  • The plaintiffs, three friends, lived with the defendant. They claim the defendant’s girlfriend didn’t like the fact that he lived with three women, so he moved out early. They’re suing for rent he owes. The defendant says he used to be friends with the plaintiffs, but everything changed when he moved in. He argues he paid part of their rent for several months. He’s countersuing for a security deposit.

      It’s not that the Judge didn’t believe him. It’s that he didn’t have any defense. He promised to pay and just hadn’t. He could have filed a countersuit for damaged furniture, window, etc., but he didn’t. Legally, this was a clear and easy case.

      Nah they got over on JM this is why JJ doesn't accept (home-aid typed letters signed by the Pope) Where was the new or amended lease agreement with current roomate period. Or even an Itemized list of damages to clean/paint 1 room is NOT for the full portion of his deposit. She stated she recvd a deposit in August. The other person was already occupying his space. Landlord can't accept deposit from the new tenant & also just inadvertently keep the defendants entire portion without informing him of charges for any damages/fees. BS 💩 Dirty hamsters ran some slick game on the Judge.

      @@cindywilliams8188 And that’s why the Judge said he needed to go after the landlord for his deposit. Not his former roommates. He paid the landlord. The landlord owes it back. As far as a new tenant already being in there, the girls had the new lease. The Judge typically reviews the evidence before the cases. But regardless, he said he was going to pay. He didn’t. So now the burden of proof is on him to prove someone else was occupying and paying rent. He wasn’t even arguing that much less providing evidence. I agree he probably had a bad deal paying all that rent compared to them, and it sounded like they were difficult to live with. However, legally-with the evidence he presented, he had zero defense!

Where the defendant would be absolved of all of their shenanigans. it has to be a new or amended lease) In which they probably never signed & most likely on a month 2 month. He was truthful, and I believe every single thing he said... They more than likely made it unbearable, took advantage of him being a male (so skyrocketed the rent for him compared to their price), and no one disputed his claim that they were destroying and breaking things. So I'm betting no deposit will be returned, when they finally leave... that's not fair to him. They should have returned his deposit and got a new deposit from the new person, to take over his original spot.

    I understand that he has to pay because he made that commitment but I don’t understand why he would agree to pay so much more rent than the other two in the first place. Also, if I had a roommate that was paying that much more rent than I was paying, I wouldn’t have sued them for the last month. Frankly, it makes me think he’s probably right about everything he said about them.

  • @9481xyz
    @9481xyz Před rokem +3

    Let me ask this question, if the plaintiffs can get money from him for his portion of the rent, even though the lease agreement was signed by all of them with the landlord, why can't the defendant get his portion of the security deposit FROm them? I understand the idea that this deal was made with the landlord and he should sue him, but shouldn't that apply to the plaintiffs as well? They should've paid only their portions, so the landlord could come after the defendant for his part. And if they did paid for his share, that means they took responsibility for it, so in return they should provide him with his security deposit and go after the landlord separately for theirs. You can't really assume responsibility for him and then act like you don't have any accountability...

    • @timboslice9905
      @timboslice9905 Před rokem +1

      I don’t think the law works that way. If they all signed a joint lease together, that means that they, together, must come up with the rent. So the women can’t just pay their share and leave the rest for the landlord to hunt down. It could jeopardize all of them. Doesn’t make them right, but they would need to go after him and not leave it to the landlord.

    • @9481xyz
      @9481xyz Před rokem +1

      @@timboslice9905 Wouldn't it mean that by doing this, they become an agent for the landlord? So they could be held responsible for his portion of the security deposit.

    The judge got it wrong on this one. When the girls got a new roommate and had them pay August 1st, that implies they paid for August. Especially if the new roommate paid again in September. Which means the first payment was for August. The follow up question should have been, did the new roommate also paid September 1st?

    I think that hes much better off where he is now. I think if the plaintiffs waited a bit they might have gotten more money out of him - especially since he was getting the short end of the (steal?) deal they had for the apartment.

    I would have liked the judge asking the girls what the new roommate is paying ? I bet definitely not $1300 so goes to show that the girls are thankless that this guy for all these months paid more and as roommates they could have picked up some off his last months rent. It's courtesy as they were roommates ((you kinda become like family) and saved a lot of money these many months.
