His biggest mistake was confronting the security guards, before reporting the assault to the police. Sometimes all that matters is who called the cops first.
💯
He wouldn't have gotten the trespass either and the security would have been liable
He went about EVERYTHING wrong that day... lolololololol
but that's what a rational person would do. he clearly wanted confrontation with everyone.
@@leeclemens879 If you've ever been unjustifiably prepper sprayed (assaulted), not to mention damage to your personal property in the process, you would likely understand that the ability to be rational is severely diminished. I sincerely doubt you would be whistling Zip a Dee Doo Dah if this had happened to you.
So it was his mistake someone filed a false police report against him?
Sounds like it was someone else's mistake for committing a crime while trying to cover up another crime
These security guards look exactly how you would expect them to look.

The problem with authority without accountability.
@@datorres67 I don't think that's what the original comment is saying lol
Yup. Retired, out-of-shape ex-cop with a lack of current understanding of the law.
We had a security guard at my old job that had to be about 400 pounds. A coworker was robbed at gunpoint in the parking lot early one morning, and not only did it take him several minutes to get outside to help her, but he called his security company instead of 911 because he didn't know how to handle the situation. Whenever I see videos of officers like this one who couldn't control any situation without getting out of breath, I always remember that incident.
Whether he was in the right or not, this guy didn’t do himself any favors by flipping out.
Yeah, I think B- was a bit generous.
I would have given him a D+, the cops a D-, and the security guards an F.
Have you ever been pepper sprayed???? Flipping out is pretty standard after that

Really. A jury is made of people and they will not like him at all.

I work for PSC James Garfield was fired, so was the other officer on duty for lying to his superior.
James acted like a cross between former LEO - wannabe cop - nothing guy (laughably) trying to convert a mall cop badge into respect and a license to bully/assault (not gonna happen). He should have tried to file changes and filed a suit against the mall/James.
The other guard mimicked the actions a LEO takes when he throws up the blue wall to protect another LEO - he looked like he knew the other guard went over the line, but is going to protect him anyway. He should have lost his job just for being stupid enough to do this.
I would strongly suggest publically discussing this stuff on the internet can end your job.

@@kiddalingur yeah taking a few deep breaths would have changed his entire universe
Screaming at the police as soon as the car door opened is the wrong way to start off. He thinks he’s above the law just like the stupid security guards do.
Yeah, providing an account of the situation before the cops got there likely would've set a better tone for the encounter. I can agree with the cops grade, but I think 'auditor' should've had a matching grade for his demeanor, incorrect citing of detention v arrest, when a detention is justified, and failure to know his state's LEO identification policy
I appreciate how this channel seemingly objectively will call out both auditors and LEOs for misunderstanding/violating the law. thanks!
however this guy wasn't an auditor, hence why he got more things wrong than you'd hope an auditor would. Literally just a photography / journalism guy, not an auditor 'doing journalism', although I realise this would be hard to realise. I only figured it out because ATA mentioned he is not an auditor, before then I was unsure if the victim's statement was true when he said that he was studying fine arts (presumably photography). I thought this might have been the usual 'auditor journalism' response but he might just be using journalism as an easier term to use in regards to his photography than fine art. Maybe his course falls under the 'fine art photography' name but he is in fact doing it for an in-roads into journalist photography.
Once they took his weapon away, their reason for holding him in cuffs *that they stated* was no longer valid...

Private Security is not a Public Servant.
In the state of Texas they are. The law states we are acting as public servants and an assault on a public servant is committed when you assault a security officer. Many places play fast and lose with the laws and it makes it difficult for those of us trying to hold to a higher standard.
Public servants are not public servants either.
@@theb.s.d.4707 That's interesting. I assumed the same as OP but I looked this up after your comment and read more about it. Pretty weird how they handle it in Texas, imo - it seems like private security is also restricted a lot even though they're called officers. Lots of downside risk there.

The security guard looking like security, but doing the right thing is another thing.
The cop leaping out and being aggressive is a direct reaction to the security guard calling up and saying that he has weapons. That immediately puts the situation into something it shouldn’t be. The people who called need to be fined for that because that’s the only way to try to show people they can’t just say what they want to 911.
It never ceases to amaze me how people can so boldly and confidently state something they are so very wrong about, yes cops can cuff you while you are detained.

People like this are the problem. The cops never once got hostile with this guy and as soon as they got there he started to get all hot at them. And then he uses their reaction to his anger to justify that anger
The cops yelled at him the second they arrived. Did we watch the same video?
They were called for a disturbance and the cop got out of his car immediately demanding compliance from the victim. No investigation, not one question, nothing. Just immediately assumed because the security guys called the man with the camera must be at fault.
@jeffcuzzort4399 they were called for a disturbance with a guy with weapons, and the caller implied that he may have been attempting to use them. The cops had no way to know the caller was exaggerating. The cop acted appropriately and the guy refused to calm down long enough to explain what had happened
@@mikecrain2076 The cop was aggressive from the time he got out of the car. The proper way for the cop to act when he arrived is to introduce himself and let the guy know that a call came in that he had a weapon and once he secured the weapon then start an investigation. Now if the guy then got aggressive and refused a weapons search, then that would’ve been an appropriate response by the cop.
@mikedougherty2243 that's just not true. The caller implied that he attempted to use the weapon. At that point tge cop has to treat him as a suspect with a deadly weapon. And the first interaction is the suspect walking up to him in an aggressive manner and yelling at him.

