  • The plaintiff hired the defendant to photograph and make a video for her daughter’s Sweet 16 party, but he missed the father-daughter dance, entrance, and crown change, so the plaintiff is suing. The defendant admits he lost one of the memory cards and is sorry. The defendant says he offered a partial refund, but he does not believe he owes a full one.

      but the verdict turned out to be unfair because she only paid the defendant 900 but he was ordered to pay 1200 . i think the judge accidentally forgot that the plaintiff only paid 900 because i have seen her in other cases only order a litigant to pay another litigant the exact amount they were out .

      I disagree with the judge, she should have awarded the plaintiff the $1500 that she was suing for. The plaintiff provided enough proof to at least get $1500 based on the estimates that were given to her.

      I'm a little confused. Because he offered her half which was $1,500. So she actually would have gotten more than what the judge offered her if she had taken his other.

      ​@@talltallladyI can see why you are confused... His initial services only cost her $900. His final offer was to pay her back half of that which was $450 but she wanted her $900 back. Since he did not give her a full refund she brought the case to court suing for $3000 (the cost of recreating/faking the event to get the footage he lost along with filming and editing it). In the end the judge only considered the cost of the new videographer (her estimates said $1500) and she was awarded $1200. So in the end he had to give her a full refund pluss an additional $300. (The new $1500 estimate was much higher than his initial 900 because of the additional editing work required to merge the new faked footage onto the 11 mins existing footage that he gave her)

    That party was at least 2-3 hours, and he gave her a 13 minutes video. Let THAT sink in! Sounds like most of the event was on that SD card. It doesn't matter how you feel about the Plaintiff's plans to recreate, he fell way short on his professional obligation. Also, daddy daughter dances are very important, specifically to those of us who have relationships with our fathers. That's a moment she may never have again, wether it's recreated or not.

      I'm a quinceaenra sweet 16 videographer and delivering a short extended highlight is the norm. In my packages I deliver either 10, 15, 25min of extended highlight. If the client chooses to have full length video then it's an extra charge. Half of my clients choose the 25min extended highlight video only. The other half pay for the traditional full length video as well.

    I do think the mom needs to keep some perspective as far as how much she allows this to take away from the memories. In the past, we didn’t have as many things memorialized so perfectly , yet we have also led rich lives with important memories.

      The moms point is valid that the memory fades and she wants a video to be able to look back at the videos she paid for.

      But this isn't the past..the plaintiff and her daughter live in a time where it's pretty standard practice to memorialize special events and due to the defendants negligence that's something they will never have. She may also lead a rich life but wants the memorialization that she paid for.

    I like that the plaintiff didn’t bring her daughter. I don’t think it’s healthy for the kids to be involved or in the courtroom unless they have useful testimony. I’ve seen so many times people bringing in their kids and having to listen to their parent get told off lol or just being in that sometimes combative environment.

      It is expensive but keep in mind the parents aren’t stuck with the entire bill the entire family aunts, uncles, grandparents and close friends all contribute several thousand dollars to the special day for the young lady. It’s traditional in the Mexican culture I should know I had three daughters and I don’t regret giving each one of them their Quinceañera

    The defendant looks SO sleepy and is so lethargic! Plus he is constantly leaning his head to his right. At times I thought he might actually lose his balance and tip over! It’s driving me crazy.

      The defendant's demeanor must have been very different for the plaintiff to have hired him. If not, I gotta question the plaintiff's judgment.

    For those who don’t understand the “big deal” about a quince or sweet 16, think of it in terms of a Jewish boys bar mitzvah. That celebration is HUGE in their culture and from what I’ve seen, they spare no expense. I’m sure had he apologized and not had the “what’s the big deal” mentality like many others seem to have, it wouldn’t have gone to court

    This was such a weird case. While I understand the plaintiff's anger (and the defendant is a complete asshole), her reasoning behind wanting to recreate the event is odd to me. If it was me, I wouldn't be able to rewatch the video of the event without getting angry all over again when it got to the parts that were recreated. Like...what's the game plan? Get everyone who was at the original party to come back and pretend like it's the same night?
    That's also where JM's ruling kind of confused me, too. If this woman is hell bent on recreating the event, she has to basically gather everyone who was at the original party to come back and play pretend so it's as seamless as possible. Most likely, that can't be done on a weekday and for a reduced rate.

