      @@Jack-ld7ku among other things, yes. To quote a comment I saw recently on another video: "I did some research. Bruce was divorced from Michael’s mother when he was 5. A year later she took her life. When Michael got a little older this was explained to him. He went into a multi year meltdown, hit the drugs and alcohol and was furious with his family. He was in and out of schools, not completing high school and going to treatment programs. He got a GED in one program but had multiple encounters with the law. Bruce remarried. Michael got into the same college his parents went to, but it was hard picturing his mother being in the same classrooms, etc. He squeaked through the first year and ultimately finished with a 4.0 in his last 15 classes. He was interested in law and communications. It takes a lot to move beyond the years of unhappiness Michael and Bruce had but obviously no grudges held. I’m quite sure Bruce could not picture himself working with Michael and this show must have been a great ego builder for Michael. They certainly have been to hell and back but the operative word is “back”. Huge respect to both of them for weathering a category 5 storm and hope all the days ahead will be blessed. As a parent, I can see why Bruce is now beaming when he talks about his son."

    When my son was in grade school he would act out and misbehave. My son told my parents and me that voices in his head tell him to do things he knows is wrong. We had a lot of therapy sessions and it was all worth it. He is in his 30’s now and well established. Please do not ignore or dismiss the signs!

    This happened in my town, so sad. I'll tell you what, these cops aren't playing any games anymore out here. They arrested my 17 year old son and a couple of his friends on Halloween for chasing and Scaring some kids with a fake plastic costume knife. I don't blame them honestly. It sucked for my kid, but he learned that we have to take these things seriously. My prayers for everyone involved in this tragedy.

      @@karenhearne I can see how defending an obviously guilty person could be seen as "bad" but really everyone deserves representation. A defense attorney is basically the last line of defense from a corrupt system. They can't change the facts of whether someone is guilty or not. They can point out holes/flaws in the prosecutions case and get things removed that shouldn't be on there in the first place, but they can't change the facts. So in the end as long as the police/prosecutor do their job correctly, no shortcuts and nothing illegal all criminals will still end up facing the consequences to the crimes they can be proven to have committed. Without them our legal system would be even more corrupt then it already is. It is amazing the things prosecutors are allowed to get away with.

Additionally, juveniles are more likely to be rehabilitated than adults after heinous crimes because they are still neurologically developing.

    Hi Bruce. Having a child murdered - and having a murderous child - are the worst things that could happen to any family. Truly awful. Thank you for showing compassion for both families. I also appreciate you talking about this case in the context of George Stinny, Jr. Grateful that the moral compass of this country has evolved somewhat since Jim Crow.
    During yesterday's guilty plea, the judge asked a litany of questions to verify that Fucci fully understood the implications of his plea. Early in the series the judge asked about medications, and Fucci's answer was striking. He is prescribed Remeron (major depression/ptsd), Lithium (bipolar), and Zyprexa (bipolar/schizophrenia/major depression). This kid is nuuuumb right now. Unclear whether or not he was receiving treatment of any kind before the incident, but today he is in a poorly state. Two years alone with one's own thoughts is a long time.
    In order to receive such medications, he needs to have spoken to a professional about his mental health. What bearing, if any, could those assessments have should he appeal or his guilty plea come up for review? If I recall from yesterday's broadcast, the convicted person's sentencing is automatically reviewed at 25 years. Had the trial continued, would the defense have needed to turn over the outcomes of these medical appointments to the prosecution as part of discovery? What role could the outcomes of these medical appointments play at sentencing now that he has pleaded guilty?
    Thanks as always for the excellent content.

