  • In this editorial episode, Mr. Sujit Nair addresses the controversy surrounding remarks made by Victoria Gowri, who was later appointed as an additional judge of the Madras High Court. Chief Justice of India D.Y. Chandrachud responded to concerns about the Supreme Court Collegium's recommendation of Justice Victoria Gowri, emphasizing that a person should not be disqualified from a high judicial office based on their past political affiliations or the clients they represented as a lawyer.
Chief Justice Chandrachud highlighted that the judicial appointment process is a collaborative effort, with no single branch of the state having a decisive role. Justice Gowri faced accusations from petitioners in the Supreme Court, alleging that she had made hate speech against minority communities on social media. Petitioners, including Anna Mathew and senior advocate R. Vaigai, urged President Droupadi Murmu to reconsider the Collegium's recommendation.
The Chief Justice defended the idea that lawyers, over their careers, represent a diverse range of clients and should not be disqualified from becoming judges based solely on their past political associations. He emphasized the duty of lawyers to provide legal aid without presuming guilt or innocence. This perspective was shared during an interaction organized by the Harvard Law School.

17 January 2023, the Collegium of the Supreme Court of India assented to her elevation as a judge of the Madras High Court. About a fortnight later, it was alleged that she had given hate speeches against religious minorities. The hearing was held before a bench of Justice Bhushan Ramkrishna Gavai and Justice Sanjay Kishan Kaul on the morning of 7 January; they dismissed the case upon an oral hearing, refusing to challenge the wisdom of the collegium by adjudicating the "suitability" of a judge. The editorial erroneously mentions “if she gets selected”.

Surprised to see our CJI's justification. When a person who is affiliated to a political party like BJP will never change their mindset (carrying their ideology) which is hardcoded in their brain. A police case filed against a person for a domestic dispute / violence disqualifies him for a government job though the issue has nothing to do with his job. Courts are considered as temples of Justice where judges are supposed to be totally unbiased. And no one can expect justice from such judges. It is unfortunate to see our judiciary being crippled by religion / caste based governance.

Sujit ji, agree with you 💯%. I too am very disappointed by the judgements and observations by our Courts. With no disrespect to the honorable courts, it's baffling to find different yardsticks. Like your example of Adani and Newsclick. Even the observation in Manish Sisodiya's case: "it won't stand in the court for even two minutes, when it comes to trial"..... but bail can't be granted????? Courts are are last and maybe only hope.... justice needs to be served and also seen to be served...

The very fence which is put up to protect the crop itself eats the crop. How good may be a constitution, if those who are out there to implement it are not fair & square what is it worthy of ? 👍