      My thoughts exactly. Who does reenactments for a… Sweet Sixteen party? Lord. Nobody can recreate as the event they had otherwise it will look so rehashed and fake. I wonder if the plaintiff is just saying it to get more than she’s owed. She won $1200 and didn’t mentioned it after that. If I were her, I’d put it towards her daughter’s college fund. 🙄

      I agree with you. But I also think the plaintiff should not have been granted money to recreate the event. If she wants to recreate it, then that's on her because you can't re-create a special moment like that. Plus, it's not like she refused to accept the footage the defendant did capture. In fact, she stated that she would use his footage to splice in the parts to be re-created. So, dispite being a total douche bag, the defendant does deserve something for his work. I think the 50% refund offered by the defendant was appropriate in this case.

    The defendant could have fixed this & maybe even have turned a small profit. But instead, decided to deceive the plaintiff and force her to take him to court. Keep your dayjob buddy.
    What I didn't agree with on the judgment was short changing the plaintiff with the "You can get it done cheaper scheduling the retakes on the weekdays."
    These are highschool kids who need to be in school during the week & the other parents involved would probably also have to take a day off from work during the week.

When they get a cancer diagnosis or a bad car crash for someone, a sweet sixteen party is going to be...umm....trivial (i suspect you see things as they are as well..... most ppl think it's a curse, but i'm in medicine...it's a blessing in that career) All the best to you!

      I agree, and she does that often. I always think to myself, we have no idea at what age these people had their children. She could have had her daughter at 16, who knows. She definitely looks old enough to have a 16 y/o. The judge was exaggerating on this one.

    He was "busy"? Dude, people paid you for a service. "I'm busy" isn't their problem. Personally, I feel like some of these teen parties are a bit much. When that girl is 30 or 40 I don't think she's going to be too bothered about how her 16th birthday was. But the guy sounds clumsy and shouldn't be in this line of work if he doesn't have the energy to devote to it.

      If you were listening, you would’ve heard that they have to re-create things. They have the clothes in the venue already but there’s makeup and hairstyling and all kinds of other stuff to re-create the video and that’s why she got the award.

Even the judge was confused and asked the defendant "why" would she try to do that, as you really can't recapture past moments in time. It will be staged and when the plaintiff and her daughter look back on the video and see those "re-created" parts they will always be looked upon as "re-created". So, why even bother? Sure, the plaintiff should have received some portion back that she paid, but giving her not only every penny that she paid, PLUS $300 to re-create such a sweet sixteen party like it's a wedding (which I still would not re-create) is absurd. Those moments are gone. They can never be truly re-created. So, the plaintff needs to accept the footage that was taken; maybe get smartphone footage from relatives and friends, and move on with life. A teenage birthday party should not be made into this big a deal. The defendant, while an inexperienced douche bag he might be, still capture a lot of the party and the plaintiff has accepted his work, so he should get something for that work. Plus, if the plaintiff wants to re-create a moment in the past that can't truly be recreated, then that's on her.

    mom and daughter need to wake up. If this is the worst thing that happens to that family, they'll have had a GREAT life! If mom is teaching her daughter to be this upset over a sweet sixteen party,....that kid is going to have a rough life when the bad stuff really hits. Sadly, Judge Milian isn't helping at all.

      Or how contracts work. This isn't a case of "she didn't like the photos"...the vendor didn't provide what he was supposed to provide.
      If they serve you chicken when you ordered steak, do you pay steak prices and walk out? What about if they serve you and empty plate? Do you pay and leave? IDK< maybe you do like to pay for things you never receive.

      While I think going through the trouble to recreate portions of the party that the "photographer" missed is a bit extreme, the plaintiff is not being unreasonable by suing the defendant. He did not provide photos or video for key moments in the party--something she paid for. Since she didn't get what she paid for I think she does deserve some portion of what she paid back, but I don't agree with the judge that the plaintiff she have to pay for the entire cost of recreating certain parts he missed. He still provided video for a good portion of the party and had to do editing work... Plus it's not like the plaintiff totally didn't accept his video. In fact, she is using it to splice in the parts that will be recreated so he still should receive something for his time and work. Instead, he'll have to pay out $200 more than what he was paid, which is absurd. I think 50% back was reasonable. That said, a case like this is unorthodox because what value can a judge place on the loss of once-in-a-lifetime memorable moments not being captured by a photographer?

    I know sweet sixteen is more of a girl thing, but I didn’t get anything fancy for my 16th. My mom didn’t give me a car at 16. She sold me one and it was a lemon… taught me the value of a dollar.

