  • The plaintiff says her neighbor’s dog went onto her property and ruined her pool screens, so she’s suing. The defendant admits her dog escaped from her yard, but she insists she agreed to fix the screens herself.

    The defendant didn't seem to care at all. Her dogs are constantly getting out. She needs to either get a better fence to contain them, build a dog run in her yard, or live with the consequences of what will happen to her dogs if they attack or if someone feels threatened by their behavior when they escape again. They are her dogs. If she cares about them, she will secure them properly.

    Why do people with misbehaving dogs think they can just let their dogs run around and cause trouble ? Can't they understand that some people are allergic , afraid and don't want dog poop in their yards ? I realize that the dog owners love their pets but not everyone else does .

    For anyone wondering. The "Black Mouth Cur" also known as the Southern Cur, Southern Black Mouth Cur and the Yellow Black Mouth Cur is a UKC recognized breed that originated in the U.S. as a hunting dog and is also used for herding today. The dog from Fred Gipson's famous novel "Old Yeller" is commonly thought to have been this breed. Doesn't change the outcome of this case at all but I figured I'd point out that it is a real breed.

      to add to this, while others are calling it a pitbull, the black mouth cur is not at all nor is it related. However a black mouth cur pitmix is hard to separate from it's pitbull traits as it looks exactly like a pitbull
      however, they test very differently on temperament and bite force (the purebred black mouth cur and pitbull)

      And looks nothing like a standard American Pitbull. My husband looked at a side by side of the two breeds and was super easily able to point out all the distinct differences. He is NOT a dog person by any stretch of the imagination. He doesn't know a poodle from a Mastiff

      RIght? Not only that, her completely "IDGAF" attitude, like she didn't understand why JM was upset with her about her dogs escaping MULTIPLE times. It's flatout selfish & entitled behavior. The neighbors don't want "strange" dogs on their property, the dogs could attack them, their pets or farm animals, someone may shoot the dogs just for running on the person's property, hit by a car.... can you tell owners like this piss me off? lol They not only don"t give AF about others, they genuinely don't care about their dog's wellbeing.

    If some wild dogs keep getting in anyone's yard, they have the right to protect themselves and their property, Judge Milan. If the child overheard the plaintiff's husband, oh well. Maybe it will teach the smug mom (defendant) to properly supervise and fence in their animals. Milan is so wrong!

    I didn’t like how the Judge came off to the plantiff woman. If a dog jumped over the fence a 2nd time.. The black cur is a big hunting dog… then I’m protecting my dog and family. She said it was biting at him. I would’ve said all types of things too and that kid probably heard it. The person to blame is the defendant. She’s so nonchalant and said ‘I guess we’ll see’ to restraining her dog. If it comes down to my dogs or yours, I don’t want to but your dog has to be eliminated. Plantiff called 6-8 times for animal control. That defendant was so careless. She’s the one making her own kid cry. Nothing about the plantiff was wrong

      the problem is the plaintiff even admitted unwittingly the husband said it to the 9 year old and not the mom. That's where they fucked up.

      No the Judge heard her say that because she wouldn’t let her speak. What she was saying before being yelled to be quiet and also finished at the end… was her husband said it after he pushed the dog back the 2nd time. He was upset and said it out loud and the kid heard it. She said she the defendant and her discussed it too. The defendant’s child her the husband and told her. That lead to them talking and she told the defendant her husband did say it. He was never talking to the child the child apparently is the only one around controlling the dog. They didn’t mess up at all, the Judge created her narrative

    This is my biggest problem with the show. It goes for more the emotional route than logic.
    The plaintiff claimed in the beginning that the dog attacked the husband as well. So his natural angry, adrenaline reaction is to say if it does it again he going to kill it. Probably said drowning out of anger. But because a 9 year old heard or was told, he becomes the bad guy.
    Not the owner of the dog but the guy getting attacked. So dumb.

      The judge totally believed the defendant--who has already been caught lying. She's too busy shouting and being emotional to listen to the plaintiff's explanation.
      Then she tells the defendant to explain to her daughter that no one is going to hurt her dog.
      Seriously? If a large vicious dog broke through my fence and attacked me or my dogs, the owner would have to come collect a corpse.
      Vicious dog attacks are horrible, and many times fatal. Judge is so wrong.

