Technically yes you are right about mods not being illegal
But it really kinda depends on a bunch of factors.
The main ones are: did you buy the game, did you “sign” a terms of service agreement, and are you/the mod creator making money off of the mod.
If you bought the game, and the terms of service states that the game can not be modded, then while it’s not illegal, you will most likely loose the right to play the game once the modding is found out (especially for online games like World of Warcraft).
If you bought the game, and the terms of service says it’s ok to mod/nothing about mods at all, then you’re good.
Now, the third reason: gaming companies make games to get money from customers.
When these gaming companies find out that mods for their games are being sold, they get upset for two reasons: their loosing money to another person, and their creative work of art is being altered.
Thus, if you are making mods and getting paid for it, you have to be really careful to make sure you have permission to make the mods in the first place, and then you normally have to pay for licensing fees to the original game’s company.
This genuinely helped me understand the situation better, good episode.

I remember watching pointcrow during school all the time, I watched him and smallant every single day during Covid.Watching the clip of pointcrow joking about collectors anxiety is iconic! It’s really sad to see Nintendo do this, I hope they can resolve this.

I was wondering do you people know if watching videos from Pointcrow, Bob, Wood and Moon Channel, etc. are illegal? Have we committed crimes by watching them? If these videos are illegal or in direct violation of 'a law(?),' the EULA then are we perpetuating or whatever the term is?
I mean the first video talked about how the first three of four videos were mods so those were no-no's and then goes on to say that the other one that didn't go against the Guidelines still violates the EULA for showing content of Nintendo, so now I'm worried, haha!
Also random thought but is it true that everyone's mom (is that offensive?) has called a video game console Nintendo since the 1990s? For the last 20+ years, I've heard most everyone call video game consoles 'PlayStation' does this mean that Sony has taken the same measures as Nintendo (What I mean is, do you know of any videos on that subject, heh)? Also, could it be a region thing? I've lived in a few countries in North America and Europe but I'm pretty sure Moon Channel is from the US so I am confused how they have exclusively heard 'Nintendo' and I have exclusively heard 'PlayStation'.

@@TrixyTrixter i’m sure you know this as well, but just thought I’d point this out they have mentioned the moon channel video in their most recent or somewhat recent podcast. That’s what got me to go watch it! So, at least people that are recurring viewers/listeners are aware of it and hopefully more people are checking it out, if they are interested :-) I’m glad that they took time out of an episode to bring attention to moon channel and their video about it

This entire conversation is quite eye-opening. In theory, Nintendo can pull CZcams’s arm into striking hundreds of CZcamsrs who have used any images of any of their games if they wanted to. Beatemups can be striked down tomorrow out of the blue as well. This is worrisome.

Pointcrow is literally the reason I started playing Zelda again after beating them once and getting bored! I don’t even mod but the entertainment he brings and the joy he shares brings so much life back into the game it’s a shame Nintendo doesn’t recognize that
They struck it down because multiplayer is in TOTK and he had a multiplayer mod.

At about the 44-minute mark, Bob says that modding prolongs the games Life... He's right! And I think that's what Nintendo hates. Prolonging the life means that you're spending more time on your current games and not going out to spend your money on newer games.

On the subject of Nuzlockes (and a lot of this conversation in general), Nintendo has a very strict idea of how they're games are *supposed* to be played. I hope I'm not misremembering this, but sometime during Splatoon 1 there were some complaints and suggestions by fans on changes they would like to see to help improve the game. The director (Or a developer in that type of position) said that they knew what was the best way to enjoy their game. Nintendo as a company has their idea of how their games should be enjoyed, and anything deviating from that is looked down upon.
My thoughts: some corporates will not see CZcamsr videos as free ads for their games. They see those videos as just a product from Google to boost their CZcams ads revenue algorithm.
That got real conceited towards the end...think they all need a reality check..they benefit far more from their relationship with Nintendo's content.

Even if they benefit more from that relationship, their channels still help Nintendo with sales. It's just facts that thousands of people buy consoles and games thanks to content creators. So why needing a reality check, when all you do is helping and not harming.

