Day 8 Recap | Johnny Depp Cross Exam and Redirect, Ben King Testimony | Johnny Depp Vs Amber Heard

  • April 25th marked the 8th day in the trial of Johnny Depp Vs. Amber Heard. After a 3 day break we opened with Johnny retaking the stand to finish his sparring match (err, cross examination) with Amber Heard's attorney Ben Rottenborn. Ben seemed to change tact this morning, opening with lots of audio, seemingly trying to establish that the arguments the couple got into and the resulting verbal exchanges from Johnny could qualify as domestic abuse. He then moved on to the 2018 OpEd, wanting to plant the seeds that anything prior to that publication by Ms. Heard was not at issue in this trial. Eventually Ben moved into the close of his testimony, coming fast and hard at Johnny with lines of questioning that seemed designed to provoke an outburst from Mr. Depp to demonstrate his alleged behaviours to the jury. It didn't work and Mr. Rottenborn drew lots of objections in these final few minutes, but he did his best to maintain his pace and attempt to close on a strong note.
    Following Rottenborn's close Johnny's team had the chance for redirect. They spent most of their time playing new pieces of audio from audio files already admitted into evidence. Basically, they played portions of audio from the same tapes Amber's team did, but different sections. The aim was to provide the jury a wider context to the clips played by the defense and shed new light on things Johnny may have said in those segments. The redirect closed on a very strong note with the Depp team playing the audio many had been waiting a very, very long time to hear. The clip where Amber tells Johnny (paraphrasing) 'Tell them you're a victim of domestic abuse, see how many people believe or side with you'. After this, Johnny's time on the stand came to an end.
    Moving swiftly along, next up was Ben King. Ben was Johnny's house manager and personal assistant. He is also the man who found Johnny's fingertip during the Australia Incident. His testimony provided insight into the aforementioned Australia incident, as well as a few other incidents in the couples history. The defense had a particularly bad cross examination of this witness, which was followed by an uneventful redirect by the Depp team.

    For some background- This is a defamation case between Johnny Depp and Amber Heard. Johnny Depp is suing Amber Heard for defamation stemming from her OpEd published in The Washington Post in 2018. Amber Heard is counter suing for defamation claims based on statements made by Johnny Depp's former lawyer. The trial is taking place in Fairfax, Virginia, the proper venue as The Washington Post is headquartered in said location. Presiding is Judge Penny Azcarate, Johnny Depp is represented by Ben Chew, Camille Vasquez, and more. Amber Heard is represented by Elaine Bredehoft, Ben Rottenborn, and more.

      I started watching this case with little info about all that had happend and I am now full on #teamJusticeForJohhny. I don't think he's a complete saint, but Amber clearly is the abbusive partner here. Don't see how they can change that with her witnesses.

      it's paying dividends as well. Going from les than 50k to 228k subscribers in the course of this trial so far is huge. Smart woman to pick this moment and this opportunity to grind it out. If you can quadruple your income from youtube in a month's time i guess most people would take 4 16-hour work days a week for granted, even on top of other potential work obligations.

    As someone who served as a juror, if I was serving on this trial as well, at this point I’d view AH’s legal team as a complete disaster. They’ve been all over the place. With dates, years, locations, text messages, and most important, being caught in lies.

      I’ve done jury service twice now and I would be so frustrated with Amber’s lawyers. At this point, unless Amber’s team pulled something spectacular out of the bag, I would have written them off. Once they’ve been caught in a lie, it’s incredibly hard to go back from that

      I don't think ATurd's team have done anything really bad, just not as effective as Johnny's. They're only as good as the facts/evidence from ATurd. She set up to frame & smear Johnny...so thatz hard to defend her as a victim esp. when she's the most aggressive, loud, unhinged one.
      Polish a turd as much as you like ...it's still ATurd.

    Alyte, the amount of work you have been putting in with this trial is astounding! I saw your stream time yesterday was over 11 hours! I watched a lot of it with you, but I still really appreciate these summaries you do daily. It helps give that overall perspective I’m lacking as someone not in the legal field. Thank you very much.

    Very strong day for Depp. Ben King was unflappable, professional and sincere, and must surely be any cross examiners worst nightmare. Depp's team also did a great job of bringing context into the audio, and imo really exposed Amber in a very damaging way. I actually think JD has a shot of winning this.

