- Day 21 began with Amber Heard's team resting their case in chief. Following this, Johnny Depp's team put forth a Motion to Strike in an effort to have Amber's counterclaims against Johnny dismissed. After both sides made some compelling arguments, Judge Penny Azcarate took it all into consideration and opted to keep her counterclaim alive and send it to the jury.
Moving swiftly along, we got stuck into the day proper. With Amber's side having rested, Johnny's team began the process of responding to what was presented in her case in chief through various rebuttal witnesses. These included a handful of experts mainly designed to rebut the expert testimony presented yesterday.
In something of a shock Mr. Depp's side called Morgan Knight, the Inn Keeper at the Hicksville trailer palace, a man present the night of the Hicksville incident. This brought the highlight of the day with lots of mentions of @ThatUmbrellaGuy , sometimes referred to as That Umbrella Man by Elaine Bredehoft.
We also heard from the hotly anticipated Jennifer Howell, who didn't turn out to be quite the bombshell everyone had hoped for. Rounding out the day was a representative from the Children's Hospital of LA who testified about Amber's supposed pledge/donation.

For some background- This is a defamation case between Johnny Depp and Amber Heard. Johnny Depp is suing Amber Heard for defamation stemming from her OpEd published in The Washington Post in 2018. Amber Heard is counter suing for defamation claims based on statements made by Johnny Depp's former lawyer. The trial is taking place in Fairfax, Virginia, the proper venue as The Washington Post is headquartered in said location. Presiding is Judge Penny Azcarate, Johnny Depp is represented by Ben Chew, Camille Vasquez, and more. Amber Heard is represented by Elaine Bredehoft, Ben Rottenborn, and more.

As big as this trial is, if I were the judge, I would never take it upon myself to make any decision I could give to the jury. There would be too much criticism either way.
I agree, she get could definitely have stricken the countersuit but just punted it to the Jury to be safe
I dunno, I feel like she's a coward. The motion to strike was sound. If we could be sued for what other people said, the world would be an impossible place to live in.
Edit - I feel like I should say why it's sound. An argument the lawyer was not allowed to make in court, and knew he couldn't make in a motion to strike, is that Johnny and Adam have attorney client privilege. So there's absolutely no way to establish that Adam was a direct mouthpiece of Johnny Depp, or whatever they're alleging, even if it were true (and I don't think it is, but that's not relevant to the discussion).
Establishment is very important, it affects what you can question witnesses about and many other things. If you have nothing but speculation, that's supposed to stay out of court. So they haven't even brought a legitimate argument for reverse damages.
But even if there was a case, they know they cannot prove it!
Imagine suing someone over something their lawyer said. Well I guess Amber doesn't have to imagine it.
Her performance for the jury was really hard to watch, like awkward comedy from the office or any of its copycats( I feel like Ricky Gervais defined the genre)
Her desperate looking at jury all the time must be awkward for the jury members. It would be for me.

I think the judge is being very careful to avoid any successful appeals.
Plaintiff has the right to request trial by jury in most type of lawsuits. This includes defamation.
took me 21 whole videos to realize the backgrounds for each livestream and recap are color coordinated. Thank you for this little detail! It shows how much effort you’re putting into these vids. ☺️
I thought the expert witness with the Q- score deserved more credit than you gave him. I am not an attorney, but a regular person that you might find on the jury. The Q- score and the rest of his presentation helped to explain that Amber's trajectory should not be compared to the other actors mentioned. It was a reasonable graphical explanation which probably helped the jury see that Amber was not as popular as some of the other "superhero movie" actors, and in fact AH was more disliked. If anyone on the jury dislikes Amber, then they must feel relieved that others feel the same way. The Q-score expert also helped to squash the theory that Mr. Waldman's alleged smear campaign had any effect or created any damage for Amber. I found his explanations & graphs easy to understand. I also believed the testimony of the owner of the Hicksville Trailer Palace. Granted, at first it seemed like, "where the heck did they pull this guy out of?" But the guy seemed believable because he was not coached or prepared. He was a likeable regular guy with no personal interest who did not care one way or the other about the case. I found it effective, for JD's side when Elaine was attempting to harshly cross examine the Hicksville witness. The guy looked totally confused, as if Elaine was speaking gibberish. For me, Elaine's questions & tone backfired on her & she opened the door for the guy to make the jury laugh at Amber's side.

