually believe, ironically, that *she* is the monster.

      You and me both! I’ve tried not to dunk on Heard’s team too much. They’re doing the best they can with what they got. And obviously they ain’t got *anything* they don’t even know how to get their side of the story out without basically relying solely on whatever Heard has said.
      I could forgive them if it wasn’t for the constant egregious whining every-time they’re reminded that they have to ask their questions properly.

    The door thing came from Johnny himself saying that's what he originally told doctor's because he didn't want to tell them the truth, but he also said they didn't believe him after seeing the damage. He testified to this himself.

      Who even was she? She's meant to be an expert but literaturly didn't know anything about anything and got arsy about being asked about it.       Disagree. You guys are trying really really hard to convince yourselves. Dr. Spiegel came across as smart and equal in tone to Dennison. Dennison started out with incredulity, and this doctor was clearly more intelligent. Plus, Elaine took a lot of wind out of his sales by brining up the Goldberg rule before cross.
      And hey, if you disagree on the facts, fine, I can still respect you. But to the degree Depp supporters (and Legal Bites) have ridiculed and made fun of Amber while she cries, you guys have acted disgracefully. No what-aboutism will excuse this. Many on #teamdepp have acted like animals. But the internet is forever. Doubt this will age well.

      @@fluffymajestic4589 clearly no one is talking about the Dr. The last witness was the movie industry expert, you know the one who didn't know what movies the people she was using as a point of comparison to amber were even in.
      And to your point about the Dr. His entire testimony was basically statistically people who abuse drugs are more likely to be abusive therefore Johnny Depp is abusive. You do realise how inappropriate that type of thinking is right particularly in a court case? Your probably right about how people talk about amber on the internet unfortunately it's hard for me to have much sympathy for some who is so willing to lie in an attempt to ruin someone's life. If you believe what she says then I really don't know what to say to you? Even if you take out all Johnnys evidence, her own evidence disproves 99% of what she is claiming, the violence she describes was done to her would require a large amount of reconstructive surgery and urgent medical attention, yet she says she didn't need medical attention and shows us a picture of what could be a bruise but definitely wasn't caused by any kind of punch. If you want to see what someone looks like after they've been punched that picture of Johnny was a good example or Google Riana after Chris brown hit her, and he did that while driving a car so imagine what her face would look like if he wasn't driving and could hit her properly? So listen to what amber discribes was done to her look at the picture that she claims was taken the day after and then look at Riana

    My thoughts on Day 20:
    Witness 1:
    He said that the wounds weren't consistent with the bottle story partly because there was torn tissue rather than a clean cut. And also partly because nobody mentioned glass in the wound. I was surprised and frustrated that the lawyers didn't bring up the fact that Johnny spent quite some time DRAWING ON THE WALLS of the residence with his injured finger. I'm no doctor but it seems to me like that would significantly change what the wound looks like.
    Witness 2:
    What this guy said was quite questionable in itself, but I feel like it barely matters because he seemed to do his damn best to come across as the most unlikable person on Earth. He interrupted both lawyers constantly, hardly ever actually answered the questions (instead he assumed what the question was aiming at and ridiculed Johnny's lawyer). It was a complete mess and I was wondering more than once what conclusions this doctor would come to if he observed his own behavior. I think just having him ramble on and destroy himself made for a decent cross.
    Witness 3:
    I took this personally. I love movies and it's clear to me that this woman hasn't seen any. I could have made more accurate statements about all of these actors/actresses and films without being an "expert witness". It was insufferable. If there are movie buffs in the jury, it's likely that they died a million deaths yesterday.

    I feel like Dennison’s strategy is to allow witnesses to talk themselves into a whole.
    By the time you figure out where his questions are going, you are trapped 🤷🏾‍♀️

      Agreed. Positioning Spiegel so that he had to agree that his findings Depp’s ‘cognitive impairment’ could have been attributed to the influence of drugs, and therefore having to admit his findings could be considered completely unreliable, was masterful.

    People with ADHD are often miss labeled as being Narcissist, doesn't mean that people with ADHD cant be narcissist but knowing someone has ADHD is a needed factor when giving a expert testimony.

