I had an ex husband who asked me for money a couple weeks after we divorced because he "didn't want to bother" friends and get embarrassed.

Mostly, probably, just because they simply do not think quite that far ahead. But also, it might not necessarily occur to them what the judge will or will not ask for, and it doesn't occur to them to get any legal counsel about that beforehand. That's my theory, at any rate...

I think he lied to her about his past with the defendant. You can see both their body language change at the beginning when the narrator says they "dated for 5 years in high school"