    I have a feeling that this trial, whether he wins or not, may in fact be Depp's greatest legacy. At the very least, I think it will rescue the legacy of his work as an actor. But this is actually so much bigger. He's managed to connect with the public in spite of the relentless untruthful media narrative against him, and he's lifted the plight of genuine, disbelieved victims of abuse everywhere. Male and female. But in the current climate, especially male. How on earth have we gotten to the place that we don't believe that men can be victims? This just shows how dangerous the mantra 'believe all women' is. How about 'listen to everyone' instead. I'm just so thankful and amazed that the evidence is coming out and justice will be served. Again, regardless of the outcome of this trial. He has already rightfully won in the court of public opinion. I don't know why the pendulum must always swing too far, but I think this may be a key moment in bringing it back to a sane place. Justice for Johnny and everyone.

      I like that. "Listen to everyone." Its not right to just believe someone's accusation. You need to look at the evidence. Victims should not be silenced and should not be automatically disbelieved, but not everyone who accuses is telling the truth. If they are telling the truth, it will come out through the evidence.

    I think the most important thing about Ben King's testimony is that he was not paid by Johnny Depp. In London, where he met Depp he worked for the House they were in. In Australia, he was paid by Disney.

    He was a bit easier to get irritated, that worried me. In redirect he explained a lot, he was very truthful even though I could tell he wanted to sell the truth. I understand why and I don‘t blame him, he wants to be heard and believed. I personally had the feeling at one point at the beginning he almost cried. Honestly the other side sometimes seem to help Johnny. The ending was strong. Ben did a good job and it fits Johnnys story. I understand more and more Johnnys language. They tried to show pics of a red carpet event I believe which is pathetic to me. Her demeanor at the beginning was different than the other days, I thought she sat their almost as if she thought she got JD.

    What stood out to me for Ben King's testimony was that when asked about the photo by Amber's attorney, Ben said that he could show him now if he wanted. It also showed that he was willing to hand over the information if they had just asked, but it was on them for not doing it

      Part of being a professional service (with a governing council or body), is you must await a subpoena before you hand over evidence.
      In our medical practice, we are compelled to advocate for our client and privacy. We cannot simply hand over or volanteer info or documents … they must come via being compelled via court order/subpoena.
      If I recall, King (the house manager), worked at Buckingham Palace … this would definitely have been their approach as well.

    Remembering my parents relationship, they divorced one I was 11, way back in the day, when peeps never divorced. She was the aggressor, her MO was to wait until he had a few, which was usually a Saturday after a football match. The man worked a five and half day week, cycled to work about 3 miles (there). But she never took him on sober - he was one of the most placid men, drunk or sober. Through the eyes of a child and now looking back, had they stayed together she would have killed him. She went on to marry a further two times, was never happy.

      I married a narcissist/borderline and had a child with her. My mother was a horrible abuser emotional and physical. When our son was 2, I realized ‘I will never make you happy.’ Divorcing her gave my son a chance at having a normal life. He is healthy and happy, in his mid 20s now. He knows to watch out for narcissist/borderlines.

      They did go first and lost because they had to reach so far that they tried to pull texts out of context that could easily be explained or didn't seem threatening in the first place. Right now it doesn't matter what the courts do Johnny already won in the public eye. I think from this point on he is only fighting for domestic abuse victims.

    RE the scratches on Amber's arm: In the recording of the Australia aftermath (one can find it on Incredibly Average's channel) we can hear Jerry Judge saying : "I've seen those scratches before on other people, and as far as I'm concerned, they're self-inflicted."

      Also, we saw video on a day where Johnny found out he'd lost $650 million, he'd had a drink and THEN sees Amber's been recording him on her phone. He just storms off amd she's grinning. If he didn't physically accost her on that day... I can't see him ever being physically abusive.

When he tells her to get out, she replies very slowly and clearly "You do not want me to call the cops" He responds: "I will call the cops" She responds: "Good luck. Do it, do it right now. I’m waiting. Go”
      I really hope his team will use this because her tone is so menacing.

    The difference in audio recording length says a lot. Most of Johnny's recordings have been minutes long which gives at least some context. Amber's have been 10-30 seconds where Johnny has finally snapped over something, something we have no clue about.

      I hope this is a point that is brought up in closing arguments. It's an extremely important point to get across to the jury to show that Amber's legal team is having to nitpick moments so tightly because too much context would undermine their argument.

