I called the VA at 800-827-1000 and inform them that:
“I would like a summary letter/disability breakdown letter to include, all my service-connected conditions, percentages and diagnostic codes.” (If you are not service connected, you will not have one). Also, you can have them email or fax (if you don’t have a fax at home, you can download a fax app in the play store on your phone) this information, if the person doesn’t want to email or fax it, hang up and call back and speak to someone else.

LAS VEGAS.????
Restless leg syndrome c&p Monday. 25 years later.
Ft Hood
When you said Ft Hood and Back I laughed. I was stationed there and deployed with 4 ID. During my first tour in Iraq in 06, I hurt my back during a patrol and going to sick call to get a shot in my back to ease the pain, drink water and drive on. Well fast forward when I got out my file during my first rotation was lost “ due to the army changing from psychical to electronic.” I am 100% but when i claimed my back I didn’t even get zero percent. The funny part in all this, I used to work as an ASVB test administrator for DOD and during my time on IRR, i got chaptered out of the IRR because of my back. They had a major as my attorney and during my court hearing they made me stay on the phone while they chaptered me out. This was during my work hour when I was at a school to administer the test to students. I was so pissed and told them this is so unprofessional even when I told them the days i was working. I literally was outside a classroom and just said yea yea please speed it up because I am doing my job. The major that was representing me assured me things will be smooth before the hearing and during it not one word but when I told those officers this is bs, she told me Fred please try to keep your bearing. My last words on the phone was this is the reason why I left the Army after 4 years with a 40K reenlistment offer and promised me e6 promotion board. I told them this is bs, you got other soldiers willing to reenlist and make it a career and they had nowhere near my offer. I made it clear during my two years as an e5, the army is getting the best part of me for 4 years and out i go. I told them do whatever with my chapter out of the IRR because I didn’t can care less. Before I hung up i said have a great day and I will definitely enjoy mine because it feels really good to be able to walk around with my hands in my pocket. I got to know how the army worked fairly quick on active duty and did myself a favor before i got out. I made sure I had them print out my med records on hard copy and being the smart ass that I was, after the first one was done printing I asked for another one to be printed as well. I can get chaptered out for my back but since there was no record of it during Iraq, I got denied for it. I am 100% so I am not ever pursuing it because I don’t want to give them anything to give me a hard time or really dig in my file to screw me. The army as a whole can be ate up, i am just blessed that I got to deploy with two different units that had good leadership that allowed me to grow and showcase it as well. Writing about this really sounds so ridiculous and how the army really chaptered me out over the phone. 🤦♂️
PS I wont file for my back but do you think that is a case to argue for someone if they were denied claim for their back like this?
You know the saddest part of it all? We have to fight the ones we fought for!
That is so true and some of them are vets themselves.
As a Senior NCO in the Army, I was DETERMINED to document ALL of my medical issues, because that’s what I always told all of my troops to do; lead by example. I received hate from higher for this. I was called a “poor leader” and a “shitbag” for missing time due to surgeries from injuries. I was bullied, badgered, and abused, and they attempted to intimidate me to take an early medical retirement. I refused. I continued to do a damn good job, I passed ALL of my APFTs, and was never on weight control, and I completed all assigned missions. It didn’t matter. I received a LOT of hate. I gave the Army my heart, soul, and body. I retired with 30 years of service, and am 100% P&T with the VA.
Thank you for your service and being an NCO that cared about the troops. I had some NCOs that didn't care about their troops and I made sure I took care of my troops when I became an NCO. The worst part of the Army is the possibility for toxic leadership. Sorry you had to go through it as well.
Amen brother. If you served, you most likely encountered some of that toxic leadership.
I took a lot of time to go to the clinic too and I got bullied a lot. Unfortunately I reached a breaking point and reacted negatively and got myself demoted and I'm being seperated on high year tenure for my rank.
Wow! Jeff, thank you very much for your service. I also spent 30 years in the service, enlisted, Air Force. I spent two years at Fort Stewart, GA (Air Force detachment) and three joint assignments with the Army, Navy, and Marines. We were highly encouraged to go to sick call.
My neck, back, shoulder, hips and knees are all kinds of jacked up from jumping. Ended up with just tinnitus from the VA

