I just found out that my night terrors are Hallucinations
I'm 100% P&T (PTSD). I have 4 Combat Tours (03,05,07,10). As well I'm fully employed at the post office. It can be done vets,stay motivated and consistent.

I am very introverted and lack communication skill, but I used this DBQ as a framework to put my personal story and feelings into context that could be communicated to the VA and C& P examiner. In doing this I went from 30 to 70% after years of feeling unheard and dismissed.

Had 2 accident while serving, 43 years later I filled out a claim for PTSD because of those accidents, panic attacks, depresión, anxiety, insomnia, 6 months later I got 70%PTSD SC, good luck.

@@housemhyou’re correct. However, if he filed for PTSD and was denied 43 years ago, he could file a “clear and unmistakable error” claim and get backpay for all 43 years. Best to lawyer up for that though.

All honorably discharged veterans should get E-1 base pay for life or their disability rating, whichever is higher. All 100 percent P&T should automatically get SSDI

In the same boat, I told them something was wrong! Went postal with a VA doctor because I just got tired of being sick and tired! Then when I went for my MST or what I thought was my MST therapy..I knew it wasn’t going to go well when I started to get a headache which is my sign of anxiety coming on! He had the audacity to ask if I was there to get help or to get benefits!!! After 20+ yrs I stayed silent & this is how I get treated by the VA.. I walked out wanting to punch him. Then the mf had the nerve to manipulate my records to claim he couldn’t finish his exam because I walked out but left out what he said .. the danm VA

I never understood why the decision letter rated me at 70 percent and listed all the symptoms that qualified me, were the exact same symptoms that were listed that I would need for 100 percent. Now I can go back and point out that the symptoms to satisfy for 100 percent, are the exact same symptoms listed under the 70% rating. I also don't think they had the hospital records where I was at, at the time of the decision letter. So I can send that in as new evidence under a supplemental claim to reopen the initial claim. Thank you for this video. So much makes sense now.

Dewayne, Really appreciate all you do. Question, I was involved in an accident while on active duty and sometimes while I’m driving in certain conditions, I reflect back and think on my accident. I don’t see anything in the diagnostic codes that relate to that because it only happens at certain times. How do convey that on a C&P exam? Also, I still have all of my records and documentation from the accident.
I appreciate you. The way you convey it on an exam will depend on the condition you are claiming. If PTSD, the accident is the stressor and what criteria do you meet under the general rating criteria for mental. As I stated in the video, this is something you have to explain, how it impacts your work and social life. You explained part of it in your question. Don't over think it. Just filed for MDD(with PTSD features and panic disorder). (After service)7 hospitalizations and 1 suicide attempt and many current symptoms. VA psych doctor said most definitely service connected and it will reflect in my VA medical records when I file. What are my chances of getting 100%.? Also do I need a in service event for a MDD claim like PTSD? Thank you for your time and your videos have helped me tremendously.

I am glad the VA is changing how Mental Issues are rated. Work impairment is going away. You have 5 domains and need to get a 2 in 2 or a 3 in one for 70 percent. I heard that 70 percent now means 100 percent next month or when the VA changes Mental Issues and the DBQ. No longer is PTSD starting at 0 percent but at 10 percent. 5 domains each getting from a 0 to 4 score.
Do you by chance know if you are currently at 70% if it will automatically convert to 100? Or would you have to file a new claim

@@JM-db9te I think you would need to file for an upgrade? That is also risky because an examiner might not understand the new changes and you could get a lower one? I’m at 70 percent and the reason why it was not at a 100 percent because the occupational impairment.
Civdiv did a video on this saying it would be easier, then released another video saying he was wrong when someone ointed some things out like removing a lot of the symptoms vets were being for.
I had a C&P mental health exam in December 2023 and in January 2024 I was awarded a 70 % rating for m/h
Total social and occupational work impairment. It helped me to get my overall combined rating to 93% static which is a big plus .

Thank you so much for the information. My private MH provider is refusing to complete a nexus letter and DBQ for me as they state they are not comfortable completing material for the VA. So they have referred me to a practice that should however, I may have to go through the VA for this. The information in this video is invaluable.

P & T means your conditions are static. There is nothing else you have to do.
As for me 100% is bittersweet.. Knowing that I had untreated PTSD for many years then getting the letter stating that I indeed had it was surreal. I have sought treatment but it’s been slow. I do a majority of it online.

