  • MLB pitcher Trevor Bauer lost everything amid MeToo allegations beginning in 2022. Now, one of his accusers, Darcy Adanna Esemonu, has been indicted for felony charges of fraudulent activity taken against Trevor Bauer and another man for her MeToo claims. In this video, we go over why... she might just be screwed.

    CONTEXT:
    MLB pitcher Trevor Bauer was accused of MeToo allegations by four women. The first to go public with these accusations was Lindsey Hill. The second was Darcy Adanna Esemonu. The two remaining women remain anonymous and have not filed any civil actions or criminal allegations against Bauer. As a result of these allegations, Bauer was let go from the Los Angeles Dodgers despite being a top performer in the league, and he was forced to play in Japan (and then Mexico) rather than the major leagues. He has been trying to get back to the MLB ever since.

    Women like these with false accusations about DV take away the opportunities for other women who have suffered domestic violence to be taken seriously or raise doubts about them and their credibility. Falsely accusing someone and damaging their reputation for evil or financial gain deserves to be penalized, whether it's a man or a woman.

    The thing about Bauer is that regardless of what happens in court, he literally cannot be made whole for his losses. Professional athletes (and MLB pitchers in particular) have a very limited shelf life, and even if he's reinstated, he's permanently lost out on his prime earning years. That doesn't even get to intangibles, such as career legacy and hall of fame voting. Regardless of his subsequent wins in the courts and in public opinion, he's already lost, and lost badly.

    • @LegalBytesMedia
      @LegalBytesMedia  Před 22 dny +18

      Yes! This is something that doesn’t get talked about nearly enough, and why his case would be even more damaging than other false claim cases. You can only play baseball for so long, and he was taken out of the league while in his prime. Those are years he can’t get back even if reinstated now.

    • @LegalBytesMedia
      @LegalBytesMedia  Před 22 dny +10

      And when I say “reinstated,” I recognize that the MLB as an organization isn’t necessarily preventing him from playing at this point. Bauer’s problem is no team will sign him currently.

I feel that it is very dangerous for people to make these allegations. It makes it harder for other people to be believed. It makes it harder for other honest people to feel comfortable to come forward with their stories for fear of being dragged thru the mud in the media. It also is so damaging for the people being falsely accused. People lose their careers, families, futures, and reputations unjustly. I think there should be consequences only after a person is determined to be guilty by a jury or a court of law. Not when the media or internet decides they are.

      The false accusations by themselves are not crimes.

    When Hill brought the claim against Bauer, the cops and prosecutors decided that they wouldn't proceed against him. Then MLB did their own "investigation" and decided he violated their domestic violence policies and suspended him... but all forms of domestic violence are CRIMES... so Baseball was in essence accusing Bauer of committing a CRIME. MLB is the baseball business and cops & prosecutors are in the crime investigation business. If the cops & prosecutors say there was no CRIME, then (in my opinion) MLB should not have suspended Bauer. I think MLB threw Bauer under the bus for public relations appearances showing that they are TOUGH on domestic violence, and allegations alone are sufficient. Bauer should, perhaps date only women who he could bring home to meet mom... instead of these lady "sharks."

    • @SEAZNDragon
      @SEAZNDragon Před 20 dny +1

      From the MLB's policy: "Domestic violence is a pattern of abusive behavior in any intimate relationship that is used by one partner to gain or maintain power and control over another intimate partner... Domestic violence includes, but is not limited to, physical or sexual violence, emotional and/or psychological intimidation, verbal violence, stalking, economic control, harassment, physical intimidation, or injury. Notwithstanding this definition, a single incident of abusive behavior in any intimate relationship, or a single incident of abusive behavior involving a female member of a Player’s family who is domiciled with him, may subject a Player to discipline under this Policy."
      Remember the police and prosecutors go of their respective state's penal code and rules of evidence. However, there are different types of domestic violence that doesn't leave marks or involved threats. For example, keeping control of the finances to the point the partner doesn't haven't any of their own money. No helping Bauer is as soon as one case was dealt with another popped up with the most recent accusation in the fall of 2023. So even if the MLB wanted him back they still have to go through the motions of suspensions and investigation.

    • @LegalBytesMedia
      @LegalBytesMedia  Před 2 dny +1

      Absolutely. This is a case where she has put these records directly at issue by making these allegations and then by suing him. Any time a plaintiff claims some kind of harms to themself either physically or mentally/emotionally, the defense is always going to be entitled to medical records that would either prove or disprove those claims. It's because the plaintiff is the one who chose to bring this all into court, and to drag the defendant there with them. A plaintiff cannot do that, and then hide behind HIPAA to claim privacy of their medical records.

    Cases like this really bother me. My brother in law just went through this. It took 3 years and $70k that his family did not have to fight it. The judge agreed that the only reason the woman reported it as **** was because she was still living with her ex husband and there were texts forcing her to report. It has caused irreparable and continuous damage to him and his family. And nothing happened/or will happen to her. I have personally known 4 woman who have lied about this type of thing. Either to get out of trouble/escape consequences, or revenge. Add a money motive, I can only imagine how much worse. Glad to see people are being held accountable. False claims make it so much harder for real victims because of nasty, greedy, and vindictive people.

    A doctor would never destroy medical records. Those are medical-legal documents that must be maintained nor would a doctor destroy them for their own protection. The only reason she couldn’t produce them right away is if the medical provider uses paper documentation (unlikely for newer records) and she needed to request them for the warehouse. Which would require someone physically finding the documents, having the documents copied, and subsequently mailed to her.

    As a woman, I understand the impetus to tell him to “start thinking with his big head” as someone else in these comments, but I personally don’t think that has any place in this story. The accused can only keep their privacy as they disappear out of the limelight that paints them as a predator forever.
    If there is no way to ever punish false accusers, then it is definitely a profitable business. The other 2 accusers of the 4 accusers outside of Lindsay Hill were requested to be a part of this 2nd woman's claim and they refused. They don't want to be caught lying.
    We need some stronger laws on these false accusers.

  • @iamthecoffeewhisperer6268

    I think men should be very careful about what women they get into a sexual relationship with. There are plenty of women who will lie and make false allegations to try and get money from them. Women who file false charges should face consequences and serve jail time for ruining a mans reputation especially if it hurts or ruins his career.