      We can commiserate together Hank.
      I didn't get anything for my 16th birthday either. And I'm a female.
      But because of my childhood, it made me determined to give my children wonderful childhoods, and I did! Still didn't have a lot of money, but they each got a party with their friends on every birthday, with a homemade cake, ice cream, games, and presents. Our own struggles make us better parents 😊

    It royally stinks that one of the memory cards was lost, they still got everything else. Also, you know EVERYONE was filming and taking photos on their cellphones(so at least they'll have the original memory). Perhaps this could have been avoided had the Defendant been apologetic and upfront in the beginning. I feel the Defendant was grossly over his head, especially with his customer service skills. Good case, good decision.

      I was thinking that- the phones these days take way better pictures than back even 10 years ago. I'll bet they got some parts of it. Definitely fair to reduce what he was paid - he was way over his head.

    I think it’s weird that the plaintiff wants to recreate the pictures (memory), bc when years pass and they want to go down memory lane and they look at the “recreated photos” it’s only gonna remind them why and how they had to do over again. I mean that’s the way I see it, I guess the plaintiff sees it in a different way. Wasn’t there ppl there taking cellphone photos or videos that they can send to the mother 🤷🏻‍♀️ but I do feel so bad for her and her daughter!

      Of course there were people there recording with their smartphones and such. The defendant probably used her own phone to record, too. But her saying she has to recreate parts he didn't capture will get her more money, and it did. I bet she wouldn' t even recreate those portions. Just seems like a lot of trouble to go through to stage prior special moments in time--when the fact is, you can't really recreate those moments. Sure, you can certainly re-stage it, but it absolutely won't be the same.

      The plaintiff isn’t claiming that anyone else cares. SHE cares and her family cares. She paid for his work but he screwed up by losing the SD card. She also paid a lot of money for the celebration that she wanted a video record of. Whether or not anyone else thinks a big Sweet 16 party is important or not is irrelevant.
      If this was about a wedding instead of a Sweet 16 would you have the same attitude?

    It’s crazy that people are commenting that the mom needs to just take the loss because they feel like recreating doesn’t make up for him losing the footage. But he still lost the footage and she still took a huge loss. Who knows how debarred the daughter and family was. And there’s nothing like PROFESSIONALLY done photos. There’s more comments about her needing to suck it up than there are that he should pay her

    We’ve lost sight of what’s important. Your kid is presumably healthy and happy, you have enough money to provide her with what she needs and much more, she has family and friends who care about her and want to share in the festivities surrounding her birthday. There’s so much emotional investment in documenting a party that seems to be more of a theatrical production than a celebration.

    The plaintiff is full of it, and the judge way overestimated. They had the party, and the issue was the footage got lost.
    The main thing was the party- not making videos. They had the party. Because the defendant lost the footage, he shouldn’t get paid for that.
    I agree with the defendant- he should get paid for what he provided.
    The plaintiff is lyeing saying she’s going to have another party just to record footage. She knows she’s never going to do that.

    This award was wrong. The usual limit of liability is the cost of film, processing and labor. You can't be compensated for the cost of recreating a memory.

    The plaintiff actually shouldn't have gotten that much. If the pictures were so important, why select an inexperienced photographer. Additionally, I'm more than sure someone at the party videography the dance.
    IMO, photographers are the most important expense for an event.

    I'm a wedding and quinceanera photographer and videographer. This dude should have used multiple cameras with dual cards. Having missed those precious moments is an automatic complete refund in my book. If he used one camera then that means to me he's a rookie or a dummy. Either way, unbelievable he didn't tell her about the lost sd card. Oh btw, my average client for quinceaneras or sweet 16s are spending between $30k to $50k on their event

      I agree. The defendant did capture a good portion of the party. And while I think the plaintiff should get some of her money back, the judge awarding the plaintiff more than she paid to recreate the party is absurd. The plaintiff needs to take what was captured by the defendant; ask family and friends for any smartphone footage they have that may have capture the key moments the defendant missed; and then move on with life because trying to recreate moments from a sweet sixteen party is lunacy.

      This is an important event in the Hispanic and Caribbean culture if you are not one of those then you do not know. Parents save the money and they do budget. This isn’t something that is made in a few weeks it takes years or months to plan and it is all about the child. My older cousin still to this day bring up their sweet 16 and we watch the videos and look at the photos still.