That being said without the beginning of the encounter I cannot say what if any actions the security officers were appropriate or not. But on video, I didn't see them do anything inappropriate. As for Mr. Stone, I don't know what happened in the beginning but judging by his action on film I am guessing he intervene on behalf of the boy on the bicycle basically sticking his nose in something not his business. His lack of understanding of police procedures and laws rubs me the wrong way and his antagonistic tone towards the officers made things harder than it had to be. The officers were professional and show patience with Mr. Stone. And yes they kept him in handcuffs throughout the encounter for good reason. He was armed and they had a call he was causing a disturbance. He was legally detain and there is no time limit on how long handcuffs can stay on someone. It is based on reasonableness. Even though you fought the police officers in a sense. You cannot because sometimes even when they try to disescalate things. People are rational like this guy was loud and irrational. It's hard to calm down a person like this.
I'll say this once: "unlawful search AND SEIZURE".
The semantics of "arrest" or "seizure" doesn't matter when both would be unlawful as there is no reason to deprive this man of his property.
"Freedom does not end where your fear begins"
Logically handcuffing someone does mean "arrest". No matter time was/were put on the detained individual.
The definition of arrest contains the verbiage “take into custody”. He was never transported nor booked. So never arrested.
ATA you contridicted yourself! Claiming that he's being held too long, then moments later stating that they have the right to keep him in cuffs do to hear-say!!
Besides there's a differance between having enough to run an investigation & having RAS for handcuffs!
B- is too generous for Stone.
He was D level at best, a true Karen. It is telling that he did not share a recording of him being pepper sprayed.
@@mbryson2899 Exactly! He knows he didn't look good in that video or he would have showed it.
Clearly the hothead gets an F. So does this channel for being bias. We all know that the "journalist" or was he a photographer that day, rushed up on that security guy like a rabid dog and got sprayed. He then tried to give us a completely different narrative. He was so pissed and probably pissed off at the world, that he went back for some more pepper spray, this time he wanted to get on camera in his favor. Mr. Stone is fooling nobody. He needs to go see someone about his problem. It would be better and his first step towards recovery if he gives us the real story, then goes and apologizes to the mall security.
Every auditor talking point, so yeah, he had the camera going.
okay, lets see how you act after you get pepper sprayed in the face by an obese security guard
Are security guards even allowed to go hands-on like spraying pepper spray??? Thought they were just glorified safety patrols.
Only in defense (of self or other) I would assume. The same right you have.
Depends on a few different factors, but sometimes yes.
Anyone is allowed to defend themselves if they fear for their life and safety. Without the altercation being on video we have no idea what led up to the pepper spray.
The way this guy was acting, carrying a knife openly, I feel it's possible he was presenting as a danger to the guard.
It's just not possible to know without further evidence.
It depends on the state. In Arizona, we can.
Why do you think they would they be carrying it (or a gun) if they aren't allowed to use it?
The guy stating he's under arrest because his wrists are literally arrested by cuffs is some damn hillbilly lawyer logic, and I'm here for it!
Security guard is supposed to be charged and arrested for the pepper spraying. Clean cut assault charges.
Yeah, was there video evidence of that encounter? I wonder why that didn’t make this video. Maybe he got up in the security guards face like he did the cops when they first got on one scene
People love to run their mouth without knowing half the information.
@@fuzz6938 I’m going based off the video. Unless you show me the complete video. I’ll stand with my statement
@coocoo5756 well then you're a smooth brain because you don't have the whole encounter to make that determination
Security should control their nerves ,and not make the wrong decision.
If I had vision problems. Pointing to your name will Not Work ...... I love your site. Tim.
How does infringing on a citizen's rights give the police officers a passing grade? Any unconstitutional act is an automatic F.
If you’re the victim, you have to identify yourself reason why if they don’t have a victim they don’t got a case
No law requires victim to identify in Texas.
@@Don-mi6zl You don't need a law to know that if there is no record of you being victimized, then it never happened. I mean really, how stupid do you have to be to think you're gonna pursue something in court when the court has no idea who you are? You gotta be really stupid to not understand that.
@@Don-mi6zl If you want there to be a case yes you do. Having an anonymous victim is a violation of a defendant's right to face their accuser.
@@Extem1 Not at all. Those like yourself have been caught yea s later with recordings of children they molested that can't be tracked down and are still prosecuted despite the victims not being identified. The security video is more than enough to convict the fat slug security guard. If his defense wants to track down his victim and out them on the stand to ensure his conviction they can but the police cannot force the victim to identify.
If the victim wants to file charges then yes if not then they don't
the first officer got out & literally starting yelling don’t resist & never once told dude he was being detained or anything so a person isn’t resisting if they were never told they were being cuffed or detained
Did you even bother to watch the video before posting this fucking horseshit? Officer got out and stood there calmly for a full 3 seconds while this guy approached him screaming while brandishing a concealed knife that they knew about on the 911 call before deciding to detain him.
What the fuck do you want the officers to do? Wait until some crazy lunatic they've never met before literally stabbed him? What the fuck is wrong with you. Officer came in LITERALLY as patient as he could have possibly been. The crazy cameraman did this to himself.
Facts, the guy was combative. And you want the police officer to become? How's the police officer continually? And the police officers keep telling them to calm down. This is a matter how madua show the police officers. Some respect when you talk remember, they don't know what's going on. They're gone by what they were called to answer fault. So the guy who called even though he knows his rights, he was arrogant and pretty loud and ridiculous.
Pepper sprayed guy should get an F for turning an easy lawsuit into much more.
Unless you’re yelling for help, it’s probably not a good idea to scream at an officer.
😂 lick them boots while your at it.
Never ask an officer gor help lol
@@Super-cb3icwish the dislike counter was visible
@@Super-cb3ic have you tried not being a piece of shit?
Isn’t that the guy that drives around at night time in Texas spotlight to the cops? These guys are losers. No life whatsoever
He's not an auditor so your comment is completely irrelevent in this guy's case.
They LOST it
This video is the perfect example why you should remain calm. His demanding attitude, although probably justified made the situation a lot worse than it was.
With the erratic behaviour of this guy I'm not entirely convinced he deserved the pepper spray to begin with. Sounds and acts like someone who acts stupid and entitled and got pepper sprayed because of it.
As the pepper sprayed victim is the complainant asking for medical help and not the mall cops he should never have been "detained" or "cuffed" and had his property illegally seized as per the mall cops "he didn't use those on us." Because it was all on camera.
Based on the report he was wielding a pointy weapon ergo scissors with a pointy edge detaining him and putting him down was for sure prudent
The cops were called for an alleged aggressive person armed with a weapon and who was willing to use it. When they arrived a man approached them who was clearly agitated and refused to listen to them when they requested him to stop and turn around. In that situation it's totally reasonable to stop and retain that person until you can figure out what's going on. It was the guy's own demeanour that got himself into that situation.
There are a lot of cops there! The security guards never denied pepper spraying him either, so he was a victim of a crime. I don’t even know what crime they alleged he committed.
Depends how he engaged the first time. For example if he was using the same demeanor when he approached the other interaction and kept crowding in, then it would be completely understandable for him to get pepper sprite of that point.
"Observe and Report" there's a really good reason it's not, "Observe, Report, Pepper Stray, and Handcuff". It's because a security guard is not a police officer.
Turns out the cops are not much more informed. I'd be embarrassed if these idiots worked in my community.
This guy needed detained. Probably also a psychological evaluation
Some of these security guards too quickl to act.they should be arrested .
Both security guards need to be fired and their certifications revoked. The cops need to be reprimanded and re-trained.
I absolutely LOVE the audit vids with Security Gaurds ❤
The handcuffs don't automatically in and of themselves transform a detention into an arrest. But it's a very significant factor, and coupled with the fact that he was also searched and had some of his property seized it's clear that in this case this was clearly a custodial arrest.
I don't give two shyts what the convoluted law of man says. If you are handcuffed, you are under arrest. PERIOD.
Exactly if you take away my freedom of movement then I’m under arrested movement which means I can not control my actions of my free will. Simple if the cuffs come out and it’s non consensual it’s an arrest