      Actually the ruling was made 100 percent minus the emotion. This comment is about the emotions about how they felt but as the judge said emotions don't make you not responsible for a loose dog

      Why does everyone keep saying “judge”? She is NOT a judge. She is a moderator or mediator in a mediation that is dressed up as a made for TV fake courtroom. Her “rulings” have no weight of law whatsoever. The parties are paid for their appearances and any settlements are paid to them by the show. This is NOT a court, she is NOT a judge. Amazing how many people don’t understand that.

    Why was the judge so mean to the plaintiff?? The defendant had a PERVASIVE ISSUE with keeping her dogs inside!! To say that the plaintiff and her husband were despicable was terrible- it was a perfectly legitimate response to nearly being bitten! And to say the dog didn't nearly bite him, wth?? This case did not go well at all, and I'm very disappointed in the judge for treating the plaintiff so poorly.

      The defendant needs to take this more seriously. The plaintiff seems like a real bitch but I agree that if the dog keeps coming over and if it is threatening the plaintiff's dogs then any force necessary is OK. I live in the country and dogs get killed for chasing and attacking livestock all the time. The dog owners might get upset but the law is pretty clear and they have no legal recourse.

    The defendant tried to use her "poor child's" feelings to sway JM. You put your daughter in that situation to have to hear them saying they would, "kill the dog". How about control your animals. Next time she may not hear them just say it. That's for your dog's safety too. They could poison it. You never know now days. It's like the defendant was slow. She just doesn't seem to comprehend the severity of this situation.🙄

I avoid 99% of the population, for a number of reasons. 1. Addicts of any type.....I only leave my home a couple of times a week and it never fails. I'm going to walk past some guy who asks - Do you have a cigarette?.....I am 1000% insulted on every level! 1. Do I look like a smoker?       100% Most states have laws that allow for lethal force against aggressive animals. AZ allows the owners of said dog to be charged as well as having the offending animal put down.

    I'm sorry I agree w/the plaintiff. Her husband has the right to protect his family if need be. Keep your dog in your yard. Also I doubt he said that to her 9yr old. She probably overheard him say that because I'm sure he was yelling and upset while he was talking to his wife.

    We moved to the country in November of 2016. That first Christmas our kids were playing outside when our youngest son ran in and said one of the neighbor's dogs, who were always running loose in our yard, came towards him and growled like it wanted to attack him. I was in the basement so he had told my wife. She immediately grabbed an air rifle and went out to where the dog was, still in our backyard. She pumped it up 4 times and shot the dog right in it's butt. It yelped and ran back through the fence and to it's home. The neighbor kids were out playing in the yard and saw her do it and they started cussing her. They ran inside and told their mom and dad. By this point I had come upstairs and my wife had come back in. She told me what was going on and just about that time the neighbor came flying up our driveway in his truck. My wife, youngest son and I stepped out front on the porch. The neighbor jumped out of his truck and started yelling at my wife about how the dog was bleeding. My wife said the dog had growled at our son aggressively and it was on our property and he needed to keep his dogs, they had 5 at the time, on their side of the fence. He stormed off saying he was going to call the cops. About 20 minutes later we saw a Sheriff's Deputy SUV drive by and pull up in their driveway. They were next door for about 5 minutes and then they hopped back in their SUV and came over to our house. Once again we met them on our porch. They first asked my wife if she had shot the dog. She said yes, with an air rifle and she only pumped it up 4 times and we had a 12 gauge inside had she wanted to do real harm. If you don't know air rifles this style gets more powerful the more pumps you put into it up to 10 total. She wasn't trying to kill the dog, just scare it off our property. One of the Deputies then asked my son if the dog had growled at him and he said yes. And the final question, was the dog on our property when it happened? Of course the answer was yes, way on our property. Both the Deputies told my wife that she had not done anything illegal and we actually were allowed to use DEADLY force in the scenario that things had occurred. They told us that they had told the neighbors the same thing as their story matched ours. My wife told the Deputies about all their dogs constantly being on our property and they said if any of them threatened us or our dogs, which were small indoor dogs, or cats, which were outside a lot, we could kill them but if they were just crapping in our yard and running around we needed to call and they would have the neighbors come and remove them. Fortunately we finally got it all sorted out after a couple years and we are all friendly now. But if you are a dog owner keep the damn things contained. We now have 3 Huskies as well as the 2 house dogs. We have a whole huge yard fenced off for them and they cannot get out.

    Judge is crazy. If you want your dog to live you better keep it in your yard. Period. If you are afraid of your child being traumatized because your dog got killed than you should take the proper steps to contain it.