Great gouge, as a soon to be retired MSgt in the Corps at 20 years! I took advice from peers and prior leaders and started getting seen for everything I didn’t as a young devil dog at 17 years. As a young motivator it was frowned upon to go to medical, as a seasoned warrior it’s impossible because we are taught to put ourselves aside for our subordinates and at the end of the day once the boots come off no one cares. Whether it’s combat, training, leadership it’s our responsibility to take care of ourselves! My advice to anyone behind me is please go to medical, file paperwork and get copies, never accept a NO and pass on the information you to learn! Thanks for the information because you are changing lives 💯
Say it again "we are taught to put ourselves aside for our subordinates". Some veterans "officers" do not believe me when I say this. Thanks for sharing. @@DewayneKimble because they are taught from OCS how important it is to take care of yourself in order to take care of their subordinates! It’s almost the complete opposite in the operating forces 💯
I was reluctant to see my provider because he was my flight Doc. As a flight med tech, our provider is whoever we are assigned with in flying squadron. Flight medic is usually attached to non Med Group sq. The rest are flyers, pilots, nav, intell, plus lingues.
I did same thing never considered trying to get disability at all. I retired in 98 and trying to get my just compensation. Due to very limited entries in Medical records. My circumstances since I was aircrew were different since as soon as we went to medical more often or not we were grounded which would impair the mission and we would be put on the black list of loyal aircrewman.
Amen!
i used to give homeless men a ride to the VA for a couple of years helping them get their disability and man i learned a lot and actually passed on what i learned from the others after this to help them and i wasnt even a vet, it was like i was getting justice for them

Who was your Camp LeJeune attorney?
After 17 months Thomas J Henry, a bigshot attorney in San Antonio dropped my claim because of the June 5th determination making claims harder.
I only have 31 days to file a Tier 2 claim for prostate cancer, depression, fatigue from the water, and PTSD from the cover-up.
Dewayne, I've been following your channel for 6 months now. This is by far one of the best informational videos to date. There are a lot of veterans that don't have their military medical records, but yet have their respective DD214 as proof of said MOS/Rate as proof or evidence. Thank you for your continued support & service.

In fact, its very difficult to obtain them. 3 times I am told they cannot find them in the national archives in MS.
I got denied Tinnitus twice. The VA would make appointments for me to get an audio exam. Although I honestly felt that I didn't do well on the audio exams, somehow the audio examiner would say that my results were acceptable enough to deny tinnitus. You can't measure ringing in the ear.
I have a video on my channel, explaining how to win your claim for tinnitus. You can go there and search for it. You can now get your signed copy of my new book "VA CLAIMS SUCCESS - Your Guide To Maximizing Your VA Compensation Benefits": store.kmd89.com/
There is no audio test for Tinnitus.
That’s what they told me at the VA I go to.
It’s all determined on what your job was in the military or the documented situations you were in.
Unless you claim it after you were discharged, which makes it hard to justify as service-connected.
@garymccord4087 I received mine after Va sent me outside va for the test. The test was given, that they placed things in both ears. An said stay still an quite. After was over he said yes you have it.
I was with the Marines a few months before 9-11. When we started fighting after that it was foam or the 3m ones. My hearings jacked. Later when rabbit ears were issued or bought life was good. Really was a full time hearing aid. Wish we got those just a bit earlier.
Thanks so very much for the information. God bless you and your family

This man is a genius. I just got placed at 70% for PTSD and 0% for migraines secondary to PTSD and all I submitted was my DD214 from Afghanistan. I looked up the definitions and the DSM5 criterion or whatever it was called. Glad he just confirmed all that. Will be watching how to win for tinnitus next.

Start a migraine log and submit as evidence. I went from O to 50 after a higher level review request.
It sounds like you've done your homework. Good luck...
my DAV lady really helped me with my PTSD rating which was caused by MST. It was turned down twice, until she found my Navy Evals and that was like finding gold. Hard to prove what happened when the people did things in private behind closed doors, the Navy Evals showed how bad I was struggling and i won and got my rating!!
Those evals served as markers. I'm glad to hear it worked out for you.
Same here for mst. Plus document from Dr. Stating him contacting my command 1st Sergeant. And one of the recommendations was to drink to clear the memory basically. So here came the underage drinking issues. Njp's art.15's til command 1st Sergeant sep'd me out. Sep'd me out cause like he stated "Boys will be Boys" no that's not how any of this works. Took over 16 years of multiple self ending situations and hospitalizations to finally get the help needed from the VA. I'm still unstable at times.
I’m doing a new claim now I have ptsd from MST when I discharged they put adjustment disorder instead of ptsd because they didn’t want to admit it happened. I was young and was just happy to discharge, even though I was hospitalized for a week because of the situation. Only got 30% back in 2006, when they tried to hide MST.
Getting help with claim now.

