    so it sounds like just because you had an injury in service, that IS documented in STR, with a present diagnosis and nexus, it can still be denied?

    I was recently service-connected 100% permanent and total. I’ve had temporary custody of my two grandkids, a girl and a boy, for the past nine years. I am about to go through the adoption process. My 10-year-old granddaughter has my last name, but my eight year-old grandson does not have my last name. I’m wondering when the VA says adopted child, if that means when I adopt my grandson would he have to have my last name in order to be considered a dependent. I don’t really have any contact with his biological father and I’m trying to navigate whether he could keep his dad‘s last name in the adoption process. And if that would affect the way VA sees him as a dependent. This may be a question for a VSO but just thought I would ask. It took me 12 years of paperwork, medical evidence, doctor statements, Nexxus, letters, buddy statements, and at least four different meetings with judges on appeal to get to 100% permanent in total. I started using your podcast and information about four years ago. I just want to let you know that your podcast and information have been so valuable to me navigating the process. You are doing an amazing job. And I can say this from my past experiences with having conversations with former VA raters that all seem to be so full of themselves and very pompous and argumentative. Whereas your very laid-back style of just presenting the information and giving your experiences as a rater , Along with helpful hints to navigate, has been a godsend to me and my family. I just wanted to take a moment to say thank you so very much for what you do for the veterans of this country.

    Dewayne ! A question not on point with your presentation but request your import . I’m filing a claim for 3 presumed conditions and 2 for pain , limitations , gait and balance problems due to complications in my lower back and right buttocks further resulting in pain and cramps bilateral to both extremities - the problem after 3 reviews the VA cannot find 30 years of my medical records prior to 2021 . They do have apparently all my VA records since 2001 . Apparently that year a new system was developed? Any thoughts ? Thanks Tom

      Where does those fall under the five ways of service connection. If it's secondary, you need three elements, current diagnosis, link to the primary S/C condition and nexus.     I am waiting on the transparency that we need from the VBA. It took me seven months to get my C-file FOIA request. I think all Vets have the right to immediate and the same access to our records that VSOs and attorneys currently have to our records. I think that transparency falls under the duty to assist.

    Hello Dwayne, My diagnosis was for 1 foot, by the time i got a nexus pain was in both feet and the c&p exam was for just the 1 foot. Still waiting decision, if they rate only 1 foot should i file a HLR or file for aggregation?

      If you didn't claim the other foot, you can go in secondary possibly. Depending on how the foot is impacted.     The VA IG has recently identified that 44% C&P exams that the VBA has performed were not required. Veterans are Being Required to Attend Unwarranted Medical Reexaminations. So the VBA could eliminate the unnecessary C&P exams. That would insure more veterans could be getting their claims adjudicated quicker by C&P examiners that could complete the required C&P exams. That would help to reduce the backlog. I got your book and am getting educated. Good video thanks for sharing.

    Here is a nugget i had this problem twice 2022 and 2024 - i called the 1-800 told them my fioa was closed out the 10 days has passed the Rep checked the records she put me on hold put the request in i got the CD in 72 hours it came certified from st.louis - timeframe was 4 months 2 months other ones have taken 6-8 months before they was closed out -

You are one of the few people on CZcams with this unique combination of skill that gives you the ability to speak on VA benifits. I have a question. I was in service from 1980-1984. I have both Medical entrance and exit forms 93. On the entrance form, no problems were noted. On the exit form Sinusitis and problems breathing was noted 4 years later. I was an aircraft mechanic and subject to jet fuel daily, which was a constant irritant to me. I also fractured my nose while in the military. In the "note" section, the physician wrote this. "Deviated septum 1983 secondary to nose fracture. " Based on the way he wrote this, it seems questionable whether the fracture happend in 1983. Would you include this document with your claim if this were you? Thank you in advance for your answer.

      The VA have lost my medical records. I have looked high and low and they cannot locate them. Form 93 is all I have that states the incident took place along with sinusitis. As I had said, I now have a CPAP. Do you think this form with the dr. notating breathing problems, a fractured nose and sinusitus is the link I need?@@DewayneKimble

    I submitted four claims and one was approved (diabetes) the others were aggregated by but they disapproved the other three. I submitted for HLR and it came back duty to assist. The three were based on sleep apnea but now I'm service connected for the diabetes. I submitted a supplemental for the ret of the claims. New relevant information is the diabetes with documentation. I went to two c&p exams at the VA (amputations&pherphal neuropathy). This is such a process which needs to have shortcuts.