    Thank you so much for your quality Recaps... your channel is the ONLY one I watch for this trial. I'd just like to say that quoting Monty Python is a HUGE thing in Britain, Australia, etc... once we get going, we just go on and on!!! Taken out of context, it could look pretty bad but it's such a typical think to do in our culture and I think it's something that many North Americans don't really understand.

    I feel like that final audio of Depp's testimony is painting 90% of the picture. Her priority was her reputation (even though he's the one who lost his major contracts), and his was to solve the problem out of the public eye. She basically said "this can't be done in silence", so he responded with this trial. She won't let him win with her, or even tie for that matter, on an emotional level; I just hope he can on a judicial level.

    I just found you, and am loving your recaps of the trial! When I heard the texts about “burning her bc she’s a witch”, I was like.. OMG! That’s from Monty python for crying out loud! It’s obviously a joke.. a little tasteless, but movie quotes! People do that all the time w their friends when they are angry during a divorce! I missed how they got those texts.. hopefully, his friend didn’t throw him under the bus by handing them over without that co text at least!

    I feel we should give more credit to Ben King’s testimony as he, for once, reported on witnessing a number of arguments between AH & JD and confirmed that she was the instigator (and a childish instigator, to top it all off).
    In addition, I found his reported conversation with AH on the plane (“have you ever been so angry at someone that you just lost it?”) and his horrified reaction to be very powerful.

      I agree! The bit on the plane was very damning. Amber confirmed, in her mind, these are normal events and behaviors. That chaos like this is an everyday day thing. No Miss Heard, not everyone looses cool to that extent and that frequently. The fact that Ben King described her behavior as childish bc that’s what it is. I’m more likely to believe BK bc he doesn’t gain anything either way from this. He also probably is not willing to favor any bc of the war zone he spent 13 hours cleaning up. I know I’d kind of hate the both of them for that

      That was so telling of Heard’s entire emotional life being dominated by trauma. Borderlines have the rock solid (in their own minds) ethos that, “I’m going to make you pay for what’s been done to me!”

I'm surprised she didn't touch on that as it was pretty damning for amber and her team when he described her instigating fights as a "spoiled teenager" and how she tried to justify the abuse and assault she acted out on Johnny by asking something so stupid as "have you ever been so angry with someone you just lost it on them?"       Edit: I almost forgot she didn't touch on ambers alcohol consumption either! Mr king said that he'd never seen Johnny drinking while he was there and that she drank 2 bottles of wine PER DAY! WHEN SHE WAS BY HERSELF! which was pretty telling because rottenborn kept asking questions trying to justify "but she had up to 7 guests at any given moment for a few weeks right? 2 bottles isn't that much for that many people" and he just simply and respectfully answered "it was 2 bottles when she was alone, when there were people there were many more" 😂
      All this showed was that amber was the one with the drinking habit and issues

I've worked as the chef in these high profile client instances and even tho our butler and manager have a pretty strong sense of client confidentiality, generally speaking, even the butler and the maid would slip up whenever damages to property were just ludicrous. "FFS they shat on the bed" "the sheets are full of piss, we spend more time cleaning piss out of the beds than anything else, what's wrong with rich people!?" Etc.
      I could see that Mr king despite having to clean up after their indiscretions was still uncomfortable breaking that code of confidentiality, which to be honest just made him more believable.

    Love this analysis which highlights key legal arguments and the processes. It is becoming clear that Johny is an abstract and divergent thinker as opposed to AH who has construed his texts literally, hence the conflicts.
    The objection by the opposing attorney was hilarious!

    The conversation at the end of Johnny's redirect is particularly damning. First he accuses her, she denies. He calls her lies and then she blames him for making her do it. Then he uses the finger and the glass being thrown at him in a way that explicitly puts the blame on her. She accepts the blame for those actions. Meaning the jury is likely to also accept she is to blame for those events. Amber has made it a pattern to record their fights as a way to frame Johnny. Johnny has then taken to recording their interaction as a way to protect himself which has led to this bombshell clip (the clip was comprised of both their recordings). Frankly with an admission like that it will be difficult for amber to mount a defense that portrays Johnny as the sole abuser.

    I think it was very powerfull and memorable to leave Johnny's redirect on him saying "I told, yes, I am". Way to end.
    One of the "wtf" moments for me was when on the redirect of King the lawyer asked if Heard Team asked for those pictures. Not only there was an objection (even though on cross exam Heard's lawyer asked EXACTLY the same question) but the answer was "NO" 🤣🤣

      This is what confused me- how the hell would Johnny Depp NOT know about this? He definitely would know about the true story/the book/the film.. He kind of came across as though he hadn’t previously heard about it and I just don’t understand how he wouldn’t have come across it until now.