Agreed, I’m not an attorney either but I really wouldn’t rely on testimony about the industry as truth. I trust numbers more. Like ability matters in their industry. For the guy to quantify that information was helpful .
In addition, people retain more information when presented a visual of the talking points. Humans attention span is short and any additional assistance is beneficial.

Honestly, I loved the expert rebuttals. A huge problem I had with a lot of Heard's experts is that they often delt in absolutes. There wasn't much of "many" or "tends", it was "all" or "is", which just automatically discredits them to me. It's extremely hard to find any fact that doesn't have deviation.

What I found odd about Elaine's cross examination of Morgan Night was how she directly asked him several questions she had just objected to Camille asking. I was also amazed they willingly put into evidence a tweet of him saying "I was there, she was the one acting crazy and jealous" lmao

Bad day for Amber, maybe the worst yet. Having her boss, the president himself, testify against her and basically telling her she was not a good actress and was not involved much in a project she had flaunted left and right... Ouch.

Wrong. She got away with this so far because she is a manipulative delusional psycho, not because she is a woman. Many women- more than men - have to deal with someone like this, often in the context of post-divorce abuse. The woman is forced to engage in protracted wildly expensive litigation to protect herself and her kids from a lunatic ex, similar to AH. That is why so many women who are DV survivors are cheering for Depp.

I thought the whole day was good except for JH’s video which was completely confusing, badly edited, incomprehensible and thoroughly disappointing. I’d fallen into the awful trap of believing her testimony would save the day and I fell hard when it became clear she balked.

Your recap is the only one I trust as you focus in the technical aspect and explain it. So many channels are more focused in offending Amber than in the actual trial. Justice for Johnny is not attack Amber, is actually forget her existence. Ostracism will be Amber's biggest punishment.

God, agreed. I was listening to the ‘D’ Guy (not saying their name) but it’s not particularly law-related but based on anecdotal ideas, personal thoughts only and how a jury looks which really could be twisted either way.
I have noticed that throughout the trial that Heard's team has been adopting the mannerisms and moments that have made the Depp team viral. You can see that the Heard team is mimicking the behaviors seen on the Depp side.
For example, the playfulness, smiling, hugging, joking between the members.
Amber has now adopted writing constantly, and communicating with her team. Before she was constantly stuck in a portrayal looking for cues to look sad or sullen then sticking with that hard emotional awestruck gaze hoping for the cameras to get their sympathy shots. However any and all memed or clipped content has been showing that in a mocking way while lionizing Depp's stoicism, his aloofness, and lack of desire to pander to the jury.
There was a moment where Camille and Ben embraced in a hug and all I could think of was that in private they have a plan to do certain things just to see if they can get the Heard team to copy them and to see if Elain and Rottenborn have a big ol hugfest tomorrow.
I remember you talking about precedent regarding suing a person over what their lawyer said. The Smollett case had a similar thing happen and I'd love to hear your thoughts on it

The Hicksville manager was , to me, honest. He basically said Amber was being a bitch and aggressor that night. That hit home for me.
for me it was his assessment of the damage to his property or lack thereof.
He was a gust of fresh air; he wasn't coached, he was found randomly and only interviewed the night before his testimony, and he made Heard's team nervous: "Who is this guy? What did he see?"
A whole lot of nothing Amber, a whole lot of nothing - except you behaving like you usually behave.
I want to know how the light fixture got broken. Elaine stopped him from saying 😅
I also think such testimony can be very important for some, since he came across as very honest and out of the loop regarding the whole trial. Hearing what random people who saw Johnny and AH interact on any occasion is the next best thing to how things looked from a neutral standpoint that you can get in such a high profile trial where evey other witness is clearly coached and very biased.

One thing that irks me is the people discrediting the panel in the livestream by saying they're wrong when they say even a word not in favour of Johnny depp. Y'all are normal folks and these are experienced lawyers. They most definitely know more and are just saying stuff that they're observing. Don't get mad at everything lol. Also the people who ask the panel to be quiet. Most are watching for their expertise and commentary. Go elsewhere if you only want to see the court stuff.