    Is it possible to request the name of your reviewer if a previous claim was erroneously denied? For example, they stated in the denial letter that there wasn't an lod but you can verify it was sent abd received. After receiving my c file I saw it.

    I would like to thank you for Spreading your knowledge to all of us veterans . I started at 30% 2006. I started watching your videos and got 90%. I’m going to HLR as soon as I receive a CD of my C&P exams in the mail. I went to see VSO the other day and she told me she’s not allowed to show my C&P exam results to me. Examiner denied service connection for OSA but opined it is due to my obesity. (Which I claimed secondary to mental health with obesity as an intermediate step with nexus ). Hoping to be at 💯 soon. Thank you so much!!!!! You’re a blessing.

    Very Few Raters look at Veterans criteria if the C&P Examiners opinion is the lesser Rating. Ive been in Appeals and HLRs for Migraines for about 11 months, Proposal for Reduction/C&P. DTA back to rater...Confirm and continue current 30.....Back to HLR after Ace exam clearly states Increase is warranted. Waiting on Informal conference....Why wouldnt the DRO just Increase....yet they will more than likely send me back again based on DTA and I will be back in the Waiting game suck

    I think this could help others. I'd like to say one thing first. Your videos have already shown me a path to 90 and honesty I think PTSD sadly I never claimed but was witnessed to 2 aircraft crashes in my career that were world news at the time while at Ramstein AB. My question, is I had 0% for knee. Had meniscus repaired and accepted to 30% I NEVER knew scars were rateable so I never claimed it. Isn't that a presumption by rater if they accepted my orthoscopic knew surgery ?? Duty to assist?? Thanks DEWAYNE

      Thanks for the reply. BTW I bought your book thru Amazon, and it's been very helpful I didn't need DBQ when I originally filed 12 years ago. It was already service connected, but they stated I hadn't received treatment. I gave them a FDC which breezed through and no C&P. I was not educated on a need to file separately for scars. I guess an accepted claim for orthoscopic would be common sense to have scars by the Rater. It's been many years, and I thought duty to assist would be a reason to claim it. I guess it's been to many years for me to cry over it??

    Use VERA call to get your C and P results after you exam...it worked for me...they sent them via email so request that option....this allowed me to file a "CAR" with an informal conference and got that higher level review decision within 10 days....the higher level reviewer granted me 4 yrs of back pay for migraines...she also agreed and kicked it backed for DTA because the examiner didn't give an opinion on my mental health claim when I have 4 opinions/diagnoses...also she confirmed my PTSD and other Mental Health diagnosis through my records and evidence i submitted....she stated my TDIU was justified from Jun 2022 and continuing...God is so good and finally put me on the phone with someone who cares.

      @DewayneKimble Google VERA VA appointment, and I used the Arizona office because it has the shortest wait time from my research. Through setting up the appt, you choose what you want to cover/address. When on the phone with the representative, request your most recent exam documents. I suggest the veteran know what exams are needed instead of winging it. That being said, know your dates for the exam. Remember, for initial claims, the examiner should do a Nexus opinion and DBQ. If they only see a DBQ, you already know thats a duty to assist in error. Again, that's for initial claims. They may say that they will mail them to you but request that they send them via email. It was a very simple process, and all of my calls have been smooth and very professional. Doing this along with the "CAR" process will put you ahead of the game. I'm just a vet trying to help another get to the finish line a little faster.

    Question. … I just received my TDIU back pay effective date 05/13/2023 , intention to file date 01/03/2024 ….. completion date 07/19/2024 …. DO THE VA NOT PRORATE FOR PARTIAL MONTHS ? My partial months are MAY 2023 and JULY 2024 ….. that’s almost $3500 missing … I’m confused 🤔

      With that effective date, you should have been paid for the month of May 2023. Completion date of 7/19/2024 you should have been paid from May 2023 to June 2024. On the first of each month, vets are paid for the previous month. You will not receive July 2024 payment until August 1, 2024

    If you submit a FOIA request for your records and open a claim or have an open claim, you will get a letter that your records are not available! If you do an intent to file to preserve the Effective Date, don't file until you receive your records or you go back to the starting line for your records. I learned this after 3 FOIA request and waiting over 18 months.