Thanks, Dewayne!
You are very welcome
When I got out of the military, I was the model soldier according to leadership that doesn’t want you to go to sick call. I didn’t document anything. Since I got out, my mental health has declined, my back has gotten worse, and my hearing is awful compared to people my age. I was in a special operations unit with two combat deployments and a bunch of jumps. I still have all my military records like deployment orders, dd214, airborne orders, jump logs, CIB award, etc… This is my first video of yours and it is extremely helpful as I get ready to submit my first claim years after my separation.
You have to get educated on the five ways of service connection. Also, I did a video on conditions you can claim due to be awarding the parachute badge. You can do a search on my channel for it. If you plan on filing for PTSD, make sure you file the correct form and provide detailed information of things you experienced. I wrote everything down and filed through the mail (this was 2013). Did a C&P exam and explained everything in detail. It took 14 months, but I got 50%. If you do that and your dd214 has service in hostile areas documented, then you SHOULD be able to get service connected
...of course I can only speak to my experience filing for PTSD. Every experience with the VA is different
@@thomastownsend2702 I was in a helicopter crash in the South China Sea while serving in the USMC 3rd Recon Battalion 3rd Marine Division. We spent 3 hours in the water before we were rescued. Every time I flight I am horrified and have to take pills to calm me down. Can I claim PTSD?
@@user-rs8ml3mh6o damn brother, I'm sorry you and your fellow Marines had to endure that, and glad you made it out alive. I would list everything that you can remember in detail as much as possible, and if you can include buddy statements from the other Marines that would certainly help. Any records of treatment, hospitalization, etc would help your case as well (if you have them). I would expect that you would be able to be granted service connection for PTSD, but it is the VA so you never know for sure. I would alao search "mental ratings VA disability" in Google and see what the severity of your symptoms are before you file a claim
I was told that I shouldn’t tell anyone about my problems. I could get kicked out for saying something. Or going to sick call, gives you a bad reputation. So I never went. In fact, I hand carried my medical records to Germany, and home. And I made sure there was nothing in them to make it look like I was a Slacker, or being sickly. I even cheated on my exit hearing test. Now I’m paying for it. They said my hearing was better, than it was when I went in. So they won’t give me any rating for hearing loss or tinnitus. BUT they recognize the hearing loss, and gave me hearing aids.
Sorry to hear that and many veterans did what you did while in service. You can now pickup my new book VA Claims Success: store.kmd89.com/
Dewayne, I would love to pick your brain regarding refiling a claim I previously got denied.
I experience the same situations. As an 0311 MOS Group Punder, I had to carry for miles on my back full Combat gear and during Cold Weather training in the deep snow up in main land Japan, my back snapped being forced to climb up a steep and snowy hill but I was too afraid to report it because I too did not want to be placed on the Slackers or Scatters bad list and to loose promotion opportunities. But as soon as I was Honorable Discharge I immediately began reporting to the VA my back injuries caused for being a Grunt in the Corps.
I was the same way initially but I realized that eventually I was gonna get out one day and I have to get things document it so
MAKE sure you go to sick call. Documentation is a must
Great information
I got service connected for lower back issues (sciatica, radiculopathy, ect) years after my service with no documentation about it while I was in service. I got service connected flat feet right after I got out with no in service documentation. I deployed twice and loaded c130s with heavy batteries in a hastly manner that screwed my back up. Only record is that i deployed and my mos.
Bilateral is where I got a lot of my ratings. After service connected, secondary is key.
You are correct and thanks for sharing.
Thnx for the info! I've worked on the flightline around fighter jets my whole air force career. I ended up with tinnitus. The ringing still kills me. Thank you for your work and support. Your truly a brother in arms. I was wondering if you might know. I got an issue, I was born in Mexico and I was in from 1992-1996. That would have to be documented. Unless you were Airborne.
I was a USAF dental assistant, AFSC 981X0. 5 days a week thru most of tech school and at my assigned, I was in close proximity with loud high speed dental drills for several hours a day. Add to that, being outside on base with T-37 and T-38 trainer jets overhead most days.