As a german I had no clue how jury trials work and I still have a lot of questions about it. Is there already a video about this? I would be really interested in how a jury is selected, why do people want to do this or are they obligated to? How is their identity protected? Dont they have jobs to attend to? :D if there is already a video about this or if it was topic in one of the livestreams maybe someone can send me a link?
Q: Can you have a poll for non-legal folks to show where the lay- people show believability of of evidence, which of course includes testimony, for JD, AH, and Inconclusive? PLUS, a second poll for those learned in the law? Maybe after closing, or now and allow a person to change vote from now untill after closing?

Honestly, I think even if juries were leaning towards Amber, they’d have changed their minds simply by listening to that notorious audio clip where you can hear Amber’s wicked laughs and evil shrills.
I always had a little voice in my head telling me: but what if she tells the truth?

In my opinion I believe her to be a narcissist sociopath.
I knew someone who had a very similar operation to Johnny Depp for a severed finger. A girl at my school got her ring caught in the door latch on the door frame. She had grabbed the door frame to swing out into the hall and her finger was pulled off as a result. I wasn't there to see it, but my sister was right behind her when it happened. She had a pin in her finger and a special splint to immobilize the hand and they had to essentially fuse her top joint im that finger together because it was crushed beyond repair. Having seen the result of such an injury, I dont believe that Johnny could have done much of anything with that hand even with a cast protecting it for a long time after the injury.
As a professional in my field I can agree that we saw a lot of experts who did not at all go into the details of assumptions, limits of the analysis done etc. . But that actually goes for both sides. So I kind of assume that is how experts testifying at court do it in the US and it is up to the cross to bring scientific integrity into the testimony.
Mr. Knight was my favorite witness from yesterday. It would have been Mr. Marks, but the trailer testimony was more important.

If the case was lower profile I would guess that she would throw it right out. Too many people following these proceedings. It's easier to throw it to the jury and wash her hands of this mess.

I was watching some of the trial yesterday with you guys. I caught the end of q score guy who I thought was at least slightly compelling with his rebuttal. Then I heard the psychologist who I that was lovely compared to the guy from ambers side, the difference in just how likable they were was massive. Then I also caught Morgan’s testimony he seemed likable and not over selling his testimony, I even felt he seemed pretty honest about his experiences and only cared about sharing the truth. Really interesting to see a fresh witness for both sides come in. Sucks for AH they did vadere him better that comment about abuse even if stuck isn’t great for her side.

Regarding video depositions, I assume these are basically people who can't attend the trial so their questions are done by the lawyers in advance of the trial and the video is shown during the trial right? So what happens when the opposing lawyer objects to the question being asked? The question can't be rephrased so do they just skip that question and fast forward to the next one or is it just accepted that as part of the video deposition process questions cannot be objected to please?

I agree with Elaine's cross, during whole this trial, I've never seen her like that and it was intimidating and precise how a cross-examination should be, also considering how little information she had on the witness! I also love, love Dr.Shaw's testimony because it was so professional, logical and precise, he didn't violate Goldwater rule himself by throwing diagnosis anyone's way, he didn't talk about Amber or Johnny. All he did was nullify or tried to nullify Dr.Spiegel's testimony and what's beautiful was how calmly he described how Dr. Spiegel could've handled it! He didnt have any defensive nature as most other expert witnesses. He didn't seem to portray or buy into any narrative!

Question in regards to knights testimony.
Given he contradicts the claims of damage to the trailer, and that could be proved by records, wouldn't that put amber and her friend down at risk for lying under oath.
And vice Versa for him.

It was just that the part with the Jennifer Howell testimony was a huge let down! With the information from Jennifer Howell already out there, and she being all about the truth, it just seemed drastically incomplete?! At least imo.
Maybe Johnny Depp's team brings her back on the stand? Maybe when Ambers Heard's team has no time left?
Until now they brought at least some people (back) on the stand, just to debunk/ clarify former claims of Amber hearts team, which were already pretty shady on its own. Again imo.
The fact over the thing with the 'staircase incident': That it was really the other way around with the violence, that Whitney was ultimately so scared of her sister she fled to Jennifer Howell and that Jennifer Howell got bribed/ intimidated to keep her mouth shut, just seems too important/ essential to pass over like this...
As I understood it, it's not even sure the letter of Jennifer Howell is even listed under evidence at all?! Very strange!
Maybe the whole trail is just staged and they are trying to make the ending like a cliffhanger, until Amber Heard goes in appeal for a follow up to this lawsuit... ;-)
Morgan Knight (Night?) was my favourite witness today, although Dr Shaw comes in very close second. Both seemed very honest, likeable, and trustworthy.

