    In this editorial episode, Mr. Sujit Nair addresses the recent contempt of court proceedings initiated by the Supreme Court of India against the National Company Law Appellate Tribunal (NCLAT). The Supreme Court took a strong stance on Wednesday against NCLAT's judicial member Rakesh Kumar and technical member Alok Srivastava for allegedly violating its order and delivering a judgment.
    A three-judge bench led by Chief Justice of India DY Chandrachud expressed their displeasure, stating that they were prepared to send these individuals to Tihar jail if they defied the Supreme Court's order. The Chief Justice emphasized the court's authority and stated that they believed the NCLAT members had attempted to defy their order, making them liable for contempt proceedings.
    The bench has summoned the two officials to appear in person before the court on October 30, highlighting concerns about a systemic issue, describing it as a ""rot"" that has affected both the National Company Law Tribunal (NCLT) and NCLAT. This specific case served as an example of this problem.
    The Supreme Court was examining a case related to the disclosure of results from the Annual General Meeting (AGM) of Finolex Cable. On October 13, the Supreme Court directed NCLAT to issue its judgment and declare the AGM results only after receiving the scrutinizer's report. However, the NCLAT did not comply with this directive.
    Upon learning of this, the Chief Justice instructed NCLAT's chairperson, Justice Ashok Bhushan, to provide a report regarding the defiance of the Supreme Court's order.
    The allegation against the NCLAT bench is that they disregarded the Supreme Court's order issued earlier in the day, despite being informed of it.
    The order in question was issued by the Supreme Court on Friday morning, instructing the NCLAT not to deliver its judgment in a pending appeal until the scrutinizer's report, declaring the AGM results, was available.
    During the hearing, the Chief Justice expressed his astonishment at the NCLAT's actions, particularly when they were explicitly informed of the Supreme Court's instructions. He stressed that individuals with significant resources and influence should not attempt to manipulate the court, and he emphasized the court's commitment to upholding its orders.
    The Supreme Court overturned the NCLAT's order and made it clear that Corporate India should understand that the court is vigilant and will act when its orders are subverted. The Chief Justice also noted concerns about a judge's impartiality and instructed Justice Ashok Bhushan to rehear the case.

      Upto what extent can SC take action. Can a mandate passed by the Rajya Sabha be declared null by the SC.
      It's the people who voted for this government. Let them take the consequences and be satisfied with MPs like Brij Bhushan etc.

    It’s about time the Supreme Court enforced the law , and punishes the ED, and CBI, according to the laws of the land. If they behave in an unlawful manner, how can citizens have any faith in these agencies, whose salaries are paid by the public.

    In stead of passing comments and giving instructions Supreme court must use directly to pass orders against the accused persons/agencies/departments in the form of certain penal actions.

      The accused don’t seem to bother DC as they are protected by Govt….I really don’t know what is the next step of action by Supreme Courts. Don’t the Contempt of Court doesn’t apply to them….& SC initiate action directly….I think we have not come across such disobedience and arrogance before 2014…..!

    Judiciary is short of giving orders. No orders no fear. Now use of having such court. In local courts nothing what the courts say is obeyed is my experience in spite of giving it to court.

      Indians are just not wired to accepting laws and rules in a personal family situation too. This lack of seriousness goes all the way to the top. Choose to live in the West and my mothers flat has been disputed for thirteen years since her death. Powerless to have any judicial justice and was told by expensive lawyers that better to arbitration but even that has failed and we will be dead and so will our children before this juggernaut judicial system is fixed

    Sheer lawlessness! The action on contempt of Court should be taken immediately and exemplary punishment should be given to the defaulters so that the Majesty of the Rule of Law is established unquestionably. Wilful disrespect by the powerful should be dealt with, with a heavy hand. What was being attempted to in Israel, which resulted in people taking to the streets to protect the Judiciary, must be borne in mind. We just cannot have such a situation here.

    It is no longer merely Contempt of Court but contempt for the Indian Constitution and the system as a whole. The present ruling dispensation is totally innocent about how a modern nation state is supposed to be governed. In the process, it makes a complete mockery of the sacred bodies or institutions, which are enshrined in our Constitution and are imperative if our nation and its citizens are to exist within the framework of a modern nation state, such as rule of law and respect for human rights.

    Mr Nair excellent analysis cum assessment esp the present status of Hon'ble SC n the respectable CJI chair held by Shri Chadrachud.       It is particularly jarring when the CJI was educated at one of the best universities in the US. CJI must also have observed how justice is delivered and implemented! Just don't get it. Surely as an individual why not follow through with any case to show your authority in the name of justice

      Objective criticism is healthy in order to right wrongs despite challenges from Governments. The CJI is the last port of call and authority to vociferously persevere in following the constitution to the letter. Mr. Nair's criticism must not be taken personally ever

      Sadly not just in the last few years but the last sixty years. As am old enough to remember my growing up and student days in India. One of the reasons why I chose to move to the West. Sick of lies paying bribes and this goes to close family too. E.g. If one family member has worked their socks off she or he is expected to provide for other family members who feel entitled because it is family. Indians have a lot of course correction as far as ethics go. A mindset based on the dark ages

    I have a DV case in the Jucicial Magistrate court in Alipore, Kolkata . I got an order for interim relief after 4 years' since filing of the case , only after a high court order. Still , the next half of the HC order to fix a date on every month to finish the case, to the JM is ignored by the JM . Things are like this , and a contempt petition has to be initiated , I guess.

    For India to grow you need two things, law & order and infrastructure. Look what happened to Vodafone & The BBC. It's not the job of the government to go after companies, it's the job of the regulator and the decision is made by the courts. This also happens at State level. It's easier to do business in other countries even if you're Indian.

    Judiciary is the custodian of constitution and should ensure its values are adhered but it's unfortunate that our SC always play safe instead of issuing concrete judgement/verdict. In spite of misuse of ED, CBI and such investigation agencies being used to settle score with opposition parties by the ruling BJP Govt, the Supreme Court is mere mute spectator.

How can things whether it is bcoz of politicians or conmen, are allowed to happen that are in defiance of the constitution of the country when we have SC to ensure and to safeguard it? Bcoz the SC was manned by unfit men for the past several years. Now the situation in the country is that the IT Cell of the political parties have taken the control of the judiciary and made SC a mere entity. It is the biggest shame shame for the biggest democratic country. I think and expect DYC to change the course and set the things right but will he able to do in his tenure? At least the country must learn lesson from this shabby state of affairs.

    Sir, It is the executive arm of the Govt and not the SC responsible for the rot. A muscle man goes about molesting young women, the Police do not make an FIR despite complaints before the Magistrate. The matter reaches the Higher Courts, still no action. Then it reaches the SC and the police make the FIR but do not make the arrest or even the charge sheet. The muscle man roams about undeterred while the victims face jails. Do our citizens want Kangaroo courts and mob justice. We are not talking about school administration but the very Rule of Law. Today it is the Courts, the turn of our bureaucracy and political masters will be next.Then nobody will listen even to elected politicians..

    It may not be right to say that people as they age, become victims of physical infirmities, become idle or unproductive or compulsorily need to be confined to care centers and old age homes. In India there are countless number of senior citizens, who remain active way beyond the age of 65, are independent, live a life of dignity and do not need any assistance from their own progeny or the State. The anchor seems to have invested a disproportionate amount of optimism in the power of the youth, which in any case does not corroborate or be endorsed on what is happening in the real world. Ageing is not a sin but a natural process. We have no power to avert it, as much as we have no power to avert the grave.