Hard lesson just learned. Even for the new PACT Act, Burn Pit, or Gulf War Syn, you MUST send in "diagnosis" docs from a doctor. Meaning, look for the specific verbiage the VA is looking for. I had "concedes" on several, meaning they ack my time there and where I was, even showing the "diagnosis", but they ALSO look for specific "exacerbations" length of time/frequency/type of affect it has on you. Now I have to do a Supplemental! My AM Legion rep really jacked me up by reviewing my packet and NOT suggesting to add those things to back up my claim.
Also, if you served in DS/DShield, YOU MUST have these things for a high rating, which the VA does 10%, 60%, and 100%, depending on the above info when it comes to service connection Lupus. Our numbers are increasing. Get checked, most docs don't test because the community thinks of Lupus as a woman's disease; typically docs say you have gout.
The exacerbation/length of time should only apply to direct, secondary in some cases, and 1 yr presumptive SC (compensable rating but that comes next). If you have a presumptive diagnosis claimed under PACT or OEF/OIF, and got denied for those reasons the rater violated regulation (C&UE).
There are examiners that do not believe in presumptive conditions, and all a rater needs is a medical opinion to legally support their decision. It doesn’t have to be right or wrong.
@@zeroturn7091 The Lupus was rated at 10% due to no provided exacerbation times/lengths, per their reply, in my original claim. I am assuming I can just do a Supplemental From 20-0995, providing my RA's notes to show I meet their 100% rating criteria (VA has a specific list, which was also in their reply). I also have the symptoms/written diagnosis of several presumptives, so another Form 20-995, or am I missing something?
Veterans should not have to tolerate this when it comes to receiving benefits.

Hello Dewayne - your videos are informative and I appreciate your tireless efforts to keep veterans well-informed to receive the benefits we deserve. The topic of this video sparked my interest but I was disappointed that while you state claims for tinnitus and hips can be filed without a medical record, I recently found out that is not the case. Despite being in the airborne / infantry and in US Army Special Forces, I was declined for both tinnitus and my hips. Another interesting fact is that I filed the L / R hips as secondary to my current rated disabilities of back, feet, and knees. The C & P doctors' report does not discuss secondary at all but concludes that my hips are not service-connected injuries. I never said they were! WTF? I filed the hips secondary claim with a VA Form 21-526EZ, included medical evidence, and a personal statement clearly stating at the beginning that this claim was secondary to my rated disabilities. I plan on filing a supplimental claim for my hips. Any other suggestions? Thanks. Dennis

Hi Dewayne, thank you for the video. Is it specifically Airborne? I ask because I was an Army Lineman (climbed telephone poles, etc). The BVA at least seems to acknowledge that the Lineman MOS is as bad as Airborne as pertains to lower back claims, etc. But what about at the VA level? What is your opinion? Thanks!
Your welcome and it's not all MOS's. I used Airborne and Air Assault as an example. It's up to the VA employee if they concede it may have happen due to the job duties and they have to follow the other VA guidelines.
@@DewayneKimble Thanks Dewayne. If I'm reading your reply correctly, there is not a rule or policy at the VA for Airborne, but it's just widely acknowledged and often applied? And that just as the BVA acknowledges Lineman, so could the VA potentially? Thanks
@@DewayneKimble Hi DeWayne, just got my C-File and looked at my foot conditions C&P exam and nexus statements. The VA examiner specifically mentioned my Lineman MOS as evidence supporting presumed in-service trauma (carrying/climbing heavy poles and cable reels, etc) which helped to cause in-service pes-planus. So it appears that in my case, my Lineman MOS, like someone with Airborne, helped my claim. Just thought I'd pass this along. I don't think there are as many Lineman veterans as there are Airborne, but hopefully this will help them if they read this. Maybe you can mention this in future videos when you mention Airborne. I never did any exam virtually but the 3rd party examiners are doing some of them. I don't know which one would be better in this case.
@DewayneKimble I ended up doing the in person ptsd exam instead of virtually. @@whitleywhitley2280 Every disease, injury, and medical procedure you have done while in the military on active duty is “service connected,” unless there was misconduct involved. For instance, if you get drunk while on leave, get behind the wheel and wreck your vehicle, resulting in spine damage, the spine damage will not be approved for disability due to your drunk driving.
If, however, you had the same accident and misconduct was NOT involved, your injuries ARE considered “service connected,” in spite of being on leave. In short, any female Soldier who has a hysterectomy while serving on active duty, it IS service-connected.

so if you are diagnosed with a medical issue within a year after discharge does that mean you have to file that claim within that year too? I separated from the AF in 1990 and a month after separation I started having problems with my gallbladder but they kept misdiagnosing it for almost 7 months when they finally decided to do an ultrasound and found I had gallstones and had to have a cholecystectomy. I never even knew about filing claims til I had been out many years, almost 30 years after separation I filed my first claims and was awarded 70%. However my claim for gastrointestinal issues was denied even tho I developed the issues very shortly after getting out. I did actually have some issues during service but since I was pregnant the last 9 months of my enlistment all my stomach issues were ignored or dismissed as just ordinary pregnancy related.
i have a documented fall and the examiners ruling was for my knee not service connected, denied because i didnt complain about it while i was still in service 🤦♂
Even if you have it documented in service, some examiners will still deny it.
