I'm glad I found this because I have a C&P exam tomorrow for Tinnitus. I filled out a statement in support and detailed all my exposure to "elevated noise" environments throughout my career hand how it impacts me today. My NEC (Navy) was in Aviation and included ships an flightdecks, is listed in HIGH category on the noise exposure list. I hope to have a successful claim after tomorrow. We'll see!
Thank you Dwayne for the insight on how to articulate for tinnitus and VA rating . Thank you also for continuing to educate us veterans on how to win our claims
You are right, I had a Field Artillery MOS so it was fairly easy for me to get rated for Tinnitus. But I know some other FA soldiers who were denied merely because they could not articulate how, when and where the Tinnitus started, which should have been fairly easy for them to do. Good info to share, Thx
Call me a skeptic Curious Relic, but if a veteran can't articulate what incident/incidents caused his/her Tinnitus, then in my opinion, they are probably lying about it and just trying to get free benefits. When you've had a significant loud noise event happen that caused your ears to ring (and it never stopped) you WILL remember it vividly. Or, if you've had prolonged exposure to loud noise, such as being on a flightline without hearing protection, using loud tools as a military mechanic, artillery, etc, you will KNOW it. And, you will simply state that in your VA disability application. It makes no sense that a veteran won't state that due to their repeated exposure to artillery blasts, they developed Tinnitus while in the military or just after leaving the military. It does make sense if they are faking though. I am rated for Hearing Loss and Tinnitus, and it was easy to write my statement in support of claim because I knew exactly what caused my hearing loss and tinnitus and I had in-service evidence and an MOS that backed up those statements. Every vet I know in my area who is rated for the same things also had no problem articulating how their problems started (actual combat, training accident, artillery MOS, flightline/helicopter, etc etc). But when I read the BVA appeals on the VA website, most of the appeals are coming from POGs who have to manufacture a reason for having Tinnitus. Yes, some legit Tinnitus claims do get denied and need to be appealed. But the vast majority I've read in the BVA appeals decisions are coming from people who are obviously either faking or exaggerating. Hearing Loss and Tinnitus SUCK big time and no one should be faking and stealing the valor of those who had legitimate incidents in the military which caused them to have this very uncomfortable disability. Sincerely, John
Adding on to my last comment, I believe this is why the VA is trying to remove the Tinnitus rating, because of all the fakers who are overwhelming the VA with applications. It's a shame, because Tinnitus sucks big time for those who legitimately have it from service.
I was denied Tinnitus last month because I waited more than one year to make a claim and that my MOS was "airborne" that is a designation not a MOS. My MOS was 19E Armor Crewman and I was in the Free Worlds Only Airborne Armor Unit 3 BN (ABN) 73 Armor Regiment. I would spend hours sitting behind running C 130's and C 141's waited to board. I submitted a higher review pointing this out and the fact 19E no longer exist but the equivalent is now 19K M1A1 Crew Member. I included a personal statement about my service experience and when and where I first noticed the tinnitus. How long does a higher review take for something like this. Anyone know?
I was in Airborne status for a short while. I man in my own platoon was trained to administer periodic hearing tests and he had the foresight to document "Routinely exposed to excessive noises" in almost everyone's record. I resently had a hearing test at the VA hospital in Evansville Indiana, when I told her about the ringing in my ears and tried to tell her exactly when it happened she was interested in setting up my hearing test more than listening to what I had to say about when and where it happened and my different jobs in the Navy and how much noise I had to work in. At the end of the test she tried to tell me that the hearing aids should all but stop the ringing in my ears, I tried to tell her more about what I did in the Navy and still didn't seem interested in what I had to say about it