@@GoldChocobo77 there's a good video on 'moon channel' that explains the situation from a legal standpoint but essentially everything that video game content creators do on CZcams is at the mercy of developers. Let's play and other such content is allowed as a result of those companies choosing not to enforce their copyright. And if a company determines that they have more to lose allowing your content to remain up then they are well within their right to take action.
@Matt Gibson I understand that, they also explained it in the podcast. But the point is Nintendo is copyright striking game footage to have mod video removed, while moding is legal by their own rules. So they're contradicting themselves with a shady tactic that's unfair. All content creators are asking is for clarity.

I think it has a lot to do with, Nintendo not wanting anyone to start messing with TotK and modding that. Since it’s about to be coming out they are trying to cover their butts.
One of the biggest things that was done in botw is the bomb glitch, although that is not modding, my point of bringing it up is they removed bombs because they don’t like their game being messed with in even the littlest ways.
With TotK using a lot of technical things to make the fusing abilities work, the ultrahand work, the ascend and recall work, and if there’s any other big abilities, Nintendo doesn’t want those things messed with in the game, they are going a different direction with this Zelda game and even patented a few new things, they don’t want it getting into some else’s hands other than playing the game how it’s intended to be played and not opening it up to mess with files or add in files to change gameplay in anyway.
That’s my opinion anyway. I could be wrong, but Nintendo always seems so protective over their stuff and I get it in a way, they are a huge company that doesn’t want any secrets they have getting out. Secrets as in how they made all this worked in TotK so well and run so smoothly on the switch, or if there’s hints to graphical changes or anything in TotK files to run better on new hardware, they wouldn’t want someone knowing about it and potentially leak info.
I think TotK coming out def speaks loudly to being the reason they are coming after him right now. This game just took them 6years or so to perfect.
Also they just had a ton of ppl leaking stuff recently lol they are prolly pissed and are trying to show the world you dnt mess with Nintendo.

All I can say is that going off of their track record with this sort of thing, expect at least some of the content in those mods to show up in TotK.
If you haven't noticed by now, the projects that tend to be the target of Nintendo DMCA are usually fangames and mods that are similar to something they're internally working on (AM2R, Mario 99, etc.), so if TotK ends up having some sort of MP or whatever I'm not gonna be shocked.

I originally started watching PointCrow a couple years ago for his less common non-Breath of the Wild stuff, but bought it because of him. Now I have almost 600 hours and ToTK is the only game I have ever pre-ordered. Probably would have never played otherwise, because all I was hearing on the internet was about how much it deviated from past Zelda hames, which concerned me.
Bob got me to buy my switch at 2019 too. Before that my last (and only) nintendo console was a gameboy advance sp.

@PointCrow Fwiw, I watched your original video and while I was sympathetic, I really didn’t grasp the situation. This interview convinced me. And it’s not just because I like Wood and Bob or that it’s longer. 😏 I don’t recall that you explained the strikes as well as y’all do here. Plus, frankly, you do come across a lot more likable and credible. I think there would be value in editing and presenting this content and hitting more of the “I’ll be fine; this is bad for Nintendo and the community” notes on your own channel.

On some level, I do hope PointCrow does take a stand on this against Nintendo. I respect his desire to keep things civil and on the down-low, cus the fear of losing your channels, the fear that by the end of things Nintendo will settle on something that's even worse than it is now... those fears are fully rational.
However, I think it's important to realize that this could have been _anyone._ The fact that they've taken down normal gameplay videos proves that. PointCrow and the other 3 people mentioned, them making mod videos just made them the perfect scapegoats. At the end of the day, Nintendo is fully ready to go back to the days of them taking down each and every video of people playing their games.
I think that PointCrow just so happens to be in the best position that anyone has been in for _years_ to put Nintendo on the back foot, even for just a single step. The videos that got taken down don't violate Nintendo's rules, and by taking them down, Nintendo is proving that their own word is valueless. So, they can either sit with that, or let the videos go.
This doesn't affect anyone who avoided modding. They flagged 23 modded videos and 1 whose thumbnail/title looked like it might be modded - probably a mistake. Croton had 11 modded videos removed and 1 that was probably a mistake. It's about the modded content.
Why? If you wanted to play these mods, be honest and admit it's easier to pirate the ROM than to dump it yourself. it doesn't help that he commissioned the multiplayer mod and made unlicensed content with their IP.
Lol the unmodded one was accidental if you look at the ratio of the taken down modded and unmodded videos.