      Bruce, I somehow find myself despising the mother of Aidan Fucci somewhat more than the boy…but I think they are both monsters 👿. The fact that she was caught trying to wash all of Tristyn Bailey’s blood out of her son’s jeans to hide his involvement in her death is chilling. It makes one wonder what all she has done before to protect him from his atrocities.
      I believe that, instead of prison, young murderers like this should be locked away from the public in a mental institution-instead of prison-for a long time (maybe forever). However, so many mental health experts seem intent upon believing that little monsters like this are miraculously healed after a little therapy and are released…free to kill again. Like the many judges who only slap rapists-and men who assault women-on the wrists, give them light sentences, and then let them go free to rape and assault other women again. I read about it time and time again.
      Bruce, I understand exactly what you are saying. What was done to that poor little 14-year-old African American boy was barbaric. It was during a time of horrific racism and the treatment of black people in our country was unforgivable. And in some places and instances, this type of racism is definitely still occurring in some form-in policing and our justice system.
      But what do we do about the young Aidan Fucii’s and the 6-year-old who shot his teacher? These children are so aggressive and are clearly so dangerous to others that they can’t be allowed freedom to continue to live among us when they commit these heinous and abnormal acts. And their parents?…those who have done nothing to help their child or stop them, ignore their behavior, or even help them to avoid punishment? Clearly in these cases, and others like these (like the Uvalde shooter) were aware that their children were dangerous and did nothing about it. Obviously though, there are some instances where it seems the parents were completely unaware that their child was planning to kill (like the mother of one of the Columbine killers who wrote a book about her devastation and how she was treated because of what her son did). But all this just proves how important the proper guidance of parents is to instill such things as empathy and to recognize unhealthy behavior in their child early on. And it shows the effects that indifference, neglect, and abuse by parents has on children; as well as how important it is for parents to keep tabs on their children about where they are and what they are doing and who their friends are. The parents of both Fucci and the 6-year-old were aware their child had a history of being violent. And don’t you know that that the parents of Tristyn Bailey were devastated to learn that their daughter was sneaking out of the house after 1 a.m.?
      Bruce, it’s obvious that you have a good heart, and are an unusually compassionate and ethical defense attorney and a good parent. But do you really believe that Aidan Fucci and that 6-year-old can be rehabilitated? I think you do. But it’s been reported that being in jail has not tamed Fucci’s aggression one iota or shamed him in any way, as it’s been reported that he’s been so disruptive that he’s threatened guards and extorted other inmates to the point where he’s had to be chemically restrained. I have the impression that decades of therapy and medication will not change Aidan Fucci. And the 6-year-old? Time will tell.

    Watching the video of Fucci when he was alone in the police interrogation room, where he knew he was on camera so he pretended to be insane, just proved to everyone he was not insane. He was so obviously acting. He was looking all around, bug-eyed and with an exaggerated and confused look on his face like he was hearing voices. He was well aware of what he did and why he was there and he knew that he had planned the murder and that it was wrong. The facts in this case are sickening. Fucci was known to torture animals and he told others that he wanted to kill someone (and was deciding who to kill) and he planned the murder. He even decided on a girl he knew liked him, he stabbed her over 100 times, and his mother knew he had hurt or killed someone because of all the blood on his pants and her reaction was just to wash the pants (indicating she knew he was capable of the crime).
    IMO this young 14 year old was a serial killer in the making and I don’t know how he could possibly be rehabilitated. And the mother turns my stomach.

But with so many governments trying to hide the horrible acts of rac!sm they participated in, I doubt it will be told. In short - his story is he lived in a segregated town where these 2 little girls crossed into the Black side of town to look for flowers. They asked Stinney and his sister for directions, then they left and no one had seen them since. When the cops found them, they said they died due to blunt force trauma at a level this baby couldn’t have inflicted. But still they arrested him, kept him confined for 81 days!!!! Without his family or a lawyer and then said they “got a confession out of him” but other than the cops saying this, no one else ever saw him say this and he never said it in court. He only got to see his family once before the government killed him. This baby spent his last months of life alone ! His family lost everything - dad lost his job, they had to move to avoid lynching and couldn't even get to lay his body peacefully!!! A white man from a very rich family confessed to the murders on his death bed decades later… I am just so tired of hearing about how much we continue to fail Black people, and in turn, fail everyone else! the murderer lived freely in his community amoung the public because of this racism!