Tinnitus doesn’t have to be associated with hearing loss. I passed my hearing test and was still approved for the tinnitus claim. You just have to have the ringing in your ears. I know some sailors that got approved based on firing an m16
What about those of us who are "Combat Vets" who served a year in the war zone. While running a convoy we took incoming concussive explosive rounds causing my Tinnitus. Would that qualify ? Hi Dewayne, God bless you for providing all your super helpful VA vet claims updates and videos! You have made my VA claims process much easier and smarter. I’m retired Army. I served 18 years in combat arms with missions in Africa, Central America, Europe, and the Middle East. Thus, I’ve received service-connected claims by doing what you say in your videos. But here’s my problem. Last month, the VA Benefits folks granted me a NEW service-connected 30% rating for my Meniere’s syndrome. Then, they took away my OLD 10% Tinnitus service-connected rating because they combined the 2 conditions into only 1 combined condition at a total service-connected 30% rating. Is this normal? Uncommon? A big VA Benefits folks mistake? If you were me, how would you proceed to separate my 2 conditions so that they each get different ratings- 30% for Meniere’s syndrome and another 10% for Tinnitus? Big thanks again!

Thank you for the information Dewayne. I am scheduled for my C&P exam for Tinnitus and I'm worried about being able to reasonably articulate like you are saying in the Video. I was a Generator Mechanic which is a high risk MOS for developing Tinnitus. I cannot pin my Tinnitus down to one certain event like you are saying. I think mine developed from Repeated exposure when we were on field exercises in Grafenwohr and Hohenfels Germany and not being able to wear hearing protection.

This is a topic I'm very interested in understanding. I worked as an Admin (office) person for Aerospace Ground Equipment in the flightline office. I had to hear the jets EVERYDAY outside the office and of course when I went out the bld.
I am filing for Tinnitus. Mine started at range back in 98. I was wondering if I should also go more into detail and tell them that it got worse when I was on the airfield. I was military police and spent 4 years on an airfield and we did not get issued any hearing protection. I am not sure if I should just tell them when it started and leave it at that. I do not want to give the VA more to try and pick apart.

Tinnitus is a presumptive now. I filled out the claim online, uploaded my week old Audiologist test (showing hearing loss, which I haven't even claimed) , my personal statement listing specifics for tinnitus, and now the VA just called to have a Hearing C&P test done. I am considering calling the VA and telling them that I will NOT go to the C&P, citing 38 CFR 3.309(a) and M21-1 V.iii.2.B.3.b again, which I specifically wrote down in my personal statement! Clowns.....
You claimed it as a 1 year presumptive under 38CDR 3.309a, most veterans don't know about that if they have been out less than a year. Also, don't forget to pick up my new book: store.kmd89.com/
Yes, I came across that info in one of your videos. Undecided if I go to the regional C&P exam, it just seems like they are not following proper guidelines, even if giving them the exact laws/schedules.... I've been out for over 25 years, so thanks for all you do for us. I also put the words "Pact Act - presumptive" in the claim form, since the hotline advised me to do so.
I ended up going. VA audiologist agreed with my personal test, told me he would state in his DBQ - 10% Tinnitus and also hearing loss; advised me to file for HL and refer to his DBQ. Was shocked he was so helpful. Filed for hearing loss based. My Tinnutus decision letter advised to file for HL. I think the info in your videos def helped me, I'm moving along and have several still in process. Vets need to get educated on the process and handle your own claims, if you've lost trust in VSOs. I got to 70% on my own.
I am SC for tinnitus. I recently made request per Directive 1134 asking my VA primary care physician to write Nexus letter for Insomnia secondary to my SC tinnitus. I’ve recently had a hearing test by a private audiologist and been diagnosed with bilateral mild hearing loss and with tinnitus. I had an MOS in the “high probably” category and I think I adequately articulated how it occurred in my draft statement. Of course I will be submitting the audiologist’s report with my claim, but do you think I should also get an IMO to secure the tinnitus? (I don’t expect compensation for mild hearing loss.)

They say I could have received tent at any point after hearing loss.. its been a fight since 98.. the tent drives me insane.. VA says here some pills cuz you are ptsd.. I won't take pills so denied ptsd rating.. I have issues and don't need more.. they are the ones that need a chill pill.. im just a number but not the one they desire
I got a question. I just found out that you can claim tinnitus as a disability just a few days ago. I've been out of the USMC since 1994 and all these years my ears have rang all day long and it has gotten louder and louder over the years, headaches and have to plug my ears cause sound around me is so painful, many times I don't even go out with family because i don't feel like putting up with peoples noise. I was a 1371 combat engineer(explosives)I just played the tv or something for sound. I have asked my personal DRs if there was anything that could be done about the ringing and they all have said no as long as I'm not loosing hearing not once all these years have they asked if it was service related and no one is out there telling people about this stuff. What should be my first steps I have no clue where to start.