Idk if Eric is gonna see this but I think he should definitely get into starfield when that comes out, it's the next big game by Bethesda and very well might be the second biggest game of the year behind tears of the kingdom and it's a fun looking open world rpg by a company that, you know, actually cares about their community and content creators. I know that's gonna be like late this year but I still think it's worth looking into

I started watching Eric at around 30k subscribers on CZcams in 2020. I'm so proud to watch him grow over the years, and I'm proud to have supported him at tier 3 for far longer than my wallet should have. 😅
If he really wants to talk to nintendo, he would hire a japanese translator, reupload the video where the reupload is a japanese dub. The main reason nintendo doesn't listen is because the japanese side, the corporate executives, they are very eccocentric.
They do not care about non-japanese speaking cultures, they do not care about what happens over seas, they do not care about what you put out, UNLESS it effects their bottom line. YOU WILL HOWEVER notice that the way they abuse fans here. . . they treat Japanese channels ALOT differently there. This is strictly because they do not care to hurtle over the language barrier.
If you make a notice to nintendo, but you do it in english, you are shouting into the void where it will be DIRECTLY forwarded to their legal team. They will not read your subtitles. If you REALLY want to get their attention. . . the video title has to be written in Japanese, the video description has to be written in Japanese and the video's spoken content has to be spoken in Japanese. Anything less than this will be passed on to their legal department who do not care and only exist to hurt you and hunt you down.

Please Eric, hire a translator to dub the video the same way nintendo does with their trailers/directs. I can't promise it will do anything, but it will increase your odds of getting noticed by the correct eyes. Leaving it only in English WILL do more harm to you than good.

NoA is a Regional Division of the japanese company. What matters isnt who makes the claims but rather who gives the commands, which isn't NoA. Convincing a "branch" is like convincing the lawyers. Their job isn't to make decisions and policies. As a "branch", their job is to follow orders from the main company. Who you want to convince is not the group receiving orders but rather an entity that actually has power here. That being the main company, not one of their regional branches. That's how a Chain of Command works.

It is such a thin line we live in because of this guidelines and licences. I see Nintendo getting mad at a guy paying 10K to fund a mod, and somehow that goes public cause of internet, but it's so harsh for them to go and strike twice like a mafia dude holding your head at gunpoint.

Crazy that they're talking about IP and Owner's Rights with Pointcrow looking like a young Louis Rossman. No shade, but when Bob brought up John Deere, that's all I could see from there.
The thing about the mod -if Nintendo ever responds and claims it's about the mods- is that they don't have a legal leg to stand on. These mods (as Pointcrow is explaining them) are not much different than what cheat devices from the 90's (game genie, game shark, etc.) And if you remember, Nintendo actually took one of those companies to court... and lost.
Maybe that's why Nintendo is being very sneaky about things, so they don't have a repeat of that embarrassing moment.

I feel like the culture in Japan is very much based around respecting authority and not questioning it and that this might be the mindset of the administrators at Nintendo. Maybe this explains why they don't want to sit at the table with people like PointCrow?
I think that the main catch in the fight against Nintendo and its strikes is the fact that money was paid for multiplayer. it could have a negative impact in court
i don’t think that should be an issue because the mod itself 1) does not contain any nintendo assets and 2) is functionally the modern day version of a gameshark/action replay/etc. which had the consumers directly paying for the modifications. another comment mentioned this, but apparently nintendo took one of those aforementioned companies to court back in the day & lost so they know precedent isn’t in their favor legally

Probably a risky but not a bad idea, that every Nintendo content creator plays the multiplayer mod all at the same time on Twitch and or CZcams. Curious how Nintendo would cope with that.

