This is the first time I saw your post…….. I’ve been rated 100% with PTSD combined with agent Orange prostate cancer. my rating took place in 2008 and the cancer a little little bit later. I have been diagnosed with sleep apnea and I was told not to put a claim in because of a possibility of reduction on what I have now. I would truly appreciate your thoughts if not, I totally understand. thank you so much for the information you have given me

I learned the hard way early on. I retired in 2004 at 80%. Barely went to my appointments eventually I got reduced to 60%! I wasn’t educated! That was a bad experience. I am currently 100% P&T for 6yrs now. I will let other vets know about this CZcams channel so they want experience what I did.

@@sweetchinmusiq1623 you should be fine but I would still go to my appointments which I have to because of my conditions. The way things are changing with the VA I wouldn’t take that chance sir.

so you got reduced because you didnt schedule appointments or because you scheduled appointments and didnt go.

Hello, I am a new VSO and subbed your channel a few months ago. Not only have you helped me help other veterans.... You helped me with my own claim! I finally got adjudicated on SOME contentions after 320 days (from my file date not the ITF). I'm not 100% yet but hopefully soon. To all your subscribers or anyone watching.... please know that not even VSOs have a magic portal to get claims processed faster. This is crucial information. I didn't properly educate myself and went for an increase about 6 months prior to my 5 year window. I am pretty sure they will come up with something to reduce me, but I know now. It's the little things like this that make a world of difference. Keep it up because we need to understand the game in order to play it.

1. Get the ratings code sheet
2. Find the effective dates for your disability
3. Wait for 5 years before you have the C&P examination - don’t do the exam within the 5 year window, do it outside of the 5-yr window.
Yes it’s confusing.
Not at all, the point is, educate yourself on the process and what you are doing with your claim. For example, PTSD at 30 percent and you feel it has gotten worse. Educate yourself on the 50 and 70 percent criteria, provide evidence if you have it and be able to explain it to the examiner. Unless you have your own DBQ from your private example. Thank you for the education Sir bc I just got my disability approved in October of last year with one c&p and then a month later they sent me to another c & p exam, then I got a letter saying the VA was gonna reduce my percentage due to improvement in my condition, now I have a Higher level review scheduled for later this month to try to stop the V.A. from reducing my benefits.

@@dcmoor4662 Well if it keeps you from working file for Individual Unemployability do to your disability form 21-8940 and form 21-4192 you would have to had been working but had to stop because of your disability.........hope this helps

Hi Dewayne, thanks for sharing this critical information. Initially filed a sleep apnea claim without being educated so we know what happened there. I have since had a sleep study and was issued a CPAP device by the VA. Because there was no evidence of an in-service event, should I close out the claim as a direct, or can I just modify that claim as secondary to migraines or tinnitus?

Great info! Thanks for all you do to help us 'get educated'. How does this work if the vet is 55+? Per my C File, my SC Anxiety Disorder is from 5/9/2022. But I am over 55 yo. Once the upcoming criteria changes to mental health disorders go into effect, I may file for an increase. I'm wondering if the over 55 rule protects me from the situation you describe.

Im at 100% thru the pact act for AML Leukemia. According to my rating letter, I'm subject to reduction if if the the disease improves. My latest bone marrow biopsy shows no lukemia blast ho I'm still on chemo pills along with 30 other perscriptions fighting graft vs host disease from my bone marrow transplant. Does my current condition mean they will reduce me due to not currently having any Leukemia blast?

I was medical retired from Army in 2013 for PTSD (70%) and i’m like 80% VA with UI so paid at a 100% , i’m always nervous they will drop me but i feel since i was Medically retired for PTSD and have SSDI for PTSD it would be hard to drop me, i don’t work and have a real hard time sleeping and even leaving my house to get a haircut. My original VA rating happened in 2009 while i was still in and that helped me get through the process of medically retired in the Army

I am 100% PnT and have never used the VA. I have TriCare and go to civilian docs out in town for my continuing care.Do I need to have a relationship with the local VA or am I good to go if I continue with my own docs?

My question specifically is if I submit a claim in the future for another condition thats not previously service connected or rated yet, will they re open my entire history and look at everything and possibly reduce something I've had for years already?

I was rated 100% for mental health leaving the military. I had my re evaluation in December. They gave me a decision later saying i would be reduced to 70%. However i didn’t have my first appt with my therapist until after my reevaluation due to them being short of providers. I’m going to try to get a nexus letter

I plan on trying to get my ratings upgraded this year. Some were assigned in 2013 and some in 2014. You discussed waiting until after the 5 year mark, but should I submit after my 10 year mark, or is sooner alright?

