    I feel sorry for his family too. His parents are both retired, one sister was a school counselor and lost her job, and his other sister got fired from her job too (according to interviews). No wonder his family hasn't been to visit him in jail. They didn't kill anyone, yet his family's life has been changed forever.

    Thank you Bruce and Michael Rivers for your channel and what you do. You have an 80-year-old fan who watches all of your videos and admires your integrity, intelligence and wit, Bruce. I enjoy the law and watch many of the trials being televised and subscribe to many of the true crime channels. Years ago I was twice employed as a paralegal-although for lawyers involved in civil law (very boring), not criminal…but I would have been fascinated with criminal law.

    Some reasons defendant might "stand silent": (1) prosecutors and defense attorneys are in the process of negotiating a plea agreement; (2) high profile case and defendant wants to try to lessen public outrage if he were to state "not guilty" as opposed to having the judge enter it by default; and (3) defendant wants to be "different" and difficult.

      @@weeshirley5934 I suppose it could be about what prison they get to spend their life in? Newer prisons often have better facilities not just for guards, but as a byproducts for safety of the correctional officers, the prisoner spaces are also more functional.

      I read an article which stated an inmate who is incarcerated with him says all he watches is coverage of himself so he's going to make a statement by being silent, and he's going to watch that too. He was getting his Ph.D. so he obviously knows about criminology and probably thinks it is some kind of strategy. I wouldn’t be surprised if he takes the stand.

    A 72 year old man was convicted of armed robbery. At the sentencing the judge sentenced him to 30 years. The old man said that he would be 102 years old and that he couldn't do that much time. The old, grizzled judge looked him in the eye and said, "Well, do the best you can".

      I am in Australia and these court processes are nothing like ours . In fact once someone is arrested, then no public discussion is allowed . The jury is anonymous forever and are never allowed to discuss the case before , during or after .

    As someone from Idaho, I understand we have plenty of cities and counties that are unusual, usually because they have roots to the Native Tribes of the area. But it's pronounced LAY-TAH county, and MOS-COH (with a long O). Hope this helps!

      I recently found this Channel, and love it.
      I would love to hear what he has to say about Tiffany Marmaduke. The case is very interesting.
      She worked at a mortuary and her job was showering the bodies to prepare them for funeral. She noticed a man had an erection, so she climbed on top. Later she discovered she was pregnant.
      After giving birth she filed a child support case with his family, maybe the estate.
      She was arrested.
      I would love to hear what he has to say about this. I am pretty sure your comment will be read before mine would.

    Greetings from Ireland. This case was huge news here and in the UK. Thanks for covering it. It's such a tragedy. Hearing the anguish of the families really brought that home to me. Four lives of young people with such promise snuffed out in such a short time. And four families destroyed and for what? For a sick fantasy, probably.

      @gaiaiulla it really shook up our community, and still kinda does. My boss, who is also one of my closest friends, is friends with the parents of one of the victims. Bruce mentioned there was a prior encounter of some kind at a coffee shop. And, as far as I know, there was also one on the night of the murders. Apparently, one of the girls had snubbed him ata bar earlier that night. That’s not 100% certain, but it’s one of the narratives locally that remains in play.
      But, he was also studying serial killers, and was a “star pupil” of noted forensic psychologist professor Dr. Katherine Ramsland, who worked with and wrote about the BTK Killer, and others.

I'd like to say how sorry I am that your community has had to deal with this tragedy. I'm sure I'd be horrified and maybe a bit scared considering y'all live in a college town. Does everyone believe he is guilty, or have you heard of any who think he's not, and they're afraid to admit it? For the life of me, I can't believe that everyone in town believes it, or at least doesn't question how he was able to do all that, and leave two others behind.       Phonics....most adults know to write a name like it sounds if they can't pronounce it properly...it's how tv anchors and radio announcers have pronounced words and names correctly for decades...it's NOT rocket science. Mispronouncing names is disrespectful especially when the person is deceased.

    My question: Why is the State so apparently adamant about keeping whatever evidence they have against Kohberger a big secret from the public? If the case is an obvious "slam-dunk" conviction, why not tell the world what it's all about? Eventually, it has to be disclosed anyway. What's the big secret?

    Papa George, of LYK...Peter Tragos, has 40 years of experience and agrees this "silent" aspect is unusual. He did say it could be due to the possibility of civil claims by the family members of the 4 students that were mur#ered.
    I'm grateful for most of the attorney's that create factual and truthful commentary on legal cases. I never miss a Bruce Rivers video as you're top tier, imho...💜

      At this stage of the proceedings, a silent plea or not guilty plea on his part would be irrelevant to future civil proceedings unless he pled guilty. If he is offered a no-contest plea bargain to resolve the case, that might be useful to him. It just means they couldn’t use the plea as evidence.

    Idaho rarely has grand juries. According to a DA friend of mine, this DA probably did it to save the roommates from testifying until trial. He also said standing silent is very rare here too.

      Rarely has grand juries??? What the hell you talking about?? All felonies need a grand jury.. that's how indictments are returned.. I'm not sure what you mean , but unless those felonies are resolved somehow in lower court, i.e. dismissed or reduced to misdemeanors, the they go straight to a grand jury who determines if there is even enough evidence to support the charges to be tried . They either return a. "true bill" ( indictment), or a " no true bill" ( it's over with).. in the case of a true bill it goes to high court for further proceedings, jury trial ext...

