Everything you said not to do, I fallowed it to the T. I hired lawyers, was respectful, had evidence, had witnesses, she was caught lying on the stand, never interrupted, never showed any emotion, and STILL, I lost. What I learned from my experience it comes down to how does the judge FEELS about the case. That’s how judgment is adjudicated. I was in disbelief about the outcome.
They really need to do something about the moms who abuse the restraining order to gain leverage in a custody case since it is known so well. Maybe make it more difficult so it is used as intended following an actual incident where police get involved. I only oppose the abusive way this restraining order is used.
Exactly! There should be a bill passed through both state and federal government. Make it a felony punishable by state or federal prison sentence.
When the mom has been targeted by a narcissist ex, it can be very difficult to "prove" what the ex does. Sometimes the ex targets the children, too.
this is exactly my case .. 5 years no fistfight no police called.. I kicked her out of the home for abuse and not getting along with my wife ... yes me n my wife had a gf ... I don't drink ,smoke,pills nothing ever . I'm madly in love she just hit me with a no contact order 5pm I love you bave 7pm out of nowhere just to take our daughter 😢 . falsified and got me thrown in jail . said when I left her home every time she was calling the police . I was so dumb . now her small town her lawyer is a family friend, the d.a is the main lawyers wife .. I mean I'm not lieing .. like I'm sick inside I'm madly in love with this chick 😢

I have been living in my semi truck for 90 days now. It is not fair. On top of everything. I am paying for all expenses, house, car payment , her phone. It is about $4,000 , plus I was giving her $1220. No anymore. My new attorney is helping a lot. Because the first attorney betrayed me.

Hi thanks for the share. Can you go over the other methods and alternative services? Like Posting at the courthouse, and leaving with another adult and their job and/or at their residence? Not everyone can afford paying $200-$400 to post in the newspaper. In fact most people going through court ordeals are extremely limited on funds to begin with. Thank you!
That's one thing I've observed in a court case that can be solved other ways, to have your, and or the other side's dirty laundry aired out to dozens of other people in the courtroom, or if on zoom, the judge regardless. This is highly embarrassing and it's shameful in my opinion.
When the accuser lies, how can you have evidence or witness His witness lied the same and judge accepted as it was truthful Hard to believe that can happen in the court not having evidence

I had to divorce my wife. Her HIV positive boyfriend was her false witness in the dvo he coached her to file. Disprove lies, I'm told.

I am currently dealing with Conflict of interest and politics corruption . My case was filled early 2019 has had over 35 continuances has gone through multiple days of trial trailing no preliminary hearing . Political corruption has come to light through emails between the DA , the local PD and the City government I work for. No criminal history whatsoever now the DA after 5 years is requesting. CPO and DA union president has assigned a felony team to the case. Would love to hear thoughts about this 🎪

What if i have evidence but have no witnesses? Im the defendant. Trying to prove my innocence.
Also iv been contemplating filing a dvo in defence. Because i had been going through abuse and this dvo is another form of abuse towards me. How do i do it? And what if one of the abuse is the other person getting othsrs to abuse is that considered dvo?

My friend or someone I thought was, my friend got an EPO on me, and I honored it to a T and now they are saying more lies in the Police delivered me more papers, and it involves the word kill, and I am scared to death and I cannot find anyone to represent mein the hearing is on the 22nd of this month
Long time ago I printed out evidence of text messages on messenger proving my innocence and the judge wouldnt look at it because he said it was "hear say" I still dont understand when the incriminating words came straight from the so called "victim". 🤦
Our system is very old and you have to burn your video to a CD and submit that otherwise they will confiscate your phone for evidence for 30 days. One guy said he never got his phone back. You can’t find a laptop these days with dvd drivers anymore. 😮They won’t allow you to email the videos or put them in a usb stick.
Horrible, but I’m not surprised. I carry around an external DVD drive for when prosecutors drop CDs at the last minute

I have an upcoming hearing with the same judge 🤦🏼♂️ and she definitely reminded me that she will be the one the sees my case ( basically telling me that I shouldn’t have did that ) I responded “ just be fair “ !

Threats of Violence or Terroristic Threats.
If you weren't released when you asked to be that could also be considered false imprisonment.
Get the police involved and reach out to a lawyer. On the internet no one can really give useful answers let alone any kind of advice.
Next time get the police involved the moment you need to leave. Have them speak to the stalker and escort you to your car. Their testimony is stronger than any one else's short of video as far as I know
Hey, I have a tpo hearing coming up on the 25th of this month. My son's mother is trying to break a parenting plan by lying about "family violence" claims. Do you recommend always hiring a family atrroney if I can? I don't have the money but I believe I can up with it for an attroney. My son is extremely important to me
If you can hire a good attorney, do it. My test for whether they are good (in California) is whether they recommend filing a written response. If they do recommend it, IMO, they are not good. There is usually almost no advantage to filing a written response and a gigantic downside (giving the other side notice of your defense so that they can think of new lies in advance). One family law attorney admitted to me that they file they only because it’s easier to blame the client if you lose and less pressure for the attorney at the hearing.
If you can’t afford a good attorney (there are lots of bad attorneys who handle restraining orders) then you honestly might be better off representing yourself. (The course I made on this is worth at least checking out if you’re considering doing so; defeatthedvro.com was literally created because many people in this position can’t easily afford a good attorney.)

@@stevebutter3k You're welcome! Keep in mind that I'm only licensed in California. It's possible that a written response is required in other states; I really do not know. (I would suggest asking if it's required and, if the attorney wants to file one but it's not, ask why. There may be some reason that is not applicable to California but makes sense for Georgia, like maybe judges expect it there.)
