    Computer Forensics can most often revcover the contents of anything that has been deleted. That said, I can see that computers may have been used without criminal intent before realizing that they should be left alone and turned over to legal counsel.
    Unless it can be proven that something was intentionally deleted that was incriminating, I think a tampering charge would be on shaky ground.

      If you recall this case was dismissed entirely as Courtney claimed self defence, she went on vacation.
      Then the autopsy showed her story of self defence by nunchucking the knife across the room was impossible due to the angle of entry showing a distinct downward motion.

      Good questions! I personally don’t understand why they needed to access the laptop in the first place if not for nefarious reasons. They both clearly knew it was Christian’s when she gave her dad the password. What were they looking for? This is the same father who hid Courtney’s money for her (came out in the pretrial) and the same family that didn’t even contact Christian’s family about his death. The reason the police didn't impound his laptop is because they let Clemmy walk and did NO investigating at ALL. They didn't just let her walk, they didn't just let her leave the state, they let her get on a plane to Hawaii. And then stay there.
    It was ONLY because Mr Obumseli's mother fought and fought and fought, even while she was devastated by her loss, that any attention was given to the case.
    And the attention was paid to it ONLY because the DA finally twigged that Clemmy was a "media personality" and she, the DA, could get a bunch of publicity from the case. So she, rather illegally, turned every court date into a press conference for herself. She wanted to be on TV as much as she could.
    If this case it lost, it'll be because the police were corrupt. lazy, racists. The circumstances are so similar to that of the Ahmaud Arbery murder. The police did zero. The mother had to fight for any attention.

    • @LegalBytesMedia
      @LegalBytesMedia  Před 2 měsíci +1

      I do agree that it's a tragedy that the police didn't investigate the case as thoroughly as they should have in the beginning. That said, from what I've seen of the evidence (from what's been leaked, what's in the arresting docs, and what came out in her bail hearing) I think this is a very strong one for the prosecution.

    • @greenman6141
      @greenman6141 Před 2 měsíci

      @@LegalBytesMedia You are bound to know more about it than I. I do really hope that the prosecution have pulled their case together. It would be shameful for this young man's death to be allowed to slide by.
      I see far far too many women trying to piggy back their abuse of men, and even murder of men, onto the real despair and plight of women who have been abused, and who have been caught in terrifying situations of violence.
      Be they Amber Heard, Jodi Arias, or Monica Kay. Doing this undercuts the decades of effort it has taken to get domestic violence against women taken seriously. And I do not mean that DV against men is any less serious. Not at all, though it is much less pervasive. The position of men is so tricky, because even defending themselves can be turned into a claim of an attack.
      This case involves so many issues that devil our society - from gender issues of DV, publicity, social media, pornography, drug abuse, race matters, & police bias or incompetence.
      One hopes that the really important part, the murder of a young man, does not get lost in all that noise.

      I don't begrudge any parents for wanting to defend their kid, on either side of this ledger. That said, when those actions cross ethical and/or legal lines, that's where we have problems. Also, it might not be known to most that initially the police apparently took Clenney's word for what happened during the encounter (namely, that she defended herself while being abused by him) and didn't investigate further. It wasn't until Obumseli's family kept haranguing Miami PD about it (for months and months) that they looked further and realized this was a wholly different kind of case. If not for his family continuing to fight on his behalf, we wouldn't be talking about this case.

    Come on now. She'll be proven innocent. She's a woman and even being toxic and violent doesn't change that. All she needs to do is suggest she's the victim, and she'll be given a fine. Murdering a black man while being a white woman isn't a crime. Even with the videos of her being violent, women are always the victim and men are always the threat so she must have been scared of him. Innocent by the fact she's a poor, abused, strong woman who is a survivor. A survivor Ms Heard

    As men we are in this situation often. We do what we reasonably can to calm a woman like this down which isn't easy because we need to be careful with using any kind of force, if we so much as hold her to tight we can leave bruises and that can be used against us.
    The fact that she went on to butcher this guy is so disturbing, seeing that blood trail I want to believe it was just him walking and not trying to get away while she was chasing him and stabbing him.

    I wonder what they mean exactly by "Crypto Exchange". I do most of my financial transactions on a dedicated machine. It's not popular but not unheard-of. Still fishy af.