      I don't think you can ethically try a 14 year old as an adult. Cases like this are why we need ROBUST health care infrastructure and massive investment in the mental health sector. Mental health is just another part of overall bodily health, and it should be treated as such. Under this regime, anything beyond basic primary care is seen as some kind of extraneous add-on product that you, the customer-patient, have chosen to consume. Somehow, your physician is basic care, but your dentist is not. I can get boner-pills over the phone with essentially no friction from the private practice doctors that the boner-pill website sets you up to video chat with for 10 minutes so you can get your subscription prescription, but diabetics cannot afford insulin because they literally need it to live and it's too profitable not to jack up the price... and if a few of those pharmaceutical executives suddenly found a conscience, they would promptly be replaced by others who had not.
      It's as if we've gone past the point of human control of this thing, and it has instead become a mechanical institution. By definition, such a thing can not regard life quality as the end goal because there's no money to be made.

    As one who works in Forensic Psychiatric Healthcare and CJS & CDJO I have NEVER thought it appropriate for a juvenile, or "child", to be certified as an "adult". Two different brains. Two different systems. Until the CJS, both Adult and Juvenile facilities have made radical policy reforms, deprivitization regulations they must remain separate. In NO case, should a 14- 17 yr old child, regardless how horrendous the act, be "gifted" into an adult penitentiary.

    I'm generally not for capital punishment, but I'm DEFINITELY not for capital punishment if there can be ANY doubt whatsoever as to the guilt of the defendant. However... if an adult stabbed someone 114 times, and there was no doubt whatsoever that he did it, I'm for capital punishment. I strongly believe in redemption, but I don't see coming back from that.

    For anyone that feels on the fence about the death penalty, I highly recommend the last week tonight episode on it. It breaks down the entire picture, and frankly, once you see the reality of it, I find it impossible to support. As Bruce says, even one innocent person being wrongfully sentenced to death is too many.

    • @escrowfreelancer5613
      @escrowfreelancer5613 Před rokem +4

      It’s this mentality about one too many that leads to more deaths. Because murders and offenders are left to work free. The stricter the penalty the higher the likelihood of deterrence.

      @alexpopov6661 Před rokem

      The same thing can be flipped right back at you, the mentality that giving the government control of who gets to live or die will lead to more death. More tyranny, and gov already likes to play god too much

      I bet being stabbed 114 times felt way worse for this terrified young girl. How in the world can you care about him feeling some pain before death when his victim was so cruelly brutalized this way? I'll compromise though, how about a bullet to the brain instead of the drug? That's way cheaper and quicker.

    I cannot say how strongly I disagree with ANY minor ever being tried as an adult. We ascribe limited rights to minors on the presumption that they are not developed enough to handle the full rights and responsibilities of adults.
    We have a juvenile justice system because minors do commit crimes that require a societal response. That is the system that should be handling all minors, no matter the crime.
    If legislatures feel that the penalties available to that juvenile system are not adequate, the correct way to fix that is to amend the system, not to pretend that a child is an adult where convenient.

    There were so many links in the chain that lead to the murder of Trystin Bailey, so many kids who knew what Aiden was planning but said nothing; who knew that he said repeatedly he was going to kill someone and wanted to be a serial killer, but they said nothing until it was too late. If any one of the links in the chain leading up to this murder had been broken, the whole thing might've been prevented.
    EDIT: Ethan Crumbley, "The Oxford High School Shooter," was 15 and plainly mentally ill at the time he killed 4 students and injured at least 2 others (including a teacher) on
    30 Nov 2021. He had asked his parents for mental health treatment, being either ignored or told to "suck it up." He wrote extensively about his "dark side" in his diary, and that he considered calling 9-1-1 on himself in order to be taken to a hospital. He ultimately decided against this course of action, fearing his parents would be angry. He wrote words to the effect that, because he couldn't get help to control his dark side, it was causing him to shoot up his school. He also plead guilty and got a life sentence. What he went through for years is heartbreaking to read.
    His parents are being prosecuted on 4 counts of involuntary manslaughter, for their roles, including the fact that they bought their troubled son a 9 mm Sig Sauer as an early Christmas present, a fact they broadcasted on Facebook and Instagram. If you want to read the entire appellate court opinion that holds the parents accountable for their son's crimes, here's a link:
