Of course that doesn't excuse her behavior but when I was younger, I took way too many risks and every time I see something like this, I'm grateful that age brought me wisdom instead of a tragedy that I could never have forgiven myself for.

Yeah and even though she was clearly intoxicated, likely benzodiazepines, AKA xanax, she did great on the sobriety test other than the pen eye test. The craziest thing is, half of society that's not in good shape cannot balance on one foot and it doesn't mean they're drunk. The tests are hugely flawed.

This is not from weed. Weed does not affect people like that. It is not debilitating. To my trained eye, this looks to me like benzos mixed with alcohol.
@@nicholascrimaldi1565 I recently tried to do the walk and turn test sober at my house and I failed it. I have a lot of severe issues with my back, so that might have been the cause of my issue. But yeah, I agree with you.

The cop said that her pupils were enlarged and I know that meth, acid, and shrooms are some of the other substances that can cause enlarged pupils. I highly doubt that she was psychedelic drugs or meth - which is a stimulant.

I'm a retired nurse and spent most of my career caring for patients who'd suffered neurological injuries or illness. Drunk driving vehicle collisions were responsible for far too many of the head and spinal cord injuries I helped care for and I will never NOT be angry at anyone too damned selfish to refuse to ask for a ride home.

Same here as a medical/psyhciatrci and NICu social worker. I saw more than my share of brain damage from substance abuse induced unintended consequences. So glad I’m retired. I gave it my best shot. It was rough at times but rewarding work too until the end when patients became more entitled and demanding.

So, feelings aside about having seen some tragedy from DUI, what do you think the chances are that she has suffered a neurological disorder as a result of the car that broke her leg as a child? She was also clearly in shock after she lost control of the car. Social anxiety. She held her own on the barrage of tests. I kind of wish she had taken the breathalyzer just to know.

That cop was definitely skating the line when telling her he wanted to test her. She had every right to refuse the test, go to jail and get a lawyer. When she was directly asking, he should have informed her of that right.

This woman was clearly under the influence of something, but it sure looked to me like she passed every field sobriety test. What's the point of field tests, if passing them doesn't get you out of it?
I think the point is to determine if the person is drunk or on other drugs. And to help secure a conviction
the point is to give cops reasons to say you were drunk, there is no "passing" a field test. its just a trick to give them data
Because they're not past or fail. They're only to look for indications and see if you can follow directions.
Looking for indicators and having more evidence for their case, that's why they have to say directions in a certain way too
That exact thought is why you don’t do the tests no matter what. The test is made to make you fail. When you deny they just take you to jail and do a blood test. They will even try and threaten you but just say no

I was in a custody battle for my daughter. I couldn’t afford an attorney so I had to become one. Lol Not literally, but I had to do a lot of research and represent myself in court. But it all turned out to be worth it. That was almost 10 years ago. My daughter and I are doing great. She turned 11 this year.

I hike almost everyday throughout all seasons but i have custom inserts in my shoes. I even struggle walking heel to toe completely sober because my natural balance is off and I am very active. I can hike for twenty miles but walking heel to toe makes me look stupidly impaired. most people don't have as much balance as you would think. I am in no ways excusing her behavior but a lot of people don't have the balance they think they do when they need to stand on a line with people watching. completely sober with my balance issues I would probably fail and that's exactly why the heel to toe test is used because any type of stutter or unbalance is deemed as a failure.

Most of us have a family member or acquaintance killed by a drunk driver. Painful. My friend and neighbor went to prison 8 years for motorvehicle homicide. 2 years after release he was killed by a drunk driver. What are the odds ?

She point blank asked him a few times if the tests were mandatory and he gave her evasive weasel answers that in my opinion took advantage of her messed up state. Probably legal, but gross sus.

But nobody assessed her mental status to make that determination. Being drunk or high has very similar signs and symptoms to a head injury. She was not oriented to place or event in the video. The mechanism of injury strongly suggests a possible head or spinal injury. Asking "Do you want to go, or no," isn't adequate. Once she is placed under arrest, she can be forced to go to the hospital. We don't see that part of the video, but I suspect she went to processing at the jail, not to the ER. Apparently everyone on scene had x-ray or computed tomography vision.

Cops played her on her questions regarding if she had to take the test. Remember the police’s job in these situations is to get you to give up as much information as possible, especially self incriminating information.
They didn’t lie to her. They’re not mandatory but they’ll have to judge based on everything up until that point if she doesn’t do them.
I do not condone drunk driving but the cop saying doing the roadside tests is a "chance to tell your side of the story" made me laugh. No...its not. Its his chance to get even more evidence agaist you. Sober people fail those tests, never do the tests except the breathalyzer (esp if you arent drunk, you want to do the breathalyzer) because that impacts your license if you refuse that.