I am medically retired and recently obtained my 100% mh rating w smc-s. On my decision letter it states under retired pay app laws and findings on 38 cfr 3.750 entitlement to concurrent receipt of ret pay and va disability comp. Does that mean I can draw both at the same time?? As of now my ret pay is waived by va waiver so I'm only receiving va comp.
There is a section on the 526EZ asking about election. Look at that box and see which one you selected. Normally, if the vet is over 50 percent S/C, they get both. Raters do not handle anything with this. They only rate.

Same. They recognize that Vets even with 50 to 70% PTSD or MH issues could still maintain employment because its necessary. The one key factor between 70% and 100% is the employment part. You could have a lot of overlapping symptoms between the two but having a job is the seperator.

If I submit a DBQ that is complete, accurate and actionable from my Psychiatrist Doctor. I was told by VBA a C&P is mandatory, which goes against 38 CFR 3.326 subpart B (previous video of yours :-) anyway, seems fishy they said if no C&P they would deny claim. All verbal of course.

I had a documented injury in my service record that led to a TBI, found by my VA Advocate about 1-1\2 years ago. It since has been rated at a 10% disability, Ever since the injury, I have MANY of the symptoms listed in the anxiety and mood disorders, I have been regularly seeing a Mental Health Professional at my Local VA Clinic(3-4 month intervals) and have gone through numerous medications for anxiety disorder, currently take Lorazepam when needed. My question is: Why did the VA ONLY rate this TBI at 10%, when my service record shows a decline in performance amongst other symptoms I go through daily ever since the injury? My diagnosis is close to, if not closed to re-evaluate the 10% disability. What do I do?

I just recently went for an increase and at my C&P exam the provider said why wasn’t I diagnosed properly 9 yrs ago with PTSD and the fact of certain incidents that happened on the battle field. The provider therefore checked all those boxes and said the max she could do is put in for 70% and I couldn’t get the 100% because I was never hospitalized in a mental institution. I still have to work to pay my bills because even at 100% it’s very difficult to live these days. But I have had to change my profession because of health issues and go back to college to even get into a office setting. So non the less I have had 6 employers in the last 5 years because I didn’t see eye to eye with their bad decisions. My question is could the VA rater still grant me 100% if they feel it should be? Most of those symptoms I have and with sleep apnea, hypertension, and type II diabetes are the most recent within the last couple years I have been diagnosed with.
Did you ask her where in the VA regulation where it states the only way to get 100 percent is you have to be hospitalized, that is only for paragraph 29. As stated in the video, they can if the evidence warrants it. They can go up or down based on the evidence. Did you see that part in the video. Thank you. I think the easiest route is to claim that I have hallucinations. It's hard to prove or disprove. They lowballed me and only gave me 30%. I want to be in the hundo club.

My C&P examiner checked the total occupational and social impairment box and I still only got 70%. The va said I didn't have gross impairment in thought process or delusions or in appropriate behavior or the personal maint. part.

The DBQ is important, but it’s only a part of the evidence. Just because you have a specific box checked does not necessarily mean you will get a certain rating. Example, I have been helping a coworker with their VA stuff. I helped him get a copy of his DBQ from his C&P exam. The box under the social and occupational impairment section was checked for the “30%” category with symptoms that mostly fell under the 30% and 50% categories. When he received his decision his rating was for 100%. When we went over his decision letter it stated they used evidence from his private medical opinion and his VA health records.
I’m just trying to reiterate there is no magical checkbox, it’s the totality of the evidence that matters.
Like I said in the video, the rater will have to look at all the evidence.

I can't recall cases by the vets MOS, military jobs. Each claim is different for any DX to include PTSD. I've rated hundred of these and non stick out. If that happens, you check total box in VBMS and it will give you the percentage. Also, there could have been symptoms in other evidence that could have been used. you are not telling anyone anything that will help them. theres more to a diagnosis than the label. you can have mild major depression. the word major in that giagnosis does not mean severe. you have to have severe major depression.
people lack the ability to cut their wrists deep. unless you are that severe to where you do those things

@@DewayneKimble but you do not look at a diagnosis name or symptom name then rate someone. its about how bad the symptom is. you should know that 2 people with major depressive disorder are different. like someone that has the main symptoms of MD qualifies for the diagnosis. and someone that is constantly depressed to where they have bad hygiene rotting teeth. trash on the floor, bad oder, dirty/nasty clothes, knotted hair, but they make money and live in a house with bills up to date. working washer and working shower, someone like that is losing weight by the week due to lack of eating, even though they have food. and they continue to get hospitalized by police for self inflicted wounds.