      I’m assuming you’re not in Hollywood so it’s a bit different, Marilyn Manson who was named in this case was even in that film. It seems really weird that he specifically hasn’t heard of the case, book, or film. Michael Alig died recently so it was in the news again and Johnny Depp seems really into alternative scenes. I would be so surprised if he genuinely hadn’t heard about it.

      Tbf I think plenty of actors have no clue about what’s beyond their scripts. I remember seeing somewhere A listers being asked about what movies they never saw and the answers were all quite shocking, like Star Wars, gone with the wind, sound of music, etc. Rachel McAdams doesn’t even own a tv 😝
      And obviously not comparable but it was even more shocking in film school what no one knew about (my nerdiest classmate asked what after all was Titanic lmao), so I wouldn’t be surprised, especially for an actor that hardly even watches his own movies.

    The cross of Ben King reminds me of myself in high school mock trial lol! Honestly, my opinion of this trial is evolving a lot during the trial. I definitely still believe there was reciprocal abuse going on, but it definitely looks like Johnny is increasingly likely to win this case. The audios just get more and more disturbing every day...I'm starting to feel really gross about listening to them. The latest one where Amber is panicking and talking about her credibility reminds me a lot of how I used to sound when I would try to strike back against bullies in high school and then get in trouble. I'm NOT trying to say that I think Amber is in the right by any means--clearly in this audio Johnny is trying so hard to defuse the situation with dignity and grace--but I honestly see where she's coming from. She felt like she had to "get ahead" of the story because Johnny's legal team was going to take the offensive against her and she was SCARED, he's powerful, rich, famous, etc. Obviously he never meant to make her feel that way, and was trying to say he would talk to his team, that wasn't what he was trying to do, etc. That audio does look bad for her legal case, but on a personal level it just makes me sad for her. Johnny was being so kind to her and offering them both a much better way out of this whole mess and she just couldn't see her way through that path. Its just sad.

    0:13 I haven't watched the whole video yet, but I want to immediately make this correction. (Edit: you restated the same thing again later in the video at 13:52) You say that Ben King was Johnny Depp's house manager and personal assistant, but he stated in court on trial day 8 that he was employed by Disney's production company Hershey, not Mr. Depp, and that his job was to take care of the daily housekeeping needs of both Mr. Depp and Ms. Heard. This is, in my opinion, an important distinction since it shows that Ben King has no monetary bias toward either party while testifying during this trial.

    I was so happy the redirect on JD gave some context to those micro clips AH's team played. I only really started paying attention to this case when I came across your live broadcast on day 3. I wasn't expecting that last audio she played, I knew there was a clip of her saying that but had never heard it, it even made me gasp. Has to be one of the best mic drop moments in a court case ever. I did love Ben too, you could tell he was nervous. It's in their job description to keep everything private so to have to sit in front of a worlwide audience and tell secrets was obviously uncomfortable for him.

    Edit: Johnny was shaken because he's hurt deep inside and was controlling himself not to burst into tears. The only strength he has in this case is that fans are with him which keeps him fighting.

      And that he his telling the truth. Telling the truth gives a person strength. Conversely, there is a reason that Heard falls apart emotionally while on the stand (as seen in deposition videos).

    Omg almost 100k!!! Let’s go!!!
    Day 8 was so emotional in the audio bits of the re-direct… for me, it was specially painful when Johnny explained why he wanted Amber to cut him. That she took everything from him and he only had his blood left, so she should just go ahead and take it. It was dramatic, but you could feel the pain. It was such a lowly move for AH’s team to use it, specially since it did her side no favors.
    And as for “positives”, I really liked the butler Chad. He had the manners of a British gentleman and his responses were on point and sometimes I don’t know if unintentionally funny or if it was intentional. And then the defense objecting their own question lol!

      Heard pushed Depp to a psychotic episode. What we heard was dissociation. She harangues, harasses, lies, mocks, intimidates, assaults Depp. And then when he reacts, she denigrates and humiliates him for reacting. This is what malignant narcissism looks like.

    I was shocked by all the damage the Mr. King described in the residence, even marble was damaged in two places, across the room from each other! This wasn't just a little tiff from Amber. It was all out assault. It was the only part I was able to watch live yesterday, his testimony. Also, he was very handsome and charming, so not to miss! I'd watch him read a phone book!