      I have ADHD and autism and while yes we can sometimes come off as harsh in some ways, Spiegal was overly combative, self-centered, and rude. I know everyone presents differently, so my opinion should be taken with a grain of salt. I also know neurotypical people can also act this way. Still, you also have to consider that Ambers's team should have either notified the jury about his diagnoses or not chosen him at all, because whether he is neurodivergent or not, he came across very negatively and did not give useful information.

    It has already been testified by multiple people that Johnny was dropped from Pirates 2 days after her article came out. How they could even spend the argument that they did it to himself when he already had a contract is ridiculous and I don't understand why this is not brought up

    I’ve watched court almost every day, and I still believe all of this is due to AH’s vengeance. I don't believe she truly wanted to get divorced, I think she was happy to ride on JD’s coattails and everything his lifestyle brought her. When he told her he was “done” and wanted a divorce, she brought her vengeance upon him for daring to leave her and disrupt her high flying life.

      Imagine how much easier her life would have been, if she had been a nice, non-abusive person. He seems like he just needed a good human around him to bring him up in his personal life, she could have chosen to be that person. It’s really sad that she enjoyed being hurtful and abusive more than just being decent. She could have ridden his coattails, taken all his money, and at least they both would have been happier than they are right now.

    She said in cross examination that she had been working on this case for 3 years. I found it amazing, the lack of knowledge, when there are so many Hollywood publishings which cover all the actors, their pay,ratings and film/ tv appearances. $60,000, I could have done a better job that by shouting "hey google".

      I had noticed Depp's surprise when the Dr. testifying said that his figure injury couldn't have been what Depp claimed. Which would fit because if you're telling the truth and an "expert" says it's not possible the mind would be blown.

    In my opinion so far AH's Attorneys have realized that they are done, now they just wanted the jury to be confused, that they can't fell the decision who is guilty and the case run's into nothing...it's the last that they can do for AH.

As a defensive mechanism, it works because righteous opponents are too drained of energy to sort out and untangle the Gordian Knot the demonic tied. The closing scenario is FUBAR, fouled up beyond repair. In the fiasco, while everyone is enmeshed in half-truths and tangled up in obvious lies, the instigator of the confusion quietly slips off unnoticed, making an escape.

      I feel like JD wouldn't neccessary be forthcoming on a serious injury [DV] in another country to avoid risk of publicity- seems plausible he would have lied to ER to avoid police reporting/ leaks...
      Also was injury after AU entry of illegal dogs??? Would this have just add to another public incident in JD mind ie. optics

      @@gigi6997 Also might not have said anything to protect Amber. It's not uncommon for victims to protect their abusers, especially when they're in a place without a support system. I can't be sure for him, but I know for me, optics would be the last thing going through my mind while in that much pain and panic.

    Awesome analysis! As a social science researcher, I was blown away by Spiegel’s lack of professional methodology in his evaluation of an individual based on his movie roles. Holy crap, does he think movies are real?! Also, I had no idea of the cinematic impact of Aquaman until this week. 😅🧜🏼‍♂️

    To sum up the day: the medical expert had nothing relevant to say, he basically just made up a story and nearly got impeached for it.
    The psychiatrist expert needs a psychiatrist at this point, but it was pretty entertaining.😂
    The movie expert felt like her expertise came from reading 15 minutes of wikipedia. Not a good day for AH, this was just wasting time from her team.

    A key point re the doctor at the beginning: the Golden Rule, you cannot testify and give expert opinion re a patient, if you have not met them and or interviewed them, and or have been given the patient's consent. Yet the first thing this doctor is doing, is giving expert opinion and testimony on JD, whom he never met and or interviewed. The doctor cites that all the expert testimony so far may as well be struck. The thing is, Dr Curry did interview A H in person. So in effect, the doctor has just pointed out his testimony and all the testimony for A H is null and void.

