FLORIDA? supreme court? THE USA SUPREME COURT DOES NOT AGREE!
THEY HAVE RULED PASSENGERS WHO ARE NOT SUSPECTED OF A CRIME ARE NOT REQUIRED TO ID AND ARE NOT ABLE TO BE DETAINED!
This is why other videos show cops saying the passenger is not detained and the person can leave if they want!

The relevant supreme court case is Maryland vs. Wilson, 1997. The passengers are also detained during a traffic stop. Suspicion of a crime is not required. The officer can maybe release them before the stop ends if that makes sense in the situation, but he has no obligation to. And since they are detained, they can be ordered out of the car, ordered to stay inside the car, or identified by the officer if he deems that necessary, among other things.

WOW - HAVE YOU EVEN READ A PARAGRAPH SUMMARY OF THIS CASE? (apparently NOT!)
In your expert opinion which doesnt understand how this is completely different and has nothing to do with demanding passengers ID! 🤦‍♂️
EXPLAIN WHAT THAT CASE WAS ABOUT!
      HOW IT COVERS THIS CASE!
Also if you read the case he refs in the 2017 quoted by balion
It has nothing to do with this!
The guy supplied his name willing!
GO READ THE CASE! (second thoughts waste of time after you comment on wilson!)
It even states (IN REF TO OTHER CASES)
That police can not detain people for no reason! THEY NEED REASONABLE SUSPISION!
Being near a driver is not one!
Clearly like you balion can read and understand simple things
EG TELLING A PERSON TO GET OUT THE CAR IS NOT DEMANDING THEY ID! 🤦‍♂️🤣

Did van balion even read Presley Vs Florida? 🤦‍♂️
PRESLEY GAVE HIS NAME AND DATE OF BIRTH WILLINGLY!
THIS CASE HAS NOTHING TO DO WITH A PERSON REFUSING TO GIVE THEIR NAME AND ADDRESS!
HERE IS WHAT THE FLORIDA COURT SAID!
In Wilson v. State, the Fourth District Court of Appeal held:[A] police officer conducting a lawful traffic stop may not, as a matter of course, order a passenger who has left the stopped vehicle to return to and remain in the vehicle until completion of the stop. The officer must have an articulable founded suspicion of criminal activity or a reasonable belief that the passenger poses a threat to the safety of the officer, himself, or others before ordering the passenger to return to andremain in the vehicle.
734 So. 2d at 1113. The Fourth District determined that:[A] command preventing an innocent passenger from leaving the scene of a traffic stop to continue on his independent way is a greater intrusion upon personal liberty than anorder simply directing a passenger out of the vehicle. Such an arbitrary interference with the
-5 -freedom of movement of one who is not suspected of any illegal activity whatsoever cannot be classified as a de minimisintrusion
So the passengers are not detained!

@@danquaylesitsspeltpotatoe8307 Obviously you did not read it.
If you actually *read* the cases you are citing, you may have noticed a few things showing that YOU ARE WRONG.
1.) _Presley Vs Florida_ specifically says that _"Law enforcement officers may _*_detain the passengers of a vehicle_*_ for the reasonable duration of a traffic stop without violating the Fourth Amendment."_
AND I QUOTE - _"hold that law enforcement officers may, as a matter of course, detain the passengers of a vehicle for the reasonable duration of a traffic stop without violating the Fourth Amendment."_
      law.justia.com/cases/florida/supreme-court/2017/sc16-2089.html
2.) You would also see that it is ridiculous for you to say _Wilson v. State_ says they cannot be detained since _Presley_ specifically states that IT OVERTURNS _Wilson v. State_
AND I QUOTE (literally from the first page of the decision) - _"The district court certified that its decision _*_is in direct conflict with the decision of the Fourth District Court of Appeal in Wilson v. State._*_ We have jurisdiction."_
      law.justia.com/cases/florida/supreme-court/2017/sc16-2089.html
      *So the passengers ARE detained!*
      So - to sum up:
      - You quoted a 20+ year old precedent that was overturned in 2017 while claiming the new precedent was irrelevant.
      - You claimed "passengers are not detained" which is in direct conflict with the 2017 precedent.
      - You claimed Van Balion _"NEEDS TO READ THE WHOLE THING IF HE CAN UNDERSATND IT!"_ while proving you obviously did not read it (or could not understand it) because the case *literally states* that passengers may be detained and specifically states it overturns _Wilson_ ON THE FIRST PAGE.
YOU NEED TO STOP LECTURING OTHERS AND TRYING TO APPEAR LIKE YOU ARE AN AUTHORITY WHEN YOU OBVIOUSLY HAVE NOT READ AND/OR UNDERSTOOD THE COURT CASES YOU ARE QUOTING.
      Anything else?

He told me I was doing 80 and passing him and asked what the hurry was. Gave him my ID and explained the situation. Afterwards we had a nice brief convo because I told him I was going for the vet med field and how he was a K9 handler and gave me a warning.

The first mistake most of these officers make is to give them their name and badge number. Their answer should be, "as soon as you give me the information I need I will give you the info you need. Now give me your license, registration and insurance NOW". if they refuse, or interuppt you, it is over, you get pulled out of the car and thrown on the ground and cuffed and jailed.

You know, I recently had a similar issue--I had changed insurance, had a lapse, hadn't realized it, and was pulled over for a suspended registration that I hadn't seen the notice of. But I was up front with the cop, did everything he asked me to, and he gave me a ticket. I was on my way in 10 minutes. I paid the $10 fine online for having a day of lapsed insurance, and the whole thing was dismissed in online court with no court fines, the ticket disappeared, and everything cleared up with no fuss.
    Easy as could be.

Exactly. In our state we used to have to have an inspection sticker on the windshield. I was stopped at a check point and the sticker was out. We had just bought the car and didn't realize it. The cop was nice, said he saw it was anew car, just get it inspected, take the ticket to court with proof and they would tear up the ticket. I did it,no ticket and all went well. That's how you do things!

I had a similar experience. In NSW Australia any unpaid fines go to state debt recovery and they can put a suspension on licences and registration, making it an offence to drive. I got pulled over because of highway patrol getting a hit on their licence plate recognition. I had paid it but there was a clerical error so it showed up as me being on a cancelled licence. Same thing, I was totally unaware as I had paid it in good faith and told it was all sorted. I spoke to the cop politely and explained the situation. He even allowed me to call the SDRO then and there to sort it out and prove it was a clerical error. Because I was polite and compliant he let me do that even though he wasn’t obligated to do so. It’s far better to not give the cop a hard time as they will always win.

In California, all road and bridge tolls are collected either by reading a regular user discount card (debit system) or reading the license plate and sending you a toll bill(s) via snail mail. They are also used for red light runner detection.