Can I make a claim for tinnitus if I didn't complain about suffering with tinnitus while I was on active duty? If you were me, how would you proceed to separate my 2 conditions so that they each get different ratings- 30% for Meniere’s syndrome and another 10% for Tinnitus?
Big thanks again!

Just had my hearing loss increase C&P
Good luck with the increase.

Sounds like you were espoused to acoustic trauma.

Hello Mr. Kimble I got denied tinnitus. I was a 42A in an infantry unit
In the rating decision they should note the reason from the examiner if you had a C & P exam. "The examiner opined".
Same w/ MH or Sleep Apnea. See prior comment.
Will do.
Great Stuff. Thank you so much for all you do!
Thanks, and it's my mission to educate veterans
I am SC for tinnitus. I recently made request per Directive 1134 asking my VA primary care physician to write Nexus letter for Insomnia secondary to my SC tinnitus. He replied, 'I could not find any study that shows that tinnitus leads to insomnia.' Thank you Kimble. Ribs on me.
Sounds good to me.
I just got denied tinnitus although the examiner wrote I experienced acoustic trauma do to my job being in engineering department on the ship and my work with firearms. She diagnosed me with tinnitus. VA said because my records were silence while in the military they denied me. My hearing test was not conclusive. Do I need a nexus letter? I purchased your book yesterday.
You noted what the examiner stated about acoustic trauma but you didn't state the medical opinion from that examiner. Thanks for the support for buying the book.
What about the DBQ with the nexus.
I did not know what tinnitus was at the time of my first exam. they used my job as S-1 against me also

Dewayne, thanks again for sharing your knowledge. Call me a skeptic, but if a veteran can't articulate what incidents caused his/her Tinnitus, then in my opinion, they are probably lying about it and just trying to get free benefits. When you've had a significant loud noise event happen that caused your ears to ring (and it never stopped) you WILL remember it vividly. Or, if you've had prolonged exposure to loud noise, such as being on a flightline without hearing protection, using loud tools as a military mechanic, etc, you will KNOW it. Yes, occasionally legit Tinnitus claims do get denied and need to be appealed.

Hi Dewayne I have a question. I previously received 40% for hearing loss.I also have tinnitus,Can I apply for tinnitus?
It's nothing saying you can't
If a claim for sleep apnea has been filed before the deadline for changes. Will the claim for sleep apnea be rated under the new ratings scale or old ratings scale
I did a couple videos and mention this: czcams.com/video/-N0Ngi56QsA/video.html and czcams.com/video/LePi1F1Hfbo/video.html but no one truly knows what the VA will end up doing.

Drives me insane... the ringing.. always need noise to help the ringing..
The quiet makes it worse..
Did you get a copy of the C & P exam and reviewed the rational.

So are you saying that if we submit our claims before the potential changes, we are grandfathered to the standing 38CFR for tinnitus?
I linked videos at the end of this one that talk about that.
Can I make a claim for tinnitus if I didn't complain about suffering with tinnitus while I was on active duty? I was a security policeman (SP) 81170 /3P071 working on flightlines of aircraft [B-52, KC-135, F-106, F-15, F-111, EF-111, C-5, C-141, C-130] and aerospace ground equipment that produced extremely loud noises that I was subjected to starting in 1982 at Castle AFB, Ca. SPs didn't wear ear protection while we were on flightline duty because we couldn't hear our radios.

What if you already filled a claim and waiting for your C&P Exam
The exam is the next stage.
If you file a claim and the VA change while your claim is pending will the claim be grandfathered in?
It's hard to say what the VA will do in the future (going forward), in the past, the veteran was grandfathered.
Is a diagnosis needed to file tinitus?
The diagnosis can be given at the C & P exam.
I was denied my VA claim for tinnitus so can I file again and used a supplemental claim again