On this day I was watching the stream with a layperson reacting to it. It was quite interesting to see what the layperson thought was compelling evidence. Mr Bania played very well in this setting because he presented something quite tangible in his demonstratives. It was also the consensus that the cross-examination hardly moved the needle on his testimony.
Mr Marks was well-liked because of his "50 years in the trenches".
But we all agreed Walter Hamada was like the final nail in the coffin.

I'm so sad that his team made the error that ultimately kept out Jen Howell's depo from the jury. How is it that things keep going Heard's way?
They aren't. According to people in the courtroom that aren't part of the jury, the security team, or either party, the jury is seemingly already in JD's favor and has been basically turned off whenever AH or any of her witnesses were giving testimonies, but were completely focused on cross examinations from JD's team and the testimonies of JD's witnesses.
I mean amber's team fabricated evidence to get it kicked out. And a confused jen made a mistake of saying she was following the trial. It sucks but it's just about the only win amber got.

I legit don't understand why people thought Jennifer Howell was going to "save" this trial in any way. Her entire letter/email culminated to "I wasn't there personally to see anything so everything I'm writing is hearsay."
I can't wrap my head around why legal experts would have thought a letter like that would be made admissible in court.
In closing arguments, can Johnny's team bring up the contents of Jennifer Howell's statement?
I think because Howell’s experience contradicted Whitney/Amber’s story. (Even though Howell wasn’t there for the actual incident.)

I think everyone who is familiar with her story is disappointed with what we got in the trial. I think the legal team was hoping her letter would be given the same weight as Rocky's letter. Whitney was living in Howell's guest room throughout the staircase incident timeline. So, she did not "sleep on the floor in a neighbor's house" to escape the fighting. Howell and Whitney called each other 'chosen sister', and Whitney told her she feared for Johnny's life, and that she had suffered abuse from her sister and father.
Howell recently suffered witness intimidation when someone drilled into the locks of her home. She has a doorman; it's all very suspicious.

Alyte, it really bothers me that Johnny's hand doctor did not testify to the cause of Johnny's injury. Like Jennifer Howell's weakened testimony, it makes me wonder why. I know you said, the doc did not need to, but can you say more about it? You weren't disappointed? How could he? He wasn’t there. The most he could have done was, “Johnny told me xyz,” and that would have been thrown out as hearsay.
@@johnsilver8059 yeah, I think what they need is a medical injury recreation model created by a medical physics expert. They could show angle of incidence for the bottle - and show how unlikely the phone story is. Notice they had to change their tune from cutting it with a knife, to crushing it with the phone.
JURY EXPERIENCE: How was your experience?
I'm amazed at the issues LB claims will be damaging to Depp in particular. My husband and I compared our times on juries and in deliberation. This jury has already made up its mind a long time ago. They do NOT pay as close attention as you think. They are tired of it, their minds wander. I also believe at least one person will have a friend or relative with borderline PD and they will speak hard because it is very challenging living with a BPD (personal experience). Very damaging. I also believe at least one juror has looked at their cell phone re. the case. This is from combined personal experience, thinking specifically being a juror on a case re. a bogus LAPD criminal case.
I felt that jason and AH does not have chemistry after watching aquaman 1. It was very pronounced around the market scene or the scene at dessert where she took a drop of his sweat.

I would say that it is important that his team proves he didn't do anything to her closet. While it is not as awful as if he had hit her, destroying her personal items is abusive. I think she's a lying scumbag and he needs to win, AND in a case where someone's personal items *did* get destroyed, that is violent and abusive.

Totally agree with the expert stuff. When I see someone beeing overly confident in their opinion I always look at it with a healthy dose of skepticism. I think real experts in their respective fields always come to the point where they realize just how little they know. And others never reach that point but think they have figured it all out before everyone else.
Amber and Jason's careers can't be made comparable because Jason was a part of one of the biggest TV shows in history before being Aqua Man. Yes, his role was small, but it was beloved by the fans and critics (also he can at least act too)