How do I find out when in the 1990s I used my Automotive Allowance? I need the date but the VA website only shows my claims going back 20 years.
Get a copy of your VA claims folder from VBA and it should be there.
I love it. GET EDUCATED and take your time to learn the system. Also pay it forward and help inform other vets with helpful information as well. Can’t tell u how many of my friends I would get on for so long for not filing for their benefits. Once they finally did and inform me they got high ratings 90 plus, I don’t hear from them from there on out. My hope is that they help other vets as I did for them.

I would just be careful on using the medical from the V.A. I know it’s very helpful with certain things, but I would stick to my private doctors because their word is bond. Unfortunately the V.A. is full of foreign doctors that think they can cure you of everything. They’re not your friends. Especially all of the nurse practitioners that are used at their hospitals, but this information was definitely helpful. Thank you. 👍🏼👍🏼👍🏼

Hello I filed a claim 2 years after I got rated for ptsd and got called in 4 months after my increase with my new claim and was reevaluated. Lucky I was not decreased. I do have a question. Should I wait another 5 years after that evaluation to file another claim? My PTSD was originally approved at 70% in Jan 2017 and then reapproved again in October of 2019. Thanks

Question for you or anyone in similar circumstances. So I'm 50% VA service connected and I worked in LEO until my back finally called it so I'm finishing my degree and looking at spots at the VA and was curious can you work for the VA collect a check and still get the 50% VA disability? The reason I ask is because when I tried to do the reserves 10 years ago they took the drill pay off my VA Check.

I'm 100%, but developed sleep apnea later down the road. I'm not sure if it was because of my service connected injuries (neck, psychosis), but should I file a claim to get it added to my record? The VA hospital were the ones to determine my sleep apnea and provided a CPAP for me.
That would be up to you if you want to file that claim. VHA gave you the DX but that doesn't VBA will grant the benefit.

The question I am asking is: If I'm already being compensated for back pain and migraines, and I want to file a claim for radiculopathy as a secondary claim, is there a timeframe or 5 year window I have to wait to expire before filing a secondary claim?
I am 64, served 69 to 85. In jan of this year i got approved for 10% for tinnitus. Also had hearing lost but was denied because my military record didn't show any history.
I just found out that sleep apnea can be caused from tinnitus also headaches.I haven't slept for more then 4 , 5 hours in years and do wale up with headaches once or twice a week. How do i go about filing another claim for this.Thank you.

I 100% permanent and total disabled veteran. When I was getting checked out by the VA doctors, they said my knees which hurt really bad we’re not service connected and they’re at 0% if I get surgery in the future because I need a knee replacement or what have you if I’m already 100% disabled is it worthwhile to get reevaluated for my knees to see if I can’t get them service connected in case in the future I need knee surgery? I don’t wanna be 100% disabled and require knee surgery only to have the VA denied to pay or deny the surgery altogether.
Does the five year period start back from when a retroactive payment is calculated or does it start based on date of the decision letter?
Your effective date, which is typically your file date. So you'll most likely be a year in by the time you actually get your decision.

I have a C&P exam for hip and thigh (I had a hip replacement 10 years ago). I submitted medical evidence I requested from a VA hospital and in 3 days I was set up for a C&P exam. Is that a good thing? Or is that common? I’m so worried.

GOMAB! Thanks for sharing information that is not common knowledge. You mentioned something that caught my ear, "you need two exams outside of the 5 year period to reduce you. I have two claims that are currently deferred and have had two c&p exams for each claim and still haven't received a rating yet (CFS and Depression). I have also had a second c&p exam for hearing loss, even though they denied my claim, but awarded me 10% for tinnitus (which I never made an initial claim for).

I received a C&P exam 20 years after my rating and the VA said that the range of motion on my back condition had improved and reduced my percentage by 30%. I did submit a new claim later and they increased it back to its original rating plus gave me 10%.

What if I have a mental health condition that is rated at 50%, just rated 2 months ago. I also am a bruxer but I only just recently realized this is a compensable condition. I would like to put in a claim for bruxing (grinding teeth), tied to my mental health condition. Can they reduce my rating on mental health?

If you have a subject to compensation code 5276: service connected, 50% from 3/5/2018 and a future exam dec 2018, but they never performed the exam. What could happen if I was apply for a rate increase?

So in order to not get reduce, a veteran should not file a new claim not until after a 5 year period. Am I correct? And if a veteran makes the mistake of filing a new claim within the 5 year window, not after it, there will be a new C&P appointment where there is a possibility of decrease or increase depending on your disability status whether it has improved, stayed the same, or has gotten worst.

Hello, thank you for the information! Quick question. I am at 90% (all static) and if one of my disabilities is improving but not healed yet, could that trigger the Va to reduce my rating? Or would they only reduce you if it’s healed 100%. Thank you sir. 7:18
