  • The plaintiff claims her landlord, the defendant, returned her security deposit, but the check bounced. The plaintiff found out her landlord put a stop payment on the check, so she’s suing. The defendant says the plaintiff caused extensive damage to his property, and it took him more than $5,000 to get back to rentable shape.

    He shouldn’t have been awarded anything back since you gave her back the security deposit he assume all the responsibility for the damages

      One month of the security was used as rent. She agreed to the landscaping and shelving. She got back what she was entitled to.
      I would have sued him for the fees related to his check bouncing as well as the stop payment.
      He shouldn't give back security until he has a maintenance person sign off on the condition of the property. You just have to get the inspections completed in a timely manner [7-10 days].

      I agree, the LL walked through the home THEN sent back her $$. She incurred fees because of what he did. As for the weeds, since he lied about the other pictures I’d want to see the date he took those because I’d bet it was after they grew back. $150 for spackle 🤦🏽‍♀️ that takes 1 minute to do & that includes getting the supplies out, that was a ridiculous call. He should’ve had to give her all her money plus the bank fees. I really like People’s Court but in my opinion this judgment was wrong.

      Absolutely not...I'm a homeowner and I also rent out a second unit in my home. People who rent always assume that the property owner should just eat up the cost of the damages they cause to an apartment. It is absolutely wrong and hope at some point the Landlord and tenant laws change because tenants are completely unable to own up to their damages and think everything cost $1.00.
      I use to be a renter before buying my multi unit home and I can tell you that I made sure to care for my apartment because I understood the cost, time and labor involved in re-renting an apartment. Tenants need to stop being such entitled idiots. If you were handed a fully renovated apartment, then have some integrity and dignity and return it back in its original state. It's called being honest and fair to others.

      ​​@@XFiorenttihe shouldn't have sent her the original cheque if he had damages. The judge could have considered that a meeting of the minds and forced him to uphold his original agreement.
      Also, he lied to the judge -- showing her photos of the condition of the rental which were in fact taken the year before the plaintiff moved in. He was not being "honest and fair to others".

      its only because she agreed in the lease to take care of the landscaping . i would never sign a lease that includes that i must be responsible for the owner's landscaping . let them hire a gardener to do that like all the other owners do .

    Even though the defendant was technically entitled to some money, I think he should have lost completely because he bold-faced lied and thought he could charm the judge. He was high-key annoyed that she wouldn't give him space to try and talk around getting caught in a blatant lie.

    I feel like the best defense for the plaintiff would be. He wrote the check. If there was damage after he wrote the check then he shouldn’t have wrote the check

      Totally agree. The landlord shouldn't haven't written the check til the damages were properly assessed and/or he was ready for it to be cashed.

      as soon as the case began and it was announced that the landlord wrote bad checks i knew he was gonna lose . writing a bad check is very incriminating and it will always make the check writer automatically look guilty of wrongdoing .

    This was a fair judgement. One month of the security was used as rent. She agreed to the landscaping. Holes in the wall from shelving or pictures aren't normal wear and tear. She got back what she was entitled to.
    With that said, I would have sued him for the fees related to his check bouncing as well as the stop payment. He shouldn't give back security until he has a maintenance person sign off on the condition of the property. When you do those inspections in a timely manner [within 7-10 days from move out] you can cut checks quickly.
    Writing a check when you have no intent of honoring could be considered fraud.
    Also, its best practice to do the walkthrough together.

    The defendant is a scammers and a liar. Why he got anything back is confusing. His creditability was done when he tried to provide evidence that was not appropriate, trying to show the place was pristine. He wrote the check and then put a stop payment on it which is illegal. It was obvious that he was just trying to scam her out of money. Every honest landlord would have assessed the damage and let her know what he was holding money back for before writing a check.

    Regardless of who is right or wrong, it drives me nuts when JM asks a question and then doesn't let the litigant answer. She does the same thing in conversations with her dear husband. Listening is an art and a skill.

    The landlord was double dipping, he probably kept deposit from the previous tenant for those damages and never bothered to fix them, now he is trying to get her deposit to pay for those damages again.

    The defendant should be ashamed of himself. First of all, he's a crook and too. He should be in jail because that woman had to pay all sorts of bank fees. And it messes up your banking when you pass a bad check that's ridiculous. And the plane of deserves every penny plus punitive damages.

    i had a tenant move out and i did a walkthrough on the day of. We normally return deposits because tenants will leave lived in damage. like picture holes and stuff like that. The tenant left over 100 holes from trying to hang picture, destroyed the backyard (they were responsible for) and painted a room without returning it to the original color. , and damaged the hardwood. It was over 5k in damages and all we did was keep the $1,600.00 deposits.

    What the landlord did in this case was really grimy and underhanded when he wrote a check all the while knowing that he would stop payment. Citing not wanting to be confrontational or not that's some dirty shit the defendant did. It's good that the plaintiff won something at least..

    He should not have got a quarter. He never sent her a letter after sending a bogus check. Then tried to mislead the judge on when the pictures were taken. At least she got the majority of it back. She should've sued also for double or triple but judge would've probably changed the rules on that too. She only enforce when they piss her off.

    I moved into a rental and th efloors lookslike those pictures, SHINING AND ALL!!! I got to the hours and there was ano shine!!! She took photos with light shining in!!! I ook photos an dput newspaper on the floor as to how the floors really looked!!!

    He not only had the wrong pictures he knew exactly he had the wrong pictures. He wanted to see if he could get away with a lie. This landlord did nothing but lie on the witness stand and I'm not even a judge and I knew that from the get-go. and Judge Milian has been a judge for how long? She doesn't know what she's talking about she needs to go back and get a refresher course and judge😅

    No way those floors were like that from them in one of the other photos you can see the stains from the dirt in the same gray color. Glad the judge pressed that issue because sometimes liars are winners in this world.