      He produced a lot of memes and while that might sound like a joke, it will definitely help with the public perception.
      Will we remember that we were screaming at our screens for him being ineffective in 2 weeks? Probably not.
      Will we remember "but what about Willy Wonka?"
      Or... "What about Marlon Brando? Isn't he dead?!"
      etc...
      So that should also be taken into account. He's actually doing his client a real service IMO. 🙂

      I agree with you, Jakob. He does get the necessary information which immediately makes their expert opinions less credible and questionable. I understand all the complaints people have but again every lawyer has their own style or some crosses don’t always go as planned for various reasons. I feel people are still hung up on the cross-examination he had with the pyschologist, which I agree could have been performed better, but was by no means a fail (he successfully made her testimony less credible in several ways). Also, I do not agree with people’s comments on his way of speech - not everyone can speak as fluidly (even myself at times), and this happens for several reasons (aging, anxiety, nervousness, etc.).     I think the cross byDennison was really well done, yes, he could've asked questions about topics that are more direct but I don't think that's they approach they're going with, he dismantled all the experts and made them look uncredible

      I think he got confused a bit by the Spiegel and his off topic verbal diarrhoea. Would have loved him to bring up the “Johnny eats candy and is therefore a narcissist” comment and then play ambers UK deposition again and show her eating while being questioned, then ask is it just candy or does eating any food that make you narcissist?

      I think he got there in the end, but he was too prone to argue with the witnesses and let them control the time they took. And he kept going on about stuff after his point had been made. He also slipped up and parroted back "defamatory statement" in reference to Waldman's statement after the "movie expert" said it when he should have been correcting that speech because the statement has yet to be proved to be defamatory. If there wasn't a time limit, it wouldn't be such a big deal. I would rather have seen the time go to rebuttal witnesses later on (I'm excited to see the rebuttal witnesses...lol). But... like I said... at least he mostly got to where he needed to go when he finished.

    I find it bizzare that so many expert witnesses and even Heard's own legal team seem so utterly surprisingly incapable or even lazy. Those people are licensed psychiatrists, licensed lawyers and surgeons who really went through a decent system of exams and qualification tests. One could argue that they may have been influenced by Johnny's overwhelming winning trajectory or that they may not be particularly good in a courtroom, but still, this level of incapability in such a high prevelance is just unusual. I am tempted to think that it is really Heard herself who is driving this ship. Her arrogance and, later on, her desparation, made her tempted to take even more control on something that she really has no expertise in.

    On the whole finger thing, it feels like AH's team have just been trying to say "well, it could have been this, or it could have been that". It's almost like they're thinking that if they give everyone 4 options instead of 2, there's now a 3/4 chance they'll choose something other than the vodka bottle, instead of it being 1/2.
    It's very odd logic.
    And he was their best witness that day.

    Thanks Alyte. I found Day 20 frustrating and disappointing in terms of quality of witness. They let themselves down as professional experts. However, I did like Dennison. Initially, I found him slow, previously too, and a bit muddled but watching and listening to him, his style worked well for him because he listens too. Everyone is unique. For gentleman johnny.

    Okay, I just got through a month of jury duty (never, ever want to do that again) and I did see the three "experts". I know more about movies than Katherine Arnold (or at least have seen more, since she didn't have much knowledge about film, she lost all credibility.) I don't doubt the other two had degrees and have worked in their professions for a while but I would never want either for any medical or psychological needs, and there lies the crux of my complaint. If I had been on the jury, I wouldn't have liked any of these witnesses. They all came off as arrogant and unlikeable. In spite of wanting to be unbiased, jurors are humans and no one likes to being condescended to (having or showing a feeling of patronizing superiority). If I were a juror, my thought would be "Is this honestly the best you can come up with?" I can't help but notice that the two legal teams personify the characters of their clients. One is calm, respectful, likeable and always in control, while the other is abrasive, argumentative, out of control and accusatory. I'll let you judge which is which.

