In Feb 2007, I filed right shoulder, secondary to left shoulder, and was granted it during Aug 2015. Here is the history: RO, appealed denied, BVA (traveling judge), remanded, C&P exam, and RO decision. I used a traveling judge because I needed the extra time to get educated. The judge gave me 60 days to get a nexus letter, and I received one on the 55th day. CZcams and you were not available, lol!
During Mar 2012, I filed for sinusitis and rhinitis (pending), and then in Sep 2012, I filed for OSA, secondary to sinusitis and rhinitis. I explained to the VA rater what I was doing. All three were granted in Nov 2013. Thanks again; you are the man! God is good! 😊

I have had two run-ins with the same VA appeal judge. The first time I barely was able to get a word in and look like she had a bad attitude and the second which was today got on and said she wasn’t sure if she had jurisdiction and now had to go over my entire file. My thing is if she didn’t have jurisdiction she should’ve known that before she got on the call. I’m really close to Washington DC because we had to reschedule again. If she doesn’t have jurisdiction, she should’ve checked before she got on the call in the 1st place. she had plenty of time. And I was prepared, but at least now I have another week to go over my stuff to make sure it’s ironclad.

Thank you for the information! I have service connection for PTSD that led to GERD which led to eosinophilic esophagitis. I got recently got denied for my eosinophilic esophagitis because the CP examiner was going over IBS instead of my GERD. I have favorable findings on a diagnosis. The CP examiner was rude and he refused to listen to what I had to say. He told me during the exam its impossible to have all these GI issues. This resulted in a negative medical opinion.

Hello Mr. Kimble. As of yesterday, I went from 10 to 60% (OSA, Glaucoma, asthma along w/ SMC-k) with the help of your videos and did so without any lawyers or claim sharks. I am still pushing forward with other claims and appeals. Not sure if I will be part of the Hundo club but I am sure I can get at least 80%. I was discharged in 1991. Anyway, Just wanted to say thanks.

Service connected primary eye condition with secondary migraines… did Chronic fatigue, IBS, and Insomnia secondary to migraines. All medications for my primary messed my digestive system up heavily which I have Reflux now as well. 🤮

In the process of gathering medical evidence for my right shoulder. Had medical complaint to Primary Care doctor who had X-Rays done already. I now have Physical Therapy scheduled for July 16th.
My question is can I submit a supplemental already with the current evidence or should I wait for my Physical Therapy session to create that chronic evidence?

I just submitted for RLS, migraines, and sleep apnea secondary to PTSD. I have a Nexus letter and a VA diagnosis for all conditions. They sent me to a C and P exam and the examiner said they do not even look at the Nexus letters since those are paid resources. He also stated that the secondary conditions needed to be occurring while in service. If this is the case, how do you appeal it. I thought I did my homework but now I’m concerned.
Guess what, the 3rd party examiner gets paid. What they told you about in service is wrong. That's why as a VA rater I I obtained my own DBQ and nexus. I took the option for them to give me a negative opinion off the table. On July 2023, I filed a claim for service- connected Sleep Apnea and was denied. That's understandable; I didn't have evidence. Fast forward to last month. I finally won 70% claim for PTSD. Next, I filed the sleep apnea claim secondary to PTSD (with obesity as an intermediary). I had good evidence this time; Nexus, DBQ, etc. I submitted the claim almost 2 weeks ago only to have the claim completely disappear from VA portal this morning; no approval, denial, anything....just vanished from VA site. So, I called the VBA toll free number this morning, and the rep told me I needed to refile as a supplemental claim because they had denied the original sleep apnea. But, here's the issue: I'm filing as a secondary now, and the supplemental claim never gave an the option to file as a secondary. However, the statement as secondary to PTSD is in my Nexus, lay statement, etc. I'm keeping fingers crossed that they can figure that out, but man, they don't make this stuff easy!

interesting I have filed a fully developed secondary claim for Sleep apnea, Secondary to depression and anxiety with link of obesity and was denied and told my nexus from private doctor was irrelevant and i use a CPAP and been diagnosed with sleep apnea the VA. Also secondary fully develop for ACID reflux/ GERD secondary Depression anxiety, medication, and obesity with VA evidence and medication prescribed by my PM are and denied. Currently waiting for higher level
The VA actually used the word "irrelevant" in the rating. Where was the DBQ you submitted and if you went to a C & P exam, why did the examiner say no and provide a negative rationale. So how do you word that in the lay statement? Don’t actually state that you think that the secondary disease whatever it is say IBS is being caused by anxiety if anxiety is already SC? Or do you state your symptoms only associated with IBS and state you think the anxiety is exacerbating these symptoms? We are not doctors so to write a statement with a secondary diagnosis in it, would it be denied?
I provided examples toward the end of the video. You can certainly add symptoms in your statement. Don't over think the process, it will confuse you. Short direct and to the point. Great video and the 2ndary. I have a question; I am 100% P&T TDIU....just got 50% for Migranes due to TERA. Backdate with an effective date August 10, 2022 on my decision letter. but when I look online it say back it say my effective date is -8/10/2024 which is not here. I watched the video again. I assume If a service-related disability causes a mental health issue and that mental health issue causes migraines I assume you file migraines secondary to the service-connected disability. I'm not 100 percent sure. Is this accurate?

So with all these secondary filings, what happens to the primary disability the first secondary is based on, if at the C&P exam, the examiner "opines" that its rating is too high, or worse yet, recommends 0%, and the adjudicator takes that recommendation. Now you've got a secondary approved anyway? But lost the compensation for the primary? Seems like a gamble to me.
As a former rater, I've never seen a VA examiner say reduce from 80 to 40. It's based off the information on the exam. If you claim something secondary, why would the primary be evaluated on exam. Where did you see that at 38CFR or court case.