    For some reason, I’ve missed this entire case/crime; just been away from social media and I’m not American. It’s interesting, with the gag order, how different this case reads in the news. Without evidence being known the news really has nothing to report, and so many articles are more “reporting what is known,” and while some articles are still trying to infer guilt, it still makes me think far more cases, especially sexual assault cases, should have a gag order to keep the details of the case out of the media. It makes it a lot harder for the media to simple throw in the word “allegedly” before going on to destroy an individuals life, if there isn’t much they can talk about, until it’s heard in the context of the case.

Not your speech about a crime, not what you say on facebook, not what is in the comments.       Issue is that whatever behavior he displays it can be construed as conscience of guilt.
      Laughing and lighthearted? It's not because he knows he is innocent but because he is calleous.
      Serious and silent? It's not because he invokes the fifth but because he is cold and calculating.
      Collected and rationally talking? It's not because he is convinced of his innocence but he is - again - cold and calculating.
      Crying and emotional? It's not because he is facing a lifetime of prison for what he didn't and sympathy for the victims but he is 'only sorry for himself'.
      You can not win.

    WOW, I'm impressed with Bruce's analysis. Most other sites are trying to make the silent plea a nefarious thing when in all actuality Kohberger was never even asked how he pleads. It was asked of his lawyer.

    If I remember correctly, standing silent allows you to change your plea with little judge oversight. If you plea not guilty I think that there has to be trial that goes to a ruling so you can't really make a plea deal mid trial.

      Yes, once you get a plea deal, you have time between hearings to make a decision.
      Once the hearing comes for a decision on trial by jury or by judge you then have the opportunity to take the plea for the last time, if not you will then get to choose which trial you would like to take. Big cases like this is normally done by jury.
      I don’t think they will offer him one though

      What?? This makes no sense. Sorry I appreciate you opinion, but I’m almost certain it’s not out of the norm. The puts in the not guilty plea. Plea deals, only if the prosecution chooses to bring a plea-deal they can from this point until trial. Idk many who just plea guilty. There’s 3pleas you can enter, (mainly 2), Guilty, Not Guilty(most plea), our constitutional rights, must be upheld during this time until you have been proven guilty and have been sentenced. I feel a lot of ppl do not understand what our Rights are as Americans.

    Thx for the video and info regarding „standing mute/silent“: Idaho law professor Samuel Newtwon explained, that this is a tactical move in Idaho. There is no special plea if they would go for an insanity defense. Furthermore the defendant and especially his attorneys could now better negotiate with the DA (I do not why, but that is what the Mr. Newton explained in an interview). A „not guilty“ is often misunderstood as saying „I am not responsible in any way“ in the court of public opinion, which making defense much harder as it already is.

    This is a genuine question. How does it feel to defend a defendant that you know is guilty of said crime? I know everyone deserves a fair trial, but I’ve been on a murder trial as a juror and the lawyers of the suspect obviously knew they couldn’t win their case. The evidence was so overwhelming. Anyways, I enjoy your content. Keep up the good work.

      i wondered the same thing.. but i think i once heard a CDL said that they just tell the defendant to take the plea deal to avoid the worse outcome.. so in Brian’s case; i assume he takes the guilty plea so he doesn’t get the death penalty

      This judge was working other cases all the way up until this hearing. People misread, mis pronounce names all the time. Some people just don't follow a case just because it's high profile. Especially when you work in the court system. Sometimes you just don't want to see or hear anything about crime after working around it day in and day out. He may have thought the Kaylees name was misspelled or pronounced a certain way, giving how people spell names oddly these days.
      I watched a CZcamsr today criticize him for getting the names wrong, claiming that even though he loves 5000 miles away from America, he could pronounce them all and he mispronounced the Goncalves last name himself. So he sounded pretty stupid.
      Just because someone makes a mistake doesn't make them disrespectful. Judges are always super busy.

    You need to study this case further, I have been following it since it happened, and my perspective has changed a lot. I think there is way more to this story, Kohberger may have been involved, but I'm not convinced he is the murderer.

    I'm wondering if the "standing silent" plea is strategic in terms of future appeals? Also, I never really thought about murder sentences generally running consecutive. Seems like a lot of other charges they run concurrent (or at least in NYS). ✌️❤️🙏

      I think "life without parole" running consecutively would make the families feel better. In practical terms, the guy hasn't got four lifetimes to give up, but at least each victim is recognised by a life sentence, rather than one quarter of one life sentence, if they were run concurrently. That's how I'd feel. I usually tend to feel that concurrent sentences end up being too lenient.

    I saw a video of a young girl arrested for DWI. Apparently, she was a drug dealer who was implicated in the drug overdose of a University of Idaho student. The drug was Fentanyl. She appeared in photos with one of the surving victims who took hours to report the incident at 1122 King Road. Wondering if the use of the drug was the reason for the delay in reporting the incident by the roommates.

      I feel uncomfortable speculating on things like drug use. It feels unfair to the surviving roommate involved. Sure, it’s always possible, but if there’s no real evidence other than her being in a picture with another young woman, then I don’t really think it’s appropriate.