      I didnt. I admit that I stopped watching this one after 3,5 minutes, because I dont understand your points Alyte... a lot of people are watching these recaps, because we expect a fair objective analysys, but right now I am diasppointed. The ortopedic surgeonts testimony was very important, because it proves that it is very likely, that JD lied under oath about Australia.
      1.Amber did not say that he cut off that finger with the phone, she said, that she doesnt remember, and that is her best guess.
      2.The doctor did not say, that he cut it off with a door, but he spesifically said, that he couldnt have cut it off with a bottle that way how he was describing it in his testimony.
      So it is fair to say, that he probably lied, and that is a huge problem for him. JDs team was really trying to prove, that AH is lying about abuse, but they couldnt, they could only prove that she is lying about that money, what looks bed of course, but it is not that much related to the case... But JDs potential lie is much bigger. And the next witness made it so much worse for him, when he said that he has a history of cutting himself, and when he was describing how are drug use and dv related.
      I would be really happy, if someone would finally give us an objedctive analysys... Because this wasnt an objecitve one

    I am glad to see that after you took some time to collect your thoughts, you've changed your opinion on Wayne Dennison. To a layperson, Dennison is not bad - he's winning. He's dismantled three expert witnesses and made them look foolish. Yes, perhaps they would have seem foolish on on their own. And perhaps there aren't any specific take-a-ways I have after Dennison performs his cross, but if in general I think that the expert doesn't know what they're talking about, then Dennison did what he needed to do.
    I think the word you're looking to describe Dennison is "unorthodox". But I would rather have a lawyer with an unorthodox approach that wins me the case over a lawyer with a concise, by-the-book approach that doesn't get the job done.
    Really, the only thing potentially to ding Dennison on is the amount of time he uses., but Depp's team has a 4-to-1 time advantage. And to be honest, if Dennison's crosses were short and sweet, I would likely have specifics on the expert witness testimony and why they were wrong in my head. Rather, I'm left with a feeling of "I'm not sure I followed everything that went on, but that witness clearly did not know what they were talking about, so I'm just going to disregard all of their testimony and move onto other facts within the case."
    I think this is why Kurt was getting dumped on a bit in yesterday's stream. Taking the stance that Dennison is a bad lawyer even though he got exactly what he wanted out of his cross examination solely because Dennison took an unorthodox approach feels like a pompous, Dr. Spiegel-like statement to make.

    Idk if I've ever felt more invested in a verdict that involved celebrities. But I have no regrets, just anxiety about the verdict. It feels obvious to me that she's lying. I hope there isn't some dumb technicality that robs him. Yesterday was surreal. This trial has been super unique and interesting imo.

The burden of proof by a preponderance of the evidence is on Johnny so if the jury thinks that Johnny pushed Amber once, then, technical, or not, he could lose. It’s his case after all. I REALLY hope the jury doesn’t believe it but Whitney maybe someone they feel is credible. Either way, he has won in the court of public opinion. I don’t think Amber’s counter claim will be accepted, though.

      Typically I don't care about celebritys. In fact I vaugly remember hearing about Johnny years and years ago and just thought oh turns out an other celebrity is an ars hole. Then totally forgot about it until I heard some of the tapes a few years back. I had no idea who amber was until that point either.

    I love the way Spiegel and the doctor were talking to the jury about things they “thought it was important for them to know” instead of just answering the question. I would call this day a trip to the circus as all the clowns were trying to get into the car called “expert”.

    My impression after seeing Amber Heard's "expert" witnesses is that the higher paid an expert is the worse they are (I know that this isn't true, but dang her team sure knows how to pick them).

    Great point about all the conflicting stories Amber's side has produced to explain what happened to JD's finger. I had forgotten most of them 😅😂 Heard and her team make me think of the phrase, "Throw everything at the wall and see what sticks." 🤦‍♂️🤭 Gr8 vid

    the thing that got me about dr spiegel is that his evidence for johnny being an abuser is his conclusion that johnny had narcissistic traits. but then in his redirect, his evidence of johnny having narcissistic traits was johnny being an abuser. like…that is circular logic, my guy!!

    No mention of the APA definition of Goldwater rule and the weird assertion that the expert made about it nullifying ALL expert testimony? Also, that witness was incredibly combative over some other weird stuff.

    THIS. That’s *exactly* my problem with these experts. I’m completely open to them telling me why Depp’s in the wrong and Heard’s in the right. But the minute their expert opinion is ripped apart because they only cherry picked evidence that supported what they’d already concluded, I feel they’ve misled me and wasted my time. Do your research!