He stated the breathalyzer is non admissible in court, as well as gave her the latter option after failing the FSE. Maybe the moral of the story should be don’t drive drunk and high and you won’t have someone trying to “stack evidence” against it?

She moved her head during the eye test. She only counted 22 seconds on the 30 second count. Her nine steps and turn around weren't heel to toe. The last test was ok but thats because heroin addicts have incredible balance.
It’s a simple think to keep your head still, I go to my ophthalmologist a lot and never have any trouble holding my head still, the differences is I haven’t been drinking or doing drugs

You know, I support law enforcement and in this case, this woman was clearly under the influence of some substance, seriously injured, or has a pronounced physical or mental impairment. I don't see why he needs to lie to her, telling her he just wants to see if she is good to drive. His intent is to see if she was impaired at the time of her crash. it seems a small thing but still, if a person starts out lying to you, why would you trust them? If you are a liar, why should people respect you?

Never admit to smoking weed or drugs or alcohol!!! They will always use that against you. The fact she admitted weed even 7 hours prior or more that was probably the main reason why the cop wanted her to take his "sobriety" test. Never take that test, or volunteer to give them anything to use against you!!

@@sixtycats8652 it depends on the state and situation. They might be able to force it but usually that is only if they're was an accident and there might have to have been injury for that. They probably will take your license depending on the state but what is worse having to lose your license for a few months or giving them more ammo to use against you when you're trying to fight it in court?. If they don't have the "sobriety test" and breathalyzer they will only have the cop saying he smelt alcohol or bloodshot watery eyes. This case since there was accident they probably will be able to get a warrant for blood but not all cases are like this one right here. Most of the time there was no accident at all. I'm saying in general it's never a good idea to help police make a case against you.
I’m going to say this again 😂 there is no passing of the field sobriety test. They only do that to cover themselves so your lawyer can’t say you weren’t given the chance. Once they ask you to do it. They are taking you to jail period. So you might as well deny the breath test and lose your ID for a year. And don’t drive drunk
Not true. I've had a field sobriety test and was sent on my way when they realized I wasn't intoxicated at all. I made a left on red at about 3 AM on my way home from a job, forgetting that you can only do that on a right turn not a left. I did get a ticket for running a red light, though.

I’m talking about the ones who’ve had 1 drink or 10 drinks or 1 pill or 20 pills, or 1 blunt or two blunts, etc . Either way once they smell it, or you admit it, or they have obvious reason to believe, once they ask you to take that test it’s over. They can’t take a sober person to jail, that’s common sense

She passed the field sobriety tests as far as I could tell. She may have been under the influence of something else or fallen asleep at the wheel. It's 4 a.m. and obviously, according to her answers, she has been up awhile.
Officers don’t care. Once they’ve asked you to do the field sobriety test, they are already planning to arrest you. They are just trying to make you look more impaired for their “investigation” before they do so. And a field sobriety test is a good way to do that. Especially since most people lose their balance even when sober.
Did you not watch the video? She tested positive for alcohol mixed with drugs which by my best examination seems to be benzodiazepines.

You can't expect common sense from the general population but we should always expect common sense from the rules created. Asking someone who is wasted, drugged, and just slammed into a light pole if they need to go to the hospital is not common sense. Just like a drink person cannot consent to sex, a drink person has no idea of they are injured. We should be much more advanced than this.
I got pulled over in CA about 30 years ago with the car reeking of weed and a half joint in the ashtray. They had me do the field sobriety test and apparently I did very well because they only asked me to drive to a diner nearby and have a cup of coffee before continuing...that was it...
That was back in the old days before people were very responsible about letting people drive drunk/stoned. It was NOT a good thing.

Such a shame that this many emergency vehicles, and personnel were wasted on a call that didn't have to be if she was a responsible person. People should have to start paying the damages and time incurred when they cause mayhem due to their illegal actions.

That’s the story of American Police everywhere.
Ambulances literally just drive around "looking for work". That's why they try and convince you to take a ride if you have a scratch. They get roughly 3k for the ride to the hospital. The fire trucks were necessary because the light pole falling could cause a fire and also the car accident it's self. So I wouldn't say it's a waste..

Dont know why but i feel sorry for her. She seems like a really sweet girl, she's young but was very polite and corporated with the police officer. Pretty funny when she told i dont think my car is drivable 😂😂😂

I have to give her props for her response when the officer asked her if she'd be willing to do some tests to make sure she was good to drive, and she responded with, I don't think this thing is drivable. lmao!

She was probably on the phone shes addicted to ! Which is a huge problem too ! They can't listen, walk, or talk without a phone in their face really , we have fired people at out job because they literally can't put down their phone for their shift !
