    Thanks for the information. I used DIC to help my mother get back my father’s benefits and back pay of over $90 thousand. She was in dire need after my father passed. He was 100% when he passed but they cut my mother off and she was left to fend for herself. I was able to educate myself with videos like yours and your book. I also used your book to help myself get 100% P&T. Thanks again airman.

    Thank you for your service and everything that you do for Veterans. Because of you, he field an intent to file before he died this year. My husband was at Camp Lejeune for 30 days and had diagnoses that would service connect him BUT he died from complications of pneumonia. Some of his underlying conditions were GI issues, anemia, stage 3 kidney disease, and respiratory issues. I would hate to think that the government would use a loophole to get out of paying what is rightfully his. Regardless, I will be suing and staying on top of my congressperson.

    Question: can a surviving spouse, who is also receiving 100% P&T, qualify for DIC?

  • @chiefr31
    @chiefr31 Před 3 měsíci

    Second question. I applied for DIC for my spouse and had been denied. I reapplied and submitted additional relevant medical evidence and a medical opinion for service connection to hypertension. Now the VA has a request out to a third party examiner for an opinion on how the service connected condition is associated to cause of death. At that point I realized that the original doctor who wrote the opinion failed to opine on how the cause of death related to service connected condition. Would it be smart for the doctor who wrote the opinion to offer an additional opinion as to cause of death relation to the service connected conditions (hypertension and secondary hypertensive heart disease)? I am hoping this will speed up the process, rather than waiting for VA doctors to write an opinion.

    I just got diagnosed with prostate cancer. I'm 100% P&T for 5 years. Is it worth filing for the presumptive condition for the cancer? I'm only asking is because of the DIC benefits my wife would get if I pass away from the cancer. But if I wait 5 more years, that'll be 10 years as 100% P&T and she would rate the DIC anyways. I don't want to rock the boat in taking a chance of being reduced by filing. Any recommendations would greatly be appreciated.

    • @DewayneKimble
      @DewayneKimble  Před 3 měsíci +1

      How are you P & T for five years, I've never seen that. I've seen P & T but not for five years. If you are already S/C for prostate cancer why file a claim for it. Something is not right here.

  • @chiefr31

    So my mom applied for DIC in 1986 one month after my fathers death and was denied in 1988, she was approved for survivor pension but made too much at the time. Years later near retirement with a lower income she began to receive survivor pension. However, when she began receiving Social Security she was informed that her income disqualified her for survivor pension and the VA also assessed an overpayment from the start of her social security claim. Recently the I submitted new evidence that came to light that prove service connection. If the claim is granted for service connected death and DIC is approved, would the VA readjust her previous survivor pension payments to reflect what the DIC amount should have been receiving? Since this claim has been open since 1986 when my father died, will they go back to her original application date and assess backpay from that point?

    • @DewayneKimble
      @DewayneKimble  Před 3 měsíci +1

      I can't say they will go back and readjust it. It's not the VA itself, VSR's handled those corrections, not RVSR's. I was an RVSR. I never heard of a claim being open for that many of years. If it has been open since 1986 (which is highly unlikely), I would want to know the EP established for that claim and the date assigned. Someone would have to review all the evidence from 86 to now.

      If yes, I would think the VA would recognize that too. You can try to get get free help/guidance from a Veteran Service Organization such as:

Fr the American public who gets nothing for their ailments, be prepared for your to change as the communities are being visited by regular Americans who have a hard time making ends meet and suffer from SA, headaches, tinnitus, etc.. This will come crashing down at some time.