    A comment about the emotional effects of following this trial, including various commentaries: as a counselling psychologist who has worked with trauma (sexual abuse and torture), and also documenting my work on my own traumas, I'm finding this trial quite triggering. When Amber Heard was testifying I could barely watch a few minutes. I saw a bit of Dr. Spiegel yesterday - when I received a few memes comparing him to Dr. Brown from "Back to the Future", the cosmic order made a teensy bit more sense. In terms of traumas being activated, I'd say there has been very few media events as powerful as this case. I've been taking an interest in this case only in the past two weeks and I've been careful to monitor my own reactions to various commentary sites. With some sites the commentator's physical disposition end up being an enactment of my own cringe feelings, which can be validating (maybe something to do with mirror neurons...). I noticed that I look forward to Lyte's recaps as I find them soothing, mainly because my intellect is being engaged in an emotionally balanced way. So the video above, at 13:52, there is a lovely moment where Alyte says she got "worked up", it left me smiling and thinking "please go nuts", it can only validate what everybody is bottling up.

    On the finger/angle thing:
    I tried this out, resting my hand on the side of my desk and imagining a bottle had been thrown at me from the right side. My automatic response was to use my right hand to slightly push away to dodge it, meaning that my hand turned over towards the left, slightly. My index was turned about 45 degrees, my other fingers lost immediate contact with the edge of the desk, exposing the side of the index. Would sit perfectly with the injury.

      My only issue is how there's no injury on any other part of the hand, when a large glass bottle explodes and cuts off a part of one finger. How's that even possible?

      @@sakethedpuganti5697 it didn't cut off the finger. It crushed it so hard that the bone broke and tissue got torn off. Then, after it crushed the finger and Johnny was likely in the process of jerking his hand away, the bottle shattered. And depending on the angle of the throw, the shards could've mostly flown down while the hand was moving up and away.

So, maybe the thick base of the bottle hit the finger first, continued to make contact with the bar at which point is broke, and the other side sliced as it continued downwards. Crush injuries will tear skin badly, though, which seems to have been the main factor here.

    Hey, I’m surprised the discussion about Goldwater rule didn’t come up in this recap? Hope for a separate video? I feel it is most important for all the psychiatric expert witnesses as Jonnys side did examine Amber but Ambers side didn’t examine Jonny. Shouldn’t this be a rule within the courtroom too for future trials?

      I watched a lawyer's reaction video. He said that Amber has claimed psychological damages due to his abuse, that's why she was examined by psychiatrist from Johnny's side. However, Johnny hasn't claimed any psychological damages, so he was not assessed.

      Johnny refused to be examined for one thing. Secondly, the Goldwater rule is applicable only to APA members, and this “Dr” violated the rule by giving his opinion.

    Watching these witnesses after having come home from a root canal and temporary crown procedure at the dentist, I can certainly say that their testimonies were much more painful. The psychiatrist and all of the live chat comments had me crying tears of laughter, so thanks to all of the followers for the comedic distraction.

    Lol, problem is, even Amber's own acting coach said amber told her that Johnny did himself with thw vodka bottle right after it happened... directly contradicting her own testimony about the phone.

    That surgeon just made it harder for amber and for the jury... Now the jury will appreciate Johnny for giving them a way clearer picture unlike amber, but most importantly i hope the jury realise the fact that this is what liars do, they blur things out and never give you a clear image, they also give you too much "info" hoping it would confuse you.

    Thank you as always for the recap, I am from Germany and looking forward to it every day. I watched the hole trial and your knowledge helps a lot. I think they brought in the door theorie because that is what Johnny told the doctor in the emergency room. He lied there because he didn't want to get Amber in trouble. So for me it made sense to bring that up. It didn't make sense at all to hear from Amber that it was smashed with the phone. So in fact Amber came up with a new version. But I found the explanation from that last witness not convincing because he described the position of the hand wrong when the bottle hit it, so all he said was rubbish, as Ms. Vasquez pointed out perfectly.