    JM was emotional and out of line for berating the plaintiff like that. I don't believe for a single second that her husband told the 9 year old that he'd kill the dog. Also, if a dog comes onto your property and attacks you and/or your animals, you have the right to defend yourself. And if that's by killing the dog, then that's what happens. JM had no authority to tell her they can't kill the dog to protect themselves.

    So judge preferred to have someone attacked or killed by not taking care of these dogs? If dog came and attacked me or my kids, that dogs a gonner. Obviously the dog owner didn't care because they would have fixed this problem the 1st time it happened and not until someone gets Injured or killed and judge needs to understand that.

    Sure it was sh*tty of the plaintiff's husband to threaten to harm the dog, but that wouldn't have happened if the defendants didn't keep letting their dogs get out. Telling the judge a story about their kid supposedly crying all night over it was an obvious manipulation that the judge fell for hook, line, and sinker. Those kids and dogs deserve better.

    The judge needs to get in touch with reality and not be so catered to. Out in the country if a dog goes onto your property continuously and is a threat to people or livestock it gets killed…. That is reality and allowed! So to avoid all of that….. keep your dogs on your own property!! Be responsible pet owners! Not all of us live in mansions lol

    The Black Mouth Cur's origins are in the Southern United States where it is known by a number of names including the Southern Cur, Southern Black Mouth Cur and the Yellow Black Mouth Cur. The most commonly held story is the breed descends from dogs brought to southern Mississippi by European settlers, among these progenitor European dogs included Belgian Malinois.     I am yelling at the judge through my computer but she doesn't seem to hear me. LOL. The Judge normally listens carefully, but doesn't seem to hear what the plantif is saying. If the the dog breaks into their house/patio and attacks them, he (husband) is going to kill it. (The neighbor girl overheard the husband tell the wife). If a dog attacked my family or myself, the proper response is to put it down. The black mouth Curr bread is a fearless dog and is used to hunt and kill wild boar and bears in the Southeast States. It is extremely protective and can be aggressive towards humans.

      It is clear the dependents lied several times during the trial and twisted the facts of what the neighbor said. The decision was correct, but the scolding was uncalled for.

    The Judge was wrong about what she said to the plaintiff! If a dog, who is strong enough to tear through a screen, breaks into my pool area I will defend myself and my 3 little dogs! If it means drowning the dog, then so be it! The 9 year old overheard him, but the judge should have held the defendant responsible for habitually letting her dogs escape! The plaintiff and her husband were the victims!

    I'll never understand people who think that others should care more about their animals than they do. If you love your dog protect it. Keep it secured. If a neighbor doesn't kill it for attacking them, their kids, their livestock or simple trespass it could be killed by a fast moving car. It's your dog, which makes it your problem and your problem alone; not the neighbors'.

    Beyond the fact that the Plaintiff probably should have quit smoking around 2o years ago, the defendant was acting like a typical irresponsible aggressive dog owner that doesn't believe that they have any responsibility, whatsoever, for the damage their uncontrolled animal causes.     The dog owner should of received a bigger lectured from the judge, she does NOT love her dogs if she thinks its ok to let her "friendLy" dog run around lose, A car can hit the dog, the dog can eat something poisonous or an aggressive dog can attack him. IT IS NEVER ok to let your dogs roam around friendly or not, KEEP THEM IN YOU PROPERTY. Avoid problems, and keep them in, if your child leave the door open then you shouldn't have dogs and focus on your kids ... WHERE ARE YOU while your kids are running around leaving the gates open, FOCUS ON YOUR KIDS and don't have dogs if you CANT TAKE CARE OF THEM. The husband is correct, if it comes down between HIS DOGS or the ones that are entering his property illegally to attack his babies ....he has the right to do whatever it takes to save his pets and himself. I was put in this situation and I LOVE ANIMALS but my neighbors pitbuls entered my property once and they pin down my cat and were thisssss close to grabbing her by the neck, but luckily I came out on time.

Multiple dogs getting loose repeatedly is ridiculous and they should be confiscated, until she can properly contain them.       Not from lack of trying, she said it was biting at her husband but he was able to restrain it. Which led to his anger and outburst. Also the possibility remains the bite is one possibility or the child being sad is another. How about the mother fix it all and neither is an option. The judge needed to come harder on this defendant because she didn’t learn a thing at the end

      Day in question, my boss calls me because nobody showed up. I told him I was only coming in to cover the midday shift. Welp, nobody came in so I was there until 10. The drawing closes at 9.
      that fortune cookie had 4 numbers + the powerball which for the multiplier would have been 2 mill. And every year since I repost that same facebook post to him with the fortune cookie.