Really?
He used "minimal force" to detain him?
He was aggressive and confrontational from the onset and immediately used force to restrain a citizen before gathering even the most basic facts or giving any time to comply with his orders, and never had a reasonable fear for his safety in order to justify the restraint.
AtA already earned an F less than halfway into the video.
AtA appears to be getting more and more comfortable licking the boot over time...
And he completely earned that F by continuing to justify the unconstitutional restraint until the very end.
He came agressivelyat the officer and had weapons. The office had every right to detain him for his own safety. If the guy was calm and cool then he wouldn't be in cuffs.
@@seeya205
No, he didn't.
He was, at most, agitated when he approached the officer, not aggressive.
The possession of weapons is not, in and of itself reasonably frightening, and they could have simply disarmed him without restraining him, which could have easily been voluntarily achieved had he approached the situation calmly and rationally instead of fearfully and aggressively.
Also, the guy approached the officer obviously filming, which is not characteristic of people about to commit a violent crime, further weakening the constitutionally required fear for safety necessary to justify the physical restraints placed on a private citizen.
How's that bootleather taste, @seeya205?
@@phukyerpheefeesalso he states himself the skizors were on his backpack. Simple ,”take off your backpack friend” and he woulda had no problem, the. A “hand me the pepper spray I’m checking if I can see any signs of recent use dripping fluid warm to the touch because it was held, and in the video the security has the pepperspray in his hand most of the time.
That was an extraordinarily generous grade for Mr. Stone.
As a German I am not familiar with US laws, why are US citizens so strikt on refusing on giving their name to police officers, claiming they don’t have to as they didn’t commit crime. Wouldn’t giving the name make the whole process easier anf quicker?
The officers admitted that RAS was dispelled, and he should have immediately been released from handcuffs.