It might be because they where planning a multiplayer game like this and it's probably already donde to and they don't want to look bad that they've never done multiplayer
I think the main problem Nintendo has with this (besides the out of touch executives of course) is that they don't sell the games on PC, so people can't easily buy them and the play with the mods. Switch emulation easily leads to piracy because let's be honest, not everyone is gonna dump their own games into the emulator. Unlike Playstation and Xbox, people buy Nintendo consoles to play Nintendo games, if there's anything that may lead people looking into piracy Nintendo will freak out like this. The only 2 possible solutions I see to this are: they release their games on PC or they allow mod support on the switch successor.
PC releases of Nintendo games is something I've thought about for a long time. I honestly really don't see why Nintendo doesn't have more interest in the PC gaming market. Sure, it could *maaaybe* detract from console sales, but it would also increase the amount of sales they make on Nintendo exclusives exponentially. I mean imagine all the people who emulate their games because of an inability or lack of justification to purchase a Nintendo console *NOW* suddenly being able to legally purchase and run Nintendo games on their computers.
And it'd be cool if they were able to adapt to the industry standard of releasing on Steam and using the Steam Workshop to its full potential and everything, but if they went with the route of creating a first-party Nintendo game launcher on PC that could also be cool- I'd just like to see them incorporate something similar to the workshop bc that's a win for us (because community-made mods make every game more exciting) just as much as it is a win for them when it comes to maintaining consumer interest.

No, I don’t want to bloat Valve’s wallets anymore than they already are, but, that being said, I appreciate what they’ve given their consumers in terms of the right to “own” software you purchase. Yea, “own” kinda typically refers more to the licensing aspect of games, but Valve (as far as my limited knowledge is aware) doesn’t have a track record of causing their consumers to be unable to even redownload games they previously purchased *cough* *cough* like Nintendo eventually does between every new console release and the inevitable shutting down of their previous consoles’ stores/servers.

I personally think a lot of this is happening because of the art book leak. I think it pissed Nintendo off to no end that all their hard work had just been leaked and now they’re being SUPER protective over everything and unfortunately pointcrow is the one who they’ve chosen to make an example of. All stems back to that art book!

The Sims community thrives on modded content… idk why Nintendo can’t just let people mod it and have fun. I get not wanting people to pirate it but modding is different
They want their stuff to be seen as "the best it can be". When someone makes their products better, it makes the value of the thing nintendo made look lesser by contrast. Look at this HD remake of M64 I did with overhauled graphics. Nintendo: here's an emulated port. Sixty bux pls. I modded Smash Melee to have amazing netcode. Nintendo, here's OUR netcode. 🧀
They don't want their version to be the inferior one so rather than just improve their own quality, they just ban the competition and monopolize the whole thing. This is why copyright, even in concept, is stupid. >.>

I also love how there are numerous mod videos for Mario Odyssey and those have not been touched by Nintendo. I agree, if you take some down then they need to take them all down, otherwise this is not fair.
He paid 10k to make a mod and released it publicly. It's not remotely the same as just making videos of mods.
I would bet good money Nintendo is doing this because there is going to be multiplayer in Tears of the Kingdom, because other players could play as the companions as seen in the final pre-launch trailer, and this mod pisses them off.

because nintendo has a pro-modding tos clause that nullifies their anti-modding tos

what means its not nullified...just a grey line, since they always go against moders, I would say yeah...you can mod the game..but cant make money out of it by creating Content out of the IP what they created and you transformed

There are three parties. There are creators of the game, there is Nintendo, and then there is Nintendo's lawyers. Even though the creators of the game probably care a lot about this game and want it to be played for a very long time, Nintendo wants you to buy the new game. Furthermore they hired lawyers that are willing to do more than necessary to achieve the desired result that Nintendo the company wants, not the creators of the game nor the fans.
